Competition update: We have had a great response to our Ghanniversary competition to win a trip for you and 5 friends in your own private carriage. To clarify a few issues, we have now worked on the mobile version of the competition app which should make entering easier. Also, the 5 facebook friends that you select are not aware that you have chosen them and should you be lucky enough to win you can take whoever you like! Best of luck with your entry.

TERMS AND CONDITIONS
PROMOTER
1. The Promoter is Great Southern Rail Travel Pty Ltd, ABN 84 088 933 742 of Adelaide
Parklands Terminal, Keswick SA 5035 Australia, telephone number (08) 8213 4542.
CONDITIONS OF ENTRY
2. Entering this promotion constitutes acceptance of these Terms and Conditions and any
other terms and conditions appearing on https://www.facebook.com/GreatSouthernRail
(Great Southern Rail Facebook Page) specific to this promotion.
3. The promotional period will commence at 3.00pm ACDT on Friday, 10 January 2014
and closes at 5.00pm ACDT on Sunday, 2 February 2014 (promotional period).
WHO MAY ENTER
4. Entry is open to all Australian residents aged 18 and over.
5. Employees or contractors of the Promoter or its associated companies or agencies, or
any suppliers of prizes, or the immediate family of such persons, are not eligible to enter
this promotion. “Immediate family” means spouse, parent, child or sibling, whether or
not they live in the same household.

HOW TO ENTER
6. To enter the competition, entrants must:
6.1 “Like” the Great Southern Rail Facebook Page;
6.2 visit the ‘Gift of The Ghan’ promotional tab on the Great Southern Rail
Facebook Page;
6.3 via a pop up Facebook permissions dialogue box, entrants must then ‘Allow’
Facebook to access their friends list;

6.4 enter their contact details including first name, last name, phone number, email
address and post code;
6.5 tick a checkbox confirming they are aged over 18, an Australian resident and
agree to the Terms and Conditions of the promotion;
6.6 select 5 friends from their Facebook friends list;

6.7 provide an answer to the question “Now tell us, in 25 words or less, what you are
celebrating and why you want to share it with your friends”

(Work); and
6.8 click the ‘enter’ button to finalise their entry.
7. Each entrant may only enter the promotion once. Multiple entries are not permitted.
8. All entries become the property of the Promoter.
9. Entries not completed in accordance with these Terms and Conditions or received after
the closing date will not be considered.
10. The Promoter reserves the right, at any time, to verify the validity of entries and entrants
(including an entrant’s identity, age and place of residence) and to disqualify any entrant
who submits an entry that is not in accordance with these Terms and Conditions or who
tampers with the entry process. Errors and omissions may be accepted at the Promoter’s
discretion. Failure by the Promoter to enforce any of its rights at any stage does not
constitute a waiver of those rights.
11. By submitting the Work to the Promoter, entrants grant the Promoter and its licensees
and assignees a non-exclusive, royalty free licence to exercise all rights in perpetuity
throughout the world in the Work and all other material provided by the entrant to the
Promoter pursuant to this promotion at any time.
12. Without limiting the rights granted to the Promoter under clause 11, entrants specifically
agree that clause 11 grants to the Promoter the non-exclusive right to communicate the
Work in whole or in part to the public throughout the world on any media platform and
grants to the Promoter all associated rights necessary to exercise the above rights.
13. All entrants warrant that:

13.1 all details provided with entries are true and accurate;
13.2 the entrant has all necessary rights and licences to grant the rights set out in these
Terms and Conditions;
13.3 the Work is the entrant’s original work and has not been previously
communicated to the public;
13.4 the exercise of the rights granted to the Promoter in these Terms and Conditions
will not infringe the rights of any third parties; and
13.5 the entrant will indemnify the Promoter against any loss or damage resulting from
any breach of these warranties.
SELECTION OF WINNERS
14. There will be one (1) prize winner.
15. Judging of the winning entry will be conducted at the Great Southern Rail Head Office
Adelaide Parklands Terminal, Keswick SA 5035 at 12.00pm ACDT on Monday, 3
February 2014.
16. The prize winner will receive a prize package including:
16.1 two (2) nights in Private Service aboard The Ghan from Darwin to Adelaide for
up to six (6) people;
16.2 up to six (6) flights from nearest capital city to Darwin;
16.3 one (1) night accommodation in Darwin (3 x Twin Share); and
16.4 up to six (6) flights from Adelaide back to capital city of origin.
17. All other costs associated with the prize are the responsibility of the winner.
18. The Promoter will decide the winning entry in its absolute discretion.
19. Entries will be judged by representatives of the Promoter, based on the originality and
creativity of the entry. There is no chance component to determining the winner.

20. The result of the competition, including the determination of the winner, is final, and the
Promoter will not enter into any correspondence regarding the result.
PRIZE
21. The prize is valid only for travel on The Ghan from Darwin to Adelaide prior to 31
March 2015. Prize is subject to availability at time of booking (blackout dates apply) and
cannot be transferred to another service or used in conjunction with any other offer.
Flights and accommodation are at choosing of Great Southern Rail.
22. Prize value is GST inclusive and is in Australian dollars and represents the estimated
retail value as provided by the supplier as at time of printing. The Promoter accepts no
responsibility for any variation in prize value.
23. The total prize pool value is estimated at up to $25,000.00 (depending on residence of
winner).
24. The prize must be taken as offered and is not exchangeable, transferable, or redeemable
for cash or for resale. In the event that the prize is unavailable, the Promoter reserves
the right to substitute a prize of equal or greater value.
NOTIFICATION OF WINNERS
25. The winner will be notified by phone and/or email on Monday, 10 February 2014.
26. In the event the winner cannot be contacted after reasonable attempts (as determined by
the Promoter in its discretion), the second-placed entry (as selected by representatives of
the Promoter in accordance with clause 19) will be deemed the winner.
27. In the event the winner does not book their journey by 31
March 2015, the prize will be
automatically forfeited.
28. The winner may be asked for proof of identity, age or residence to confirm eligibility.
29. The winner agrees to the use of their name, image and photograph/s for publicity and
promotional purposes, without compensation, and agrees that the Promoter will own
copyright in any such images and photograph/s and in all material incorporating the
photograph/s.

PRIVACY
30. In order for entrants to participate in this promotion, the Promoter may collect the
name, age, email, address and postcode of each entrant (Personal Information). Any
Personal Information is protected by security safeguards as detailed in the Promoter’s
Privacy Policy, which is available on the Promoter’s Website (Website) at
https://www.greatsouthernrail.com.au/site/privacy_policy.jsp. The Personal
Information is collected to enable the Promoter to administer the promotion and identify
the winners.
31. By entering this promotion, those entrants who provide Personal Information consent to
the use of their Personal Information for future marketing and promotional purposes of
the Promoter. Winning entrants agree that their identities may be disclosed in
promotional material and on the Facebook Page and Website. Personal Information will
not be used for any other purpose.
32. Anyone can opt-out of receiving future advertising material by email at any time by
sending an email with the subject heading “unsubscribe” to sales.enquiries@gsr.com.au.
33. For further information, the Promoter’s privacy policy is located on the Website.
LIMITATION OF LIABILITY
34. The Promoter makes no representations or warranties as to the quality, suitability or
merchantability of any goods or services offered as prizes. To the extent permitted by
law, the Promoter is not liable for any loss suffered to person or property by reason of
any act or omission, deliberate or negligent, by the Promoter or its employees or agents,
in connection with the arrangement for the supply of goods and services by any person
to the prize winner or by use of the prizes. This clause does not affect any rights a
consumer may have which are unable to be excluded under Australian law. To the fullest
extent permitted by law, any liability of the Promoter or its employees or agents for
breach of any such rights is limited to the payment of the costs of having the prize
supplied again.
35. If for any reason the promotion does not run for its duration due to a computer virus,
tampering, unauthorised intervention, fraud, technical failures or any other cause beyond

the control of the Promoter that corrupts or affects the administration, security, fairness,
integrity or proper conduct of the promotion, the Promoter reserves the right in its sole
discretion to cancel, terminate, modify or suspend the promotion or disqualify any
individual who tampers with the entry process. The Promoter is not responsible for any:
35.1 malfunction, delay or traffic congestion on any network or line, computer on-line
system, servers or providers, computer equipment, software, or website;
35.2 failure of any email or entry to be received by the Promoter; or
35.3 injury or damage to entrants or any other person related to or resulting from
participation in the promotion or downloading any materials for the promotion.
36. In the case of the intervention of any outside agent or event which naturally changes the
result of the promotion or prevents or hinders its determination, including but not
limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest
or strikes; the Promoter may in its absolute discretion cancel the promotion and
recommence it from the start on the same conditions.
