The Toshiba Encore Competition – rules and regulations
Terms & Conditions of entry
1. Information on how to enter and prize details form part of the terms and conditions of entry. By entering the competition, entrants accept these terms and conditions of entry.
2. The competition is known as “The Toshiba Encore competition”.
3. Entry is open to Australian and New Zealand residents only. Officers or employees of Toshiba (Australia) Pty Limited (“TAP”) including any related bodies corporate or related entities of TAP or any immediate family members of such officers or employees, are ineligible for the competition and may not enter.
4. The competition is only eligible to users who purchase a Toshiba Encore tablet (PDW09A-00100C, PDW09A-00200C or PDW09A-00300C) between the 17th – 31st March inclusive through a Toshiba Authorised Reseller, “Like” the Toshiba Australia and New Zealand Facebook page, fill in the required details on the competition tab on the Toshiba ANZ Facebook page, and submit in 25 words or less “What feature of the Toshiba Encore tablet appealed to you and why?”. Proof of purchase must be kept and submitted to be an eligible winner.
5. Promotion runs between 17th March 2014 and 31st March 2014.
6. Entries are limited to one per Toshiba Encore tablet purchase.
Prizes
7. Prize list
There will be 6 prizes in total, including 1 major prize (1x Toshiba TV, 1x Xbox One gaming console, 1x Toshiba Tablet Case) and 5 consolation prizes (5x Toshiba Tablet Case). Each prize is valued at the following:
1x Toshiba 50” TV (50L2300A) valued at A$1,219.00 inc. GST
1x Xbox One gaming console valued at $599.00 inc. GST
6x Toshiba Encore Snap Case (PA1542U-1BLK) valued at A$359.70 ($59.95 each)
Total prize pool is valued at A$2,177.70 including GST
8. The winner will be judged based on creativity, at approximately 3pm on Tuesday 1st April 2014 at Building C, 12-24 Talavera Rd, North Ryde, Australia.
This is a game of skill. Chance plays no part in determining the winner. Each entry will be individually judged, based upon literary and creative merit. All entries must be the original independent creation of the entrant and free of any claims that they infringe any third party rights. Entries must not have been published previously and/or have been used to win prizes in any other competitions.

9. The prize must be taken as offered and cannot be changed or exchanged for money.
10. If the winner is unable to take the prize or unable to provide proof and purchase then it will be re-determined in accordance with Item 8. above.
11. The winner will be notified by phone and email, using the details supplied by the entrant at the time of submission. The winner’s name will also be published on Toshiba’s website (www.mytoshiba.com.au/competition-winners). Accuracy of personal information supplied is the responsibility of the entrant.
12. The winner must be 18 years of age or older.
13. If the winner does not respond to the notification by the Promoter within a period of 14 days, the Promoter reserves the right to award the relevant prize to another entrant.
14. If the Competition is not capable of running as planned for any reason including but not limited to technical failures, unauthorised intervention, fraud or any other causes beyond the control of the Promoter which affects the administration, security, fairness, integrity or proper conduct of this Competition, the Promoter reserves the right in its sole discretion to disqualify any individual and/or to cancel, terminate, modify or suspend the Competition.
15. By entering the Competition, you agree that the Promoter may collect, store and use the personal information supplied to it, including but not limited to, for the purposes of electronic commercial messaging. All information retained by the Promoter will be collected, stored and used in accordance with its privacy policy, which can be viewed at www.mytoshiba.com.au/about/privacy and the privacy principles set out in the Privacy Act 1993.
16. All entries become the property of Toshiba and may be used for promotional purposes.
17. Toshiba reserves the right to amend the terms of the competition at any time
18. The Promoter shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for personal injury which is suffered or sustained, as a result of taking any of the prizes, except for any liability which cannot be excluded by law.
19. These Terms are governed by Australia and New Zealand law and any dispute arising out of or in connection with these Terms, depending on the country of the claimant, shall be subject to the exclusive jurisdiction of the Australia or New Zealand courts respectively.
