Terms & Conditions

Information on how to enter and the prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
Entry is open to Australian residents who can travel on the dates outlined in clause 18(a – d) depending on football code selection at time of entry (if drawn as the Major Draw winner), excluding the following persons:
Any person who has represented their State/Territory or country in any under 16’s or higher representative Aussie Rules, AFL, Rugby League, Rugby Union, American Football or soccer team;
Any person who has played in any of the following Australian Rules Football teams: AFL; VFL; SANFL; WAFL; NEAFL; and AFL Tasmania;
Any person who has played in any of the following Rugby League teams: NRL; VB NSW Cup; QLD Intrust Super Cup; and Holden Cup (under 20’s);
Any person who has played in any of the following Rugby Union teams: Wallabies; Super Rugby; and Premier Grade;
Any person who has played in any of the following soccer teams: Socceroos; Matildas; A-League; W-League; and National Premier League;
Any person who has been a contracted and/or paid American Football player; and
Employees (and their immediate families) of the Promoter, participating retailers and agencies associated with this promotion are also ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
Entrants under 18 years old must have parental/guardian approval to enter and further, the parent/guardian of the entrant must read and consent to these Terms and Conditions. Parents/guardians may be required by the Promoter to enter into a further agreement as evidence of consent to the minor entering this promotion.
Promotion commences on 14/04/2014 and closes at 11:59pm AEST on 25/05/2014 (“Promotional Period”).
To be eligible to enter and receive an entry card, while stocks of entry cards last, individuals must purchase any SKINS product from a participating retailer during the Promotional Period. Participating retailer means any retailer that features point of sale material about this promotion. It is the responsibility of the entrants to ensure that they receive an entry card at point of purchase.
To enter, individuals must then visit www.skinsgetrichkick.com.au, follow the prompts to the promotion entry page, input the requested details including their full name, valid email address, telephone number and the unique code (found on the entry card), select the football code they would prefer to attend if drawn as the major prize winner and submit the fully completed entry form during the Promotional Period.
The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions may be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
Incomplete or indecipherable entries will be deemed invalid.
Multiple entries permitted, subject to the following: (a) only one (1) entry permitted per specified purchase requirement; (b) each entry must be submitted separately and in accordance with entry requirements; (c) only one (1) unique code per entry is permitted; (d) the same unique code cannot be used more than once; and (e) unrecognised codes will be deemed invalid.
Entrants must retain either their original or a photocopy of their purchase receipt(s) for all entries as proof of purchase. Failure to produce the proof of purchase for all entries when requested may, in the absolute discretion of the Promoter, result in invalidation of ALL of an entrant’s entries and forfeiture of any right to a prize. Purchase receipt(s) must clearly specify the products purchased, store of purchase and that the purchase was made during the Promotional Period but prior to entry.
If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
There will be one (1) draw conducted for the entries received each day of the Promotional Period, for a total of forty-two (42) draws (“Daily Draws”), and there will be one (1) draw conducted for all entries received during the Promotional Period (“Major Draw”). Subject to the starting and closing time of the Promotional Period, entries into each Daily Draw will open at 12.00am AEST and close at 11.59pm AEST each day. Entries in each Daily Draw will NOT be entered into any subsequent Daily Draw(s), however, all entries (including the Daily Draw winners) will be entered into the Major Draw.
All draws will take place at Greeneagle Distribution and Fulfilment, Unit 10, 20-28 Ricketty Street, Mascot, NSW 2020. Each Daily Draw will take place at 11:00am AEST on the first business day after entries close for that Daily Draw, with the first Daily Draw taking place on 15/04/2014 and the last Daily Draw taking place on 26/05/2014. The Major Draw will take place at 11:00am AEST on 27/05/2014. For the removal of doubt, no draws will be conducted during the weekend or on a public holiday in NSW. The initial drawn entrant in the Major Draw will be notified in writing within one (1) business day of the Major Draw and will have seven (7) calendar days to provide the Promoter with confirmation that they will participate in the Major Prize, as defined in clause 17 below. If the event that the initial drawn Major draw entrant does not confirm their participation within seven (7) calendar days, a reserve will be selected. The reserve Major Draw entrant will have seven (7) calendar days to provide the Promoter with confirmation that they will participate in the Major Prize. In the event no confirmation is received, another reserve will be drawn and this process will continue until a Major Draw winner is confirmed.
Daily Draw winners will be notified in writing within two (2) business days of the relevant Daily Draw. Subject to the operation of the Game, as defined in clause 17 below, the name of the Major Draw winner will be published in The Australian on 27/06/2014.
The Promoter’s decision is final and no correspondence will be entered into.
The first valid entry drawn in each Daily Draw will each win a $200 SKINS Voucher (“Daily Prize”).
The first valid entry drawn in the Major Draw who confirms they can participate in line with clause 13 will win that entrant (“Participant”) the opportunity to play a game (“the Game”) for the chance to win $250,000, and a trip to attend the Game (“Major Prize”).
The location, dates and rules of the Game will depend on the football code selected by the Major Prize winner at the time of entry submission. The details of each Game, based on the football code selected, are as follows:

If the Major Prize winner selected AFL: The Game will take place at the Richmond Tigers v Brisbane Lion match at the MCG, Brunton Avenue, Richmond, VIC 3002 on 05/07/2014 from 2:00pm AEST. In order to participate in the Game, the Participant will be awarded a trip for two (2) people to the Game valued at up to $10,000 depending on point of departure:
two (2) return economy airfares from their nearest capital city in Australia to Melbourne, VIC (if necessary);
return transfers between airport, accommodation and MCG;
three (3) nights night 4 star twin share accommodation;
two (2) general admission tickets to the Richmond Tigers v Brisbane Lion match; and
$1,000 spending money for the Participant.

There will be one (1) regulation adult sized AFL football on the field at the commencement of the Game. The objective of the Game is for the Participant/proxy (“Attendee”) to successfully kick a converted goal by kicking the football, from their hands, through the regulation AFL posts from the fifty (50) metre line. The Attendee will only have one (1) opportunity to kick the football and must kick with either their right or left foot. If the Attendee successfully kicks a converted goal, the Participant will be deemed the winner of the Game and will win $250,000, subject to verification by the judges. If the Attendee fails to kick the football through the posts, the $250,000 will not be awarded.

The AFL Major Prize must be taken to coincide with the Richmond Tigers v Brisbane Lion match event with flights departing on 03/07/2014 and is subject to booking and flight availability.

If the Major Prize winner selected NRL: The Game will take place at the North Queensland Cowboys v Manly Sea Eagles match at 1300Smiles Stadium, Golf Links Drive, Kirwan, QLD 4817 on 06/09/2014 from 3:00pm AEST. In order to participate in the Game, the Participant will be awarded a trip for two (2) people to the Game valued at up to $11,200 depending on point of departure:
two (2) return economy airfares from their nearest capital city in Australia to Townsville, QLD (if necessary);
return transfers between airport, accommodation and 1300Smiles Stadium;
three (3) nights night 4 star twin share accommodation;
two (2) general admission tickets to the North Queensland Cowboys v Manly Sea Eagles match; and
$1,000 spending money for the Participant.

There will be one (1) regulation adult sized NRL football on the field at the commencement of the Game. The objective of the Game is for the Participant/proxy (“Attendee”) to successfully kick a converted goal by kicking the football through the regulation NRL posts from the forty (40) metre line. The football will be placed on the ground in line with the centre of the goal, at the forty (40) meter line. The Attendee will only have one (1) opportunity to kick the football and must kick with either their right or left foot. If the Attendee successfully kicks a converted goal, the Participant will be deemed the winner of the Game and will win $250,000, subject to verification by the judges. If the Attendee fails to kick the football through the posts, the $250,000 will not be awarded.

The NRL Major Prize must be taken to coincide with the North Queensland Cowboys v Manly Sea Eagles match event with flights departing on 04/09/2014 and is subject to booking and flight availability.

If the Major Prize winner selected soccer: The Game will take place at the Central Coast Mariners match at Bluetongue Stadium, Dane Drive, Gosford, NSW 2250 on 27/09/2014 from the commencement of the match which is yet to be determined. In order to participate in the Game, the Participant will be awarded a trip for two (2) people to the Game valued at up to $10,000 depending on point of departure:
two (2) return economy airfares from their nearest capital city in Australia to Sydney, NSW (if necessary);
return transfers between airport, accommodation and Bluetongue Stadium;
three (3) nights night 4 star twin share accommodation;
two (2) general admission tickets to the Central Coast Mariners match; and
$1,000 spending money for the Participant.

There will be one (1) regulation adult sized soccer ball on the field at the commencement of the Game. The objective of the Game is for the Participant/proxy (“Attendee”) to successfully kick the football to hit the cross bar from a forty (40) metre distance. The football will be placed on the ground in line with the centre of the goal, at a forty (40) metre distance form the goal. The Attendee will only have one (1) opportunity to kick the football and must kick with either their right or left foot. If the Attendee successfully kicks the football and hits the cross bar, the Participant will be deemed the winner of the Game and will win $250,000, subject to verification by the judges. If the Attendee fails to hit the cross bar when they kick the soccer ball, the $250,000 will not be awarded.

The Soccer Major Prize must be taken to coincide with the Central Coast Mariners match event with flights departing on 25/09/2014 and is subject to booking and flight availability.

If the Major Prize winner selected Rugby Union: The Game will take place at the Wallabies v All Blacks Bledisloe Cup match at Suncorp Stadium, 40 Castlemaine Street, Milton, QLD 4064 on 18/10/2014 from 7:30pm AEDST. In order to participate in the Game, the Participant will be awarded a trip for two (2) people to the Game valued at up to $11,600 depending on point of departure:
two (2) return economy airfares from their nearest capital city in Australia to Brisbane, QLD (if necessary);
return transfers between airport, accommodation and Suncorp Stadium;
three (3) nights night 4 star twin share accommodation;
two (2) general admission tickets to the Wallabies v All Blacks Bledisloe Cup match; and
$1,000 spending money for the Participant.

There will be one (1) regulation adult sized Rugby Union football on the field at the commencement of the Game. The objective of the Game is for the Participant/proxy (“Attendee”) to successfully kick a converted goal by kicking the football through the regulation Rugby Union football posts from the forty (40) metre line. The football will be placed on the ground in line with the centre of the goal, at the forty (40) meter line. The Attendee will only have one (1) opportunity to kick the football and must kick with either their right or left foot. If the Attendee successfully kicks the football through the posts, the Participant will be deemed the winner of the Game and will win $250,000, subject to verification by the judges. If the Attendee fails to kick the football through the posts, the $250,000 will not be awarded.

The Rugby Union Major Prize must be taken to coincide with the Wallabies v All Blacks Bledisloe Cup match event with flights departing on 16/10/2014 and is subject to booking and flight availability.
If the drawn Participant resides within State in which the Game is to take place, based on their football code selection at the time of entry submission, flights will not form part of the Major Prize and the Participant will be responsible for transport to and from accommodation. Additional spending money, meals, taxes (excluding airline and airport taxes), insurance, transport to and from departure point, transfers, items of a personal nature (including but not limited to in-room charges) and all other ancillary costs are not included. If the Participant cannot attend the Game, the Promoter will appoint an eligible proxy to play the Game on his/her behalf (regardless of the State/Territory in which the Participant resides). The proxy will be an Australian resident and must not fall into any of the categories of persons listed as excluded in clause 2.
All kick attempts will be recorded and an independent referee (“Referee”) will witness the kick attempt. The Participant/Attendee must follow all reasonable directions of the Promoter and/or Referee at all times for the duration of the Game. If the Participant or Attendee is deemed to be in breach of this condition, or is deemed to be behaving in an inappropriate, aggressive, offensive or unsportsmanlike manner, the Participant or Attendee may be disqualified by the Promoter and removed from the Game in the Promoter’s sole discretion.
During the entire duration of the Major Prize, a nominated parent/guardian must accompany any person under 18 years of age. The Major prize winner and their companion must depart from and return to the same departure point and travel together. Itinerary to be determined by the Promoter in its absolute discretion.
Frequent flyer points will not form part of the Major Prize. Major Prize is subject to the standard terms and conditions of individual prize and service providers. The Major Prize winner may be required to present their credit card at time of accommodation check in.
SKINS Vouchers can be used over multiple transactions. Any ancillary costs associated with redeeming the SKINS Voucher are not included. Any unused balance of the SKINS Voucher will not be awarded as cash. Redemption of the SKINS Voucher is subject to any terms and conditions of the issuer including those specified on the SKINS Voucher.
If for any reason a winner does not take a prize (or an element of the prize), then the prize (or that element of the prize) will be forfeited.
If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
Any ticket prizes are subject to the event venue and ticket terms and conditions, including any applicable age restriction. The Promoter and event organisers hereby expressly reserve the right to eject the winner (and/or his/her companion/s) for any inappropriate behaviour, including but not limited to intoxication, whilst participating in any element of the prize.
Total prize pool value is up to $270,000. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.
In the case of any unclaimed Daily Prizes or the $250,000 is won by the Attendee in the Game, but remains unclaimed, the unclaimed prizes will be entered into the unclaimed prize draw which may take place on 16/01/2015 at the same time and place as the original Daily Draws, subject to any directions from a regulatory authority. Winners, if any, will be notified in writing within two (2) business days of the draw and in the case of a $250,000 prize winner, their name will be published in The Australian on 23/01/2015.
Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) if any match or the Game events are delayed, postponed or cancelled for any reason beyond the reasonable control of the Promoter; (f) any tax liability incurred by a winner or entrant; or (g) use/taking of a prize and participation in the Game.
As a condition of accepting the Major Prize, the Major Prize winner (and their companion and/or proxy) must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form. In the event the Major Prize winner or Major Prize Winner’s companion is under the age of 18, a nominated parent/legal guardian of such person will be required to sign the legal documentation required under this clause on their behalf.
The Promoter collects personal information (“PI”) in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed at http://r.skins.net/privacypolicy. In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. The Privacy Policy also contains information about how entrants may opt out, access, update or correct their PI, how entrants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. All entries become the property of the Promoter. Unless otherwise indicated by the Promoter, the Promoter may disclose personal information to entities outside of Australia (for a list of the countries, see the Promoter’s Privacy Policy).
