Moet “Moet Can Buy” Promotion Monday 22 September – Sunday 19 October 2014

1. Information on how to enter and prizes form part of these Terms and Conditions (Conditions). Entry into the ‘Dan Murphy’s Moet promotion’ (Promotion) is deemed acceptance of these Conditions.
2. Entry is only open to residents of Australia aged 18 years or older who, in the event they are a winner, are able to travel to and remain in France during the relevant travel period in order to participate in the Major Prize as described below. The directors, management and employees (and their immediate families) of the Promoter, its related entities, printers, suppliers, providers and agencies who are directly associated with the conduct of this Promotion, are ineligible to enter.
3. All entrants acknowledge that the Promoter can rely on these Conditions even if the Promoter only learns of an entrant’s ineligibility after the Promoter has awarded a prize to the ineligible person. Return of a prize or payment of its equivalent value to the Promoter may be required by the Promoter if this occurs.

4. The Promotion starts at 12.01 (AEST) on 22 September 2014 and ends at 23.59 (AEST) on 19 October 2014 (Promotional Period).

How to enter
5. To enter, individuals must complete the following steps during the Promotional Period:
a. purchase any of the following Moët et Chandon products from any Dan Murphy’s store in Australia during the Promotional Period (each an Eligible Purchase):
• Grand Vintage 750mL
• Rose Imperial 750mL
• Brut Imperial 375mL
• Brut Imperial 750mL
• Brut Piccolo 200mL
• Diamond Suit 750mL
• Rose Diamond Suit 750mL • Nectar Imperial 750mL

c. visit the “Moet Can Buy” competition page at: www.danmurphys.com.au/Moet;
d. select the tick box to “opt in” to receive Dan Murphy’s email communications; and
e. complete all mandatory fields and submit the online entry form. In completing the online entry form, entrants must include their full name, valid email address, and phone number.
6. Incomplete or indecipherable entries will be deemed invalid.
7. Multiple entries are permitted, provided that:
a. only one entry into the Promotion may be submitted per Store Receipt evidencing the purchase of one or more Eligible Purchase(s);
• Brut Imperial 1.5L
b. retain the store receipt of their Eligible Purchase (Store Receipt) as proof of
the Eligible Purchase;
b. each entry must be submitted separately and must independently comply with these Conditions; and
c. a maximum of one prize may be won by any individual.
8. Failure to produce the original Store Receipt(s) for all entries upon request may, in the absolute discretion of the Promoter, result in invalidation of all of an entrant’s entries and forfeiture of any right to a prize.
9. Any entry that contains content that the Promoter, in its sole discretion, considers to be offensive, crude or inappropriate in any way or that the Promoter considers may infringe any intellectual property rights or other rights of any person, corporation or entity will not be accepted as an eligible entry into the Promotion.
10. Entries will be deemed to be received at the time of receipt by the Promoter and not at the time of submission by the entrant. The Promoter does not accept responsibility and is not liable for late, lost, incomplete, incorrectly submitted, delayed, illegible, corrupted or misdirected entries, claims or correspondence due to error, omission, tampering, deletion, theft, communications failure or otherwise. The Promoter has no control over communications networks and is not liable for any problems associated with them due to traffic congestion, technical malfunction or otherwise. The Promoter is not liable for any consequences of user error including (without limitation) costs incurred.
11. The use of any automated entry software or any mechanical, electronic or other means that allows an Entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that Entrant invalid.
Draws and prizes
12. A prize draw will take place at Red Jelly at 34–36 Elizabeth Street Hobart TAS on Monday 20 October 2014 at 12pm. The first valid entry randomly drawn will win the Major Prize (described below), the second valid entry randomly drawn will win the Second Prize (described below) and the subsequent 14 valid entries randomly drawn thereafter will win the Third Prize (described below). The winners will be notified in writing by Friday 24 October 2014. A notice will run in The Australian newspaper on Friday 31 October 2014. In the event that there are unclaimed prizes, a second draw will take place at the same time and place as the original draw on 16 January 2015. The winner(s) will be notified in writing by Friday 23 January 2015. A notice will run in The Australian newspaper on Friday 23 January 2015.
13. There are a total of fourteen (14) prizes to be won are as follows:
a. one (1) Moët et Chandon Experience, which includes:
i. two (2) return business class flights from the Australian capital city closest to the winner’s home including airport transfers and booking costs (valued at up to $23,320);
ii. return airport transfers and 5 star accommodation in Paris for two (2) nights (valued at $2,640);
iii. return transport and 4 star accommodation in Epernay for one (1) night (valued at $2,475);
iv. an overnight trip to the Champagne region in Epernay for a luxury Moët et Chandon VIP tasting experience (valued at $1,100);
v. return transport from the hotel and two (2) one-day exclusive VIP passes to the 2015 Roland Garros French Open Tournament during Week 1 hosted by Moët et Chandon (valued at $2,530);
vi. a glamourous Moët et Chandon VIP dinner experience and gift items in Paris (valued at $2,420), total first prize value $34,485.00,
(the Major Prize);
b. one (1) Moët et Chandon Dinner, which includes:
i. stylised VIP Moët et Chandon dinner party experience for up to ten (10) people (valued at $17,950); and
ii. a 3 course dinner, matched to the extensive Moët et Chandon Champagne portfolio with live entertainment and an exclusive host (valued at $3,800), total second prize value $21,750.
(the Second Prize);
c. twelve (12) individual magnum bottle of Moët et Chandon Brut Imperial (each valued at $151.80 – total $1821.60) + 6 Moet glasses (each valued at $140 – total $1680) = value of $3501.60 + delivery $264 = $3765.60
14. The total combined value of the prize pool for this Promotion is up to $60,000.60 (including GST).
Specific prize conditions
Major Prize
15. The Major Prize must be taken between 24 and 31 May 2015 (subject to availability) and as mutually agreed between the winner and the Promoter. If travel dates cannot be agreed upon, then the Major Prize must be taken on the dates determined by the Promoter in its absolute discretion. All components of the Major Prize must be taken together and when offered. Any element of the Major Prize not taken at the time offered will be forfeited and will not be redeemable for cash.
16. The winner and their travel companion (if any) must travel together and depart from and return to the same departure point. The Winner and their travel companion must cover the costs of travel over $440 each way) in order to make their way to their nearest Australian capital city for flight departure. If the winner is from Tasmania, the Australian Capital Territory or the Northern Territory, connecting economy class flights from the capital city of those states/territories to an international flight departure capital city (as determined by the Promoter in its sole discretion) will be included in the Major Prize.
17. The winner and their travel companion (if any) may not accrue frequent flyer points. Use of the Major Prize and any tickets, passes or vouchers issued as part of the Major Prize may be subject to prevailing supplier terms and conditions of use. Major Prize elements may not be redeemed in conjunction with other travel discounts or special offers.
18. All additional costs not expressly stated, but which may be incurred in acceptance and use of the Major Prize, are the responsibility of the winner and their travel companion (if any). Such additional costs include, but are not limited to, additional meals and beverages, room service, telephone calls, laundry services, additional spending money, transport to and from airport departure points if valued at over $450 one-way, other transfers, travel insurance, destination taxes including arrival and
departure taxes (if applicable) but excluding airfare related taxes and charges. A winner may be required to present a credit card to cover such incidental charges at the time of checking-in to the relevant accommodation.
19. The winner is solely responsible for their entry and the entry of their travel companion (if any) into France, at their own expense, including ensuring all necessary passports, visas, travel authorisations, medical advice and recommended vaccinations and immunisations have been obtained prior to travel and, if required, on or by a date nominated by the Promoter. Failure to do so may result in the Major Prize being forfeited.
20. The Major Prize does not include travel insurance. The winner and their travel companion are responsible for obtaining appropriate insurance coverage in relation to the Major Prize. Without limitation, the Promoter is not liable for any loss howsoever suffered or sustained by the winner or their travel companion in the redemption of the Major Prize.
Second Prize
21. The Second Prize must be taken before 31 January 2015 and as mutually agreed between the winner and the Promoter. If the redemption date cannot be agreed upon, then the Second Prize must be taken on the date determined by the Promoter in its absolute discretion. The Second Prize may be redeemed in either the winner’s home (provided that it is within a 20km radius of an Australian capital city) or at a Moët venue in the central business district of the Australian capital city closest to the winner’s home.
General conditions
22. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash. The Promoter accepts no responsibility for any tax implications that may arise from prize winnings. Independent financial advice should be sought. The Promoter accepts no responsibility for any variation in prize value. All prize values are the recommended retail price including GST at the time of printing (assuming departure from Sydney). The Promoter accepts no responsibility for change in prize value between now and the ultimate prize redemption date.
23. If this Promotion is not capable of running as planned for any reason beyond the reasonable control of the Promoter, including but not limited to war, terrorism, state of emergency or disaster (including natural disaster), infection by computer virus, bugs, tampering, unauthorised intervention, technical failures or anything which corrupts or affects the administration, security, fairness, integrity or proper conduct of this Promotion, the Promoter reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the Promotion and/or if necessary, to provide an alternative prize or prizes to the same value as an original prize(s), subject to regulatory approval.
24. The Promoter’s decision is final and no correspondence will be entered into.
25. Entrants can only enter in their own name. Entrants who provide incorrect, misleading or fraudulent information are ineligible to participate in the Promotion and all entries of an entrant who is deemed by the Promoter to have provided incorrect, misleading or fraudulent information may, at the discretion of the Promoter, be deemed invalid. The Promoter reserves the right to request the entrant produce (within the requested time) appropriate photo identification or other documentation (to the Promoter’s satisfaction, at its sole discretion) in order to confirm the entrant’s identity, age, residential address, eligibility to enter and claim a prize, and any information submitted by the entrant in entering the Promotion, before issuing a prize. If the documentation required by the Promoter is not received by the Promoter (or its
nominated agent) or an entrant or entry has not been verified or validated to the Promoter’s satisfaction then all the entries of that entrant will be ineligible and deemed invalid. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
26. The Promoter reserves the right to request a winner’s travel companion (if any) produce (within the requested time) appropriate photo identification or other documentation (to the Promoter’s satisfaction, at its sole discretion) in order to confirm the travel companion’s identity and age before issuing a prize. It is a condition of accepting a prize that the winner(s) and their travel companion (if any) may be required to sign a legal release or releases in a form determined by the Promoter or any agencies associated with this Promotion in its or their absolute discretion.
27. The Promoter reserves the right to verify the validity of any and all entries and reserves the right to disqualify any entrant for: (a) tampering with the entry process; (b) submitting an entry which is not in accordance with these Conditions; or (c) if the entrant is engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the Promotion. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved. A prize will only be awarded following any winner validation and verification that the Promoter requires in its sole discretion.
28. The Promoter and its associated agencies and companies excludes all liability (whether direct, indirect or consequential and whether arising under statute, from negligence, personal injury, death, property damage or otherwise) except for any liability that cannot be excluded by law, for any direct or indirect injury, loss and/or damage arising in any way out of or in connection with the Promotion or a prize. This includes, but is not limited to: (i) technical malfunctions, delays or failures, including those resulting from accessing any materials related to this Promotion and any incorrect, inaccurate or incomplete information communicated in the course of, or in connection with, this Promotion as a result of any technical malfunctions, delays or failures; (ii) theft, unauthorised access or third party interference; (iii) lost or damaged entries, prize claims or prizes; and/or (iv) acceptance and/or use of any prize.
29. Certain legislation may imply warranties or conditions or impose other obligations including statutory consumer guarantees, which cannot be excluded, restricted or modified except to a limited extent. To the extent permitted by law, the Promoter excludes all guarantees, warranties, conditions or other terms that apply under or are implied by statute, common law or trade custom or usage.
30. If in the conduct of this Promotion the Promoter is liable for a breach of any guarantee, warranty, condition or other term that applies under the Australian Consumer Law or is implied by any other commonwealth, state or territory law that cannot be excluded, the Promoter’s liability under that legislation is limited, to the extent permitted by law, to the cost of replacement of any benefit or prize won.
31. As a condition of entering this Promotion, an entrant consents to, in the event they are a winner, the Promoter using their (and their guest(s)’ if applicable) name, likeness, image and/or voice (including photograph, film and/or recording of the same) in any media for an unlimited period of time without further notification, remuneration or compensation for the purpose of promoting, publicising or marketing the Promotion (including any outcome), and/or promoting any products or services manufactured, distributed and/or supplied by the Promoter. The entrant agrees that, in the event they are a winner, they will participate in all reasonable promotional activities in relation to the Promotion as requested by the Promoter and its agents.
32.
All entries and any copyright subsisting in the entries become and remain the property of the Promoter. The Promoter collects personal information about entrants to include entrants in the Promotion and where appropriate award prizes. If the personal information requested is not provided, the entrant may not participate in the Promotion. The Promoter may disclose entrants’ personal information to the Promoter’s contractors and agents to assist in conducting this Promotion or communicating with entrants, and as required, to Australian regulatory authorities. If the entrant has marked the ‘opt-in’ box on the online entry form, the entrant consents to:
a. the storage of their personal information on the Promoter’s computer systems; and
b. the Promoter using their personal information for future promotional and marketing purposes regarding the Promoter’s products, including contacting the entrant via electronic messaging and disclosing the entrant’s personal information to its contracts and agents for those purposes.
Entrants can opt out, seek access to the personal information the Promoter holds about them, request correction of any errors or complain about a breach of the privacy rules that bind the Promoter by contacting the Promoter’s Privacy Officer at privacy@woolworths.com.au or writing to the Promoter at the following address below:
