New York Competition Terms And Conditions

1. Information on how to enter the promotion forms part of these terms and conditions of entry. Entry into the promotion is deemed acceptance of these terms and conditions.

2. The promoter is Qantas Airways Limited (ABN 16 009 661 901) of 10 Bourke Road, Mascot, NSW 2020 (telephone number 02 9578 4184) (Promoter).
Duration

3. The promotion commences at 12.01am (AEDT) on 4 April 2014 and closes at 11.59pm (AEST) on 27 April 2014 (Promotion Period).
Eligibility to enter

4. Entry into the promotion is open only to Australian residents who are Qantas Frequent Flyer members, are over 18 years of age, are eligible to receive Qantas Cash as set out in Clause 5, have successfully activated the Qantas Cash facility and are an Eligible Entrant during the Promotional Period as set out in Clause 6 (Eligible Entrants) but excluding:

(a) directors, management, agents, employees (and their immediate families) of the Promoter, Issuer of the Prize Package or Mike Da Silva and Associates (Aust) Pty Ltd ABN 50 003 894 022 (MDSA) and each of their related bodies corporate;

(b) registered travel companions of employees of the Promoter and its related bodies corporate; and

(c) members whose Qantas Frequent Flyer account is suspended, cancelled or otherwise terminated at any time.

5. To be eligible to receive the new Qantas Card with the option of Qantas Cash you must be an Australian resident Qantas Frequent Flyer member 16 years of age or older. Heritage Bank Limited (AFSL 240984) (the Issuer) issues Qantas Cash under arrangements between it, Qantas and Access Prepaid Australia Pty Ltd (AFSL 386837) (a MasterCard business) (Access). Access distributes Qantas Cash (together with Qantas which is an authorised representative of Access for the purposes of providing general financial product advice with respect to Qantas Cash). Access can be contacted at customercare@qantascash.com. Access and Qantas earn foreign exchange revenue from Qantas Cash transactions. Access receives a processing fee from domestic Qantas Cash “point of sale” transactions. Qantas receives revenue generated by Qantas Cash transactions based on interchange fees paid to the Issuer, deposits held by the Issuer, cardholder fee and certain rebates and incentives from MasterCard Asia/Pacific Pte Ltd. This promotion has been prepared without taking into account your objectives, financial situation or needs and you should consider the appropriateness of the Qantas Cash facility having regard to those matters. A Product Disclosure Statement in respect of Qantas Cash is available via qantascash.com. A person should obtain and consider the PDS before making any decisions about whether to acquire or continue to hold the prepaid facility.
Entry into the promotion

6. Eligible Entrants will be automatically entered into the competition when, during the Promotion Period, they register for the campaign by one of the following methods and make an eligible purchase (as set out in Clause 8) of any amount using their Qantas Cash facility during the Promotion Period:

(a) Registering online by submitting their details on www.qantascash.com/newyork, or

(b) Clicking on the link contained in an email sent by Qantas Frequent Flyer promoting the competition and following the instructions.

7. Eligible Entrants are permitted one (1) entry per eligible purchase. Multiple entries are permitted.

8. Eligible purchases do not include money orders, traveller’s cheques, gambling chips or purchasing foreign currencies in cash. You will not receive an entry when loading funds to your facility, transferring funds to another currency balance or another member’s facility or when withdrawing funds from ATMs or cashing out your facility balance. Purchases that are reversed, refunded or charged-back are also ineligible for an entry into the draw.

9. The Promoter is not responsible for any technical malfunction of any communications network or any late, lost, incorrectly submitted, delayed, ineligible, incomplete, corrupted or misdirected entry whether due to error, transmission interruption or otherwise.

10. The time of entry will be deemed to be the time the entry is received by the Promoter.
Drawing of entries and notification of winner

11. The draw will take place at 2:00pm (AEST) on 16 May 2014 at the offices of MDSA at 15 Grosvenor Street, Neutral Bay, NSW 2089 and will be conducted by MDSA. The winner will be determined by an automated random draw of all eligible entries. There will be one winner only. The result of the draw is final and no correspondence will be entered into.

12. The winner will be notified in writing by email or phone (using the details provided in the winner’s Qantas Frequent Flyer online profile or details provided on the entry form at the time of entry) within 2 business days after the draw and their name will be published on www.qantascash.com/newyork on 21 May 2014 and in The Australian newspaper on 21 May 2014. The winner is responsible for ensuring that his/her contact details in his/her Qantas Frequent Flyer online profile, or his/her details provided via the entry form on www.qantascash.com/newyork at the time of entry, are accurate and up to date. The Promoter takes no responsibility for inaccurate or incomplete details.

13. The Promoter reserves the right, at any time, to verify the validity of entries and Eligible Entrants (including an entrant’s identity, age and place of residence) and to disqualify any Eligible Entrant who tampers with the entry process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
The prize

14. There will be 1 prize of a trip for two people to New York, USA from 22-27 August 2014 including:

(a) 2x return Qantas Business Class flights issued by Qantas from the winner’s nearest Australian capital city to New York (flight associated taxes are included),

(b) a Priceless Moments package for 2 adults issued by MasterCard including;

• 5 night twinshare stay in a 4-5 star hotel as selected by the Promoter;

• Return Airport/Hotel transfers in New York;

• A welcome reception including a dinner for the winners to meet the other guests on the experience and a night out in New York City.

• personal shopping experience with a personal stylist for 2;

• a New York City guided tour for 2;

• 2 x dinners and 1x lunch in New York City as arranged by MasterCard;

(c) $2,500 USD loaded onto the winner’s Qantas Cash prepaid MasterCard Facility.

15. The total maximum notional value of the Total Prize Pool awarded in this Promotion is AUD $43,395, based on the dollar fare for a commercial Return Qantas Business flight totals AUD $26,771 as at 11 March 2014, $2500 USD priced at $2770.42 AUD as at 14/03/14, and the total Priceless Moments package provided by MasterCard valued at USD $12,500 ($13,853.58 AUD as at 14/03/14). The estimate of the maximum notional value of the Total Prize Pool and Prize is provided for the purposes of licensing this promotion only. The maximum notional value may vary. The Promoter accepts no responsibility for any variation in the maximum notional value of the Total Prize Pool or Prize.

16. The prize is not transferable, non-changeable, non-extendable and may not be exchanged for cash. MasterCard will use its best endeavours to provide the prizes listed in 14(b). If any portion of the prize is unavailable for whatever reason, the Promoter reserves the right to substitute that prize or item for a prize or item of an equivalent value. The winner is responsible for paying all additional costs associated with the prize that are not specifically included (as stated in 14), including (where applicable) transport (including to and from the airport in the winner’s nearest Australian capital city), meal costs, spending money, insurance and all other incidentals. Octagon will fulfil the prize in 14(b) on behalf of MasterCard.

17. The prize includes GST and taxes included in the price of the ticket. Compliance with any health or other government requirements is the responsibility of the prize-winner and companion. The Promoter makes no representation as to the safety, conditions or other issues that may exist at any destination. Prize travel is subject to Qantas’ General Conditions of Carriage.

18. Prize travel, accommodation and restaurant reservations are subject to availability at the time of booking. The winner and their companion must travel together on all prize travel and will not accrue Qantas Points on any element of the prize. An upgrade cannot be purchased on airfares with cash or Qantas Points.

19. Prize travel, accommodation and reservations must be booked at least 4 weeks prior to departure date from Australia. There can be no changes to travel arrangements once tickets have been issued or accommodation and restaurant bookings once the reservations have been confirmed.

20. Each prize must be taken as stated and no compensation will be payable if a winner is unable to use the prize as stated. Prizes are not exchangeable or redeemable for cash or other goods or services. A prize cannot be transferred to any other person, unless agreed to by the Promoter. It is a condition of accepting a prize that the winner accepts the conditions of use of that prize.

21. If the prize (or part of the prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
Right of the promoter to redraw

22. In the event of any entrant being unable to satisfy these terms and conditions, forfeiting or not claiming the Prize by 12.00pm (AEST) on 18 August 2014, the Promoter may conduct such further draws on 18 August 2014 2014 at the same time and place as the original draw as are necessary in order to distribute the Prize if unclaimed by that date subject however to any written directions given under applicable law. Any second chance draw Prize winner will be notified in writing by email (using the details provided in the winner’s Qantas Frequent Flyer online profile or provided via the entry form on www.qantascash.com/newyork at the time of entry) within 2 business days following the draw and their name published at www.qantascash.com/newyork and in The Australian newspaper on 20 August 2014. The winner is responsible for ensuring that his/her contact details in his/her Qantas Frequent Flyer online profile and provided via the entry form at the time of entry is accurate and up to date. The Promoter takes no responsibility for inaccurate or incomplete details.
Limitation of liability and variation of terms

23. The Promoter, its related bodies corporate and their respective officers, employees, contractors and agents (Promotion Parties) will not be liable for any losses, damages, expenses, costs or personal injuries arising out of this promotion, the promotion of this promotion or the use of any prize, including but not limited to any breach of these terms and conditions, contract or tort (including negligence) and any other common law, equitable or statutory remedy (Damages) whatsoever, including but not limited to direct, indirect and consequential Damages, including Damages that cannot reasonably be considered to arise naturally and in the ordinary course of things, even if those Damages were in the contemplation of the Promotion Parties.

24. The exclusion of liability in clause 23 does not apply to limit or exclude liability:

a. for personal injury or death suffered or sustained in connection with the supply of goods or services which are supplied by the Promoter in the ordinary course of business. To remove doubt: third party goods or services, which other than in connection with this promotion, are in the normal course of business supplied by a third party unrelated to the Promotion Parties, are not supplied by the Promoter in the ordinary course of business; and the Promoter’s Conditions of Carriage and general booking conditions (and any exclusions contained therein) apply despite any statement to the contrary in these terms and conditions; or

b. to the extent it is not permissible at law to limit or exclude liability in the manner contemplated in that clause (in which case that liability is limited to the maximum extent allowable by law).

25. If any act, omission, event or circumstance occurs which is beyond the reasonable control of the Promoter and which prevents the Promoter from complying with these terms and conditions, the Promoter will not be liable for any failure to perform or delay in performing its obligations and the Promoter reserves the right (subject to any applicable law) to cancel, terminate or modify or suspend this promotion.
Entry details and privacy

26. Entry details remain the property of the Promoter. The name, photograph of the winner and testimonial from the winner may be used for promotional purposes by the Promoter, unless the winner otherwise notifies the Promoter at the time of accepting a prize. Entrants consent to the Promoter using personal information provided in connection with this promotion for the purposes of facilitating the conduct of the promotion and awarding any prizes, (including to MDSA and any applicable statutory authorities). Without limiting the foregoing, entrants’ personal information provided in connection with this promotion will be handled in accordance with the Promoter’s Privacy Statement, a copy of which is available at available at qantas.com/privacy.
Tax implications

27. The Promoter accepts no responsibility for any tax implications that may arise from accepting a prize. Independent financial advice should be sought.
