Terms and Conditions

By entering The Block COLORBOND® competition (“the Competition”), you are agreeing to the following terms and conditions:

1) Information on how to enter forms part of the terms and conditions. Entry into this Competition is deemed acceptance of these terms and conditions of entry.

WHO CAN ENTER?
2) Entry is only open to Australian resident aged 18 years or over who own a residential property (or have a deposit on a new build) in Australia and are interested in the following products for their home; roof or wall cladding, shed installation and/or garage doors installation, and who agree to accept the prize on the terms outlined herein if selected as the winner.

HOW TO ENTER
3) The Competition commences on Sunday 12th August 2018 at 7pm AEST and closes on Sunday 21st October at 2018 at 23:59 AEST (“the Competition Period”). Competition draw periods are stipulated below.

4) In order to be eligible to enter the draw to win the prizes in the competition (“Competition”), participants must go online to www.9now.com.au/the-block and:
a. follow the prompts to vote for any one (1) of the five (5) couples and their renovated rooms from the most recent Room Reveal;

b. follow the prompts to the Competition entry form, input the requested details including their full name, full street address, valid email address and telephone number;
c. agree to the Competition terms and conditions; and
d. submit the fully completed Competition entry form.
5) Multiple entries permitted, subject to the following: One (1) entry per person per Room Reveal. A total of eleven (11) entries permitted per person.
6) If there is a dispute as to the identity of an Entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the Entrant.
7) All entries are deemed to be received at the time of receipt by the Promoter and NOT at the time of transmission by the Entrant.
8) The Promoter reserves the right to verify the validity of entries at any time during or after the Competition Period, and reserves the right to disqualify any Entrant who tampers with the entry process (including but not limited to tampering by way of the utilisation of techniques designed to avoid the payment of postage costs) or who submits an entry that is not in accordance with these Terms and Conditions. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
9) Subject to state permit authority restrictions, In the event that The Block is cancelled prior to the first Room Reveal, the Competition will be cancelled (subject to relevant regulatory approval). In the event that The Block ceases to be broadcast at some time after the completion of any Room Reveals, all entries received prior to The Block ceasing will be entered into the draw. Any entries received after The Block ceases will not be included in the Competition.
PRIZE
10) There will be eleven (11) minor weekly prize draws and one (1) major Prize awarded from all entries received over the entire promotional period. The Prize winners will receive the prize detailed below. The first valid entries drawn from each draw period will win the Prize stipulated below. The draws will take place at Nine Digital Pty Ltd, ABN 33 077 753 461, Level 7, Tower Building, Australia Square, 264-278 George Street, Sydney, NSW 2000 on the dates stipulated in Table A. The winners will be notified by phone and mail and their name will be published on the dates stipulated in Table A at www.9now.com.au/the-block
MINOR WEEKLY PRIZES
• $1,000 that will be awarded in the form of the winner’s choice of electronic funds transfer to the winner’s nominated bank account.
• The total prize pool for the minor prizes is valued at $11,000.00

MAJOR PRIZE
• $10,000 that will be awarded in the form of the winner’s choice of electronic funds transfer to the winner’s nominated bank account in Australia; and
• AU$20,000 worth of COLORBOND® steel (including COLORBOND® steel Matt), OR any other BlueScope material, specified by the winner, in the colour of choice (subject at all times to availability) and installation/delivery services, to be used on the winner’s residential property in Australia, for roof or wall cladding, shed and/or garage doors. Product/installation can be used on a new home or as part of a renovation.
11) The total prize pool for the major prize is valued at $30,000.00. The total prize pool for the entire promotion is valued at $41,000.00
12) The COLORBOND® and/or BlueScope prize materials must be installed at a single residential property owned by the winner, and the entire allocated budget must be used for an eligible installation(s) at a single home. On-selling or otherwise giving away of the material provided as part of the prize by the winner is not permitted. The Sponsor will liaise with the winner to organise exactly what COLORBOND® steel and/or other BlueScope product(s) the winner wishes to receive, subject to availability, and will organise the installation and delivery of that material, within the allocated budget. The Sponsor may engage its contractors to supply, deliver and/or install the material. Commitment to installation is required from the winner within 12 months of the closing date of the promotion and installation must be complete within 18 months of the closing date of the promotion. In the event that the winner’s chosen material (including delivery and installation) is valued at less than $20,000, the remainder of the allocated budget will be forfeited by the winner and will not be awarded as cash. If the winner wishes to choose material in excess of the $20,000 (inclusive of delivery and installation) budget, they can do so, however, the winner may then be required to pay for any cost additional to $20,000, as specified by the Sponsor. In the event that agreement cannot be reached between the Sponsorand the winner (in relation to the exact material or installation and delivery timelines), despite reasonable efforts of the Sponsor, or if the winner is unable to or refuses to have or accept the materials, installation and/or delivery at their property for any reason or refuses to agree to any condition of accepting the prize, the Sponsor reserves the right, in its absolute discretion, to invalidate such a winner and deem the entire prize (i.e. both elements outlined under ‘Major Prize’ heading in clause 10) to be forfeited by the winner. The Sponsor may in some circumstances, in its absolute discretion, consider awarding a winner who is unable to have the COLORBOND® steel or other BlueScope material installed at their home with the $10,000 cash element of the ‘Major Prize’ prize outlined in clause 10 only, in which case the remaining element of the Major Prize outlined in clause 10 will be forfeited by that winner and may, at the Sponsor’s discretion, be awarded to an alternative winner in accordance with Table A.
13) No responsibility will be taken by the Sponsor for any delay and/or error in the delivery of the prize by means of EFT which is outside of the Sponsor’s control.
14) All prizes must be taken as offered. The prize, or any unused portion of the prize, is not transferable, exchangeable and cannot be redeemed as cash, unless otherwise specified. The prizes are not valid in conjunction with any other offer.
15) In the event that a prize, or part of a prize, is unavailable, the Sponsor reserves the right to substitute the prize or part of the prize in its discretion with an alternative prize or part of the prize to the same and equal or greater recommended retail value and/or specification subject to any written directions from the various Lottery Departments.

16) It is a condition of accepting a prize that a winner must comply with all the conditions of use of the prize and the prize supplier’s requirements (as applicable). If a winner fails to take or redeem a prize by the time stipulated by the Sponsor, the prize will be forfeited.
17) It is a condition of accepting a prize that a winner agrees to participate in and cooperate with all reasonable media editorial requests from the Sponsor and/or Promoter including but not limited to, being interviewed, photographed and filmed and the winners grant the Promoter and the Sponsor a perpetual, non-exclusive license and consent to use such footage and photographs, and the winner’s name and likeness, in all media worldwide and the Winner will not be entitled to any fee for such use. The inclusion of any such footage or photographs (including but not limited to creative control of the feature) will remain with the Promoter and Sponsor at all times.
18) Winners are advised that tax implications may arise from their prize winnings and they should seek independent financial advice prior to acceptance of their prize.
19) In the event of a prize not claimed an unclaimed prize will be redrawn on 25/02/19 at 09:00 am at the same place as the original draw. Winners, if any, will be contacted in writing within two (2) business days of the draw and their names will be published on https://www.9now.com.au/the-block/season-14/extras/win/competitions/bluescope-steel- viewers-choice 27/02/19.
GENERAL
20) The use of any automated entry software or any other mechanical or electronic means that permits the entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
21) The Promoter is not responsible for any incorrect or inaccurate information, either caused by the user or for any of the equipment or programming associated with or utilised in this competition, or for any technical error, or any combination thereof that may occur in the course of the administration of this competition including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telecommunications, telephone, mobile or satellite network failure, theft or destruction or unauthorised access to or alteration of entries.
22) If this Competition is not capable of running as planned due to any reason whatsoever, including but not limited to, programming changes, technical failures (either in the administration of the Competition or the broadcast of the television program), unauthorised intervention, fraud or any causes beyond the control of the Promoter which corrupt or affect the conduct, administration, security, fairness or integrity of the Competition, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law and subject to any written directions given by a regulatory authority, to: (a) modify, suspend, terminate or cancel the Competition; and/or (b) disqualify any entrant, as appropriate, including banning an entrant from participating in future promotions conducted by the Promoter, for any reason including, but not limited to, behaving in any manner that is, as determined by the Promoter in its absolute discretion, deemed to be inappropriate or contrary to any broadcast codes, regulations or any applicable laws including mentioning or promoting any product, service, venture or item or using inappropriate language or saying anything that may in the producer’s reasonable opinion be abusive, rude, threatening, offensive, harmful or hurtful to any other third party.
23) The Promoter accepts no responsibility for any entries not received by the Promoter or delays due to technical disruptions or for any other reason. An entry will only be counted as being received when it has been received by the Promoter’s software system, not when it was sent from the entrant.

24) The Promoter reserves the right to request each Winner to provide proof of age and identity. Identification considered suitable for verification is at the discretion of the Promoter.
25) If the Promoter determines that the winner has breached clause 5 of these Terms and Conditions, their entry will be deemed invalid and the prize will be forfeited and subject to the unclaimed prize draw in accordance with clause 22 above.
LIABILITY AND RELEASE
26) Except for any liability that cannot be excluded by law, the Promoter and the Sponsor and its related entities and their respective officers, employees and agents, exclude all liability (including negligence) for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Competition, including, but not limited to, arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after its receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Conditions of Entry; (e) any tax liability incurred by a Winner or Entrant; (f) participation in the Competition and/or (g) redemption of the prize.
27) The Promoter and the Sponsor and their related entities and their respective officers, employees and agents will take no responsibility for defective prizes or prizes damaged or lost in transit, or late, lost or misdirected mail.
PERSONAL INFORMATION
28) The Promoter will collect entrants’ personal information in connection with this Competition and will use and handle the personal information in accordance with these Terms and Conditions and the Promoter’s Privacy Policy at https://login.nine.com.au/privacy?client_id=9nowweb.
29) Sponsor opt-in: The details of all Entrants who opt-in to hear from the Sponsor will be entered into a database and the Sponsor may use these Entrants’ names, email address, residential addresses and telephone numbers for future promotional, marketing and publicity purposes in any media worldwide without notice and without any fee. By opting-in, Entrants confirm that they allow their details to be used for this purpose. 32) Subject to state permit authority restrictions, the Promoter may amend these Terms and Conditions in its absolute discretion.
