Dee Vine Holiday Giveaway: In-Store Promotion Terms and Conditions
You are invited to enter a trade promotion advertised by Dee Vine Estate, and as conducted in accordance with these terms and conditions.
1. The promoter is Dee Vine Estate Pty Ltd ABN 33 137 671 580.
The entry period for the prize draw will commence at 9am Australian Eastern Standard Time (“AEST”) on Saturday 19th July 2014 and will close at 9pm AEST on 19th October 2014. Entries submitted after the Closing Date will not be valid.
2. Entrants must be at least 18 years of age to participate and an Australian resident. The prize draw is not open to residents of the Northern Territory, Queensland, South Australia, Tasmania, Western Australia, employees, family members and/or contractors of Dee Vine Estate.
3. By entering the prize draw, entrants agree to accept and be bound by these terms and conditions (“Terms and Conditions”), and by the decisions of Dee Vine Estate, which are final in all matters relating to the promotion. No correspondence will be entered into.
4. Entry into the prize draw requires purchase of two (2) bottles from the Dee Vine Estate wine range (Cheers, Dee-lish, 2 Monkeys) in participating retail stores in NSW & ACT. Entrants must be made online via the Dee Vine Estate website (www.deevineestate.com) and requires the last 4 digits from the purchase receipt as proof of purchase. Receipts used in each entry must be kept as proof of purchase for the entry to be valid.
5. Incomplete entries will be deemed invalid.
6. Dee Vine Estate reserves the right to seek verification of eligibility to enter and receive a prize under these Terms and Conditions. Dee Vine Estate reserves the right to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions may be accepted at the Promoter’s sole and unfettered discretion.
7. Only one entry to the prize draw per receipt is allowed. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
8. All entries become the property of the Dee Vine Estate.
9. The total prize will be up to the value of A$3300 inc GST. Prizes have been pre-allocated. The prize will be awarded to the eligible entrant whose entry is drawn in the case of a game of chance) .
10. The prize consists of one A$3300 Flight Centre Travel Card.
11. The Draw will commence at the Dee Vine Estate office located at Suite 1-4/220 Banna Ave, Griffith NSW 2680 on 22 October at 12:00 AEST.
The winner of the promotion will be drawn at this time.
12. There is no cash or credit alternative to the prize. Dee Vine Estate reserves the right to provide an alternative prize of equal value if, due to circumstances beyond its reasonable control, the stated prize is no longer available, or if Dee Vine Estate is prevented from issuing the prize for any other reason.
13. Winners will be notified by email and telephone to make necessary arrangements for the winner to claim the prize. Details of winner will also be published on Dee Vine Estate’s Website, Facebook page & Twitter account. Winners details will be published on Wednesday 12 November 2014, unless the winner has not been contactable by this date.
14. The winner must be 18 years or older and will be required to show a form of valid photographic ID when claiming the prize, along with the purchase receipt.
15. The winner must sign any release form(s) as may be required by the Dee Vine Estate (and its associated agencies and companies), and/or any other third party directly or indirectly involved in and with the prize and refusal to sign such form(s) shall result in the immediate forfeiture of the prize and that person shall have no claim, action or recourse at law or otherwise, against Dee Vine Estate in respect of the forfeiture.
16. Prizes are non-transferable, not for re-sale, non-refundable, and non-changeable.
17. If a winner is untraceable within 90 days after Dee Vine Estate’s reasonable efforts, Dee Vine Estate will conduct a “second chance draw” on Wednesday 21 January 2015 at 10.00am for any unclaimed or outstanding prize. The second chance draw will be open to all eligible entrants who were not selected as winners before the Closing Date. The winner of the second chance draw will be notified in accordance with Clause 13.
18. By entering the prize draw, each entrant consents to the collection of his/her personal data for the purposes of managing and administering the prize draw, and for future marketing and promotional purposes, in accordance with Dee Vine Estate’s Privacy Policy. Entrants can access or request the amendment of their personal data at any time by contacting Customer Services. Dee Vine Estate collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this information.
19. Dee Vine Estate may use a winner’s name, town of residence, and likeness for the purpose of announcing the winners without the need for any additional payment or permission. In addition, the winner consents to Dee Vine Estate using their name, likeness, image and/or voice (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by Dee Vine Estate.
20. No responsibility is accepted by Dee Vine Estate for matters beyond its reasonable control, and no refund or replacement prize will apply for such matters. Dee Vine Estate accepts no responsibility for any incomplete or inaccurate entries received or for system errors or other issues that may result in disruption to, lost, delayed or not received entries or winner notifications.
21. Dee Vine Estate will not be responsible for third party products and services offered as prizes and all such prizes may be subject to third party providers’ standard terms and conditions.
22. Dee Vine Estate reserves the right to alter or amend these Terms and Conditions, and conditions of operation of the promotion, subject to the approval of the gaming authorities in each State or Territory where required.
23. Failure by Dee Vine Estate to enforce its rights at any state does not constitute a waiver of those rights.
24. Except for any liability that cannot by law be excluded, Dee Vine Estate (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of:
a. any technical difficulties or equipment malfunction (whether or not under the Dee Vine Estate’s control);
b. any theft, unauthorised access or third party interference;
c. any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by Dee Vine Estate) due to any reason beyond the reasonable control of Dee Vine Estate;
d. any variation in prize value to that stated in these Terms and Conditions;
e. any tax liability incurred by the winner or any entrant; or
f. the use of the prize.
25. This prize draw shall be governed and construed by Australian law and is run by Dee Vine Estate, Suite 1-4/220 Banna Ave, Griffith NSW 2680.
