OFFER TERMS AND CONDITIONS
The following Offer Terms and Conditions govern both the Offer and the registration of your Card. Our Online Terms of Service and Privacy Statement also form part of these Offer Terms and Conditions. By registering your Card for the Offer you agree to the Offer Terms and Conditions. If you do not agree with the Offer Terms and Conditions, do not register your Card.
The Offer is provided by American Express Australia Limited (ABN 92 108 952 085 Australian Credit Licence No. 291313) of 12 Shelley Street, Sydney NSW 2000 (“the Promoter/American Express/We/Us”).
If you are successful in receiving a competition entry, the Prize Draw Rules apply.

A. The Offer
If you register an Eligible Card (your “Registered Card”) through the registration page at amexnetwork.com.au/merivale, for every single Eligible Transaction in which you spend $33.00 or above on your Registered Card at participating Merivale establishments (listed in clause C) in New South Wales, Australia between 00:01 (AEST) on Wednesday, 12th February 2014 and Friday 11th April 2014 at 23.59 (AEDT) (the “Offer Period”), you will receive one (1) entry into the Prize Draw for a Merivale voucher at AU$5,000 or $2,000 – subject to the Prize Draw Rules.
Only Australian residents over the age of 18 may register, who reside in New South Wales state are eligible for this Offer. If you are not eligible to register, you are not eligible to enter or win the Prize Draw.
B. Eligible Cards
Only American Express Cards issued by American Express Australia Limited or by the following licensed network partners are Eligible Cards:
•National Australia Bank Limited;
•Westpac Banking Corporation;
•Australia and New Zealand Banking Group Limited (ANZ);
•Commonwealth Bank of Australia;
The following are not Eligible Cards: American Express Business Travel Accounts, Government Cards, Corporate Purchasing Cards, Corporate Meeting Cards and Corporate Cards.
If a replacement Card with a new Card number is issued during the Promotion Period, this will be deemed as a new Card and a separate registration will be required. Supplementary Cards qualify as an Eligible Card only if registered for the Offer separately.

Transactions must be made directly with the participating merchant. The following are not Eligible Transactions:
•Purchasing gift cards from any of the participating Merivale establishments.
•Transactions that are subsequently cancelled or refunded.
•Transactions made at other Merivale establishments not listed above and online.
D. Maximum Participation & Limits
There are no limits on the number of entries to the Prize Draw during the Offer Period and only one prize can be issued per winner
E. Prize Draw Rules
a.Employees of American Express, or Sales Success Pty Ltd (trading as ‘Tribe Marketing’) or any of their immediate families, licensees and agencies, are ineligible to enter.
b.There are 2 x AU$5,000 Merivale vouchers as primary prizes and 10 x AU$2,000 Merivale vouchers as secondary prizes to be won. Prizes will be drawn on Friday 6th June 2014 at Tribe Marketing PTY Ltd at Ground Floor, 1 Kent Street, The Rocks, NSW, 2000. Winners will be notified by telephone and in writing within two (2) days of the draw and their names will be published in The Australian on 12th June 2014.
c.At the time of the Prize Draw, a second draw will also be conducted to determine a back-up winner in case the primary winner is ineligible to receive the prize for any reason. If the primary prize winner is eligible to receive the prize, then the back-up winner will receive nothing.
d.Total maximum prize pool for the promotion is valued at up to AU$30,000 (GST inclusive).
e.The vouchers are only valid for 12 months from date of issue.
f.The vouchers can be used at any Merivale venue, list of venue and locations can be found here: http://merivale.com.au/venues/.
g.Proof of address in New South Wales may be asked to the discretion of the Promoter must be provided upon Promoter’s request to claim the prize.
h.The Promoter’s decision is final and no correspondence will be entered into.
i.The Promoter accepts no responsibility for any variation in any prize value. Prizes are not transferable or exchangeable and cannot be taken as cash in part and/or in full.
j.No responsibility is accepted for late, lost or misdirected entries.
Re-Draws
k.The promoter reserves the right to redraw if the winner and the back-up winner are ineligible to receive the prize due to the winner’s failure to satisfy the Prize Draw Rules, the Offer Terms & Conditions or if the winner’s Card account is suspended or cancelled. The Promoter will conduct further draws at 3.00pm AEST on Friday 5th September 2014 (“Unclaimed Prize Draw”) at the same place as the original draw, subject to state regulation. A winner will be notified in writing within 2 days of the draw and their name will be published in The Australian on Friday 12th September 2014.
l.The Promoter and the licensees are not liable for any tax implications (including any Fringe Benefits or Personal Income Tax) and Cardmembers should seek their own independent financial advice.

F. Privacy and Security
We will use your personal information to register your Card and to provide the Offer. In particular, we will:
a.Transfer or disclose personal information confidentially to American Express, its related companies or external organisations that provide services in relation to the Offer. This includes transferring personal information outside of Australia to the USA, Canada or other countries for data processing and servicing;
b.Request verification of card account status and/or personal information from your card issuer;
We treat all personal information strictly in accordance with the American Express Network Privacy Statement (available at www.amexnetwork.com.au/privacy.html). The American Express Network Privacy Statement also includes our Privacy Policy Statement which sets out our policies on the management of personal information. In accordance with our Privacy obligations, we will ensure that your personal information is adequately protected. To arrange access to your personal information, request a copy of the American Express Privacy Policy Statement or enquire generally about privacy matters, write to American Express.
G. Availability/Interruption.
From time to time, you may not be able to register your Card for reasons such as performance degradation, service interruption, and problems with your internet connection or device. We do not accept any liability if you cannot register your Card or if access to the registration page is unavailable, interrupted or suspended for any reason. If you cannot register your Card or access the Registration page, your only remedy is to try and access it again later.
H. Fraud/Gaming/Glitches
American Express reserves the right to suspend or cancel the Offer or other sales transaction if any fraud, gaming by users, technical failures or similar factors impair the integrity or proper functioning of the Offer or the registration process which results, or is reasonably likely to result, in any unforeseen or unpredicted loss or damage to American Express.
We will try to give you reasonable notice of any such incident and take reasonable steps to ensure you are not unfairly impacted if the incident is due to something we have done or failed to do. Please let us know if you suspect any fraudulent or abusive activity at any time.
American Express reserves the right, at its sole discretion, to disqualify any individual suspected of tampering with or gaming any aspect of the Offer or this registration page or any other current or prior program made available by American Express.
Caution: Any attempt by a user or any other individual to deliberately damage any website or undermine the legitimate operation of the Offer and/or a sale is a violation of criminal and civil laws and should such an attempt be made, American Express reserves the right to seek damages and costs (including, without limitation, attorneys’ fees) from any such person to the fullest extent permitted by law.
