THE ILLUSIONISTS IN MELBOURNE TICKET COMPETITION TERMS AND CONDITIONS

1. The promoter is The Herald & Weekly Times Pty Ltd (ABN 49 004 113 937) of 40 City Road, Southbank, Victoria, 3006 (HWT).

2. Instructions on how to enter form part of the conditions of entry. Entry into the competition is deemed acceptance of these terms and conditions.

3. Entry is only open to residents of Victoria. Employees of the Promoter and their immediate families, directors, management, related companies, and their agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether by natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin.

4. To enter, friends of the Herald Sun Facebook page must send their full name, email address and contact number, along with their answer to the question “If you could perform any type of magic, what would it be and why?” by email to socialmedia@heraldsun.com.au or via a direct message on the Herald Sun Facebook page.

5. The competition commences at 9.00am (AEDT) on Thursday 2 January 2014 and finishes at 5pm (AEDT) on the same day.

6. Only one entry per person will be accepted provided that it is submitted in accordance with the entry instructions.

7. The time of entry will in each case be the time the entry is received by HWT in the socialmedia@heraldsun.com.au inbox or the time that is displayed on the submission on the Herald Sun Facebook page.

8. The Promoter, its agents, affiliates or representatives will not be liable for any lost, late or misdirected entries.

9. The most creative entry (as judged by the Promoter in its discretion) submitted in accordance with these terms and conditions will win a double pass to The Illusionists, plus the chance to go backstage for a meet and greet with the cast (pending availability) at the Arts Centre in Melbourne between Friday 3 January and Sunday 12 January.

10. Entries will be collated and the winners determined by the Promoter at 10am on Friday 3 January 2014 at the offices of the Promoter (at Level 12, 40 City Road, Southbank, Victoria, 3006). The Promoter’s decision is final and binding. No correspondence will be entered into. Judging will be by suitably qualified judges appointed by the Promoter to assess the creativity of the entries and each entry will be judged on its merits. Chance plays no part in determining the winners. The winning entrants name and postcode will be published online on 6 January 2013.

11. If the winner of any prize is under the age of 18 years, the prize will be awarded to the winner’s nominated parent or guardian. Entrants under the age of 18 years must obtain the prior permission of a parent or guardian who is over the age of 18 years before entering the competition.

12. Any additional charges are the responsibility of the winners. The Promoter accepts no responsibility for any variation in the prize value.

13. Tickets are non-transferrable and cannot be exchanged for cash.

14. If the prize or any part of the prize becomes unavailable for reasons beyond the Promoter’s control, the Promoter will endeavour but is not obliged to provide a substitute prize of equivalent value.

15. In the event that a winner does not take a prize, then the prize will be forfeited by the winner and cash will not be awarded in lieu of the prize. Prizes must be taken as offered and cannot be varied. Any unused portion of the prize is not-transferable, non-refundable and non-redeemable for other goods or services and cannot be taken as cash.

16. Competition entrants acknowledge that this promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook.

17. The Promoter reserves the right to verify the validity of entries and to disqualify any entry which, in the opinion of the Promoter, includes objectionable content, profanity, potentially insulting, inflammatory or defamatory statements, disqualify any entrant who tampers with the entry process, who submits an entry that is not in accordance with these terms and conditions of entry, or who has, in the opinion of the Promoter, engaged in conduct in entering the promotion which is fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the promotion and/or Promoter. The Promoter reserves the right to disqualify a winner if the Promoter becomes aware that the winner and/or the winner’s entry is of a type described in this clause.

18. Unruly and unreasonable behaviour is prohibited. Any behaviour that is considered unacceptable by the venues or Promoter will result in the person(s) being removed from the relevant venue.

19. The prize winners and their companions must comply with any terms and conditions specified by any relevant third party in relation to any component of the prize.

20. The winning entrants and their companions acknowledge that they participate in the events that form part of the prize at their own risk. If the winning entrants or their companions become aware of any medical condition or impairment that will be detrimental to their health if they participate in the events that form part of the prize they must withdraw from those events.

21. If for any reason, this competition is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the reasonable control of the Promoter which corrupt or affect the administration, security, fairness, integrity or proper conduct of this promotion, the Promoter reserves the right, in its sole discretion, to disqualify any individual who tampers with the entry process, take any action that may be available and to cancel, terminate, modify or suspend the competition subject to any written directions given under State Legislation.

22. Except for any liability that cannot be excluded by law, competition entrants agree to exclude the Promoter (including its officers, employees and agents) and Facebook from all liability (including negligence) for any personal injury, loss or damage (including loss or opportunity) whether direct, indirect, special or consequential, arising in any way out of the promotion, including but not limited to, where arising out of the following:

a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control);

b) any theft, unauthorised access or third party interference;

c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter;

d) any variation in prize value to that stated in these conditions of entry;

e) any tax liability incurred by a winner or entrant;

f) the broadcast of any program relating to the competition or the publication of any material, including statements made by any compere, staff member, journalist, other entrants or any other person; and/or

g) participation in the prize.

23. The Promoter reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.

24. When entering the competition, competition entrants provide their personal information to the Promoter, not Facebook. The Promoter collects information about you, including for example your name and contact details which you provide when registering or using our services as well as information from other sources. We collect and use that information to provide you with our goods and services and to promote and improve our goods and services. We may share your information with our related companies and any of us may be in contact for those purposes (including by email and SMS). We may also use your information as described when we collect information from you. If you do not provide us with requested information we may not be able to provide you with the goods and services you require. We disclose your information to our related companies, service and content providers, including those located outside Australia. Where you have entered a competition, we may disclose your personal information to authorities if you are a prize winner or otherwise as required by law.
