Conditions

PARTICIPATION
This competition (“Competition”) is conducted by Fonterra Australia Pty Ltd, ABN 52 006 483 665 of 327 Ferntree Gully Road, Mount Waverley, Victoria, 3149 (“Promoter”).

Entry to the Competition constitutes acceptance of these conditions.

The Competition is only open to Eligible Entrants. An “Eligible Entrant” is an individual who: (i) is a resident of Australia aged 13 years or older as at the time of entry; and (ii) is not an employee of the Promoter or any of its related corporations or any of their agencies associated with the Competition; and (iii) is not a spouse, defacto spouse, parent, child or sibling (whether full, half, step or by adoption) of such an employee. An Eligible Entrant who is under 18 years of age, must obtain the permission of a parent or guardian to enter.

The Competition opens at 00:00 hrs on 15/09/14 and closes at 24:00 hrs on 9/11/14 (“Entry Period”). All times and dates are times and dates in Melbourne which may be AEST or AEDT depending on the date.

ENTRY

To enter, an Eligible Entrant must, during the Entry Period, first make a Qualifying Purchase from a store within Australia. A Qualifying Purchase is the purchase, in one transaction, of any two Qualifying Products (2 of the same product, or any combination). Each of the following products is a Qualifying Product:

Entry can only be made by internet. To submit an entry, an entrant must, during the Entry Period, use a compatible browser to visit www.westernstarkitk.com.au (“Competition Website”) and follow the directions there. For each entry, the entrant must provide: (a) the last 4 digits of the bar codes on the two Qualifying Products being used to enter; and (b) all other details required at the Competition Website, including first and last names, postal address and e-mail address.

All entrants must ensure that their entries are received by the Promoter during the Entry Period. The Promoter takes no responsibility for any late or misdirected entry or for any delays or failures in any telecommunications service or equipment.

For each and every Qualifying Purchase that an Eligible Entrant uses to submit an entry, he/she MUST retain: (i) the original packaging of the Qualifying Products comprising the Qualifying Purchase, and (ii) a copy of the receipt that was issued when that Qualifying Purchase was made.

All entries to the Competition may be subject to verification by the Promoter. The Promoter will reimburse an entrant for any reasonable costs incurred in complying with this condition.

(i) An entrant MUST, within 7 days of being asked, deliver to the Promoter (by a means determined by the Promoter) all of the items which condition 8 requires the entrant to retain and which are requested by the Promoter. The Promoter may elect not to return those items.

(ii) An entrant MUST also deliver to the Promoter (by a means determined by the Promoter) copies of any other documents the Promoter may request establishing eligibility to enter or win, including evidence of age, residence or identity. The Promoter may make one or more requests for such documents. Once the identity of documents available is established, an entrant must deliver requested copies within 7 days of being asked to do so. At the Promoter’s request, an entrant MUST also, within 7 days of being asked, allow the Promoter to inspect and copy the original of any such document.

The Promoter may, at its absolute discretion, declare any or all entries made by an entrant invalid if the entrant: (i) fails to establish their entitlement to enter the Competition to the Promoter’s reasonable satisfaction; or (ii) fails to produce items as required by condition 8 or produces items that, in the Promoter’s reasonable opinion, are illegible, stolen, forged, reconstructed, altered, incomplete or tampered with in any way; or (iii) in the Promoter’s reasonable opinion, tampers with the entry process or benefits from such tampering; or (iv) in the Promoter’s reasonable opinion, submits an entry which is not in accordance with these conditions.

An entry by more than one person (ie a joint entry) is invalid.

INSTANT WIN BY TIME AND PRIZES

There are 2,000 Prize Packs (each an “Instant Win Prize”) available to be won instantly during the Entry Period.

Each Instant Win Prize comprises 2 x Head Chef Utensils and 1 x Rio and Western Star branded children’s apron together valued at $48.85

2,000 times during the Entry Period (each a “Time”) will be randomly selected. One Instant Win Prize will be allocated to each Time. For each Time:

(i) The Eligible Entrant who submits the first valid entry that is received by the Promoter at, or after, the Time will, subject to condition 14(ii), win the Instant Win Prize allocated to that Time.

(ii) A valid entry will be disregarded for the purposes of allocating the Prize for the Time if that entry has previously been allocated a Prize for another Time.

If, at the end of the Entry Period any Instant Win Prizes have not been won, they will be awarded in a second chance draw which will be drawn from all entries except entries that have already won a prize. The second chance draw will commence at 12.05pm on 10/11/14 at 403, 62 Beach St, Port Melbourne VIC 3207.

MAJOR PRIZE DRAW AND PRIZE

A draw, from all entries received, will be held at 12 noon on 10/11/14 at 403/62 Beach Street, Port Melbourne VIC 3207 (“Major Prize Draw”).

The Eligible Entrant who submitted the first valid entry drawn in the Major Prize Draw will win the Major Prize.

The Major Prize, which is specifically subject to conditions 21 and 22, is valued at a maximum of $25,009 and comprises for its winner and three guests of his/her choice:

(i) return economy flights to New York, USA, from the Australian capital city nearest to the winner’s place of residence (including airline and airport taxes);

(ii) 4 nights in a two twin rooms at a four star hotel in New York of the Promoter’s choice (the “Accommodation”);

(iii) a tour of Blue Sky Studios in Greenwich, Connecticut (“Tour”) (with interactions and demonstrations from artists) to be held on a date in May or June 2015 to be chosen by the Promoter;

(iv) during the Tour, a Rio 2 ‘Scratch’ recording experience in the Blue Sky Studios’ sound booth for the winner or one of his/her guests, and 1 x edited DVD of the Rio 2 voice recording and animation clip;

(v) a buffet lunch at Blue Sky Studios on the day of the Tour;

(vi) group return transfers between Blue Sky Studios and the Accommodation;

(vii) a helicopter tour of New York;

(viii) admission to the zoo in Central Park (with access to the main zoo, children’s zoo and 4-D theatre);

(ix) limited travel insurance (see condition 19);

(x) A$5,000 spending money (provided to the winner only and not to his/her accompanying guests).

All components of the Major Prize must be taken together as a single trip to be booked by the Promoter on dates to coincide with the Tour. Any part of the Major Prize that is not taken for any reason is forfeited.

Travel insurance with no pre-existing medical conditions will be supplied to the winner and their guests before departure. The travel insurance is subject to the restrictions and the terms and conditions of the insurance provider. It is the responsibility of the winner and/or their guests to meet any additional costs relating to obtaining insurance cover for any pre-existing medical condition and/or for any additional costs as may be specified if the winner and/or their guests are aged 65, or over.

Subject to condition 22 all aspects of the Major Prize (including travel and Accommodation) are for the winner and three guests travelling together. The winner of the Major Prize is free to select any person as a guest, provided that:

(i) the Promoter may require the guests to confirm in writing that they agree to comply with the provisions of these conditions relating to guests (see condition 33 ; and

(ii) if a person aged less than 18 years wins the Major Prize, he/she must bring a parent or guardian as one of his/her accompanying guests.

The Major Prize does not (except as expressly stated) include:

(i) any transport between a traveller’s residence and the departure airport;

(ii) any overnight accommodation while travelling to the departure airport or destination;

(iii) any other travel or accommodation;

(iv) any meals, food or beverages;

(v) any incidental hotel charges (such as mini-bar charges, communication services (eg telephone and internet/email); in-house movies and games, entertainment services, and laundry services);

(vi) any insurance;

(vii) any costs associated with any passport, visa, health or other requirements for entry into any foreign country and return to Australia;

(viii) any vaccinations or other medical or health related services;

(ix) any other ancillary costs which may be incurred by the winner or his/her guests in relation to the Major Prize.

The Major Prize cannot be exchanged for other travel or accommodation at other destinations.

The winner of the Major Prize and his/her guests are responsible for compliance with any health, passport, visa and other requirements for entry into the USA, any country en-route and return to Australia and bear all risks associated with any refusal of entry into any country. No compensation will be payable if the winner or a guest is unable to use the Major Prize (or any part of it) as stated for whatever reason.

INTERNET ENTRY

Any costs associated with accessing the Competition Website are the responsibility of the person seeking access and are dependent on the internet service provider used.

Eligible Entrants must make their internet entries manually using an internet browser. The Promoter may reject internet entries if it reasonably forms the opinion that they have been entered using automated entry means or by use of a competition entry service.

PRIZES GENERALLY

The maximum total value of all prizes is $122,709.

If a prize is unavailable for any reason, the Promoter will, in its absolute discretion, substitute alternative goods or services of no lesser retail value and/or specification, subject to the approval of the authorities that have issued permits for the conduct of the Competition. The Promoter accepts no other liability or responsibility for any loss incurred by a winner or any other party if a prize (or part of a prize) is unavailable for any reason.

A right to receive a prize is not transferable or exchangeable and cannot be taken as a monetary payment

WINNERS

Each winner, whenever determined, will be notified in writing which will be sent by e-mail to the e-mail address indicated in their winning entry. So far as practicable, the notifications will be sent to instant winners within two days of their determination and to an entrant whose entry is drawn in a draw, within 2 days of that draw. The notification will include instructions as to how the winner is to claim the prize and establish his/her entitlement to it.

The winner of the Major Prize will be published on the Competition Website no later than 19/11/14 for a period of at least 28 days.

Subject, where relevant, to any directions given under the legislation regulating the Competition, if:

(i) the Major Prize is not claimed by the winner within 3 months of the Major Prize Draw the prize will be awarded to another Eligible Entrant in a redraw commencing at 12 noon on 25/2/15 at 403/62 Beach Street, Port Melbourne VIC 3207. If there is a redraw for the Major Prize, the name of the winner in the redraw will be published on the Competition Website no later than 4/3/15 for a period of at least 28 days;

(ii) any Instant Win Prize is not claimed by a winner by 23/2/15 the prize will be awarded to another Eligible Entrant in a draw commencing at 12.05pm on 25/2/15 at 403, 62 Beach St, Port Melbourne VIC 3207.

In order to be entitled to any prize, a winner must, if requested by the Promoter, agree to and sign and return an eligibility form confirming his/her compliance with the Conditions and eligibility to accept the prize (“Eligibility Form”).

If a winner is under 18 years of age, the winner, if requested by the Promoter, must ensure that his/her parent or guardian agrees to and also signs the Eligibility Form. A winner will forfeit his/her prize if he/she fails to ensure that the Eligibility Form is signed and returned in accordance with this condition, as and when required by the Promoter.

GENERAL

If for any reason the conduct or operation of the Competition is interfered with or disrupted in any way (including by vandalism, power failures, natural disasters, acts of God, civil unrest, strikes, computer bugs or viruses, tampering or technical failures), the Promoter reserves the right to cancel, terminate, modify or suspend or recommence the Competition, subject to the approval of the authorities that have issued permits for its conduct.

Promoter assumes no responsibility for: (i) any error, omission, interruption, or delay in the operation or transmission of any communication sent to (or by) the Promoter or any entrant whether caused by problems with communication networks or lines, computer systems, software or internet service providers, congestion on any carrier network or otherwise, (ii) any theft, destruction or unauthorized access to, or alteration of such communications; (iii) any problem with, or technical malfunction of, any computer system or other equipment used for the conduct of the Competition.

CAUTION: ANY ATTEMPT TO CAUSE DAMAGE TO ANY WEBSITE OR THE INFORMATION ON ANY WEBSITE ASSOCIATED WITH THIS PROMOTION, TO CAUSE DAMAGE TO OR TO INTERFERE WITH THE FUNCTIONING OF THE SMS PROCESSES, OR TO OTHERWISE UNDERMINE THE FAIR AND LEGITIMATE OPERATION OF THIS COMPETITION MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS. THE PROMOTER RESERVES THE RIGHT TO SEEK DAMAGES TO THE FULLEST EXTENT PERMITTED BY LAW IN THE EVENT THAT ANY SUCH AN ATTEMPT IS MADE, WHETHER OR NOT THAT ATTEMPT RESULTS IN ANY SUCH DAMAGE, INTERFERENCE OR UNDERMINING.

All of the Promoter’s decisions are final and no correspondence will be entered into.

The Promoter accepts no responsibility for any tax liability incurred as a result of an entrant participating in the Competition. Entrants should obtain independent tax and financial advice.

To the full extent permitted by law, the Promoter, its associated companies and agencies and all those entities’ personnel (the “Relevant Parties”) exclude all liability for any loss (including any damage, claim, injury, cost or expense) which is suffered or incurred by any Eligible Entrant in connection with the Competition or prizes, including: (i) any indirect, economic or consequential loss; (ii) any loss arising from the negligence of a Relevant Party; (iii) any liability for personal injury or death. Nothing in these conditions is intended to exclude, restrict or modify an entrant’s rights under the Competition and Consumer Act 2010.

The Major Prize winner consents to the Promoter using their name, likeness, image and/or voice (including any photograph, film and/or recording of them) in any media at any time or times without remuneration for the purpose of promoting this Competition, the Promoter and/or any of the Promoter’s products.

Entrants’ personal information will be collected by or on behalf of the Promoter to enable it to administer the Competition and publicise its winners and, if an entrant consents, may be used to market its products to the entrant. The personal information of each winner may be provided to others assisting in the conduct of the Competition, including the Competition administrator, prize suppliers and deliverers, and to regulatory authorities. Persons may contact the Promoter by post at the address stated in condition 1 to request access to, or corrections of, any of their collected personal information that is held by the Promoter. If an entrant does not provide accurate personal information the Promoter may determine that they are not eligible to win a prize.
