“FOX SPORTS BATHURST CAMPING EXPERIENCE” Game of Skill Competition
CONDITIONS OF ENTRY
1. Competition and Promoter
1.1 By entering the “FOX SPORTS BATHURST CAMPING EXPERIENCE” Game
of Skill Competition (Competition) and in consideration for the opportunity to
participate in the Competition, each entrant agrees to be bound by and
observe these Conditions of Entry. Information on how to enter and prize
details form part of these Conditions of Entry.
1.2 The promoter of the Competition is FOX SPORTS Australia Pty Limited ABN
16 065 445 418 of 4 Broadcast Way, Artarmon NSW 2064 (Promoter).
2. Who may enter
2.1 Subject to paragraphs 2.2 and 2.3, entry into the Competition is open to all
permanent residents of Australia aged 18 years or over at the date of entry.
2.2 The officers, management and employees (and immediate family members of
officers, management and employees) of the Promoter and its respective
corporations, affiliates and associated agencies are not eligible to enter the
Competition.
2.3 Each entrant may submit an unlimited number of entries in the Competition
Period (defined below), provided that each entry is unique.
3. Competition Period
3.1 The Competition commences at 9:00am Australian Eastern Standard Time
(AEST) on 17 August 2017 and closes at 10:00pm AEST on 17 September
2017 (Competition Period).
3.2 Entries not received during the Competition Period or not completed in
accordance with these Conditions of Entry will not be eligible to win.
4. How to enter
Entry submission
4.1 The entry question for the Competition is, “Why camping is the best way to
experience the Supercheap Auto Bathurst 1000?” (Entry Question).
4.2 Eligible entrants must, during the Entry Period:
(a) Tweet their answer to the Entry Question in 144 characters or less with an
accompanying picture or video, using the hashtag #bathurstcamping; or
(b) Answer the Entry Question in 25 words or less with an accompanying
picture or video via a post on Instagram or Facebook, using the hashtag
#bathurstcamping,
(each, an Entry).
4.3 Without limiting paragraph 10 below, by submitting an entry to the Promoter,
each entrant acknowledges that the Promoter may (but does not guarantee
that it will) read or display the entrant’s Entry on the Competition Website
(www.foxsports.com.au/bathurstcampingcompetition), the FOX SPORTS
channels, including during the broadcast of ‘Inside Supercars’ and on FOX
SPORTS’ social media platforms.
4.4 To be eligible to win a prize, the entrant must have a public Twitter, Instagram
or Facebook account and must not remove their Entry from their account until
15 September 2017. Entries that are removed prior to this date will not be
considered in the Competition.
5. Prizes
5.1 Judging of all entries received during the Competition Period will be
conducted by the Promoter at 4 Broadcast Way, Artarmon NSW 2064 on 17
September 2017.
5.2 The entrant who submitted the most creative and unique Entry during the
Entry Period (as judged by the Promoter in its sole discretion) in accordance
with these Conditions of Entry will win the FOX SPORTS Bathurst camping
experience prize comprising:
(a) Bathurst camping experience
i. two nights’ accommodation at the Bathurst Campsite on 6-7 October
2017 valued at A$281;
ii. Camping equipment including sleeping, cooking, and safety equipment
from BCF valued at A$5,000;
iii. four Paddock passes to the Bathurst race weekend on 5-8 October
2017 valued at A$196; and
iv. a meet-and-greet experience with FOX SPORTS talent on 6 October
2017, valued at A$200 in total.
5.3 The maximum total prize value is A$5,677 (including GST).
5.4 The prize winner will be notified in writing on 19 September 2017. The prize
winner must accept or reject the prize by 12:00pm AEST on 21 September
2017. If the prize is unclaimed in writing by 21 September 2017, the promoter
will offer the prize to the next most creative and unique entry in accordance
with paragraph 6.
5.5 The Promoter accepts no responsibility for any variation in the value of a prize
and makes no warranty as to the availability of FOX SPORTS talent for the
purposes of paragraph 5.2(a)(iv). The prize is not assignable, transferable or
exchangeable. The prize is not redeemable for cash and must be taken as
offered. If for any reason the prize winner does not take an element of the
prize during the stated period and on the conditions stipulated by the
Promoter or any third party (for example, if the prize winner is not able to
attend a trip in 5.2, if the prize winner elects to attend an element of the prize
in the same city as another element of the prize), that element of the prize will
be forfeited and cash will not be awarded in lieu of that element of the prize..
5.6 In the event that any element of the prize is not available, the Promoter
reserves the right to substitute a prize of equal or greater value.
5.7 The prize winner is responsible for all expenses not specified in these
Conditions of Entry, including but not limited to, expenses with regard to the
documents and requirements set out in paragraph 5.8 below, any spending
money not stated above, meals, drinks, insurance (including medical, travel
and health), transport to and from the Bathurst, all transfers, items of a
personal nature (including but not limited to in-room charges, tips, telephone
and laundry) and all other ancillary costs.
5.8 The prize winner and their companions are responsible for travel to Bathurst
and compliance with any health or other government requirements.
5.9 The prize winner acknowledges that the prize is subject to additional terms
and conditions imposed by third party prize suppliers, including all venue
operators. The prize winner must become acquainted with any such
additional terms and conditions prior to taking the prize. The prize winner and
their companion must comply with all ticket conditions, supplemented by the
conditions of entry imposed by each stadium, course, and any venue
operator. The Promoter does not accept responsibility and is not liable for any
conditions imposed on the taking of the prize by any other third party prize
supplier. At all times whilst participating in the prize, the prize winner and their
companion are required to comply with the Promoter’s policies and
procedures, including in particular, any policies and procedures or reasonable
direction in relation to work health and safety.
6. Unclaimed prizes
If a prize is unclaimed by 12:00pm AEST on 21 September 2017, it will be
awarded to the entrant who submitted the next most creative and unique
Entry out of all Entries on the Competition Shortlist (as determined by the
Promoter in its absolute discretion). The unclaimed prize winner will be
notified by writing on 21 September 2017. The process will be repeated every
24 hours until the prize winner is contacted and the prize is claimed. The prize
remains the property of the Promoter until it is collected by the selected prize
winner or unclaimed prize winner as the case may be.
7. Information for Prize Winner
All entrants agree to provide the Promoter with identification and/or proof of
age if selected as a prize winner. In accepting a prize, each prize winner
agrees to the release set out below. The form of identification and/or proof of
age are at the discretion of the Promoter.
8. Limitation of Liability
8.1 Except for any liability that cannot by law be excluded (including as set out
under paragraph 8.3), the Promoter, their related corporations and associated
agencies (and any of their personnel) exclude all liability for any loss
(including any damage, claim (including any claim pursuant to workers’
compensation legislation), injury, cost or expense) which is suffered or
incurred by any entrant (including the prize winner and their companion) in
connection with the Competition or a prize, including, without limitation: (i) any
indirect, economic or consequential loss; (ii) any loss arising from the
negligence of the Promoter, its related corporations and associated agencies
(and any of their personnel); and (iii) any liability for personal injury or death.
8.2 No responsibility will be taken by the Promoter or its authorised agents for
lost, ineligible, misdirected or late entries due to technical reasons or any
other reason. Entries that are not genuine or are incomplete, late or in any
way fraudulent will be declared void.
8.3 Nothing in these Conditions of Entry limits, excludes or modifies, or purports
to limit, exclude or modify, the statutory implied guarantees/warranties as
provided under the Competition and Consumer Act 2010 (Cth) and the ASIC
Act 2001 (Cth), including the statutory consumer guarantees under the
Australian Consumer Law, or similar laws in the States and Territories of
Australia.
9. Privacy
By entering the Competition, the entrant understands and agrees that the
Promoter may use and disclose the entrant’s personal information to assist in
conducting the Competition and communicating with the entrant in regard to
news and updates and special offers from the Promoter and its related
entities. Entrants in the Competition acknowledge that the Promoter may
share an entrant’s personal information with the Promoter’s Australian and
foreign related entities which may contact the entrant with marketing
messages and special offers. Without limiting the foregoing, the Promoter
may disclose the prize winner’s personal information to third parties for the
purpose of fulfilling the prize. If an entrant elects to receive information from
other third parties, the Promoter may also disclose the entrant’s personal
information for that purpose. The Promoter is bound by the Australian Privacy
Principles in the Privacy Act 1988 (Cth). Entrants may find out more
information about how the Promoter collects, uses and discloses personal
information by reading the Promoter’s Privacy Policy, which is available at
http://www.foxsports.com.au/about-us/privacy. Entrants may access the
personal information the Promoter holds about them by writing to the
Promoter at the address set out below. If the Promoter limits or denies an
entrant access to their personal information in certain circumstances, the
Promoter will tell the entrant why access was limited or denied. The entrant
can contact the Promoter by writing to the Promoter at 4 Broadcast Way,
Artarmon NSW 2064.
10. General
10.1 All Entries must be original to and created solely by the entrant. All Entries
and all copyright and other rights in such entries and/or other materials
(including but not limited to, photographs and videos taken by the prize winner
in entering the Competition) become the property of the Promoter and will not
be returned. Each entrant agrees to provide a written assignment of all rights
to the Promoter if requested. By submitting an Entry and any other materials
(save for any personal information) to the Promoter in connection with the
Competition, each entrant:
(a) specifically authorises the Promoter to use and/or license third parties
to use such Entry in whole or in part, throughout the universe, in
perpetuity in or on any and all media, whether currently in existence or
developed in the future, and alone or together or as part of other
information, content and/or material of any kind or nature;
(b) represents and warrants that all elements contained in the Entry or
other material:
(i) are original to the entrant and fully cleared for use as
contemplated in these Conditions of Entry;
(ii) do not and will not, in any way, violate or breach any of the
terms of any other agreement the entrant may be a party to;
(iii) do not contain defamatory, tortious or otherwise unlawful,
untrue or inaccurate information, infringe or violate any
copyright or other right; or contain any matter the publication or
sale of which will violate any law;
(iv) are not obscene or likely to cause offence;
(v) are not in any way cruel or abusive; and
(vi) will not require the Promoter to pay or incur any sums to any
person or entity as a result of Promoters’ use or exploitation of
the same; and
(c) unconditionally and irrevocably consents to any act or omission which
would otherwise infringe any of their moral rights in the entry and
waives all moral rights in the entry that arise outside Australia.
10.2 This Competition is a game of skill. Chance plays no part in determining the
prize winner.
10.3 No correspondence will be entered into and the judges’ decision is final and
binding.
10.4 Acceptance of the prize constitutes consent on the prize winner’s part to allow
the use of the prize winner’s name, image, voice and/or likeness (including
but not limited to, any recordings of the prize winner taking the prize in 5.2 by
Promoter) for editorial, advertising, promotional, marketing and/or other
purposes without further compensation except where prohibited by law.
10.5 If for any reason the Competition is not capable of running as planned,
including due to infection by computer virus, bugs, tampering, technical
failures or any other causes beyond the control of the Promoter, which corrupt
or affect the fairness or integrity or proper conduct of the Competition, the
Promoter reserves the right in its sole discretion to disqualify any individual
who tampers with the entry process and to cancel, modify, terminate or
suspend the Competition. Any entrant who breaches the aforementioned
warranties in paragraph 10.1 above, and/or any other provision of these
Conditions of Entry will be not be eligible to win a prize and their Entry will be
disqualified from the Competition.
10.6 The prize winner is advised that tax implications may arise from the prize and
should seek independent financial and taxation advice prior to their
acceptance of the prize. The prize winner is responsible for all taxes
(excluding GST) which may be payable as consequence of receiving a prize.
10.7 The prize winner (and their companion) acknowledges that:
(a) participation in the prize is on a voluntary basis only and for their own
benefit;
(b) the prize in no way creates a principal/contractor or an
employer/employee relationship;
(c) for the duration of the prize they are not a “worker” within the meaning
of the Work Health and Safety Act 2011, the Workplace Injury
Management and Workers Compensation Act 1987 (NSW) or other
relevant state or territory workers compensation legislation, and are
not entitled to claim under the Promoter’s workers’ compensation
insurance;
(d) the prize is primarily for their benefit, is unpaid and any activities that
they may perform are purely incidental to their prize experience; and
(e) they are not entitled to any employment related conditions including
but not limited to a wage, superannuation, paid leave or the terms of
any award or other industrial instrument.
10.8 As part of participating in the prize and their companion may become privy to
the Promoter’s confidential information. Confidential information refers to any
information, in whatever form, which is not publicly available. The prize winner
and their companion must preserve as confidential, and not reveal to anyone
or use for themselves or anyone else, any of the Promoter’s confidential
information that they may become aware of, unless the Promoter provides its
prior written consent to such use or disclosure.
10.9 The Competition is not sponsored, endorsed or administered by, or
associated with, Twitter, Instagram or Facebook.
11. Contact details
11.1 It is the entrant’s responsibility to inform the Promoter of any change to the
entrant’s contact details, including their email address.
