Terms and Conditions
1. Information on how to enter forms part of the terms of entry. Entry into the competition is deemed acceptance of these terms and conditions.
2. Entry is open to all residents of Australian Capital Territory, New South Wales, Queensland, South Australia, Tasmania, Victoria and Western Australia who are 18 years of age or over. However, employees and their immediate families of the Promoter and KFC and their associated agencies and companies are not eligible to enter.
3. The competition commences on Monday, 2nd December, 2013 at 12:00 pm AEDT and concludes Friday 24th January, 2014 at 9:00 am AEDT (‘Promotional Period’). All entries must be received within the Promotional Period.
4. Entry is via the Promoter’s website, Tenplay.com.au. Prior to submitting a valid entry an entrant must become a Member of Tenplay.com.au. Membership is free. The entrant must provide member details including but not limited to name, address, email address, date of birth and telephone number.
5. There will be two components to this competition, they are:
(a) COMPONENT ONE: The Home Viewer
(i) To submit a valid entry, entrants will be required to either:
 Upload a maximum 30 second video of themselves explaining why they love the KFC T20 Big Bash League. Compatible formats include .mov .avi .wmv or .mpeg files. Please note – Video must be in landscape orientation, preferably in 512x288px in dimension and under 60MB; OR
 Upload a photo of themselves, family and friends showing how they would enjoy the KFC T20 Big Bash League and in 25 words or less tell us why they love the KFC Big Bash T20. Compatible formats include .jpg, .png, .tiff, gif, .raw and .bmp.
(ii) Home Viewer winners will be judged from all entries received between commencement of the competition and each Entry Closing Date in Chart A. One winner will be selected by a judging panel for each Game as per Chart A (twenty seven (27) winners in total). The winners will be the entrants who, in the sole opinion of the judges, submitted the most creative and original video or who submitted the most creative and original photo and 25 words or less answer to the question in clause 5(a)(i).
(iii) Each Home Viewer winner will be required to host a camera crew provided by the Promoter on the day of their assigned Game as per Chart A at one of the following locations:
1. their home, which must be a ground floor location within a 50km radius of their nearest capital city CBD; or
2. the home of a friend or family member which is a ground floor location within a 50km radius of their nearest capital city CBD; or
3. a home which is not within a 50km radius of their nearest capital city CBD but which the Promoter approves as being accessible to its camera crew.
(iv) It is a condition of entry that entrants are willing and able to provide a location in order for the Promoter to film the Home Viewer as part of Component Two.
(v) A Home Viewer winner will forfeit the Component One prize in full if:
1. If the home viewer winner nominates a location that complies with 5(a)(iii) above but for any reason the location is unsuitable for filming for technical or logistical reasons. The determination of whether a location is suitable will be at the Promoter’s absolute discretion;
2. If the Home Viewer winner is no longer able, for any reason, to host the camera crew on the Game Date.
(vi) The Home Viewer winner can host up to a maximum of 15 people (inclusive of the winner) in the Location on the Home Viewer Filming Date (‘Guests’).
(vii) The Home Viewer winner, the home owner or leasee of the nominated property and any Guests may be required to sign legal releases agreeing to the use of the Location and their participation in the Component Two Filming.
(viii) The Home Viewer winner and/or home owner or leasee of the nominated property may also be required to provide access to the home at a mutually agreed time in order for the Promoter to test the location suitability and broadcast signal from the Location.
(ix) The Home Viewer winner agrees that no alcohol will be consumed prior to and during the filming of the Match on the Home Viewer Filming Date.
(x) The Home Viewer winners will be notified on the relevant Judging Date as per Chart A. The winners will be notified of their Component One prize in writing and by telephone.
(xi) All reasonable attempts to contact the Home Viewer winner will be made in writing and by telephone. If, after 48 hours of the prize Judging Date, the Home Viewer winner cannot be contacted or has not responded to the Promoter’s request to contact them to confirm their acceptance of the prize, the Home Viewer winner will forfeit the Component One prize in whole and no substitute prize or compensation will be offered. The Home Viewer winner’s entry will be returned to the entry pool for future consideration.
(xii) The judge’s decision is final and the Promoter will not enter into correspondence regarding the Competition result
(xiii) Prize:
Each of the 27 Component One Home Viewer winners will receive:
4 x 2013/2014 or 2014/2015 KFC T20 Big Bash League. Season general admission tickets to a game of their choice (excluding semi-finals and final) subject to availability valued at $30 (including GST) per ticket.

Total maximum prize pool is $3240 (including GST)

(b) COMPONENT TWO: The Million Dollar Six
(i) Each Home Viewer winner will have the chance to win the Cash Prize** allocated to the Home Viewer Winner’s assigned Game as set out in Chart B below.
(ii) During each Home Viewer winner’s assigned Game, a ‘celebrity’ or an alternate nominated person, nominated by the Promoter in its discretion, will be sitting in the Game audience on a 3 x 3 metre podium. If throughout the game the celebrity or alternate nominated person catches a ‘six’, the Component One Home Viewer winner assigned to that Game will win the Cash Prize for that Game as per Chart B.
(iii) A ‘celebrity’ or alternative nominated person is considered to have caught a ‘six’ if:
a. the batting team is awarded six runs in respect of the bowled ball; and
b. the ball has been caught on the full, meaning that the ball does not make contact with anything before being caught except for the clothes or body of the ‘celebrity’ or alternative nominated person; and
c. the ball is held for a minimum of two (2) second in at least one hand by the ‘celebrity’ or alternative nominated person; and
d. the ‘celebrity’ or alternative nominated person is on or above the podium at the time of the catch. The ‘celebrity’ or alternative nominated person will be considered to be on or above the podium if:
i. he/she has at least part of one foot on the podium (but may be leaning over the edge of the podium); or
ii. he/she has jumped into the air above the podium but lands back onto the podium for a minimum of two (2) seconds with the ball in his/her hands; and
e. the Promoter’s nominated judge determines, following the catch, that this definition has been met.
(iv) If whole or part of a Game is cancelled, forfeited or abandoned the Promoter may still conduct filming at the Location. Except where the catch of a six has resulted in the award of a Component Two Cash Prize prior to the cancellation, forfeit or abandonment, the Home Viewer winner will be awarded the Component One prize.

**If, during any Game in Chart B, a ‘six’ is caught then the value of the Cash Prize for the following Game will reset to the Minimum Cash Prize of $30,000.00. The value of the Cash Prize for each following Game will increase by $30,000.00 up to and including the first 24 games. The Semi Final 1 will be increased by $80,000.00, Semi Final 2 will be increased by $100,000.00 and the Final will be increased by $100,000.00.

6. Inaudible, illegible, incomprehensible and incomplete entries will be deemed invalid.
7. A limit of one entry per Member during the Promotional Period applies.
8. Each entrant warrants that their entry is the original work of the entrant and does not infringe the rights of any third party. Entries that are not the original work of the entrant, infringe the rights of any third party or contain defamatory material will be deemed invalid.
9. The entrant hereby indemnifies the Promoter from and against any loss, action, proceeding, suit, claim and demand brought or made against the Promoter by any person arising from or in consequence of any representation or warranty made by it in not being complete, true and correct.
10. Where an entrant submits a video or a photograph in accordance with 5(a)(i) above, and that video or photograph features multiple persons, the entrant acknowledges that he/she has received permission from all persons appearing in the video or photograph to use their name, image and/or voice for the purposes of entering this promotion and that such persons agree to these Terms and Conditions.
11. The Promoter reserves the right to request winners to provide proof of identity, proof of residency at the nominated prize delivery address and/or proof of entry validity (including phone bill or store receipt for purchase requirement) in order to claim a prize. Proof of identification, residency and entry considered suitable for verification is at the discretion of the Promoter. In the event that a winner cannot provide suitable proof, the winner will forfeit the prize in whole and no substitute or Component One prize will be offered.
12. The Promoter reserves the right to verify the validity of entries and to disqualify any entry which, in the opinion of Promoter, includes objectionable content, profanity, potentially insulting, inflammatory or defamatory statements, disqualify any entrant who tampers with the entry process, who submits an entry that is not in accordance with these Terms & Conditions of Entry or who has, in the opinion of Promoter, engaged in conduct in entering the Promotion which is fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the Promotion and/or Promoter. This includes, but not limited, to entrants and households using multiple email addresses, postal addresses or PO Box addresses to register single or multiple entries. The Promoter reserves the right to disqualify a winner if Promoter becomes aware that the winner and/or the winner’s entry is of a type described in this clause.
13. All entries must be received by 9:00 am AEDT on Friday 24th January, 2014. The time of entry will in each case be the time the online entry is received by the Promoter’s database. The Promoter accepts no responsibility for any late, lost or misdirected entries due to technical disruptions, network congestion or for any other reason.
14. Any entry that is made on behalf of an entrant by a third party will be invalid.
15. Prizes will be awarded to the Member named in the entry. Participants featured in any video or photograph uploaded as a Component One entry are not deemed to have entered the competition purely based on their inclusion in the video.
16. The cost of accessing the promotional website will be dependent on the entrant’s individual Internet Service Provider.
17. Prizes cannot be transferred or redeemed for cash.
18. If the Component One prize is unavailable, for any reason, the Promoter reserves the right to substitute the Component One prize for a prize of equal or greater value, subject to State Regulation.
19. The Promoter reserves the right to refuse to allow a winner to take part in any or all aspects of the prize, if the Promoter determines, in their absolute discretion, that a winner is not in the mental or physical condition necessary to be able to safely participate in the prize. It is a condition of accepting the prize that the winner may be required to sign legal releases in a form determined by the Promoter in its absolute discretion.
20. Once prizes have left the Promoter’s premises, the Promoter takes no responsibility for prizes damaged, delayed or lost in transit.
21. Cash prizes will be paid via an electronic funds transfer into the winners’ nominated account within 28 business days of the nominated Game date.
22. By accepting the prize, the winner agrees to participate in and co-operate as required with all reasonable media editorial requests relating to the prize, including but not limited to, being interviewed and photographed, filmed and/or chaperoned throughout the duration of the prize.
23. In consideration for the Promoter awarding the prize to the winner, the winner hereby assigns to the Promoter all right, title and interest in and to all copyright in any material created pursuant to the winner’s participation in any aspect of the prize (‘Works’). The winner acknowledges that the Promoter is free to use the Works in any media whatsoever throughout the world and to exercise its rights in relation thereto and the winner will not be entitled to any fee for such use.
24. In consideration for the Promoter awarding the prize to the winner, the winner hereby permits the winner’s name, image and/or voice, as recorded, photographed or filmed during the winner’s participation in the prize to appear in connection with the Promoter or the advertising or marketing thereof, in any media whatsoever
throughout the world and the winner will not be entitled to any fee for such use.
25. In consideration for the Promoter awarding a Cash Prize to the Home Viewer winner, the Home Viewer winner hereby agrees to appear on a Network TEN program, broadcast on Network Ten, via satellite link or in person on the program within 48-72 hours of the Component Two ‘six’ catch being taken. The winner must agree for their entry, image and/or voice, as recorded, photographed or filmed during the winner’s participation in the prize to appear in connection with the Promoter or the advertising or marketing thereof, in any media whatsoever throughout the world and the winner will not be entitled to any fee for such use.
26. In the event that for any reason whatsoever a winner does not take an element of the prize at the time stipulated by the Promoter then that element of the prize will be forfeited by the winner and cash will not be awarded in lieu of that element of the prize.
27. Prize values are based upon the recommended retail prices at the time of printing (inclusive of GST). The Promoter accepts no responsibility for change in prize value between now and the ultimate prize redemption date.
28. Independent financial advice should be sought as tax implications may arise as a result of accepting the prize.
29. If an entrant’s contact details change during the promotional period, it is the entrant’s responsibility to notify the Promoter. A request to access or modify any information provided in an entry should be directed to Promoter.
30. The Promoter’s decision is final and the Promoter will not enter into correspondence regarding the Competition result.
31. It is a condition of accepting the prize that the winner must comply with all the conditions of use of the prize and the prize supplier’s requirements.
32. It is a condition of accepting the prize that the Home Viewer winner and Guests may be required to sign a legal release and relevant access releases in a form determined by the Promoter in its absolute discretion.
32. In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter’s ability to proceed with the competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel the competition and recommence it from the start on the same conditions, subject to any directions given under State Regulation.
33. The Promoter shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for any personal injury suffered or sustained in connection with any prize/s and filming except for any liability which cannot be excluded by law. The Promoter is not responsible for any incorrect or inaccurate information, either caused by the phone user or for any of the equipment or programming associated with or utilised in this competition, or for any technical error, or any combination thereof that may occur in the course of the administration of this competition including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite network failure, theft or destruction or unauthorised access to or alteration of entries.
34. The Promoter reserves the right in its sole discretion to disqualify any individual who the Promoter has reason to believe has breached any of these conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.
35. The Promoter and its associated agencies and companies assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to, or alteration of entries, and reserves the right to take any action that may be available.
36. If for any reason this competition is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any causes beyond the control of the Promoter, which corrupt or affect the administration, security, fairness or integrity or proper conduct of this promotion, the Promoter may in its absolute discretion cancel, modify or suspend the competition and recommence it from a later Game Date on the same Terms and Conditions subject to any directions given under State Regulation.
37. Further to clause 36 above, the Promoter reserves its right to disqualify any individual or entity who tampers or interferes with the entry process and to take any legal action that may be available.
38. All entries become the property of the Promoter. The Promoter collects personal information about you to enable you to participate in this promotion but no further use of this information will be made without prior consent.
39. The Promoter, is collecting the entrant’s personal information for the purpose of conducting and promoting this competition (including but not limited to determining and notifying winner). The entrant’s personal information may be disclosed to select employees of the Promoter for this purpose. If you are not willing for this to occur you cannot participate in the Promotion.
40. Entrants’ personal information may be disclosed to State and Territory lottery departments and winners’ names published as required under the relevant lottery legislation. For purposes of public statements and advertisements the Promoter will only publish the winner’s surname, initial and state. A request to access, update or correct any information should be directed to the Promoter.
