CMC’s “CMC Music Awards Vote + WIN 2014” competition Terms and Conditions
Entry into the competition
1. Entry into the CMC “CMC Music Awards Vote + WIN” competition (the “Competition”) is open to all residents of Australia. The Promoter is FOXTEL Management Pty Ltd (ABN: 65 068 671 938) of 5 Thomas Holt Drive, North Ryde NSW 2113, Australia (the “Promoter”). It is a condition of entry that all entrants under the age of 18 must have their parent or legal guardian’s express permission to enter this Competition in accordance with these Terms and Conditions. Entry into the Competition is deemed acceptance of these Terms and Conditions.
2. The officers, management and employees (or immediate family of an officer, manager or employee) of the Promoter, the parties associated with this Competition (including Salmat Digital Pty Limited), Foxtel, Telstra or Optus TV and their related bodies corporate are not eligible to enter.
3. Competition begins at 00:01 (AEDT) on Friday 3 January 2014 and finishes at 23:59 (AEDT) on Sunday 2 March 2014 (the “Competition Period”).
4. To enter the Competition and be eligible to win, entrants must during the Competition Period:
(a) go to the Country Music Channel website (www.countrymusicchannel.com.au) and click on the link to the Country Music Awards;
(b) submit a vote in any category of the Country Music Awards. The categories are as follows:
 CMC Oz Artist of the Year
 CMC International Artist of the Year  CMC New Oz Artist of the Year
 CMC Australian Video of the Year
 CMC International Video of the Year  CMC Female Oz Artist of The Year  CMC Male Oz Artist of The Year
(c) provide all information required by the entry form, which will include (without limitation) full name, state, email address and contact number.
5. All valid votes submitted during the Competition Period will go into the draw to win a prize.
6. Any entry that is made on behalf of an Entrant by a third party, or otherwise by proxy, will be invalid. Incomplete entries will be ineligible.
7. Entries will be capped as per clause 8 below. The use of any automated software or any other mechanical or electronic means that permits the participant automatically to enter repeatedly is prohibited (“Repeat Entry Device”). If the Promoter reasonably believes that an entrant is using any Repeat Entry Device, the Promoter may disqualify that entrant without notice
8. Entrants may submit as many votes as they like during the Competition Period. Each valid vote will be entered into the draw to win a prize. However, only one Prize will be awarded per household (except for SA residents who are entitled to win more than one prizes). Only one vote per artist and per category for each entrant, each day will be counted toward the Country Music Awards voting tally.

PRIZES
9. There is 1 x Major Prize and 2 x Minor Prizes. The Minor Prizes and Major Prize are collectively referred to as the “Prizes.”
a) The Major Prize is valued at a maximum of $2,825.00 and consists of:
– return economy airfares for the Major Prize Winner and one (1) guest from the capital city in Australia closest to the Major Prize Winner’s place of residence to Sydney airport, NSW (the “Airport”) (including taxes), valued at a maximum of $1,200.00,
– three (3) night’s accommodation (twin share) for the Major Prize Winner and their guest in a minimum 3 star hotel in the Hunter Valley (the “Hotel”), valued at a maximum of $805.00;
– transfers for the Major Prize Winner and their guest between the Airport and the Hotel, valued
at a maximum of $200.00;
– two (2) VIP tickets to attend the “CMC Rocks The Hunter” festival which will be held from
Friday 14 March 2014 to Sunday 16 March 2014 at Hope Estate Winery, Hunter Valley, NSW
(the “Event”), valued at a maximum of $520.00; and
– two (2) tickets to the CMC Music Awards which take place on Friday 14 March 2014 at the
Hope Estate Winery, valued at $100.00
b) Each Minor Prize consists of two (2) VIP tickets to the Event, valued at $520.00.
10. The total Prize pool is valued at AUD$3,865.00 (Major Prize valued at AUD $2,825.00 and Minor Prizes valued at AUD$1,040.00). The Promoter is neither responsible nor liable for any change in the value of the Prize occurring between publishing date and date the Prize is claimed. All Prize values are in Australian dollars.
11. If a Prize winner is under the age of 18 they must be accompanied at all times throughout the Prize by their parent or legal guardian.
12. The Prizes are not transferable, non-endorsable, non refundable or redeemable for cash. The Prizes or any element of the Prizes cannot be exchanged for any other prize. The contents of the Prizes will be at the Promoter’s sole discretion. The Prizes are subject to availability and the terms and conditions of the entities supplying the elements of the Prizes and must be taken on dates specified by the Promoter.
13. If the Major Prize Winner is a resident of NSW, they will forfeit the flights. Transfers by car to a total maximum value of $1,200.00 will be offered as a substitute.
14. Unless expressly stated, all costs and expenses associated with taking a prize become the responsibility of the winners and their guests, including (without limitation):
a) additional taxes (excluding departure and any other flight-associated taxes, where flights are included in the Prize);
b) costs associated with inoculations, passports and/or visa applications;
c) transfers;
d) travel insurance;
e) spending money;
f) meals;
g) transport to/from an airport departure or return point;
h) any extra sightseeing or activities; and
i) all other incidental and ancillary costs incurred by the Winner and/or their
travel partner as a direct or indirect result of taking the Prize.
15. If a winner and/or their guest determine that travel insurance is required, they will be responsible for arranging and paying for such insurance.
16. The Major Prize winner and their guest must travel at the same time and must depart from and return to the same capital city.
17. The Prizes must be taken to coincide with the Event. In the event that, for any reason whatsoever, a winner or their guest do not take a prize (or any part of a prize) at the time stipulated by the Promoter, that prize (or that part of that prize) will be forfeited and no substitute or compensation will be offered.
18. It is the sole responsibility of the Major Prize winner and his/her guest to ensure that their personal documentation (including but not limited to passports, Visas etc) is valid for travel. Any expenditure incurred as a result of not meeting such requirements is the sole responsibility of the Major Prize winner and their guest.
19. Airline tickets included in the Major Prize are available on the regular scheduled services of each airline and are subject to seasonal embargos. Flight itinerary may have to be adjusted depending on the airlines departure city and their current flight schedule. Frequent Flyer points are not available from any airline.
20. Airline tickets included in the Major Prize cannot be used as part payment of another airfare.
21. A credit card will be required from the Major Prize winner at check-in to the Hotel, for all incidental charges. Once accommodation vouchers are issued they are non-changeable.
22. The Promoter and Salmat Digital Pty Limited make no representation as to the safety, conditions or other issues that may exist at any destination.
23. If the prize is unavailable, for whatever reason, the Promoter reserves the right to substitute the prize for a prize of equal or greater value, subject to State Regulation.
24. Once prizes have left the Promoter’s premises, the Promoter takes no responsibility for prizes damaged, delayed or lost in transit.
AWARD OF PRIZES
25. Each valid entry received during the Competition Period will be entered into the draw. The winners will be randomly selected from all valid entries. The draw will take place at 12:00 (AEDT) on Monday 3 March 2014 at Salmat Digital Pty Limited, Level 2, 116 Miller Street, North Sydney, NSW, 2060. The Winners will be contacted by phone and email on the day of the draw. The details of all Prize winners will be published on the CMC website from Monday 3 March 2014, and published in The Australian Newspaper on Wednesday 5 March 2014.
26. The Promoter accepts no responsibility for outdated or incorrect contact details or contact details by which the entrant cannot be contacted during business hours on the relevant dates or during the contact period as outlined in clause 25. Should an entrant’s contact details change during the Competition Period, it is the entrant’s responsibility to notify the Promoter. A request to access or modify any information provided in an entry should be directed to Promoter.
27. If a Prize winner cannot be contacted or does not claim the Prizes by the stipulated date, the Prize will be forfeited and a substitute prize will not be offered in lieu of the Prize.

28. Subject to any direction given under relevant State legislation if any Prize is not claimed by 10:00 (AEDT) on Monday 10 March 2014 an unclaimed prize draw will take place at 10:30 (AEDT) on Monday 10 March 2014 at Salmat Digital Pty Limited, Level 2, 116 Miller Street, North Sydney, NSW, 2060. The Winners will be notified by phone and email on the day of the draw and published in the public notices section of The Australian Newspaper on Wednesday 12 March 2014.
29. Prizes will be awarded to persons named in the entries.
GENERAL
30. By accepting the Prize, the winner agrees to participate in and co-operate as required with all reasonable media editorial requests relating to the Prize, including but not limited to, being interviewed and photographed, filmed and/or chaperoned throughout the duration of the Prize.
31. In consideration for their participation in this promotion, the winner hereby permits the winner’s image and/or voice, as recorded, photographed or filmed during the winner’s participation in the prize to appear in connection with the Promoter or the advertising or marketing thereof, in any media whatsoever throughout the world and the winner will not be entitled to any fee for such use.
32. All entrants agree to provide the Promoter or the Promoter’s authorised agent with proof of identity, residency, age and/or proof of entry validity if selected as a Prize winner or if reasonably requested by the Promoter or the Promoter’s authorised agent. Proof of age, identification, residency and entry considered suitable for verification is at the sole discretion of the Promoter. In the event that a Prize winner cannot provide suitable proof, the Prize winner will forfeit the Prize in whole and no substitute will be offered.
33. The Promoter reserves the right to refuse to allow a winner and their guest to take part in any or all aspects of a Prize, if the Promoter determines, in its absolute discretion, that a Prize winner or their Guests are not in the mental or physical condition necessary to be able safely to participate in the Prize.
34. All Prize winners are advised that tax implications may arise from them winning a prize and they should seek independent financial advice prior to acceptance of their Prize.
35. No responsibility will be taken by the Promoter, CMC, Salmat Digital Pty Limited, Telstra or Optus TV for any changes in dates, times or cancellations or other arrangements that may prevent the Prize winner from winning the Prize.
36. The Promoter reserves the right, in its absolute discretion, to disqualify:
a) any entry which, in the opinion of the Promoter, includes any objectionable content,
profanity or is potentially insulting, inflammatory or defamatory; or
b) any individual who tampers with the entry process, submits an entry that is not in accordance with these Terms and Conditions or who has in the opinion of the Promoter, engaged in unlawful or improper conduct that is designed to jeopardise the fair and proper conduct of the Competition or is generally damaging to the goodwill or
reputation of the Promoter.
37. Subject to relevant state authority approval, the Promoter reserves the right, in its absolute discretion, at any time before the awarding of the Prize to vary, postpone or cancel the Competition or the award of a Prize including without limitation, circumstances where, in the Promoter’s opinion (which it shall form in its absolute discretion):
(a) the Prize winner did not satisfy the Competition entry requirements; or
(b) the Promoter cannot conduct the Competition for any other reason beyond its control.
38. Subject to relevant state authority approval, in the event that the Promoter cancels the Competition, postpones, varies or withdraws the Prizes it shall not:
(a) be liable to any person for any loss or damage (including loss or damage caused by any negligence) arising out of, or in connection with, such cancellation, postponement, variation or withdrawal; and
(b) be required to conduct the Competition at any other time.
39. No responsibility will be accepted by the Promoter for late, lost or misdirected entries and all entries are deemed to be received at the time of receipt of the entry into the Competition database and NOT time of transmission by the entrant.
40. The Promoter and the associated agencies are not responsible for any problems or technical malfunction of any telephone network or lines, computer on-line systems, communication (including telephone, mobile or satellite), networks, computer equipment, software, websites (and associated website accounts and applications), or traffic congestion on the Internet or at any website, or any combination thereof, including for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to, or alteration of entries, and reserves the right to take any action that may be available.
41. A decision of the Promoter in relation to the conduct of the Competition is binding and conclusive and no correspondence will be entered into.
42. Entrants enter the Competition at their sole risk. With the exception of liability which cannot be excluded by law, the Promoter shall not be liable for any loss or damage which is suffered (including but not limited to indirect or consequential loss) or for personal injury suffered or sustained as a result of taking the Prize or entering the Competition.
43. The Promoter collects entrants’ personal information (as that term is defined in the Privacy Act 1988 (Cth)) for the purpose of conducting and promoting this Competition (including, but not limited to, determining and notifying winners). Entrants are advised that their personal information may be disclosed to State and Territory lottery departments and their names as the winner may be published as required under the relevant lottery legislation. For purposes of public statements and advertisements the Promoter will only publish the winner’s surname, initial and state. Entrants are also advised that from time to time, the Promoter may disclose your personal information to third parties (including, but not limited to, third party prize providers) for the purpose of administering prizes or for other purposes contemplated in these Terms and Conditions.
44. By entering the Competition, all entrants agree that their name, image, biography and entries (including, but not limited to, any written answers, photographs/images and audio-visual recordings) may be reproduced, published, communicated, broadcast or shown to the public by the Promoter in any media for its promotional purposes, without compensation to the entrants, subject to the Promoter’s privacy policy which is available at www.countrymusicchannel.com.au; for this purpose, each entrant grants to the Promoter a non-exclusive, perpetual, worldwide, transferable and royalty-free licence in any such written answers, photographs /images and audio-visual recordings. Each entrant consents to any act or omission by the Promoter which may infringe any of the entrant’s moral rights (within the meaning of the Copyright Act 1968 (Cth)), including: i) failing to attribute (or correctly attribute) the entrant’s authorship of the entry; or ii) making any modification, variation or amendment of any nature to the entry, whether or not it results in a material distortion or derogatory treatment of the entry.
