Terms and Conditions
1. Instructions on how to enter and prizes form part of these Terms and Conditions. Participating in this promotion is deemed acceptance of these Terms and Conditions.
2. Entry is only open to residents of Australia who purchase Take 5 magazine or residents of New Zealand who purchase Lucky Break magazine. Purchase must be from an authorised outlet during the promotional period. Employees of the Promoter, their immediate families and agencies associated with this promotion are ineligible to enter.
3. SMS and 0900 competitions are not available in New Zealand.
4. Entrants under 18 years old must have parental/guardian approval to enter and further, the parent/guardian of the entrant must read and consent to all terms and conditions. Parents/guardians may be required by the Promoter to enter into a further agreement as evidence of consent to this Promotion.
5. Consumers can enter by using the official entry coupon provided in the magazine. Where applicable, Australian residents can also enter by phoning the relevant 190 number and leaving their details or by sending via SMS the keyword relevant to the prize they wish to win and their requested details to the relevant SMS number. Mail (for Australian and New Zealand residents) entries are to be sent to the PO Box 13 as published in the magazine. Consumers may enter as many times as they wish, however, each mail entry must be posted in a separate stamped business-sized envelope (220mm x 110mm or smaller) and contain an official entry coupon. Only original entry forms from magazines in official circulation are valid. Entries from newsagents’ returns will not be accepted. Only one prize will be awarded per person, excluding SA residents in Australia and excluding 190 and SMS competitions. For the sake of clarity, except for SA residents, a winner’s entry will not be entered back into the draw or included in the unclaimed prize draw. SMS and 0900 competitions are not available in New Zealand.
6. Maximum cost of a 190 call in Australia is AUD$0.55 including GST. Calls to the 190 numbers from mobiles may attract a higher rate. Service not available from payphones. 190 service provider is Salmat Digital Pty Ltd. Premium SMS cost in Australia is AUD$0.55 including GST. Entrants must have premium service access in Australia. SMS entries via the internet are not valid and will not be accepted. SMS service provider in Australia is Salmat Digital Pty Ltd. Individuals under the age of 18 must obtain bill payer’s permission to send an SMS or call the 190 numbers. SMS and 190 helpline: 1300 131 276.
7. The Promoter reserves the right, at any time, to verify the validity of claims and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process (including but not limited to tampering by way of use of techniques designed to avoid the payment of SMS or 190 call costs). Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. Errors and omissions will be accepted at the Promoter’s discretion. Identification considered suitable for verification includes a driver’s license or passport. Acceptance of alternative identification as verification is at the complete discretion of the Promoter.
8. Unless otherwise indicated, Australian Take 5 Magazine promotions for mail, phone and SMS entry commence on 6/02/14. Unless otherwise indicated, mail entries for Issue 7 in Australia close at 17:00pm (AEDST) on 21/02/14, and phone and SMS entries close at 11:59pm AEDST time on 21/02/14.
Unless otherwise indicated, New Zealand Lucky Break Magazine promotions commence on 3/02/14. Unless otherwise indicated, mail entries for Issue 7 in New Zealand close last mail received on 17/02/14.
9. Unless otherwise indicated, the draw for all mail entries received from Australian Take 5 Magazine and New Zealand Lucky Break Magazine will take place at National Products Fulfilment Pty Ltd, 6 Ross Place, Wetherill Park, NSW 2164 at 9:30am AEDST for Issue 7 on 28/02/14.
Australia Only: Unless otherwise indicated, the draw for the 190 and SMS entries received from Australian Take 5 Magazine will take place at Salmat Digital Pty Ltd, Level 2, 116 Miller Street, North Sydney NSW 2060 at 9:30am AEDST for Issue 7 on 28/02/14.
All winners will be notified in writing within two (2) business days of the draw and the names of winners of prizes valued at over AUD$250 will be published in Take 5 issue 14 on sale 27/03/14.
10. The Promoter may conduct further draws as are necessary at 11.00am AEST on 30/05/2014 at National Products Fulfilment Pty Ltd of 6 Ross Place, Wetherill Park, NSW 2164 in order to distribute any prizes unclaimed by that date subject however to any written directions from any regulatory authority. The winners of prizes in the unclaimed prize draw will be notified in writing within two (2) business days of the draw, and the winners of prizes over AUD$250 will be published in for 28 days from 2/06/2014 on www.take5mag.com.au
11. All entries received will be entered into the Bonus Draw. The Bonus Draw will take place at National Products Fulfillment Pty Ltd, 6 Ross Place, Wetherill Park, NSW 2164 on 30/05/2014 at 12pm (noon) AEST. The first valid entry drawn from all entries for the Bonus Draw prize will win AUD$100.The winner of the Bonus Draw will be notified in writing within two (2) business days of the draw. In the event that the Bonus Draw prize remains unclaimed, the Promoter may conduct further draws as are necessary at 11am AEST on 1/09/2014 at the same place as the Bonus Draw, in order to distribute the prize, subject however to any written directions from any regulatory authority. The winner, if any, will be notified in writing within two (2) business days of the draw.

13. Unless otherwise stated all prizes are in Australian dollars. Some prizes may not be available or prohibited in New Zealand under New Zealand law. In that case prizes will be offered to an equivalent New Zealand dollar value either in cash, vouchers or as a prize determined by the Promoter in its absolute discretion.
14. Any ancillary costs associated with redeeming the prize are not included. These are the responsibility of the winner.
15. Prize must be taken as offered. The prize, or any unused portion of the prize, is not exchangeable or cannot be redeemed as cash. The prize cannot be used in conjunction with any other special offer. The prize is valued in Australian dollars. The Promoter accepts no responsibility for any variation in the prize value. Prize winner is advised that tax implications may arise from their prize winnings and they should seek independent financial advice prior to acceptance of their prize. In the event that a portion of the prize is awarded to the winner in the form of a voucher / ticket / pass/ letter, redemption of that portion of the prize will be subject to the terms and conditions stipulated on the voucher / ticket / pass/ letter. The Promoter will not be liable for any voucher / ticket / pass/ letter that has been lost, stolen, forged, damaged or tampered with in any way. Redemption of prize at a venue is subject to the standard rules and regulations of that venue/s.
16. The prize does not include any installation or set-up of any of the products.
17. Products included in prize package (including but not limited to titles, colour, design, sizing, model, finish, style etc) will be determined by the promoter in its complete discretion. All prizes must be taken as offered.
18. The prize will be delivered to the nominated address of the Prize winner. Delivery of the Prize is valid to any state and/or city in Australia.
19. If the winner is under the age of 18 years, the prize will be awarded to the winner’s parent or legal guardian on behalf of the winner. It is the responsibility of the winner’s parent/legal guardian to prove their parental status/ legal guardianship at the time of winner notification. In the event that for any reason whatsoever a person/s mistakenly represents themselves to be a winners parent and/or legal guardian, then that person will be liable for all costs associated with relocating and/or re-awarding the prize (including but not limited to and administrative fees incurred by the Promoter). Where relevant, the Promoter is only responsible for ensuring that the prize is awarded to a person who is either a parent or legal guardian of the winner. The Promoter is not responsible for determining any other delivery details or taking direction that relates to any ongoing family law negotiations and/or determinations. These are the responsibility of the winner and their respective parent/s and/or legal guardian/s.
20. In acceptance of the prize, the Winner acknowledges that they may incur ongoing costs associated with the prize which are the entire responsibility of the winner.
21. Prize is subject to the standard terms and conditions of individual prize and service providers.
22. In the event that for any reason whatsoever the Winner does not take the prize at the time stipulated by the Promoter, then the prize will be forfeited by the Winner and cash will not be awarded in lieu of the prize.
23. In the event that a prize, or part of a prize, is unavailable, the Promoter reserves the right to substitute the prize or part of the prize in its discretion with an alternative prize or part of the prize to the same and equal recommended retail value and/or specification subject to any written directions from the various Lottery Departments.
24. The promoter is neither responsible nor liable for any late lost or misdirected mail (including but not limited to prizes).
25. The Promoter is not responsible nor liable for any prize damaged in transit in the delivery of their prize
