1. Information on how to enter and the prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.

2. Entry is only open to Australian residents aged 16 years or over who: are existing Optus mobile customers; have completed the Optus RockCorps program; and are able to travel for a ten (10) day period to be determined by the Promoter, in its absolute discretion, during the period June – July 2014.

3. Entrants aged 16 or 17 years old must have parental/guardian approval to enter and to accept the prize (if drawn as a winner), and must take a parent/guardian as the 2nd person in the event they win the major prize. Parents/guardians may be required by the Promoter to enter into a further agreement as evidence of consent to the minor accepting a prize.

4. Employees (and their immediate families) of the Promoter, participating Optus retailers and agencies who are involved with running this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin

5. Promotion commences on 08/02/2014 and final entries close at 11.59pm AEST on 05/05/2014 (“Promotional Period”).

6. To enter, individuals must, during the Promotional Period, visit www.optusrockcorps.com.au, register their personal details (including their Optus mobile number) and submit the fully completed online entry form.

7. If the individual selected as the major prize winner has elected to participate, and has successfully completed four (4) hours of volunteering, at an event in Paris, France, (to be determined by the Promoter, in its absolute discretion), as part of the Orange RockCorps experience, they will receive a bonus prize, as outlined in clause 13 below.

8. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age, place of residence and Optus mobile number) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions may be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

9. Incomplete or indecipherable entries will be deemed invalid.

10. Only one (1) entry permitted per entrant.

11. The draw will take place at Anisimoff Legal, Suite 3, Erina Plaza, 210 Central Coast Highway, Erina NSW 2250 at 10.00am AEST on 07/05/2014. The winners will be notified in writing and by telephone within two (2) business days of the draw and their names will be published online at www.optusrockcorps.com.au/blog/2014/Optus-RockCorps-Paris on 08/05/2014. The Promoter’s decision is final and no correspondence will be entered into.

12. The first valid entry drawn will win the major prize – a trip for two (2) people to Paris, France, valued at up to AU$12,749, depending on date and point of departure. The major prize includes:

Two (2) x return economy airfares from winner’s nearest Australian capital city to Paris, France;
Ten (10) nights twin share four (4) star accommodation at the Pullman Paris Eiffel, Paris, France;
Breakfast daily for two (2) people; and
$3,000 spending money for the winner only, awarded by direct transfer into the winner’s nominated bank account.
13. Additional meals, taxes (excluding airline and airport taxes), insurance, passports, visas, vaccinations, transport to and from departure point, transfers, items of a personal nature, in-room charges and all other ancillary costs are not included. Prize must be taken for a ten (10) day period to be determined by the Promoter, in its absolute discretion, during the period June – July 2014 and is subject to booking and flight availability.

14. If the winner (and their companion) have agreed to and successfully complete four (4) hours volunteering, at an event in Paris, France, (to be determined by the Promoter, in its absolute discretion), as part of the Orange RockCorps experience, the winner will be awarded two (2) tickets to attend an Orange RockCorps concert, to be held at a location to be determined by the Promoter, in its absolute discretion, in Paris, France. For the sake of clarity, if the winner (and their companion) elect not to volunteer, the winner (and their companion) will not receive the Orange RockCorps ticket prizes. The cost of travel to and from the volunteering event is included in this bonus prize.

15. The Orange RockCorps concert ticket prizes/Orange RockCorps volunteering experience are subject to the event venue and ticket terms and conditions, including any applicable age restriction. The Promoter and event organisers hereby expressly reserve the right to eject the winner (and/or their companion) for any inappropriate behaviour, including but not limited to intoxication, whilst participating in any element of the prize.

16. During the entire duration of the prize, a nominated parent/guardian must accompany any person under 18 years of age. The winner and their companion are responsible for ensuring that they have valid passports, and any requisite visas, vaccinations and travel documentation.

17. Frequent flyer points will not form part of the prize. Prize is subject to the standard terms and conditions of individual prize and service providers. The winner may be required to present their credit card at time of accommodation check in.

18. As a condition of winning and taking the major prize, the winner will be required to: (a) take photographs or videos of their experience(s) (in accordance with the guidelines provided by the Promoter) while taking the major prize and write an accompanying blog post (or posts) describing his/her experience(s) (“Materials”); and (b) provide the Materials to the Promoter and to RockCorps Pty Limited (ABN 63 160 558 243) (“RockCorps”) when requested and licence the Promoter and to RockCorps to use and sublicense the use of the Materials, at their absolute discretion, in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products or services manufactured, distributed and/or supplied by the Promoter or by RockCorps. The winner warrants to the Promoter and to RockCorps that the Materials provided are his/her original work and that the Materials do not infringe the rights of any third party. The winner agrees to indemnify the Promoter and RockCorps against all costs and claims by third parties arising from a breach of this warranty. The winner consents to any use of the Materials which may otherwise infringe their moral rights pursuant to the Copyright Act 1968 (Cth).

19. The next five (5) valid entries drawn will each win a Nokia Lumia 1020 handset with 41 megapixel camera, valued at $899 each.

20. Mobile phone prize is a handset only. The winners will be responsible for making all arrangements for connection with a service provider and payment of all associated connection, access, data and call charges. Prizes will be delivered to the winner’s nominated delivery address, within twenty eight (28) days of winner notification.

21. If the winner of a prize is under the age of 18 years, the prize will be awarded to the winner’s nominated parent or guardian on the winner’s behalf.

22. If for any reason a winner does not take a prize (or an element of the prize, where applicable) by the time stipulated by the Promoter, then they will forfeit that prize (or that element of the prize).

23. If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.

24. Total prize pool value is up to $17,244. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.

25. A draw for the major prize, if unclaimed, may take place on 14/05/2014 at the same time and place as the original draw, subject to any written directions from a regulatory authority. The winner, if any, will be notified in writing and by telephone within two (2) business days of the draw and their name will be published online at www.optusrockcorps.com.au/blog/2014/Optus-RockCorps-Paris on 15/05/2014.

26. A draw for any unclaimed mobile handset prizes may take place on 07/08/2014 at the same time and place as the original draw, subject to any written directions from a regulatory authority. Winners, if any, will be notified in writing and by telephone within two (2) business days of the draw and their names will be published in the Australian on 14/08/2014.

27. Entrants consent to the Promoter and RockCorps using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter or RockCorps.

28. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter or RockCorps, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.

29. Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.

30. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter and RockCorps (including their respective officers, employees and agents) exclude all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.

31. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter and RockCorps (including their respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter or RockCorps) due to any reason beyond the reasonable control of the Promoter or RockCorps; (d) any variation in prize value to that stated in these Terms and Conditions; (e) if the Optus RockCorps concert is cancelled or delayed for any reason beyond the reasonable control of the Promoter or RockCorps; (f) if the Orange RockCorps concert is cancelled or delayed for any reason beyond the reasonable control of the Promoter or RockCorps; (g) any tax liability incurred by a winner or entrant; or (g) taking a prize/use of a prize.

32. As a condition of accepting a prize, the winners (and their companion, where applicable) must sign any legal documentation as and in the form required by the Promoter/RockCorps and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.

33. The Promoter and RockCorps collect personal information (“PI”) in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI. The Promoter and RockCorps will also use and handle PI as set out in the Promoter’s Privacy Policy, which can be viewed at www.optus.com.au/privacy and as set out in RockCorps’ Privacy Policy which can be viewed at http://www.optusrockcorps.com.au/privacy-policy. In addition to any use that may be outlined in the Promoter’s/RockCorps’ Privacy Policy, the Promoter and RockCorps may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. The Privacy Policies also contain information about how entrants may opt out, access, update or correct their PI, how entrants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. All entries become the property of the Promoter. Unless otherwise indicated by the Promoter or RockCorps, the Promoter or RockCorps may disclose personal information to entities outside of Australia (for a list of the countries, see the Promoter’s/RockCorps’ Privacy Policy).
