1. Instructions on ‘how to enter’ and prizes form part of Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.

2. Entry is open to residents of Australia aged 18 and over, who purchase a participating title as listed in clause 4 from a participating newsagent as stipulated in TABLE A during the promotional period. Employees of the Promoter, and their immediate families and agencies associated with this promotion are ineligible to enter.

3. The Promotional period commences 00:01 (AEST) on June 16, 2014 and closes at 11:59pm (AEST) on July 7, 2014 (The Promotional Period)

4. To be eligible to enter, individuals must, during the Promotional Period, purchase a copy of a participating title The Australian Women’s Weekly, Woman’s Day, Gourmet Traveller, House & Garden, Real Living, Cosmopolitan, Elle, Yours from a participating newsagent as stipulated in TABLE A during the promotional period and then enter via www.roadshowent.com.au/winter and complete the entry form including full name, address, contact number, email address, and date of birth and submit the entry form as instructed.

5. Multiple entries permitted, subject to the following: (a) only one entry permitted per specified purchase requirement; and (b) each entry must be submitted separately and in accordance with entry requirements.

6. Entrants must retain the original copy of all purchase receipts for all entries as proof of purchase. If a receipt is not available from the store where the magazine(s) were purchased, entrants must provide an original copy of the magazine cover as proof of purchase. Promoter reserves the right to request proof of purchase for each entry made to verify all entries before awarding the prize. Consumers may enter as many times as they like provided each entry is associated with a separate purchase of any of the participating Magazines as listed in clause 8 in one transaction from any participating store during the Promotional Period.

The Promoter is entitled to use any of the entries submitted in any manner and for any purpose at its absolute discretion, including using the entries for future promoter’s or their agents book publications, promotional, marketing and publicity purposes without any further reference or payment or other compensation to the entrant. The promoter is entitled to amend, edit, select, crop, retouch, add to or delete from any part of the submitted entry.

Entries must not be offensive, defamatory or racist. Any entry which the judges deem inappropriate will be invalid. The entrant agrees to indemnify the Promoter.

The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions will be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

The prize draw will take place at 11:00am on July 17, 2014 at Oxygen Interactive Marketing, 117 Wellington St, Kilda VIC 3182. The first complete and valid entry drawn will be awarded the major prize. The next 50 complete and valid entries will be awarded the 50 runner up prizes. The winner(s) will be notified in writing within two days of the prize draw and their name(s) published online at www.Roadshow.com.au. Any winner(s) of a prize valued over $250 will have their name and postcode published in The Australian on (July 23, 2014).

There are 51 prizes available for the promotion. There will be 1 Major prize and 50 runner up prizes.

The Major prize is a trip for two people to New York City including:

– Return economy airfares for two people from the winner’s nearest capital city to New York City valued at a maximum of $3500 per person

– 5 nights minimum 4 star accommodation, based on twin share and valued at a maximum of $2200.

– Return airport / hotel transfers valued at a maximum of $400

– Helicopter tour of the city for two people, plus dinner cruise valued at a maximum of $800

– Travel insurance for two people valued at a maximum of $400

– $2000 spending money for the winner only

– Total prize value is a maximum of $12,800

50 x runner up winners will receive a copy of Winter’s Tale on DVD, valued at $39.95 each. Runner up prizing is valued at a total of $1,997.50.

The total prize pool value is $14,797.50.

12. The major prize must be redeemed in full and as a package within 12 months excluding national holidays. Blackout periods may apply. Blackout periods include Australian national school holidays, peak travel periods and the Christmas / New Year period. Prize is subject to availability at the time of booking. Reservations are subject to availability. Trip must be booked at least sixty (60) days prior to intended departure date. Travel dates are subject to Performance Entertainment Ltd approval. Prize is subject to availability at the time of booking. The booking time of the flights will be determined by the promoter in its complete discretion.

Redemption of prizes is subject to the standard terms and conditions of individual prize and service providers. Prizes do not include any ancillary costs associated with redeeming the prize.

The winner (and their companion) are responsible for all other expenses including spending money, meals (unless specified), drinks, transfers (unless specified), laundry charges, activities (unless specified), incidentals, energy surcharges, gratuities, services charges and all other ancillary costs.

Unless expressly stated in these terms and conditions all other expenses (including travel to and from the departure point) become the responsibility of the winner.

A valid passport is required for all international journeys. It the responsibility of the winner and their travel companions to ensure they have all required travel documentation (including but not limited to passports & visas) as required for travel to the destination point. All costs associated with obtaining this travel documentation is the responsibility of the winner.

It is a condition of accepting the prize that the winner may be requested to present their credit card or a cash deposit upon arrival at any accommodation to cover all incidentals they may incur during their stay.

The two (2) flights must be utilized at the same time, for the same travel dates, from the same departure point and to the same destination.

Transport to and from Departure point including but not limited to additional Domestic airfares if required, any additional meals, any extra sightseeing or activities, any additional accommodation, personal spending money, and all other ancillary costs, as well as obtaining any of these, are the responsibility of the winner and their travel companions. Prize also excludes medical expenses, items of a personal nature, beverages, optional tours not outlined, laundry, telephone calls, additional nights, room upgrades or other ancillary costs associated with redeeming the prize other than those specified. These costs and expenses are the responsibility of the winner. Any extension to the duration of the prize is at the winner’s sole expense and subject to availability at the time of booking. For the removal of doubt, taxes for domestic travel are included in the prize winning domestic airfares provided by the Promoter.

Prize must be taken as offered. The prize, or any unused portion of the prize, is not transferable or exchangeable and cannot be redeemed as cash. The prize cannot be used in conjunction with any other special offer. The prize is valued in Australian dollars. The Promoter accepts no responsibility for any variation in the prize value. Prize winner is advised that tax implications may arise from their prize winnings and they should seek independent financial advice prior to acceptance of their prize. In the event that a portion of the prize is awarded to the winner in the form of a voucher / ticket / pass/ letter, redemption of that portion of the prize will be subject to the terms and conditions stipulated on the voucher / ticket / pass/ letter. The Promoter will not be liable for any voucher / ticket / pass/ letter that has been lost, stolen, forged, damaged or tampered with in any way. Redemption of the prize subject to the standard terms and conditions and guidelines of the accommodation venue and the activity service provider. Failure to follow the standard rules and guidelines presented will result in the winner forfeiting their right to participate in the said activity.

21. All elements of the prize are subject to availability with no cash alternative and the prize package is non-transferable and non-refundable. Winner(s) cannot change, vary, substitute or extend any element of the prize (in whole or in part).

As a condition of accepting the prize, the winner (and their companions) must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.

Once issued, tickets are non-transferable and may not be re-issued once travel has commenced.

24. Any extension to the duration of the prize is at the winner’s sole expense and subject to availability at the time of booking.

25. Flight schedules are subject to change without notice. Domestic and International travel advice can be obtained from various sources, including government, local consular offices and the website of the Australian Department of Foreign Affairs and Trade.

26. Cancelation and/or changes to the booking will incur additional fees payable by the winner. The Prize will be sent to the winner’s nominated email address.

In the event that for any reason whatsoever the Winner does not take the prize at the time stipulated by the Promoter, then the prize will be forfeited by the Winner and cash will not be awarded in lieu of the prize.

In the event that a prize, or part of a prize, is unavailable, the Promoter reserves the right to substitute the prize or part of the prize in its discretion with an alternative prize or part of the prize to the same and equal recommended retail value and/or specification subject to any written directions from the various Lottery Departments.

29. A draw for any unclaimed prizes may take place on (October 16, 2014) at the same time and place as the original draws, subject to any directions from a regulatory authority. Winner(s), if any, will be notified via writing within two days and their name(s) published online at www.Roadshow.com.au. Any second chance winner(s) of a prize value over $250 will have their names and postcode published in The Australian on (July 23, 2014).

The promoter is neither responsible nor liable for any late lost or misdirected mail (including but not limited to prizes).

The Promoter is not responsible nor liable for any prize damaged in transit in the delivery of their prize

Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.

In the event of unforeseen circumstances, war, terrorism, state of emergency or disaster (including but not limited to natural disaster)the Promoter reserves the right to subject to reference to all relevant state and territory rules and regulations, to cancel, terminate, modify or suspend the promotion.

If a medical circumstance in some way restricts your ability to enter the competition through the required mechanic, you are still eligible to enter however you must briefly state your circumstances upon entry.

If your entry is selected as a winning entry, validation of your circumstances/ the validity of your entry will be undertaken by the Promoter. Method of validation (without limitation) will be determined by the Promoter in its complete discretion. If the winning entry is deemed to be a winner, the winner will be notified as per the terms and conditions herein. In the event that the Promoter requests the entrant to sign any legal documents relating to the verification of their medical circumstance, the legal documents will take the form determined by the Promoter. It is a condition of accepting the prize the winner sign any such legal documentation.

Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.

Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of the prize.

If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
