Terms and Conditions
1. By entering the KIA Game On! Competition, you are agreeing to the following terms and conditions.
2. Information on how to enter forms part of the terms of entry.
3. Subject to clause 4 entry is open to all residents of Australia who are 18 years of age or older.
4. Employees and their immediate families of KIA Motors Australia Pty Limited, Mnet Mobile Pty Ltd and their associated agencies and companies are not eligible to enter.
5. The competition opens on Monday 6 January 2014 at 00:01 AEDT and closes on Sunday 26 January 2014 at 23:59 AEDT.
6. In order to enter, entrants must
a. Download the ‘KIA Game On!’ app on their smartphone
b. Register to participate providing all mandatory requirements – Full Name, Mobile Number, Email Address, Player Name (6-12 letters or numbers)
c. Watch the ‘KIA Game On’ advertisement aired online (http://www.ausopen.com), on television, in shopping centres, at the KIA Open and other outlets. When the advertisement is aired the entrant plays the serve with their smart phone to generate a score/rating.
7. Entrants (including winners) in the competition may enter as many times as they like, but may not use “scripting” for multiple entries. Entries must be received by Sunday 26 January 2014 at 23:59 AEDT.
8. Entrants may incur download charges applicable to the contract they hold with their carrier.
9. There will be one (1) Major Prize Winner who will receive the prize package detailed below.

Total prize value is $34,035.00. Prize value is correct as at the date of printing and the Promoter accepts no responsibility for any change in prize value between now and the ultimate date on which the prize is taken.
10. The Major Prize comes with Compulsory Third Party Insurance only and the Prize Winners will be responsible for obtaining any additional insurance at their own cost.
11. Additional options/accessories and all ancillary costs are the responsibility of the Winner. Unless expressly stated, all other expenses become the responsibility of the Winner.
12. If the Winner does not hold a current Australian driver’s licence as at the date of delivery of the car, the car will be transferred into the name of an adult in possession of a driver’s licence, nominated by the Winner on the Winner’s behalf.
13. The prize will be available for collection by the Winner at the Winner’s nearest authorised KIA Motors Australia Pty Limited dealer within 28 days of the determination of the prize Winners.
14. In participating in the prize, the Winner agrees to participate and co-operate as required in all editorial activities relating to the Competition, including but not limited to being interviewed, photographed and social media activity. The Winner and any companion grant the Promoter a licence to use any footage and photographs and the Winner and any companion will receive no fee if material is used.
15. The Major Prize cannot be transferred (except as stated in clause 12) nor can the prize be redeemed for cash. The Winner should seek independent financial advice about any tax implications arising from the prize winning.

17. Each entrant who has entered the competition during the competition period and in accordance with clause 6 will be entered into a draw. There will be one (1) Winner drawn randomly from the national pool of entries and they will become a Winner if their entry complies with clauses 3, 4, 5 and 6. Entries that do not contain the information required may be deemed invalid and, in that event, a further draw will be conducted. The draw will take place at Mnet Mobile Pty Ltd, Level 1, 16 Anster Street, Adelaide, South Australia 5000 on Tuesday 28 January 2014 at 11:00 AEDT.
18. The Winner will be notified by a phone call on the day of the draw, and an email advising the Winner of their prize will also be sent. The Winner’s details will be published in the Public Notes section of The Australian newspaper on Monday 3 February 2014.
19. The Promoter’s decision is final and the Promoter will not enter into correspondence regarding the result.
20. It is a condition of accepting the prize that the Winner must comply with all the conditions of use of the prize and prize supplier’s requirements.
21. Subject to state government legislation, an unclaimed prize draw will take place at Mnet Mobile Pty Ltd, Level 1, 16 Anster Street, Adelaide, South Australia 5000 on Tuesday 29 April 2014 at 10:00 AEST and the Winner will be notified in writing and their details published in the Public Notes section of The Australian newspaper on Monday 5 May 2014.
22. The Promoter and associated agencies, are not liable for any loss, damage, personal injury or death whatsoever (including, but not limited to, any direct, indirect or consequential loss) suffered or sustained in connection with this competition, the use of a prize or any act or omission (whether negligent or not) of the promoter, its associated agencies or any person associated with any of them, except to the extent that any liability cannot be excluded by law.
23. The Promoter reserves the right to refuse to allow a Winner to take part in any or all aspects of the prize, if the Promoter determines, in their absolute discretion, that a Winner is not in the mental or physical condition necessary to be able to safely participate in the prize. It is a condition of accepting the prize that the Winner may be required to sign a legal release in a form determined by the promoter in its absolute discretion.
24. All entries become the property of the Promoter, and with the entrants consent, the Promoter reserves the right to use any personal information provided by an entrant to enter and conduct the competition in accordance with the KIA Motors Australia Pty Limited Privacy Policy found at http://www.kia.com.au/privacy.
25. In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter’s ability to proceed with the competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel the competition and recommence it from the start on the same conditions, subject to state government legislation.
26. KIA Motors Australia Pty Limited, Mnet Mobile Pty Ltd and their associated agencies and companies will take no responsibility for prizes damaged or lost in transit, or late, lost or misdirected mail.
27. KIA Motors Australia Pty Limited, Mnet Mobile Pty Ltd and their associated agencies and companies will not be liable for any misadventure, accident, injury, loss (including but not limited to consequential loss) or claim that may occur; during any draw; whilst undertaking any travel won on or connected with their entry into the draw; or in the participation in any prize; as a consequence of late, lost or misdirected mail; in relation to failure of an entry to be received by the Promoter on account of technical problems or traffic congestion; arising from or related to any problem or technical malfunction of any computer equipment, software, internet connection, any injury or damage to entrant’s or any other person’s computer software related to or resulting from participation in this promotion.
28. KIA Motors Australia Pty Limited assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries, and reserves the right to take any action that may be available.
29. If for any reason this competition is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupt or affect the administration security, fairness, integrity or proper conduct of this competition, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, take any action that may be available, and to cancel, terminate, modify or suspend the competition, subject to state government legislation.
30. The Promoter is KIA Motors Australia Pty Limited (ABN 97 110 483 353) of Building G, 350 Parramatta Road, Homebush NSW 2140.
31. Entry details remain the property of the Promoter. Mnet Mobile Pty Ltd, on behalf of KIA Motors Australia Pty Ltd (ABN 97 110 483 353) and its related entities, is collecting the entrant’s personal information for the purpose of conducting and promoting this competition (including but not limited to determining and notifying Winners), and, if the entrant consents, for the purpose of sending entrants promotional and direct marketing material. The entrant may request access to his or her personal information by e-mailing customer_service@kia.com.au
