1. Instructions on how to enter and prizes form part of conditions of entry. Participation in this promotion is deemed acceptance of these conditions of entry.

2. Entry is open to Australian residents aged 18 years and over. Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter.

3. Only one (1) entry per person permitted. For the removal of doubt, only one (1) entry will be permitted per nominated male person. A nominated male can be including but not limited to husband, de-facto partner or a person can nominate a male friend, father, brother, uncle, cousin, who are married or in a de-facto relation only.

4. The entire promotion commences on August 18, 2014 and closes at 11:59pm (AEST) on September 07, 2014. Each individual entry periods open and closing dates and times are as stipulated in Table A. The judging will be done by a panel of judges appointed by the Promoter. The judging will take place at the Promoter’s premises, 54 Park Street, Sydney NSW 2000 and will begin on the dates stipulated in Table A.

Finalists: Ten (10) finalists will be determined by the judges at the end of each individual entry period. For the removal of doubt there will be a total thirty (30) finalists over the entire promotional period. All finalists will go to the next stage of judging to determine the major prize winner and four (4) runners up winners. All finalists will be notified in writing and by telephone within two (2) days after the competition judging date using contact details provided in their entry. A finalist will be deemed the person whom is considered the “entrant” at the time of entering the promotion. The winner and runner’s up winner’s will be deemed the nominated male at the time of entry.

Major Prize / Runner’s up winners: The judging of the major prize and runner’s up winners will take place at the Promoter’s premises, 54 Park Street, Sydney NSW 2000 and will begin on 11 September 2014. Each prize winner will be notified in writing and by telephone within two (2) days after the competition judging date using contact details provided in their entry. The major prize winner’s name will be published in Woman’s Day issue 39 (cover date September 22, 2014).

5. To be eligible to enter, entrants must during the promotional period, purchase a copy of Woman’s Day magazine and then log on to www.womansday.ninemsn.com.au/win/, complete the required entry form by inputting the requested details including their full name, postal address, current email address, age, telephone number, name of the nominated person, age of nominated person, upload a current photograph of the nominated person, which they have been authorised to provide by the nominated person and the person responsible for taking the photograph (if not the entrant), and answer to the competition question in 50 words or less “what makes him ‘special’ man?” and submit the entry form as instructed.

6. Entrants must retain the original copy of all purchase receipts for all entries as proof of purchase. If a receipt is not available from the participating store where the participating title(s) were purchased, entrants must provide an original copy of the title magazine cover as proof of purchase. Promoter reserves the right to request proof of purchase for each entry made to verify all entries before awarding the prize. Failure to produce the required valid purchase receipt or original copy of the title cover for all entries when requested may, in the absolute discretion of the Promoter, result in invalidation of ALL of an entrant’s entries and forfeiture of any right to a prize. Each entry must relate to a separate qualifying purchase.

7. This is a game of skill, chance plays no part in determining the winner. Each entry will be individually judged based on its literary and creative merit of the answer to the question provided. The judges’ decision in relation to any aspect of the competition will be final and binding on every person who enters. No correspondence will be entered into.

8. By submitting an entry to the Promotion, each entrant assigns all rights in the entry to the Promoter (Bauer Media Pty Ltd) and Sponsor (Toyota Motor Corporation Australia Limited) and consents to the Promoter and Sponsor using the entry in any manner the Promoter wishes (including modifying, adapting or publishing the entry, whether in original or modified form, in whole or in part or not at all), by way of all media, without payment to the entrant (of royalties, compensation or otherwise). By submitting an entry, each entrant consents to any dealings with the entry that may otherwise infringe their moral rights in the entry. The Promoter may copy any content submitted as part of an entry, cause the content to be seen and/or heard in public, and communicate the content to the public. It may also allow third parties to do these things.

9. The entrant warrants to the Promoter that they will not submit material, as part of the entry process, that: (a) contains anything which may give rise to any cause of action by a third party against the Promoter, including without limitation material which is defamatory or obscene or which otherwise causes injury or damage to any person; or (b) infringes copyright, trademark, obligations of confidentiality or other legal rights of any person. For clarity, where the entrant or a nominee provides photographs or other copyright material to Bauer for use in connection with the promotion the entrant or nominee (as applicable): (a) grants to each the Promoter and the Sponsor an irrevocable, worldwide licence to use that material in any media and warrant that such use will not infringe the rights of any third party; and (b) must ensure it has appropriate permissions and consents from any third party featured in the photograph or otherwise identified in the copyright material.

10. Entrants and nominees agree to indemnify each the Promoter and the Sponsor against all costs and claims by third parties arising from any breach of these Terms and Conditions, including the warranties in paragraph 9 above.

11. The Promoter reserves the right to verify the validity of entries and entrants and nominees (including but not limited to an entrants identity, age, place of residence and proof of purchase) and to disqualify any entrant or nominee for tampering with the entry process or for submitting an entry which is not in accordance with these conditions of entry. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

12. Entrants and nominees must disclose any issues that may generate negative publicity and impact on the success of this promotion and/or Woman’s Day magazine. The Promoter can disqualify an entrant/nominee for failure to disclose any issues that may generate negative publicity and impact on the success of the “Is Your Hubby Your Hero?” Promotion and/or Woman’s Day magazine.

13. The Promoter reserves the right to disqualify an entrant/nominee if, in their complete discretion the Promoter deems that nominee’s continued involvement in the “Is Your Hubby Your Hero?” promotion will (in any way) negatively impact on the success of the promotion and negatively influence the general purpose of the promotion. For the removal of doubt the Promoter has the right to remove and/or disqualify a participant at any stage of the promotion. No correspondence will be entered into.

14. The Promoter is neither responsible nor liable for late, lost or misdirected entries, or entries not received by the Promoter for any reason whatsoever. No responsibility will be taken by the promoter in the event that the original entry is lost or damaged in editing.

15. Each entrant/nominee agrees to inform the Promoter, before acceptance of any finalist/ winner status related to this promotion of any unspent criminal convictions of any kind subsisting at the date of entry and will notify the Promoter immediately if there are any criminal charges brought against them after the date they are nominated up to and including the date of the start of the announcement of the winner.

16. The Ten (10) finalists from entry period 1 and 2 only, must be available for an interview with SmoothFm on August 27 – 28, 2014 and September 03 – 04, 2014. For the removal of doubt, this interview process will not be included in the judging of the Major Prize winner and runner’s up winners. This interview also does not mean each finalist will be awarded any prize for the interview.

17. It is a condition of participating in the competition that the finalists agree to be interviewed, photographed and filmed at any time and the acceptance of the finalist status by the Promoter or Nova Entertainment Australia/DMG Radio PTY LTD for a story or feature on this promotion to be developed and featured in Woman’s Day Magazine, website, social media pages, SmoothFM radio interview (or any other form of media it deems suitable) without further remuneration or reference to the participant. Details of any feature including but not limited to radio interview will be determined by the Promoter and Nova Entertainment Australia/DMG Radio PTY LTD at their discretion. The inclusion of any such feature (including but not limited to creative control of the feature) will remain with the Promoter at all times.

Prize winners:

18. The best (1) entry from all Finalists, as determined by the judges, will be deemed the major prize winner and will win:

• $5,000.00 – awarded in the form of a cheque made in favour of the winner.

The next best four (4) entries for all Finalists, as determined by the judges, will be deemed the runner-up prize winners and will each win:

• $250.00 – awarded in the form of a cheque made in favour of the winner.

Total prize pool is valued at up to AU$6,000.00 (including GST). Any ancillary costs associated with redeeming the prize are not included. All costs associated with redeeming and participating in the prize are the responsibility of the winner.

19. It is a condition of accepting the prize in the competition that the winner and runner’s up winners agree to be interviewed, photographed, filmed at any time by the Promoter for a story or feature on this promotion to be developed and featured in Woman’s Day Magazine, website, social media pages (or any other form of media it deems suitable) without further remuneration or reference to the participant. Details may feature Woman’s Day Magazine/website/social media pages on a date to be determined by the Promoter. The inclusion of any such feature (including but not limited to creative control of the feature) will remain with the Promoter at all times.

20. Prize must be taken as offered. The prize, or any unused portion of the prize, is not exchangeable or cannot be redeemed as cash. The prize cannot be used in conjunction with any other special offer. The prize is valued in Australian dollars. The Promoter accepts no responsibility for any variation in the prize value. Prize winner is advised that tax implications may arise from their prize winnings and they should seek independent financial advice prior to acceptance of their prize.

21. The prize will be delivered to the nominated address of the Prize winner. Delivery of the Prize is valid to any state and/or city in Australia.

22. In the event that for any reason whatsoever the Winner does not take the prize at the time stipulated by the Promoter, then the prize will be forfeited by the Winner and cash will not be awarded in lieu of the prize.

23. In the event that a prize, or part of a prize, is unavailable, the Promoter reserves the right to substitute the prize or part of the prize in its discretion with an alternative prize or part of the prize to the same and equal recommended retail value and/or specification subject to any written directions from the various Lottery Departments.

24. The promoter is neither responsible nor liable for any late lost or misdirected mail (including but not limited to prizes).

25. Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.

26. In the event of unforeseen circumstances, war, terrorism, state of emergency or disaster (including but not limited to natural disaster)the Promoter reserves the right to subject to reference to all relevant state and territory rules and regulations, to cancel, terminate, modify or suspend the promotion.

27. If a medical circumstance in some way restricts your ability to enter the competition through the required mechanic, you are still eligible to enter however you must briefly state your circumstances upon entry.

28. If your entry is selected as a winning entry, validation of your circumstances/ the validity of your entry will be undertaken by the Promoter. Method of validation (without limitation) will be determined by the Promoter in its complete discretion. If the winning entry is deemed to be a winner, the winner will be notified as per the terms and conditions herein. In the event that the Promoter requests the entrant to sign any legal documents relating to the verification of their medical circumstance, the legal documents will take the form determined by the Promoter. It is a condition of accepting the prize the winner sign any such legal documentation.

29. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.

30. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of the prize.

31. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.

Privacy:

32. The Promoter collects personal information (“PI”) in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI. The Promoter will also use and handle PI as set out in its privacy policy, which can be accessed by visiting http://www.bauer-media.com.au/privacy.htm. In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may also, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Entrants should direct any request to opt out, access, update or correct PI to the Promoter and direct any complaints regarding treatment of their PI according to the Privacy Policy. All entries become the property of the Promoter.
