TERMS AND CONDITIONS
By entering the Australian Baseball League’s ‘AUSTRALIAN BASEBALL LEAGUE OPENING SERIES DATA CAPTURE COMPETITION’ you are agreeing to the following terms and conditions:
1. STANDARD TERMS
1.1 Information on how to enter forms part of the terms of entry. Entry into the promotion is deemed
acceptance of these conditions for entry.
2. WHO CAN ENTER
2.1 Subject to clause 2.2 entry is open only to residents of Australia over 18 years of age
2.2 Directors, management, employees, officers and contractors (and their immediate families) of the
promoter, of the MLB Entities (defined below) or of the agencies or companies associated with this
promotion are ineligible. “Immediate families” means spouse, ex-spouse, de-facto spouse, parent, stepparent,
grandparent, step-grandparent, uncle, aunt, niece, nephew, natural or adopted child, and sibling or step-sibling (whether natural or adopted by a parent), whether or not they live in the same household as the director, manager, employee, officer or contractor.
2.3 The “MLB Entities” shall mean the Office of the Commissioner of Baseball (“BOC”), its Bureaus,
Committees, Subcommittees and Councils, MLB Advanced Media, L.P., Major League Baseball Enterprises,
Inc., Major League Baseball Properties, Inc., the Major League Baseball Clubs (“Clubs”), each of their
parent, subsidiary, affiliated and related entities, any entity which, now or in the future, controls, is
controlled by, or is under common control with the Clubs or the BOC, and the owners, general and limited
partners, shareholders, directors, officers, employees and agents of the foregoing entities.
3. HOW TO ENTER
3.1 The competition commences on Monday, March 10 2014 at 12:00am (AESDT) and concludes on Monday,
May 19 2014 at 12:00am (AESDT) (“the Competition Period”).
3.2 Multiple entries are not permitted.
3.3 Entrants can gain one entry in to the competition by successfully completing either a hard copy entry at one of the MLB Roadshow events or an online entry as at www.theabl.com.au during the Competition Period.
3.3 A valid entry compromises of six complete data fields on the entry form
3.5 The Promoter, its agents, affiliates or representatives and the MLB Entities will not be liable for any lost,
late or misdirected entries.
4. HOW TO WIN
4.1 The “Winner” of the “Prize” will be drawn at random on Monday, May 19 2014 at 12:00am (AEDST) at 46 Market Street Sydney NSW 2000, from the list of eligible entrants with VALID email addresses.
4.2 The “Prize Winner” will be announced no later than 5:00pm (AESDT) on 19/05/2014 and notified in writing,
by email and phone. The Prize Winner will be published in ‘The Australian’ newspaper on the 26/05/2014.
4.4 The Promoter’s decision in relation to any aspects of the competition is final and the Promoter will not
enter into any correspondence regarding the result.
4.5 It is a condition of accepting the prize that the winners may be required to sign a legal release in a form
determined by the Promoter in its absolute discretion.
4.6 Entries not completed in accordance with these terms and conditions will not be considered valid and will
not be included in the draw. Indecipherable or incomplete entries will be deemed invalid.
4.7 The Promoter reserves the right to request that the winners provide proof of identity, proof of residency
at the nominated prize delivery address and/or proof of entry validity (including phone bills) in order to
claim the prize. Proof of identification, residency and entry considered suitable for verification is at the
discretion of the Promoter. In the event that a winner cannot provide suitable proof, the winner will
forfeit the prize in whole and no substitute will be offered.
4.8 The Promoter reserves the right to verify the validity of entries and to disqualify any entry which, in the
opinion of the Promoter, includes objectionable content, profanity, potentially insulting, inflammatory or
defamatory statements, disqualify any entrant who tampers with the entry process, who submits an entry
that is not in accordance with these terms and conditions of entry, or who has, in the opinion of the
Promoter, engaged in conduct in entering the promotion which is fraudulent, misleading, deceptive or
generally damaging to the goodwill or reputation of the promotion and/or Promoter. The Promoter
reserves the right to disqualify a winner if the Promoter becomes aware that the winner and/or the
winner’s entry if of a type described in this clause.
5. PRIZES
5.1 One (1) winner will each receive a prize package valued at $4,800
– Two return economy airfares to Los Angeles departing Friday, 13 June 2014 and returning
Tuesday, June 17, 2014
– Airport transfers to and from hotel
– Two nights’ accommodation in a four star hotel from 13 June, 2014 to 15 June, 2014
– Two (2) Upper Deck tickets for the winner and one (1) guest to attend (a) the Los Angeles Dodgers v Arizona Diamondbacks Game scheduled to be played on Friday, June 13, 2014, and (b) the Los Angeles Dodgers v Arizona Diamondbacks Game scheduled to be played on Saturday, June 14, 2014
– Two ABL merchandise packs (each consisting of one cap, baseball and water bottle and two t-shirts)
5.2 The Australian Baseball League is responsible for the fulfilment of the prize directly with the winners.
5.3 The prize is not exchangeable and cannot be taken as cash, may not be sold, or used in any other
promotion. The prize winner is responsible for all expenses not specified in these Conditions of Entry,
including but not limited to, any transfers not stated above, transport to and from the prize winner’s
nearest capital city, meals, drinks, insurance (including medical, travel and health), items of personal
nature (including gratuities, telephone and in-room charges), spending money and all other ancillary
costs. The Promoter accepts no responsibility for any variation in the prize value.
5.4 If a winner, for whatever reason, is unable to attend the event or redeem prize, or does not take an
element of the prize within the time stipulated by the Promoter then that element of the prize will be
forfeited by the winner. Cash will not be awarded in lieu of the prize or element thereof.
5.5 If the prize or any part of the prize becomes unavailable for reasons beyond the Promoters’ control, the
Promoters will endeavour but are not obliged to provide a substitute prize of equivalent value. In the event that any element of the prize is not available, the Promoter reserves the right to substitute a prize
of equal or greater value.
5.6 To the full extent permitted by the law, the Promoters exclude liability for any loss, damage or injury
whatsoever suffered or sustained (including, but not limited to direct, indirect, special or consequential
loss or damage, loss of opportunity revenue or profit) arising directly or indirectly out of or in connection
with this promotion.
5.7 The winner must, on request by the Promoter, be able to provide evidence which, to the reasonable
satisfaction of the Promoter, demonstrates that the winner is an eligible entrant (as per clauses 2.1, 2.2
and 2.3) and has complied with these terms and conditions.
5.8 Any taxes (other than GST, if any) which may be payable as a consequence of a winner receiving this prize
are the sole responsibility of the winner.
5.9 Prize does not include tickets to any event or exhibition during the trip other than as specifically set forth herein. In the event that any Major League Baseball events,
exhibitions or games are cancelled, abandoned, suspended or rescheduled, the Prize Winner shall be
subject to any and all policies of Major League Baseball with regards to any such Game. In the event the
Prize Winner is unable to attend any Major League Baseball event, exhibition or game that has been
rescheduled due to the predetermined travel schedule or other such conditions, the Promoter and the
MLB Entities shall not be liable for any costs incurred through any changes requested by the Prize Winner
in order to attend such a game, event or exhibition. Winner’s guests must be of legal age of majority in
their jurisdictions of residence (and at least eighteen (18) years of age), unless accompanied by a parent
or legal guardian. Major League Baseball game, event and exhibition dates and times are determined in
the sole discretion of the Office of the Commissioner of Baseball and may be subject to change. Winner
and his/her guest(s) agree to comply with all applicable ballpark regulations in connection with the prize.
Promoter and the applicable MLB Entities reserve the right to remove or to deny entry to Winner and/or
his/her guest(s) who engage(s) in a non-sportsmanlike or disruptive manner, or with intent to annoy,
abuse, threaten or harass any other person at the game, event or exhibition. Promoter and the MLB
Entities will not be responsible for weather conditions, Acts of God, acts of terrorism, civil disturbances,
work stoppage or any other natural disaster outside their control that may cause the cancellation or
postponement of any Major League Baseball game, event or exhibition. Major League Baseball game,
event and exhibition tickets awarded as part of the prize may not be resold or offered for resale. Any such
resale may result in disqualification and forfeiture of prize, and may invalidate the license granted by the
game ticket(s).
5.10 The prize winner is responsible for all expenses not specified in these Conditions of Entry, including but
not limited to, any transfers not stated above, transport to and from the prize winner’s nearest capital
city, meals, drinks, insurance (including medical, travel and health), items of personal nature (including
gratuities, telephone and in-room charges), spending money and all other ancillary costs.
5.11 The prize winner and their companion are responsible for travel documentation (including passports and
visas) and compliance with any health or other government requirements.
5.12 In participating in the prizes, the winners agree to participate and co-operate as required in all editorial
activities relating to the promotion, including but not limited to being interviewed and photographed. The
winners grant the Promoter a perpetual and non exclusive licence to use such footage and photographs in
all media world wide and the winner (and their companions) will not be entitled to any fee for such use.
5.13 The winners agree that they will not sell or otherwise provide their story and/or photographs to any
media or other organisation.
5.14 The prize winner acknowledges that the prize is subject to additional terms and conditions imposed by
third party prize suppliers, including Delta Air Lines. The prize winner must become acquainted with any
such additional terms and conditions prior to taking the prize. The Promoter does not accept
responsibility and is not liable for any conditions imposed on the taking of the prize by Delta or any other
third party prize supplier, or the breach of those conditions by any person.
5.15 Prize travel is subject to fare rules and other conditions of carriage. Tickets will not be exchanged for
another destination. The prize winner and their companion cannot upgrade any prize travel or prize
accommodation using cash or frequent flyer points and will not accrue frequent flyer points on any prize
flights or with any prize accommodation. The prize winner and their companion must travel together on
the same flights on all sectors and stay together at the nominated hotel. Prize travel must be taken on the
dates set out in the terms and conditions or such other dates as are approved by the Promoter. Prize
travel may not be changed by the prize winner under any circumstances. If the prize winner cannot travel
in accordance with these Conditions of Entry and on the flights nominated by the Promoter, the prize will
be forfeited. Bookings will be made by the Promoter. Flight schedules and accommodation arrangements
are subject to change without notice.
