ActewAGL – Win A Once In A Lifetime Race Day Experience – Canberra Racing Club’s Competition

ActewAGL/Canberra Racing Club’s ‘Once Only Day at the Races’ terms and conditions
1.The following terms and conditions apply to the “ActewAGL/Canberra Racing Club’s Once Only Day at the Races” (competition) and by submitting an entry to this Competition, entrants warrant that they have read, understand and agree to be bound by them.
2.To enter the Competition entrants must complete an entry form in the Essentials summer publication or at www.actewagl.com.au/competitions and include their name, address, email address and telephone number on the (competition) form.
3.To be eligible to win the Competition, entrants must:
(a) be over the age of 18 years old and a resident of the Australian Capital Territory or New South Wales at the time of the draw; and
(b) be a current ActewAGL gas or electricity customer at the time of the draw.
4.The prize:
(a) is valued at $500; and
(b) is valid for use only at the Marymead Charity Race Day to be run at Thoroughbred Park on Saturday 22 March, 2014. Event begins at 11:45am, Thoroughbred Park opens at 11:00am;
(c) and consists of:
• entry for 2 people into the event at Thoroughbred Park on Saturday 22 March, 2014;
• lunch and a bottle or wine for 2 people in the Members area;
• the opportunity to be in the race callers booth when one race is called;
• the opportunity to go out with the course official for one race and be at the gates on the other side of the track as the horses jump from the barriers;
• the opportunity to be in the mounting yard before the start of one race; and
• the opportunity to meet the connections of a winning horse and have a drink with them in the owners bar after one race,
5.The Competition runs from 12.00am, on Sunday 1 December 2013 and closes at 5.00pm on Monday 10 March 2014.
6.The Prize will be drawn at ActewAGL House, 40 Bunda Street Civic, Canberra ACT 2600 at 2.00pm on Wednesday 12 March 2014.
7.The winner will be announced on Wednesday 12 March 2014 at 2.00pm and contacted by telephone and confirmed in writing via email.
8.The draw will be a manual, random draw. The first entry drawn that meets all the entry criteria will win the Prize.
9.Upon accepting the Prize, the winner will be directed on how to claim the Prize.
10.The winner must claim their Prize by 4.00pm Friday March 14 2014. In the event of an unclaimed Prize, that winner’s entry will be deemed invalid and the Promoter reserves the right to distribute the Prize to the next valid entry. In these circumstances, the new winner will be announced at 5.00pm Friday 14 March 2014.
11.ActewAGL may require the winner to provide identification as required by ActewAGL including (without limitation) proof of identity, proof of age and proof of residency. Identification considered suitable for verification is at ActewAGL’s discretion and may include suitable photo identification.
12.Incomplete or incomprehensible entries will be ineligible to win the Prize whether due to error, omission, deletion or otherwise and will be disqualified.
13.Only one entry per person to the Competition is permitted.
14.The Prize is not transferable or redeemable for cash or other goods and services and must be taken by the winner or a member of the winner’s immediate family.
15.The Promoter is not responsible for arranging or paying for any additional or ancillary costs associated with the Prize, including but not limited to travel, accommodation, transfers to or within the ACT or NSW, meals or spending money.
16.ActewAGL accepts no responsibility or liability in the event that the Prize is unavailable or cancelled for any reason whatsoever. The Promoter reserves the right to substitute an alternative prize of similar value. This is subject to the approval of the relevant authorities in each state and territory where required.
17.If for any reason any aspect of this Competition is not capable of running as planned, including by reason of computer virus, communications network failure, bugs, tampering, unauthorised intervention, fraud, technical failure or any cause beyond the control of the Promoter, the Promoter may in its sole discretion cancel, terminate, modify or suspend the Competition, or invalidate any affected entries. This is subject to the approval of the relevant authorities in each state and territory where required.
18.The Promoter shall not be liable for any loss suffered or sustained in connection with the Prize except for liability, which cannot be excluded by law. ActewAGL accepts no responsibility for any late, lost or misdirected entries including but not limited to entries not received by the Promoter due to technical disruptions, network congestion or any other reason.
19.ActewAGL may in its sole discretion, disqualify all entries from, and prohibit further participation in the Competition by any person who tampers with or benefits from any tampering with the entry process or with the operation of the Competition or aids in violation of these terms and conditions, acts in a disruptive manner or acts with the intent to annoy, abuse, threaten or harass any other person.
20.Entrants are providing information to ActewAGL. Any personal information collected will be treated in accordance with ActewAGL’s Privacy Policy available at www.actewagl.com.au
21.ActewAGL may collect personal information about entrants to include entrants in the promotion and where appropriate award the Prize. If the personal information requested is not provided, the entrant may not participate in the promotion. By participating in the promotion, each entrant also acknowledges that a further primary purpose for collection of entrants personal information by ActewAGL is to enable ActewAGL to use the information to assist ActewAGL in providing the Prize and to contact entrants in the future with information on special offers or provide entrants with marketing materials via any medium including mail, telephone and commercial electronic messages, (SMS (Short Message Service), MMS (Multimedia Message Service), IM (Instant Messaging) and email) or any other form of electronic, emerging, digital or conventional communications channel whether existing now or in the future. ActewAGL may share information with its related bodies corporate who may contact entrants with special offers in this way. By entering the promotion, each entrant agrees that ActewAGL may use entrant’s personal information in this manner. Each entrant also agrees that ActewAGL may publish or cause to be published the winners name and locality in any media as required under the relevant legislation. All personal information will be stored at the office of ActewAGL.
22.Entries and any copyright subsisting in the entries become and remain the property of the Promoter and entrants agree their entries may be published on the ActewAGL website, ActewAGL Facebook page, or used for publicity or promotional purposes.
23.All amounts include GST unless otherwise stated.
24.The Promoter accepts no responsibility for any tax implications that may arise from the Prize winnings.
25.Without limiting any other clause, ActewAGL may amend any aspect of the Competition or any of these terms and conditions subject to applicable laws and the approval of the relevant authorities.
26.Employees and their immediate families of ActewAGL and its partners, AGL Energy Ltd, ACTEW Corporation Ltd and Jemena Networks (ACT) Ltd and their related companies and their immediate families are ineligible to enter this Competition.
27.Entries not fully complying with these terms and conditions of entry may be deemed invalid at the Promoter’s discretion.
28.The promoter is ActewAGL Retail ABN 46 221 314 841, a partnership of AGL ACT Retail Investments Pty Ltd ABN 53 093 631 586 and ACTEW Retail Ltd ABN 23 074 371 207 (Promoter).
