Qantas Luggage ‘Live Your Dream Competition’ (Promotion)

1. Information on how to enter forms part of the terms and conditions of entry. Entry into the Promotion is deemed acceptance of these terms and conditions.

2. The promoter is David Jones Limited (ABN 75 000 074 573) of 8th Floor, 86-108 Castlereagh Street, Sydney, NSW, 2000 02 9266 5000.

3. The Promotion commences at 12.01am (ADST) on 02 April 2014 and closes at 11.59pm (ADST) on 15 May 2014 (Promotion Period.)

4. Entry is open only to Australian residents of 18 years of age and over and who are members of the Qantas Frequent Flyer Program (Eligible Entrant). You must be a current member of the Qantas Frequent Flyer program to earn and redeem Qantas Points. 5. Eligible Entrants must complete all of the following steps during the Promotion Period:
a. register for the Promotion by visiting www.davidjones.com.au/liveyourdream
b. purchase any suitcase from the Qantas Luggage range from David Jones during the Promotion Period and retain the purchase receipt as proof of purchase; and
c. submit an answer (in 50 words or less) to the question ‘How would you live your dream spending 500,000 Qantas Points.’

6. If an Eligible Entrant is also a holder of a David Jones American Express Card, they will receive a bonus prize if selected as a prizewinner. (Qantas luggage and travel accessories pack valued at RRP $2,000.)

7. An Eligible Entrant is entitled to one entry into the competition for every piece of Qantas Luggage they purchase from David Jones during the Promotion Period.

8. Eligible Entrants exclude:
a. employees, directors, management, licensees and contractors of the Promoter, its related companies and agencies associated with the Promotion;
b. the immediate families of the above listed persons;
c. the retailers of and suppliers to the Promoter; and
d. members whose Qantas Frequent Flyer account is suspended, cancelled or otherwise terminated at any time during the Promotion Period or at the time of the draw or any redraw (as applicable).

9. This competition is a game of skill. All entries will be judged on their merits based on creativity and originality.

10. There will be 4 prize winners. The best entries as determined by the judges will win the prizes set out in clause 15.

11. The winner will be selected by a panel of judges at the Promoter’s offices at 8th Floor, 86-108 Castlereagh Street, Sydney, NSW, 2000 on the 15th of May at 11am. The judges’ decision will be final and binding and no correspondence will be entered into.

12. The Promoter is not responsible for any technical malfunction of any communications network or any late, lost, incorrectly submitted, delayed, ineligible, incomplete, corrupted or misdirected entry whether due to error, transmission interruption or otherwise. The time of entry will be deemed to be the time the entry is received by the Promoter.

13. The winners will be announced on 18 May 2014 on www.davidjones.com.au/liveyourdream. The decision is final and no correspondence will be entered into.

14. The winners will be contacted by email (using the details provided in the winners’ registered entry) by 20 May 2014. The winners are responsible for ensuring that their contact details in their competition entry are accurate and up to date. The Promoter takes no responsibility for inaccurate or incomplete details.

15.The prizes are as follows:
a. The first prize is 500,000 Qantas Points.
b. The second prize is 100,000 Qantas Points.
c. The third prize is 100,000 Qantas Points.
d. The fourth prize is 100,000 Qantas Points.

Eligible Entrants should note that Qantas Points may take up to 2 weeks to be credited to each winner’s account from the announcement date (or any review date, as applicable).

16. The maximum notional total first prize value is AU$4,352.12 as at 26 February 2014, based on a sample of the Qantas Frequent Flyer reward options (Awards) that could be obtained by redeeming 500,000 Qantas Points through the Qantas Frequent Flyer program (as more fully defined in the terms and conditions of the Qantas Frequent Flyer program available at qantas.com/terms). The maximum notional value of the 100,000 Qantas Points of the Second to Fourth prizes is AU$1,116 each, based on a sample of the Awards that could be obtained by redeeming 100,000 Qantas Points through the Qantas Frequent Flyer program. For example, 449,000 Qantas Points could be redeemed for 2 adult return Economy Qantas Classic Award flights from Sydney to London (subject to Award flight availability) including applicable taxes, fees and carrier charges. As at 26 February 2014, the dollar fare for an equivalent commercial return Economy flight totals AU$4,352.12. For example, 92,000 Qantas Points could be redeemed for four adult one way Economy Qantas Classic Award flights from Melbourne to Perth (subject to Award flight availability) including applicable taxes, fees and carrier charges. As at 26 February 2014, the dollar fare for an equivalent commercial one way Economy flight totals AU$ $1,116.17. The estimate of the maximum notional value is provided for the purposes of this Promotion only. The maximum notional value will vary depending on how the Qantas Points are redeemed by a winner through the Qantas Frequent Flyer program. The Promoter accepts no responsibility for any variation in the maximum notional value of the prize.

18.Each prize must be taken as stated and no compensation will be payable if a winner is unable to use the prize (or any part of the prize) as stated. Any part of a prize that cannot be taken as stated will be forfeited. The prize is not transferable to another person (unless agreed by the Promoter) and cannot be exchanged for other goods and services or redeemed for cash or other goods or services. If the prize (or part of the prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written direction given under applicable law.

19. The Qantas Points must be redeemed, in accordance with and subject to the Qantas Frequent Flyer program Terms and Conditions (qantas.com/terms), the Qantas Frequent Flyer Store Terms of Use [Link to-https://store.qantas.com/termsofuse.a2], voucher terms and conditions (including expiry rules) and any other terms and conditions disclosed at the time of redemption. The redemption of Qantas Points is subject to the availability of Awards that may be obtained through the Qantas Frequent Flyer program.

20. In the event that Qantas Points are redeemed for Award travel, each winner should be aware that the number of Award flight seats available is limited and availability depends on the flight, date, season and destination and some flights may not have any Award seats available. Each winner will be responsible for all applicable taxes, fees and carrier charges of Award travel or accommodation booked by redeeming their prize. Taxes, fees and carrier charges vary depending on departure points, routes, exchange rates and dates of travel, are subject to change without notice and are quoted at the time of booking. Award flights must be booked at least 24 hours before scheduled departure (and other advance booking requirements may apply). Award travel is subject to the fare rules and the Conditions of Carriage of the relevant carrier. Compliance with immigration, health or other government requirements is the responsibility of each winner.

21. The Promoter reserves the right to request a winner to provide proof of purchase, proof of identity, age and place of residency in order to claim any prize. Proof of purchase, proof of identification, age, and residency considered suitable for verification is at the discretion of the Promoter. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

22. The Promoter reserves the right to disqualify any entrant who is in breach of these terms and conditions of entry or who manipulates, seeks to manipulate or benefits from manipulating, the entry process or the Promotion.

23. If any act, omission, event or circumstance occurs which is beyond the reasonable control of the Promoter and which prevents the Promoter from complying with these terms and conditions of entry, the Promoter will not be liable for any failure to perform or delay in performing its obligations and the Promoter reserves the right (subject to any applicable law) to cancel, terminate or modify or suspend this Promotion.

24. The Promoter and each of their respective officers, employees, contractors and agents (Promotion Parties) will not be liable for any losses, damages, expenses, costs or personal injuries arising out of this Promotion, the promotion of this Promotion or the use of any prize, including but not limited to any breach of these terms and conditions, contract or tort (including negligence) and any other common law, equitable or statutory remedy (Damages) whatsoever, including but not limited to direct, indirect and consequential Damages, including Damages that cannot reasonably be considered to arise naturally and in the ordinary course of things, even if those Damages were in the contemplation of the Promotion Parties.

25. The exclusion of liability in clause 24 does not apply to limit or exclude liability:
a. for personal injury or death suffered or sustained in connection with the supply of goods or services which are supplied by the Promoter in the ordinary course of business. To remove doubt: third party goods or services, which other than in connection with this Promotion, are in the normal course of business supplied by a third party unrelated to the Promotion Parties, are not supplied by the Promoter in the ordinary course of business; or
b. to the extent it is not permissible at law to limit or exclude liability in the manner contemplated in that clause (in which case that liability is limited to the maximum extent allowable by law).

26. The Promoter reserves the right to choose a new winner in the event of a winner being unable to satisfy these Promotion terms and conditions of entry or forfeiting or not claiming a prize. The Promoter will use all reasonable efforts to contact each winner using the contact details provided in their Qantas Frequent Flyer online profile, however if a winner remains uncontactable after 3 months from the date of the draw their prize will be considered forfeited. For any prize that remains unclaimed or forfeited (through ineligibility or otherwise) as at 3 months from the date of the original draw, the Promoter will choose a new winner for an unclaimed prize at 12 noon (ADST) on 15 September 2014, subject to any written direction given under applicable law. The first, and subsequent (if required) entries chosen will be notified by email and phone (using the details provided in the winner’s competition registered entry) within 2 business days after the judgment.

27. Entry details remain the property of the Promoter. The name and photograph of the winners may be used for promotional purposes by the Promoter, unless a winner otherwise notifies the Promoter at the time of accepting the prize. Entrants consent to the Promoter using personal information provided in connection with this Promotion for the purposes of facilitating the conduct of the Promotion and awarding any prizes (including to third parties involved in the Promotion and any applicable statutory authorities). Without limiting the foregoing, entrants’ personal information provided in connection with this Promotion will be handled in accordance with the Promoter’s Privacy Statement (a copy of which is available at davidjones.com.au).

28. The Promoter accepts no responsibility for any tax implications that may arise from accepting the prize. Independent tax and financial advice should be sought.
