TERMS AND CONDITIONS

ENTRY INTO THE COMPETITION

1. Entry into this competition (the “Competition”) is open to all permanent residents of Australia aged 18 years or over. The Promoter is FOXTEL Management Pty Ltd (ABN: 65 068 671 938) of 5 Thomas Holt Drive, North Ryde NSW 2113, Australia (the “Promoter”). Information on how to enter forms part of the terms of entry. Entry into the Competition is deemed acceptance of these terms and conditions.

2. The Competition is a game of chance, and skill plays no part in determining the winner.

3. Any person who (or a person from a household which) within any time between 5 February 2012 and 5 February 2013 (inclusive) has won a prize with a value which is equal or greater than $5,000 from a competition run by the Promoter (including any subsidiary of the Promoter, such as XYZnetworks Pty Ltd) is not eligible to enter this Competition.

4. The officers, management and employees (or immediate family of an officer, manager or employee) of the Promoter, the parties associated with this Competition (including Salmat Digital Pty Limited), Suzuki Australia Pty Limited, Foxtel, Telstra or Optus TV and their related bodies corporate are not eligible to enter.

5. The competition will be advertised on The LifeStyle Channel, LifeStyle HOME, LifeStyle YOU and LifeStyle FOOD and at www.lifestyle.com.au and suzuki.com.au

6. Competition begins at 20:30 (AEDT) on Wednesday 6 February 2013 and closes at 23:59 (AEST) on Tuesday 12 March 2013 (the “Competition Period”). However, there are five (5) Entry Periods, each with a different start time and date and draw date as set out below:

7. To enter the Competition and be eligible to win, entrants must enter within one of the Entry Periods using these methods:

(a) Tune into “Selling Houses Australia Season 6” (“Program”) on The LifeStyle Channel during the Competition Period and take note of the weekly code word supplied (both visually on-screen and aurally by voice-over) during the Program’s transmission, and:

i. send an SMS message containing their full name and the correct and current weekly code word to 1970 1234 (“SMS Number”). Entrants will receive a reply SMS message confirming their entry has been received.

OR

ii. Go to the LifeStyle Channel website: www.lifestyle.com.au; and click through to “Watch and Win: Selling Houses Australia” competition link; and complete an online entry form and provide the correct and current weekly code word. Details collected include (but are not limited to) full name, address, phone number, age, gender, e-mail address and subscription platform. Mandatory details will be indicated on the entry form.

8. Only code words supplied at the time of the original transmission of the Program will be valid for use to enter into the Competition during the corresponding Entry Periods. The code word will change weekly and entries which quote an incorrect or out-dated code word will be ineligible for entry. Entrants acknowledge that code words which appear in subsequent playbacks of the Program, including where the Program is recorded and viewed after the time of original transmission, may be deemed invalid for entry if the corresponding Entry Period for that code word has closed in accordance with clause 6.

9. The SMS entry mechanic is only open to consumers with an SMS compatible mobile phone connected to a service provider which permits text messaging to the SMS Number. It is recommended that entrants check with their individual service provider in this regard. SMS entries via the internet or computer generation and not attributable to a valid mobile phone account is invalid and will not be accepted.

10. SMS entry cost is $0.55c (including GST) which is charged by your mobile phone carrier provider.

11. The cost of accessing the promotional website will be dependent on the entrant’s individual Internet Service Provider.

12. Inaudible, illegible, incomprehensible and incomplete entries will be deemed invalid.

13. Any entry that is made on behalf of an Entrant by a third party will be invalid.

14. Entrants can enter the Competition as many times as they like via the SMS Number during the Competition Period. Only 10 entries per person per day will be permitted or accepted via online entry. However, the use of any automated software or any other mechanical or electronic means that permits the participant automatically to enter repeatedly is strictly prohibited (“Repeat Entry Device”). If the Promoter reasonably believes that an entrant is using a Repeat Entry Device, the Promoter may disqualify that entrant without notice. To ensure fairness, the Promoter may undertake automatic and/or manual audits of entries and may deem entries ineligible if it is reasonably believed that they are frivolous, incomprehensible, incomplete, or otherwise not genuine.

15. The Promoter reserves the right to verify the validity of entries and to disqualify any entry which, in the opinion of Promoter, includes objectionable content, profanity, potentially insulting, inflammatory or defamatory statements, disqualify any entrant who tampers with the entry process, who submits an entry that is not in accordance with these Terms & Conditions of Entry or who has, in the opinion of Promoter, engaged in conduct in entering the Promotion which is fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the Promotion and/or Promoter. This includes, but not limited, to entrants and households using multiple email addresses, postal addresses, PO Box addresses or SIM cards to register single or multiple purchases. The Promoter reserves the right to disqualify a winner if Promoter becomes aware that the winner and/or the winner’s entry is of a type described in this clause.

PRIZE

16. There will be 1 x prize awarded, consisting of a Suzuki SX4 Crossover S automatic transmission model with all on-road costs (which includes dealer delivery charges, 12 months registration, stamp duty and CTP). The Prize winner may select the colour preference of their vehicle; however, this is subject to availability and is at the discretion of the Promoter (the “Prize”). The Prize is valued at a maximum of $25,290.00 inc GST.

17. The Prize will be delivered to a Suzuki dealership located in the Prize winner’s nearest capital city. Comprehensive insurance, additional options and all ancillary costs (including travel to and from the Suzuki dealership in the Prize winner’s nearest capital city to collect the vehicle) are the responsibility of the Prize winner. Unless expressly stated in these terms and conditions all other expenses become the responsibility of the Prize winner.

18. Prize values are in Australian Dollars and are based upon the recommended retail prices at the time of printing (inclusive of GST). The Promoter is neither responsible nor liable for any change in the value of the Prize occurring between publishing date and date the Prize is claimed.

19. The Prize is not transferable. The Prize cannot be exchanged for any other prize/s.

20. If the prize is unavailable, for whatever reason, the Promoter reserves the right to substitute the prize for a prize of equal or greater value, subject to State Regulation.

21. All entrants understand that there may be tax or other implications following the award of the Prize and should seek independent advice. All entrants acknowledge that the Promoter may require the Prize winner to (and the Prize winner will) reasonably execute such further documents to limit the Promoter’s liability in relation to the Prize.

22. By accepting the prize, the winner agrees to participate in and co-operate as required with all reasonable media editorial requests relating to the prize, including but not limited to, being interviewed and photographed, filmed and/or chaperoned throughout the duration of the prize.

23. In consideration for the Promoter awarding the prize to the winner, the winner hereby permits the winner’s image and/or voice, as recorded, photographed or filmed during the winner’s participation in the prize to appear in connection with the advertising or marketing thereof, in any media whatsoever throughout the world and the winner will not be entitled to any fee for such use

24. The Promoter takes no responsibility for any Prizes that are damaged, delayed or lost in transit. The Promoter makes no warranties or representations about the fitness for purpose or suitability of any Prize and will not accept responsibility for the quality or fitness for any purpose of any Prize, or the failure of any Prize to be of merchantable quality.

AWARD OF THE PRIZE AND WINNER NOTIFICATION

25. The Prize winner will be randomly selected from all eligible entries received during the Competition Period, by Salmat Digital Pty Limited, at Level 2, 116 Miller Street, North Sydney, NSW 2060 at 12:00 (AEDT) on Thursday 14 March 2013. The Prize winner will be notified in writing within 2 days of the draw and published in the Public Notices section of The Australian newspaper on Monday 25 March 2013.

26. The Promoter shall conduct such further redraws as may be deemed necessary at Salmat Digital Pty Limited, Level 2, 116 Miller Street, North Sydney, NSW 2060 at 15:00 (AEST) on Wednesday 19 June 2013 to distribute any Prizes unclaimed by that date, subject to State Regulation. The redrawn winner of any unclaimed Prize will be notified in writing within 2 days of the draw and published in the Public Notices section of The Australian newspaper on Wednesday 26 June 2013.

27. Should an entrant’s contact details change during the promotional period, it is the entrant’s responsibility to notify the Promoter. A request to access or modify any information provided in an entry should be directed to Promoter.

28. Prizes will be awarded to the person named in the entry. However, in a dispute, will be awarded to the account holder of the entry mechanism used to submit their entry (i.e. mobile phone account holder or internet account holder).

29. If a Prize winner cannot be contacted or does not claim the Prize by the stipulated date, then the Prize will be forfeited and a substitute prize will not be offered in lieu of the Prize, subject to State Regulation.

30. If any particular draw is scheduled on a public holiday, the draw will be conducted on the next business day.

GENERAL

31. Entries must be received by the corresponding dates and times as outlined in clause 6. No responsibility will be accepted by the Promoter, Suzuki Australia Pty Limited or Salmat Digital Pty Limited for late, lost or misdirected entries and all entries are deemed to be received at the time of receipt of the entry into the Promoter’s database and NOT time of transmission by the entrant. The Promoter will accept no responsibility for any SMS messages not received by the Promoter or delays in the delivery of the SMS message due to technical disruptions, network congestion or for any other reason.

32. In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter’s ability to proceed with the competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel the competition and recommence it from the start on the same conditions, subject to any written directions given under State Regulation.

33. All entrants agree to provide the Promoter or the Promoter’s authorised agent with proof of identity, residency, age and/or proof of entry validity if selected as a Prize winner or if reasonably requested by the Promoter or the Promoter’s authorised agent. Proof of age, identification, residency and entry considered suitable for verification is at the sole discretion of the Promoter. In the event that the Prize winner cannot provide suitable proof, the Prize winner will forfeit the Prize in whole and no substitute will be offered.

34. Subject to the Promoter complying with all relevant State and Territory laws and regulations no responsibility will be taken by the Promoter, The LifeStyle Channel, Suzuki Australia Pty Limited, Foxtel, Telstra or Optus TV for any changes in dates, times or cancellations or other arrangements that may prevent the Prize winner from winning the Prize.

35. Subject to relevant state authority approval, the Promoter reserves the right, in its absolute discretion, at any time before the awarding of the Prizes to cancel or vary the terms of the Competition or to vary or cancel the award of the Prizes including, without limitation, circumstances where in the Promoter’s opinion (which it shall form in its absolute discretion):

(a) a Prize winner does not satisfy the Competition entry requirements; or
(b) the Promoter cannot conduct the Competition or award the Prize for any reason beyond its control.

36. Subject to relevant state authority approval, in the event that the Promoter cancels or varies the Competition or varies or withdraws the Prizes it shall not:

(a) be liable to any person for any loss or damage (including loss or damage caused by any negligence) arising out of, or in connection with, such cancellation, variation or withdrawal; and
(b) be required to conduct the Competition at any other time.

37. A decision of the Promoter in relation to the conduct of the Competition is binding and conclusive and no correspondence will be entered into.

38. It is a condition of accepting the Prize that the Prize winner must comply with all the conditions associated with use of the Prize and the Prize supplier’s requirements.

39. In the event that the number of valid entrants does not meet the number of prizes to be allocated, the remaining prizes will be drawn and allocated amongst all valid entrants at the time of draw until all prizes have been awarded.

40. Entrants enter the Competition at their sole risk. With the exception of liability which cannot be excluded by law, the Promoter shall not be liable for any loss or damage which is suffered (including but not limited to indirect or consequential loss) or for personal injury or death suffered or sustained as a result of taking the Prize or entering the Competition. The Promoter is not responsible for any incorrect or inaccurate information, either caused by the phone user or for any of the equipment or programming associated with or utilised in this competition, or for any technical error, or any combination thereof that may occur in the course of the administration of this competition including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite network failure, theft or destruction or unauthorised access to or alteration of entries.

41. The Promoter reserves the right to cancel the award of Prize/s to, and/or disqualify any individual who, as determined in the sole discretion of the Promoter, has engaged in unlawful or improper conduct that is designed to jeopardise the fair conduct of the Competition. The Promoter reserves the right to cancel the award of the Prize where it has determined that the individual has engaged in unlawful or improper conduct or where it has otherwise breached these terms and conditions subject to State Regulation.

42. If for any reason this competition is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any causes beyond the control of the Promoter, which corrupt or affect the administration, security, fairness or integrity or proper conduct of this promotion, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, take any action that may be available, and to cancel, terminate, modify or suspend the competition, subject to any written direction given under State Regulation.

43. Entrants are advised that “Opt in” entries will be entered into a database and the Promoter and Suzuki Australia Pty Limited may use the entrant’s names, addresses and telephone numbers for future promotional, marketing and publicity purposes in any media worldwide and without notice and without any fee being paid unless otherwise advised by the entrant. By opting-in, entrants confirm that they allow their details to be used for this purpose. If you do ‘opt in’ to receive communications from Suzuki Australia Pty Ltd, you agree that the storage and use of your personal information will be subject to Suzuki Australia’s privacy policies and the Promoter will not be liable for any misuse of your personal information. If you later wish to ‘opt out’ of receiving communication from Suzuki Australia, you will need to contact them directly. If entrants no longer consent to their details being used for future marketing purposes by the Promoter, the entrant should contact The Promoter on their details set out below. Any request to update, modify or delete the entrant’s details should be directed to the Promoter. “Opt in” is only available through online entry and not through SMS.

44. The Promoter collects entrants’ personal information (as that term is defined in the Privacy Act 1988 (Cth)) for the purpose of conducting and promoting this Competition (including, but not limited to, determining and notifying winners). Entrants are advised that their personal information may be disclosed to State and Territory lottery departments and their names as the winner may be published as required under the relevant lottery legislation. Entrants are also advised that from time to time, the Promoter may disclose your personal information to third parties (including, but not limited to, third party prize providers) for the purpose of administering prizes or for other purposes contemplated in these Terms and Conditions. For purposes of public statements and advertisements the Promoter will only publish the winner’s surname, initial and state. A request to access, update or correct any information should be directed to the Promoter.

45. By entering the Competition, all entrants agree that their name, image, biography and entries (including, but not limited to, any written answers, photographs/images and audio-visual recordings) may be reproduced, published, communicated, broadcast or shown to the public by the Promoter in any media for its promotional purposes, without compensation to the entrants, subject to the Promoter’s privacy policy which is available at www.lifestyle.com.au; for this purpose, each entrant grants to the Promoter a non-exclusive, perpetual, worldwide, and royalty-free licence in any such written answers, photographs /images and audio-visual recordings. Each entrant consents to any act or omission by the Promoter which may infringe any of the entrant’s moral rights (within the meaning of the Copyright Act 1968 (Cth)), including: i) failing to attribute (or correctly attribute) the entrant’s authorship of the entry; or ii) making any modification, variation or amendment of any nature to the entry, whether or not it results in a material distortion or derogatory treatment of the entry.
