TERMS & CONDITIONS OF ENTRY

Information on how to enter, mechanics of entry and prizes form part of these Terms & Conditions of Entry.
Entry into the competition is deemed acceptance of these Terms & Conditions of Entry.
Entry is only open to residents of Australia (excluding residents of Tasmania and Northern Territory) aged 18 years. The directors, management and employees (and their immediate families) of the Promoter and the Promoter Parties and any supplier to the Promoter who is directly associated with the conduct of the competition are ineligible to enter the competition.
The total value of the prize is capped at $5,000.
The competition commences at 12:01am (AEDT) on 23rd August 2014 and ends at 11:59pm (AEDT) on 21st November 2014 or such later date decided by the Promoter. Any change will be as advertised.
The competition will be drawn at 11:00am (AEDT) on 26th November 2014 using a computer generated method at Promoter’s premises. The winner of the draw will be notified by phone and email (if valid) no more than 2 days after the draw date. All reasonable steps to notify the winner(s) of the result of the draw will be taken by the Promoter. The Promoter’s decision is final and no correspondence will be entered into.
To enter the competition, Entrants must, during the Competition Period, book and attend a hearing test appointment at Hearing Life hearing clinic by the 21st November 2014. Only one (1) entry per person is permitted for the competition. Any subsequent entry after the first valid entry is received will be invalid.
The winner will receive (1) $5,000.00 EFTPOS Gift Card. The EFTPOS Gift Cards is subject to its prevailing terms and conditions of use (available at www.giftcardplanet.com.au or by calling 1300 079 267), including expiration dates, and are not replaceable if lost, stolen or damaged. –
The total prize pool value for the competition is no more than $5,000. The prize is not transferable or exchangeable and cannot be taken as cash. Prizes must be taken as offered and cannot be varied. The Promoter accepts no responsibility for any variation in prize value.
The Promoter may conduct a redraw at the same place as the original draw at 11:00am (AEDT) on 27th February 2015 as is necessary in order to distribute any prize(s) (if any) unclaimed by that date, subject to any written directions given under applicable legislation. The winner will be notified using the same contact methods and attempts as mentioned in clause 6. All reasonable steps to notify the winner (if any) of the results of the unclaimed prize draw(s) (if any) will be taken by the Promoter. The Promoter’s decision is final and no correspondence will be entered into.
Entrants can only enter in their own name. Entrants who provide incorrect, misleading or fraudulent information are ineligible to participate in the competition and all entries of an Entrant who is deemed by the Promoter to have provided incorrect, misleading or fraudulent information may, at the discretion of the Promoter, be deemed invalid. The Promoter reserves the right to request the Entrant to produce (within the requested time) appropriate photo identification or other documentation (to the Promoter’s satisfaction, at its sole discretion) in order to confirm the Entrant’s identity, age, residential address, eligibility to enter and claim a prize and any information submitted by the Entrant in entering the competition, before issuing a prize. If the documentation required by the Promoter is not received by the Promoter (or its nominated agent) or the Entrant or entry has not been verified or validated to the Promoter’s satisfaction then all entries of that Entrant will be ineligible and deemed invalid.
The Promoter reserves the right to verify the validity of any and all entries and reserves the right to disqualify any Entrant:
for tampering with the entry process;
for submitting an entry which is not in accordance with these Terms & Conditions of Entry; or
if the Entrant is engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the competition.

The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved. A prize will only be awarded following any winner validation and verification that the Promoter requires in its sole discretion.
If a prize or element of a prize becomes unavailable, for any reason beyond the Promoter’s reasonable control, then a comparable prize or prize element of equal or greater value will be awarded in lieu, subject to any written directions made under applicable legislation.
If the competition is not capable of running as planned for any reason beyond the reasonable control of the Promoter, including war, terrorism, state of emergency or disaster (including natural disaster), infection by computer virus, bugs, tampering, unauthorised intervention, technical failures or anything which corrupts or affects the administration, security, fairness, integrity or proper conduct of the competition, the Promoter reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the competition and/or, if necessary, to provide an alternative prize or prizes to the same value as an original prize, subject to any written directions made under applicable legislation.
In relation to the prize, the Entrant acknowledges and agrees that:
the Promoter and/or the Promoter Parties have not given any warranty or made any representation to the Entrant regarding any services or products provided to the Entrant in connection with the prize;
to the extent permitted by law and without limiting these Terms & Conditions of Entry, the Entrant releases and discharges the Promoter (on its own behalf and on behalf of the Promoter Parties), and none of Promoter nor any of the Promoter Parties is liable for any liability, damage, loss, cost, claim or expense (including legal expense) suffered (directly or indirectly) by the Entrant arising out of or in connection with the prize (including breach of contract or negligence by the Promoter or any of the Promoter Parties), including:
lost or damaged entries, prize claims or prizes;
technical malfunctions, delays or failures, including those resulting from accessing any materials related to the competition and any incorrect, inaccurate or incomplete information communicated in the course of, or in connection with, the competition as a result of any technical malfunctions, delays or failures;
dangers and risks inherent in expeditions and activities similar to the prize;
accident, illness, personal injury or death;
theft, unauthorised access or third party interference;
inadequacy of, delay in, change or variation to, or failure in the provision of any services or products in connection with the prize (including travel agent services or products and expedition services or products);
events beyond the direct control of the Promoter including acts of God, civil disturbances and war, natural disasters, risks inherent in travel including by boat, automobile, cycle, train, ship, aircraft or any other means of travel, limited or restricted access to medical facilities or transportation or means of rapid evacuation and assistance, terrorist activities, social or labour unrest, mechanical, construction or equipment failures or difficulties, diseases, local laws, or weather conditions;
any statutory or regulatory obligation in connection with travel, including obligations in relation to entry, safety or security such as passport, visa, or vaccination obligations; and
acts or omissions of the Promoter or any of the Promoter Parties.
The Entrant indemnifies the Promoter and the Promoter Parties in respect of any claim or action brought by any person in relation to the above release ; and
without prejudice to the ability of the Promoter to enforce the above release and the above indemnity for its own benefit, the Promoter holds the benefit of each such release and indemnity to the extent that it is expressed to apply in favour of the Promoter Parties on trust for each of the Promoter Parties.
It is a condition of accepting a prize that the winner may be required to sign a release and indemnity in the above form or a form determined by the Promoter in its absolute discretion.
As a condition of entering the competition, the Entrant agrees and acknowledges that publicity photographs may be taken of the Entrant by one or more of the Promoter Parties and the image/photographic likeness may appear in photographs taken during the prize. The Entrant grants an irrevocable, royalty free license to the Promoter for any intellectual property contained in the photos containing the Entrant’s image or likeness. The Entrant agrees and acknowledges that such images or likenesses may be used by the Promoter for publicity or general information purposes including marketing and advertising materials and associated websites of the Promoter or within other publicity, whether print or online, which may be seen by the general public. The Entrant agrees and acknowledges that the Promoter will not seek any further permission nor provide any notification before using such photos.
An entry and any copyright subsisting in an entry irrevocably becomes, at time of entry, the property of the Promoter. The Promoter collects personal information (such as name, address, telephone number, email address) about the Entrant to include the Entrant in the competition and, where appropriate, award prizes. If the personal information requested is not provided, the Entrant cannot participate in the competition and is deemed ineligible. The Entrant agrees that the Promoter may, in the event the Entrant is a winner, publish or cause to be published the Entrant winner’s name and locality in any media, as required under the applicable legislation. The Entrant can request access to, update or correct any personal information held by the Promoter by contacting the Promoter’s Privacy Officer at: 02 9857 8271. All personal information will be stored at the office of the Promoter. A copy of the Promoter’s Privacy Policy in relation to the treatment of personal information collected may be obtained at www.hearinglife.com.au/privacy-statement or other applicable privacy policy webpage.
By participating in the competition, the Entrant acknowledges that a further primary purpose for collection of the Entrant’s personal information by the Promoter is to enable the Promoter to use the information to assist the Promoter in improving goods and services and to contact the Entrant in the future with information on special offers or to provide the Entrant with marketing materials via any medium including mail, telephone and commercial electronic messages (SMS (Short Message Service), MMS (Multimedia Message Service), IM (Instant Messaging) and email) or any other form of electronic, emerging, digital or conventional communications channel which the Entrant has provided their details for. The Promoter may share information with the Promoter Parties who may contact the Entrant with special offers in this way. By entering the competition, the Entrant acknowledges and agrees that the Promoter may use the Entrant’s personal information in the manner set out in these Terms & Conditions of Entry.
During the competition period, the promoter may apply for approval of an amendment to the Terms and Conditions of Entry, subject to written directions made under applicable legislation. Any amendment will be advertised.
