Terms and Conditions
1. Information on how to enter & prizes form part of these terms & conditions. Any entry not complying with these terms and conditions is invalid.
2. Entry is open to residents of Australia who are aged 18 years or over and have a valid email address (“Eligible Entrant”). Employees of the Promoter, the Promoter’s associated companies, the Promoter’s agencies associated with this competition and their immediate families are ineligible to enter.
3. The promotion starts on Thursday 1 May 2014 & closes at 5pm Australian Eastern Standard Time (“AEST”) on Saturday 31 of May 2014 (“Promotion Period”).
4. To enter, purchase a minimum $50 worth of any Musashi product/s (“Eligible Purchase”) from a Participating Outlet within Australia and then visit www.winwithmusashi.com find the Promotion page then follow the prompts to submit your entry, including details that appear on your purchase receipt. (Note: keep your original purchase receipt showing your Eligible Purchase safe for every entry you make online until after the unclaimed prize draw.)
5. Entry is limited to once per Eligible Purchase, provided entry does not exceed once per calendar day. Any form of automated entry using any other devices or software is invalid. Entry is further limited to no more than one entry in any calendar day per residential address (“Household”).
6. Entrants must keep their original purchase receipt each Eligible Purchase safe for every entry made until after the unclaimed prize draw. The Promoter reserves the right to require any entrant to provide the proof that every entry they made was valid before awarding the prize. Further, the Promoter may require the winner to present the original purchase receipts showing the Eligible Purchase for every entry made by their Household, including non-winning entries. The Promoter retains the absolute discretion to require any entrant, (including groups of entrants in the same Household), to provide proof of residency at the Household address shown on their entry before awarding a prize.
7. The Promoter reserves the right to verify the validity of all entries and reserves the right to disqualify any individual entrant or group of entrants for tampering with the entry process, including but not limited to the utilisation of techniques designed to make multiple entries that are not associated with a separate Eligible Purchase, or for submitting an entry which is not otherwise in accordance with these conditions of entry.
8. In the case that the Promoter finds evidence of tampering by the entrant in the entry process or the verification process, in addition to declaring any or all entries made by the entrant invalid, the Promoter may in its complete discretion preclude that entrant from participation in any or all future promotions of the Promoter.
9. All valid entries received during the Promotion Period will be entered into the Major Prize Draw.
10. Major prize is an XBOX 1 Prize pack – including an XBOX 1 console and accompanying elements, plus two compatible XBOX 1 games – “Titan Fall” and “NBA 2K14”. The total prize pack is valued at $795 recommended retail price (“RRP”). There are a total 50 prize packs to be awarded. The trade mark owners of the compatible XBOX 1 games included with the prize are not associated with, nor a sponsor of this promotion.
11. The Major prize draw will be conducted at 11am on Monday 2 June 2014 at Prime Focus Suite 403 / 62 Beach Street Melbourne VIC 3207. The first 50 valid entries drawn from all valid entries received will each win a Major Prize.
12. All winners will be notified in writing within 48 hours of the prize draw via the email address they supplied with their entry. The name and postcode of each winner will be announced on the Musashi Facebook page (https://www.facebook.com/MusashiNutrition) from 5pm on Tuesday 3 June 2014.
13. Total prize pool is valued at $39,750 RRP.
14. Prizes are not transferable & cannot be taken as cash.
15. Prize values are correct at time of printing but no responsibility is accepted for any variation in the value of the prize.
16. The Promoter is not liable for any loss or damage whatsoever which is suffered, including but not limited to indirect or consequential loss, or for personal injury suffered or sustained during the course of accepting or using the prize, except for any liability which cannot be excluded by law.
17. Each entry becomes the property of the Promoter. All details will be held in accordance with the Nestlé Privacy Policy which can be accessed by visiting www.musashi.com.au or calling 1800 005 510. An entrant’s details may only be used to contact the entrant about the Promoter, its related companies, their brands, special offers, samples, consumer research and other promotions if the entrant consents to that use, for example by ticking an “opt in” box on an entry form.
18. Promoter’s decision is final and no correspondence will be entered into.
19. If any prize remains unclaimed by Monday 1 September 2014 despite the Promoter’s best efforts to contact a winner, then subject to any written directions given by a relevant lotteries or gaming authority the Promoter may conduct an unclaimed prize draw at 12 noon at the same place as the original draw on that date to distribute any unclaimed prizes. The first valid entry drawn will win an unclaimed prize and the draw will continue until all unclaimed prizes have been awarded. Any winner of such a draw will have their name and postcode announced on the Musashi Facebook page (https://www.facebook.com/MusashiNutrition) from 5pm on Tuesday 2 September 2014.
20. Each winner should look to the manufacturer of products and provider of services awarded as prizes for all warranties. However, these terms and conditions do not exclude or limit the application of any statutory provision (including a provision of the Competition and Consumer Act 2010) where to do so would contravene that statute or cause any part of these terms and conditions to be void.
21. Subject to the approval process required by any relevant gaming or lotteries authority, in the event that any prize item is unavailable despite the Promoter’s reasonable endeavours to procure within Australia, the Promoter reserves the right to substitute a different prize item of equal or greater value.
22. Prizes will only be delivered in Australia and each winner should allow 28 days from the prize draw for delivery of their prize.
