INTEL® AUSTRALIA HOLIDAY SPECIAL CONSUMER CAMPAIGN
TERMS & CONDITIONS

IMPORTANT: PLEASE READ THESE TERMS AND CONDITIONS (THESE “TERMS AND CONDITIONS”) BEFORE ENTERING THE CAMPAIGN. THIS IS A LEGALLY BINDING AGREEMENT BETWEEN YOU AND INTEL ESTABLISHING THE TERMS AND CONDITIONS UNDER WHICH YOU ARE ENTITLED TO PARTICIPATE IN THE CAMPAIGN. BY ENTERING THE CAMPAIGN, YOU CONFIRM THAT YOU HAVE READ AND UNDERSTOOD, AND AGREE TO ABIDE BY, THESE TERMS AND CONDITIONS.

Promoter
1. This INTEL® AUSTRALIA HOLIDAY SPECIAL CONSUMER CAMPAIGN (“Campaign”) is promoted by Intel
Australia Pty Ltd, ABN 59 001 798 214, 111 Pacific Hwy, North Sydney NSW 2060 (“Intel”).

Eligibility
2. This Campaign is open only to Australian residents aged 18 years or over who can participate in the Envelope Pick at Melbourne on 18th January 2019 in accordance with paragraphs 23 and 24.

3. Not eligible:
The following persons are not eligible to participate in the Campaign:
▪ Employees, directors, officers and management of Intel and their immediate family members.
▪ Employees,directors,officersandmanagementofanypartythatisdirectlyinvolvedinorganizing,promotingor
conducting the Campaign and their immediate family members.
▪ Any Intel customer, channel partner, consumer electronics store owner, retail sales person at a Store, PC
channel dealer, etc., or anyone selling a personal computer.
▪ EmployeesofexternalauditorswhoaredirectlyinvolvedintheCampaignandtheirimmediatefamilymembers.
Campaign Period
4. The Campaign period (“Campaign Period”) shall be from 18 November 2018 to 11.59pm (AEDT) on 29 December
2018. Entries submitted outside the Campaign Period shall be void.
5. The Campaign Period shall be divided into 6 Sunday-Saturday entry weeks, as follows:
▪ Entry Week 1: 18 November 2018 – 24 November 2018;
▪ Entry Week 2: 25 November 2018 – 1 December 2018;
▪ Entry Week 3: 2 December 2018 – 8 December 2018;
▪ Entry Week 4: 9 December 2018 – 15 December 2018;
▪ Entry Week 5: 16 December 2018 – 22 December 2018; and ▪ Entry Week 6: 23 December 2018 – 29 December 2018, each an “Entry Week”. All times are in AEDT.
Participating Stores
6. The Campaign will run in participating JB Hi Fi, The Good Guys, Bing Lee, , and Costco Wholesale stores (“Stores”)
in Australia. The Stores include the online stores at https://www.jbhifi.com.au/, https://www.costco.com.au/, https://www.binglee.com.au/ and https://www.thegoodguys.com.au/.
Mechanics
7. To enter, you must, during the Campaign Period:
a. purchase a Celeron/Pentium, Core i3, Core i5, Core i7/9 or any Optane PC from a Store (“Qualifying
Purchase”); and
b. visit promotions.intel.com (“Website”), locate the entry page and fill out and submit the online entry
form, including by uploading an image of the Qualifying Purchase receipt, and providing all other
requested information.
8. The number of entries you receive will depend on your Qualifying Purchase, which are as follows:
▪ Celeron/Pentium = 1 entry; ▪ Core i3 = 2 entries;
▪ Core i5 = 4 entries;
▪ Core i7/9 = 10 entries; or
▪ Any Optane = 15 entries.
9. Your purchase receipt must clearly identify where the Qualifying Purchase was made, the product/s purchased (which must be a Qualifying Purchase) and the date of purchase (which must be during the Campaign Period before you submitted your entry). Intel is not responsible if your mobile device/desktop is not sufficiently capable for the purpose of submitting an entry, including having the requisite photograph capability.
10. Your entry/ies must be received during the Campaign Period and will be deemed to be received only when received by Intel. If you return a Qualifying Purchase your entry/ies may be deemed invalid at Intel’s discretion (unless the product is defective). You will receive a return message confirming your entry/ies. Intel is not liable for any problems with communications networks. You are responsible for your own costs associated with entering. If you enter using

automatically generated entries or multiple phone numbers/email addresses/addresses/aliases, you may be
disqualified.
11. You can enter multiple times, provided you only enter once per Qualifying Purchase. Each entry must be submitted
separately in accordance with these Terms and Conditions.
12. You must keep the original itemised purchase receipt as proof of purchase for all entries. If you don’t produce the
above proof of purchase for all entries when asked Intel may disqualify all of your entries and you will lose any right to a prize. Proof of purchase must be identical to that provided by you with your entry. If, in Intel’s opinion, you have shared any proof of purchase with another person, your entries will be invalid and you will lose any right to a prize.
Determination of Winners
13. There will be 6 winners determined in respect of this Campaign – 1 per Entry Week.
14. There will be 6 draws conducted – 1 per Entry Week.
15. The draws will be held commencing at 12noon at Prime Focus, Level 1, 500 Chapel St South Yarra VIC 3141 on
each of:
▪ Entry Week 1: 26 November 2018; ▪ Entry Week 2: 3 December 2018;
▪ Entry Week 3: 10 December 2018; ▪ Entry Week 4: 17 December 2018; ▪ Entry Week 5: 2 January 2019; and ▪ Entry Week 6: 2 January 2019.
16. The first valid entry drawn randomly in each draw from the entries received during the relevant Entry Week will win a prize.
17. Intel may arrange to draw additional reserve entries in a draw and record them in order, in case a winning entry/entrant is deemed invalid or a prize is unclaimed (“Reserve Entrants”).
18. Entries received in respect of each draw will not roll over to subsequent draws.
19. Winners will be notified in writing by email within two days of determination.
20. Winners will have their name and state/territory of residence published on the Website on the following date for a
period of 28 days:

By entering, you request that your full address not be published.
21. Winners must confirm their participation in the Envelope Pick by 10am (AEDT) on 7th January 2019. If participation has not been confirmed by this date or if, after making all reasonable attempts, Intel can’t contact a winner (or a winner does not contact Intel) by this date, the relevant entry/ies will be discarded and Intel will re-award the relevant prize/s to Reserve Entrant/s and/or carry out an unclaimed prize draw at 12pm (AEDT) on 7th January 2019 at the same location as the original draws to randomly distribute the prize/s amongst valid entrants. Any winner/s will be informed in writing by email within two days of determination and will have their name and state/territory of residence published on the Website on 7th January 2019 for a period of 28 days.
Terms Related to the Prizes
22. Each winner will win the opportunity to participate in the Envelope Pick for the chance to win $20,000 or $1,000, in accordance with the following paragraphs.
23. Each winner can participate in the Envelope Pick in one of the following ways:
a. in person, by attending the Melbourne location of the Envelope Pick at the time and date specified by
Intel (at their own cost);
b. via Skype call, using the details provided by Intel, and at the time and date specified by Intel (at their
own cost); or
c. by nominating a proxy to attend the Melbourne location of the Envelope Pick at the time and date
specified by Intel (at the winner’s own cost) on the winner’s behalf. The winner must nominate a suitable proxy within the time period specified by Intel. If a winner nominates a proxy, the winner accepts all decisions made by the proxy. For the purposes of these Terms and Conditions, all references to a winner will also be deemed to apply to that winner’s proxy, if relevant. The proxy must:
i. be aged 18 years or over and able to attend the Envelope Pick at the time and date specified;
ii. accept and agree to be bound by these Terms and Conditions and any additional conditions provided by Intel or prize supplier/s and must sign any document Intel requires for this purpose;
and
iii. accept that they will not receive any prizes awarded at the Envelope Pick on behalf of the
relevant prize winner.
24. “Envelope Pick”: The Envelope Pick will take place at the time, date and Melbourne location specified by Intel.
Each winner (or their proxy) must follow the instructions provided by Intel in relation to their participation in the Envelope Pick, depending on their method of participation (either in person or via Skype). At the Envelope Pick,

each winner (or each winner’s proxy) will be given the chance to choose one (1) envelope from a set of 100 envelopes. Each winner (or proxy) will have a separate set of 100 envelopes to choose from. In each set of 100 envelopes, one of the envelopes will award $20,000 cash (in the form of a deposit into an Australian bank account of the winner) and the remaining envelopes will award $1,000 (in the form of a deposit into an Australian bank account of the winner). Each winner will win the prize that they (or their proxy) selects. Each winner (or the winner’s proxy) will have only one chance to select a prize envelope, and must not touch, handle or interfere in any way with any of the other envelopes.
25. The total prize pool is up to $120,000. All values are in AUD.
26. Prizes and all elements of prizes must be taken as and when offered or will be forfeited, and if forfeited, Intel will not
be liable. Prizes are subject to any additional terms and conditions imposed by the relevant supplier or Intel, including, as relevant conditions of entry into any event venues (including behaviour requirements and applicable dress codes).
27. You are responsible for all other unspecified costs related to the Envelope Pick and the prize, including transport, etc.
28. Any failure by you to comply with the conditions imposed by the prize supplier(s) may result in the prize being cancelled or withdrawn without liability for Intel or the prize supplier(s).
29. You must, if required by Intel, sign disclaimer and release forms provided by Intel in favour of Intel and other parties before taking the prize. If you do not sign, your entry will be deemed invalid and you will lose any entitlement to a prize.
30. If you in the opinion of Intel (and/or a medical professional, as relevant to the circumstances), are intoxicated, under the influence of alcohol or any other drug, behave aggressively or offensively, or behave in a manner which may diminish the good name or reputation of Intel or any of its related entities or the agencies or companies associated with this Campaign, is contrary to law or is otherwise inappropriate, Intel may cancel the prize or restrict you from participating in any elements of the prize, at its discretion.
31. Prizes cannot be transferred or exchanged. Without limiting any other term of these Terms and Conditions, all prizes (and elements of prizes) must be taken as and when specified, or will be forfeited with no replacement. You agree that if a prize (or element of a prize) is unavailable for any reason Intel may provide another item of equal or higher value, subject to any necessary approval by the state/territory gaming authorities.
32. If the prize is a manufactured item or a service provided by a third party, it shall be subject to the third party’s terms and conditions for warranty, service and maintenance, and Intel does not accept any responsibility for these. Intel is not responsible for the performance of the manufactured item or service. Further, Intel is not responsible or liable for any claim, damage, loss, expense, death or personal injury (even if caused by negligence) suffered by the participant arising out of or in connection with (a) the offer of the manufactured item or service, (b) the conduct of the respective manufactured item or service provider and/or (c) the acceptance or use of the free software or service herein, except for any liability which cannot be excluded by law.
33. Prizes are provided by Intel “AS IS” without warranties of any kind, including warranties of merchantability, satisfactory quality, non-infringement of intellectual property, or fitness for any particular purpose, and the user of each prize shall use that prize at his/her own risk. Intel gives no warranty/guarantee and makes no representation whatsoever regarding the prizes, and the respective user(s) of each prize shall use the prize at his/her/their own risk.
Taxes and other levies
34. Intel is not responsible for any tax implications arising from you winning a prize. You should seek independent financial advice. If for GST purposes this Campaign results in any supply being made for non-monetary consideration, you must follow the Australian Taxation Office’s stated view that where the parties are at arm’s length, goods and services exchanged are of equal GST inclusive market values.
Promotional activities
35. If you are a winner or a proxy, you must take part in all publicity, photography and other promotional activity as Intel requires, without any compensation. You consent to Intel using your name/s and image/s in any promotional or advertising activity.
Limitation of liability; Indemnity
36. Nothing in these Terms and Conditions restricts, excludes or modifies any consumer rights under any statute including the Competition and Consumer Act 2010 (Cth).
37. Subject to the previous paragraph, Intel and the agencies and companies associated with this Campaign are not liable (including in negligence) for any loss (including indirect, special or consequential loss or loss of profits), expense, damage, personal injury, illness or death suffered in connection with this Campaign or any prize, except for any liability which under statute cannot be excluded (in which case that liability is limited to the greatest extent allowed by law).
38. Without limiting the previous paragraph, Intel and the agencies and companies associated with this Campaign are not liable for any loss of, damage to or delay in delivery of prize/s.
39. This Campaign is in no way sponsored, endorsed or administered by, or associated with any social media platform, including Facebook, Instagram and Twitter. You provide your information to Intel and not to any social media platform. You completely release any relevant social media platforms from any and all liability.

40. Intel is not liable for entries, prize claims or correspondence that are misplaced, misdirected, delayed, lost, incomplete, illegible or incorrectly submitted.
Validity and Intel’s decision final and binding
41. All matters and disputes arising out of or in connection with the Campaign and/or these Terms and Conditions shall be subject to the sole decision of Intel, and Intel’s decision shall be final and binding on all parties. No correspondence will be entertained.
42. If you or your entry are deemed by Intel to breach these Terms and Conditions, your entry (or at Intel’s discretion, all of your entries) may be discarded. Intel may, at any time, require you to produce documentation to establish to Intel’s satisfaction the validity of your entries (including documentation establishing your identity, age, place of residence and place of employment). Failure by Intel to enforce any of its rights at any stage does not waive those rights.
Privacy
43. Intel may collect your/your proxy’s personal information directly or through its agents or contractors. Intel will use your/your proxy’s personal information to conduct and manage the Campaign. Intel may disclose your/your proxy’s personal information to its related companies, agents and contractors to assist in conducting this Campaign, communicating with you/your proxy or storing data. This may include disclosures to organisations outside Australia including in places such as Argentina, Austria, Brazil, Canada, China, Costa Rica, Denmark, Egypt, Finland, France, Germany, Hong Kong, India, Ireland, Israel, Italy, Japan, Malaysia, Mexico, Netherlands, Philippines, Poland, Romania, Russian Federation, Singapore, South Korea, Sweden, Switzerland, Taiwan, Turkey, United Kingdom, United States, United Arab Emirates, and Vietnam. Intel’s Privacy Policy (see http://www.intel.com/privacy) includes information about:
a. how to seek access to the personal information Intel holds about you and seek correction of the information; and
b. how to complain about a privacy breach and how Intel will deal with such a complaint.
No cheating tolerated
44. You must not:
a. tamper with the entry process;
b. engage in any conduct that may jeopardise the fair and proper conduct of the Campaign;
c. act in a disruptive, annoying, threatening, abusive or harassing manner;
d. do anything that may diminish the good name or reputation of Intel or any of its related entities or of the
agencies or companies associated with this Campaign;
e. breach any law; or
f. behave in a way that is otherwise inappropriate.
45. ANY ATTEMPT BY A PERSON TO DELIBERATELY DAMAGE ANY OF INTEL’S WEBSITES OR UNDERMINE THE LEGITIMATE OPERATION OF THE CAMPAIGN MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS; AND SHOULD SUCH AN ATTEMPT BE MADE, INTEL RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.
Modification of these Terms and Conditions, etc.
46. If this Campaign cannot run as planned for any reason beyond Intel’s control, for example due to software, hardware or communications issues, unauthorised intervention, tampering, fraud or technical failure, Intel may end, change, suspend or cancel the Campaign or disqualify affected entries/entrants, subject to any necessary approval by the state/territory gaming authorities.
No third party rights
47. A person who is not a party to this agreement shall not have any rights to enforce any of its terms. For the purposes of this paragraph, “person” shall mean a human being or a corporate entity (whether or not having a separate legal personality), as the case may be.
