Terms and Conditions of Entry – Win a family trip for 4 to Hawaii

General
1. Information on how to enter and prizes form part of the Terms and Conditions of Entry. Entry into this competition is deemed acceptance of these Terms and Conditions. Headings in this document are included for ease of reference, and do not affect interpretation in any way.
2. To the extent of any inconsistency between these Terms and Conditions and any other reference to this competition, these Terms and Conditions prevail.

Who can enter
3. Subject to clauses 4, and 5 entry is open to all residents of Australia, as of the date of entry, who have fulfilled the requirements set out below (‘Eligible Entrants’).
4. Any entrant who is under the age of 18, as of the date of entry, must obtain the prior permission of their legal parent or guardian over the age of 18 to enter. The parent or guardian may be called to verify their consent and may be required to sign a release at the discretion of the Promoter. The release may also require the entrant’s parent or guardian to accept responsibility for the acts and forbearances of the entrant. The release must be completed with the full name, address and telephone number of the entrant’s parent or guardian. Failure to provide such proof, particulars or releases will immediately invalidate the entrant’s entitlement to any prize, subject to State and Territory legislation.
5. Employees, and their immediate families, of the Promoter, Jetstar Airways Pty Ltd, Permitz Group Pty Ltd and associated agencies and companies are not eligible to enter this competition. Immediate family means any of the following: spouse, ex-spouse, defacto spouse, child or step child (whether natural or by adoption), parent, step parent, grandparent, step grandparent, uncle, aunt, niece, nephew, brother, sister, step brother, step sister or 1st cousin. The Promoter is Boost Juice Pty Ltd (ABN 11 092 165 681) of Level 1, Tower 2, Chadstone Place, 1341 Dandenong Road, Chadstone, VIC 3148 (‘Promoter’).

How to enter
6. Eligible Entrants may enter this competition by:
6.1 Joining the VIBE Club at any Boost Juice store, if the entrant is not already a member. Entrants must ensure that they register their card by entering their details at the following address: http://www.boostjuice.com.au/vibe; and
6.2 Purchasing a Boost Kids Cup drink and ensuring that the entrant’s registered VIBE card is swiped at the time of purchase, during the Promotional Period (‘Eligible Product Purchase’).

Number of Entries permitted
7. One entry per Eligible Product Purchase. Entrants who obtain a refund or return the purchase used to meet this requirement, will not be entitled to the prize and if they are awarded the prize must return it to the Promoter. Any entrant found to be sharing any receipt or other proof to demonstrate Proof of Purchase with any other entrant, whether or not related in any way, will have all entries invalidated and will not be able to claim the prize. If such an entrant is awarded the prize and then found to have breached this clause, the entrant must immediately return the awarded prize to the Promoter. The Promoter has sole discretion to determine if this clause has been breached by any entrant. The Promoter reserves the right to request whatever documentation it deems necessary to confirm if the entrant has breached this clause. An entrant must provide any requested documentation to the Promoter upon request. The Promoter may conduct an immediate redraw if the first drawn entrant is unable to satisfy this clause (subject to State and Territory legislation).

Open, Close, Draw and Publish dates
8. The competition commences 30/06/2014 at 00:01 AEST and closes 27/07/2014 at 23:59 AEST (‘Promotional Period’). Entries must be received by the Promoter within the Promotional Period.
9. The winner will be the first valid entry drawn at the Promoter’s premises, Level 1, Tower 2, Chadstone Place 1341 Dandenong Road, Chadstone, on 31/07/2014 at 14:00 AEST. The Promoter will ensure that all entries have an equal chance of winning the prize.
10. The winner will be notified by email within two business days of the draw and name of winner will be published online at www.boostjuice.com.au/news from 5/08/2014 for 28 days. The winner will also be published in The Australian newspaper on 5/08/2014.
11. Prizes will be sent within 28 days of the draw.
12. The Promoter may conduct such further draws on 03/11/2014 at the same time and place as the original draw in order to distribute any prizes unclaimed by this date, subject to State and Territory legislation. Winners of any further draws will be notified by mail within two business days of the draw and their names will be published online at www.boostjuice.com.au/news from 08/11/2014 for 28 days. The winner will also be published in The Australian newspaper on 08/11/2014.

Prize on offer
13. Total prize value is up to $17,242 (Including GST), as at 12/05/2014.

If the winner does not reside in Sydney, Brisbane or Melbourne, he/she will also receive return economy Jetstar Starter airfares from their nearest Jetstar port in Australia to the closest of Melbourne (Tullamarine), Brisbane and Sydney, to connect to the direct Honolulu flight;

7 nights’ accommodation at the Hilton Hawaiian Village in a one-bedroom suite for a family of four.
Up to AUD $13,000 (inc. GST).

The value of the accommodation is $606 per night for 7 nights (AUD $4,242).

14. Prize must be taken by 30 June 2015. In the event a winner does not take the prize by the time stipulated, then the entire prize will be forfeited by the winner and cash will not be awarded in lieu of the prize.
15. Winner must advise the Promoter two months in advance of their anticipated travel date to allow for booking of flights. Airfares are not flexible and are non-transferable. The Winner and their companions may not accrue Qantas Points or other credits or points associated with any travel loyalty programs. An upgrade cannot be purchased on airfares with cash or Qantas Frequent Flyer points. Prizes cannot be used in conjunction with travel discounts or special offers. Any extension or variation of the travel dates nominated by the Promoter or Agent will be at the cost and responsibility of the Winner. Any requests to extend or vary travel arrangements must be made in writing and must be received by the Promoter (or Agent) prior to time of Booking. Once booked, any changes made to the booking may incur a cancellation or amendment fee, at the cost and responsibility of the Winner.
16. The winner must be over the age of 18 to accept the prize without parent/guardian permission. Accompanying guests must also be aged 18 years or over unless they are invited and cared for by their parent/guardian. Any travel insurance required is the winner’s responsibility and will not be paid for by The Promoter.
17. Where the prize involves driving, travel or an event, the winner and any companions under the age of 18 must be accompanied by their parent or legal guardian over the age of 18 at all times.
Unless expressly stated in these Terms and Conditions, all other expenses are the responsibility of the winner (and their companions) including, but not limited to, current passports (with expiry dates no less than six months following the proposed dates of travel), completion & payment of the Electronic System for Travel Authorisation (ESTA), meals, spending money, transport to and from departure and arrival points, transfers, drinks, incidentals, mini-bar, laundry, room service, telephone calls, activities, gratuities, services charges, travel insurance, pre and post accommodation, optional activities or excursions and all other ancillary costs. A credit card imprint or cash deposit may be required from the winner at check-in to the hotel, for all incidental charges. Holidays are subject to flight and booking availabilities.
18. By entering this competition, and by collecting the prize, the winner acknowledges and accepts that driving, travel and any other activities related to the prize, are inherently dangerous and may result in death, injury, incapacity, damage to property or other losses. The Promoter is not responsible for any acts of god, such as adverse weather conditions or industrial action or civil commotion that may occur whilst the winner is travelling. It is the responsibility of the winner to enquire about local issues and conditions at destinations prior to travel. The Promoter does not guarantee that the winner will enjoy the travel prize or be suited to the type of travel prize that is offered.
19. Accommodation is a one bedroom suite to accommodate a family of four. Travel arrangements to and from the winner’s home and their nearest capital city airport do not form part of the prize unless expressly stated in these terms & conditions and are the responsibility of the winner and their travelling companion/s. The winner must travel on the same flights and itinerary as their travelling companions. The travel prize cannot be used as part payment for another airfare package. Flights and accommodation are subject to availability at the time of booking and cannot be exchanged for other destinations. Travel restrictions & blackout dates apply.
20. Prize travel and accommodation cannot be taken during public holidays, school holidays and other peak periods determined by the prize provider, including Australian school holidays and American peak holiday seasons. If the winner’s preferred travel dates, departure port or arrival destination is not available, the winner will be contacted.
21. All prize travel will be subject to the carrier’s General Conditions of Carriage.
22. Each prize must be taken as stated and no compensation will be payable if a winner is unable to use the prize as stated. The prize or any portion of the prize is not exchangeable or redeemable for cash or other goods or services. A prize cannot be transferred to any other person, unless agreed to by the Promoter. There can be no changes made to travel arrangements once tickets are issued.
23. Bookings are subject to conditions & availability (including but not limited to capacity limitations and other restrictions). Compliance with any health or other government requirements is the responsibility of the winner and their travel companions. The Promoter and carrier make no representation regarding the safety, conditions or other issues that may exist at any destination. International travel advice can be obtained from various sources, including local government, local consular offices and the website of the Australian Department of Foreign Affairs and Trade at www.smartraveller.gov.au. Prizes for travel for a particular event or attraction must be taken to coincide with the event or the times and dates during which the attraction is available. Travel insurance is not included in the prize but is highly recommended. Prize travel and accommodation is subject to availability at the time of booking. The winners and their companions must travel together on all prize travel and will not accrue Qantas Points on any element of the prize. An upgrade cannot be purchased on airfares with cash or Qantas Points.
24. The winner and their companions must have and maintain valid Australian passports with 6 months or more until expiry.
25. The winner and their companions agree that should any of them be denied a Travel Authorisation, the winner will forfeit the prize (but may have the prize awarded to a friend or family member who is able to travel). Only one round of name changes will be allowed in this case. If the winner of any of the winner’s travelling companions has a criminal record, this may impact the approval of their travel.
26. The Promoter reserves the right to exclude any person from the Promotion on the ground of their medical condition or history (should it prevent that person from taking the prize as stated), for the safety of the Promoter’s staff members or others or for any other reason which would be in breach or contravention of these terms of the carriers general terms of carriage, for example, bringing the Promoter’s brand into disrepute.

Further Terms and Conditions
27. Any entrant found to have used a third party (including a paid online competition entry site) to enter on their behalf will have all entries invalidated and any claim they have to any prize will be invalidated. If such an entrant is awarded a prize and then found to have breached this clause, the entrant must immediately return any prize awarded. The Promoter has sole discretion to determine if this clause has been breached by any entrant. The Promoter reserves the right to request whatever documentation it deems necessary to confirm if the entrant has breached this clause. An entrant must provide any requested documentation to the Promoter upon request.
28. Any entrant found to be entering incorrect contact details, including incorrect email contact details, in an attempt to obtain an unfair advantage over other entrants may have all entries invalidated and any claim to any prize will be invalidated. If such an entrant is awarded a prize and then found to have breached this clause, the entrant must immediately return any prize awarded. The Promoter has sole discretion to determine if this clause has been breached by any entrant. The Promoter reserves the right to request whatever documentation it deems necessary to confirm if the entrant has breached this clause. An entrant must provide any requested documentation to the Promoter upon request.
29. If the prize is unavailable, for whatever reason, the Promoter reserves the right to substitute the prize for a prize of equal or greater value, subject to State and Territory legislation. Cash will not necessarily be awarded as a substitute. It is a condition of accepting the prize that the winner must comply with all the conditions of use of the prize and prize supplier’s requirements. Each prize must be taken as stated and no compensation will be payable if a winner is unable to use the prize as stated.
30. The Promoter highly recommends a current residential street address and active email address be provided when requested for ease of correspondence and potential prize delivery. The Promoter makes all reasonable efforts to deliver prizes to the addresses provided by competition entrants. The Promoter cannot guarantee that any prizes returned to the Promoter due to non-delivery at the provided address will be re-sent to the prize winner.
31. The Promoter reserves the right to request winners to sign a winner’s deed of release or any other relevant forms or agreements that the Promoter deems necessary, to provide proof of identity, proof of age, proof of residency at the nominated prize delivery address and/or proof of entry validity (including phone bill) in order to claim a prize. Proof of identification, residency, age and entry considered suitable for verification is at the discretion of the Promoter. In the event that a winner cannot provide suitable proof, the winner will forfeit the prize in whole and no substitute will be offered.
32. The Promoter reserves the right to conduct a redraw in the event that an entrant, claiming to be a winner, is unable to satisfy these Terms and Conditions or has breached these Terms and Conditions.
33. The Promoter’s decision in relation to any aspect of the competition is subject to State and Territory legislation but also final and binding on each person who enters. No correspondence will be entered into. No responsibility is accepted for late, lost or misdirected entries. Prizes are subject to availability, not transferable or exchangeable and, with the exception of cash prizes, cannot be taken as cash. Prizes will be sent to the winner’s nominated address as stated in their original entry. The Promoter and their associated agencies, and companies associated with this promotion will take no responsibility for prizes damaged or lost in transit.

Copyright, Statutory guarantees, Waiver and liability
34. All entries and any copyright subsisting in the entries become and remain the property of the Promoter who may publish or cause to be published any of the entries received. The Promoter and its related entities collects entrants’ personal information for the purpose of conducting and promoting this competition (including but not limited to determining and notifying winners) and for related purposes which would reasonably be expected without your permission. For example, we may from time to time use your personal information to provide you with information about products and services which we expect may be of interest to you. However, we do respect your right to direct us not to do this if and when any future communication is sent to you by the Promoter. We may disclose personal information to essential service providers who provide services in connection with our products and services. You may request access to your personal information by writing to The Privacy Officer, Legal Compliance Department, Boost Juice Pty Ltd of Level 1, Tower 2, Chadstone Place, 1341 Dandenong Road, Chadstone, VIC 3148
35. By accepting the prize, the winner agrees to participate and co-operate as required in all editorial activities relating to the Competition, including but not limited to being interviewed and photographed. The winner (and their companions) agree to granting the Promoter a perpetual and non-exclusive licence to use such footage and photographs in all media worldwide, including online social networking sites, and the winner (and their companions) will not be entitled to any fee for such use.
36. Prize-winners are advised that tax implications may arise from their prize winnings and they should seek independent financial advice prior to acceptance of that prize.
37. The Promoter (subject to State and Territory legislation) reserves the right to amend, cancel or suspend this competition if an event beyond the control of the Promoter corrupts or affects the administration security, fairness, integrity or proper conduct of this competition. The Promoter will disqualify any individual who has tampered with the entry process or any other aspect of this competition. Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.
38. Nothing in these Terms and Conditions limit, exclude or modify or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act 2010 (Cth), as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
39. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or Entrant; or (f) use of a prize The Promoter (including its’ officers, employees and agents) excludes all liability for any loss (including, without limitation, indirect, special or consequential loss or loss of profits or opportunity), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this competition including taking or using the prize, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law), including the Non-Excludable guarantees. Any change in value of the prize occurring between the publishing date and date the prize is claimed is not the responsibility of the Promoter.
40. The sponsor of this promotion is Boost Juice Pty Ltd, which is solely responsible for all aspects of the promotion. By participating in this promotion, all participants and prize winners agree that Hilton Worldwide, their partnerships, subsidiaries and affiliates and each of such entities’ respective officers, directors, agents and employees are not responsible or liable for any injury, loss, illness, litigation or damage that may occur from participation in the promotion or acceptance, possession, use or misuse of prizes. In the event that any dispute arises regarding the meaning or interpretation of these official rules, participants agree that the dispute shall be resolved by applying the laws of Australia and that it shall be resolved by and within the courts of that jurisdiction.
