Terms and Conditions

Information on how to enter and the prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.

The Promoter is Blackmores Limited (ABN 35 009 713 437) of 20 Jubilee Avenue, Warriewood NSW 2102, telephone: 02 9910 5100.

Entry is only open to Australian residents aged 18 years or older.

Employees (and their immediate families) of the Promoter, Chemist Warehouse, Priceline, TerryWhite Chemmart and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.

Promotion commences on 01/01/2018 and ends at 11:59pm AEDT on 31/01/2018 (“Promotional Period”).

To enter, individuals must complete the following steps during the Promotional Period:

Purchase any Blackmores product from a Chemist Warehouse, Priceline or TerryWhite Chemmart store (including their online stores) (“Qualifying Transaction”) and retain their purchase receipt; and then
Visit www.blackmores.com.au/WINtennis, follow the prompts to the promotion entry page, input requested details into the online entry form (including full name, address, age (from the brackets provided), the barcode from the Blackmores product purchased), upload a copy of the purchase receipt for the Qualifying Transaction and submit the fully completed online entry form online.

The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.

Incomplete or indecipherable entries will be deemed invalid.

Multiple entries permitted, subject to the following: (a) only one (1) entry permitted per Qualifying Transaction (regardless of the number of Blackmores products purchased in that transaction in excess of one (1)); (b) each entry must be submitted separately and in accordance with entry requirements; and (c) a maximum of one (1) entry permitted per person per day.

Entrants must retain either their original purchase receipt(s) OR a copy of their purchase receipt(s) for all entries as proof of purchase. Failure to produce the proof of purchase for an entry when requested may, in the absolute discretion of the Promoter, result in invalidation of an entrant’s entry and forfeiture of any right to a prize. Purchase receipt(s) must clearly specify the store of purchase, show that a Blackmores product was purchased and that the purchase was made during the promotional period but prior to entry.

If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant. Proof considered suitable for verification is at the Promoter’s sole discretion.

There will be one (1) minor draw conducted for the entries received each week of the Promotional Period (except for the last minor draw, as indicated herein), for a total of four (4) draws (“Minor Draws”), and there will be one (1) draw conducted for all entries received during the Promotional Period (“Major Draw”). Entries into each Minor Draw will open and close each week based on NSW local time (i.e. Monday to Sunday), except for the last Minor Draw where entries open Monday 22/01/2018 and close Wednesday 31/01/2018. Entries in each Minor Draw will NOT be entered into any subsequent Minor Draw(s), however, all entries (including the Minor Draw winners) will be entered into the Major Draw.

All draws will take place at Tactics Marketing, Unit 6, 106 Old Pittwater Road, Sydney, NSW 2100 at 11am AEDT on the dates specified in the table below. The winners will be notified in writing within two (2) business days of the relevant draw and their names will be published at www.blackmores.com.au/WINtennis from 09/02/2018.

Major Prize

The first valid entrant drawn in the Major Draw will win the ‘ultimate tennis holiday’ valued at up to AU$15,000 including GST (“Major Prize”). The Major Prize will be awarded as a credit redeemable through The Marketing Syndicate on behalf of the Promoter. A representative of The Marketing Syndicate will liaise with the winner to create and book their holiday up to the value of $15,000 including GST. Holiday booked must be to a destination that is hosting an official tennis tournament. The winner will have the opportunity to let The Marketing Syndicate know of their preferred destination and itinerary preferences – The Marketing Syndicate then will use its best endeavours to book the winner’s preferences, subject to availability, feasibility, Australian Government travel advice and any other matters The Marketing Syndicate and/or the Promoter consider appropriate, acting reasonably. The Promoter’s and the Marketing Syndicate’s decision with respect to all elements of booking the Major Prize is final and no correspondence will be entered into. The Major Prize can only be used towards one (1) round trip holiday and cannot be used to book multiple individual holidays. For the removal of doubt, any unused balance of the $15,000 credit will be forfeited and will not be redeemable for cash. The Major Prize of up to $15,000 credit is only redeemable for flights, accommodation, and any other reasonable holiday items, expenses or services that directly relate to, and which would normally be included in, an overseas trip as determined by the Promoter.

The Major Prize is subject to the standard terms and conditions of individual prize and service providers, including:
All flights, tickets and accommodation are subject to availability at all times and may be dependent on selected seat class with airlines or specific room category availability with accommodation partner, or select seat availability with tournaments. Black-out periods apply, and will be advised to the Major Prize winner by The Marketing Syndicate.
Travel must be booked by 31/01/2019 and completed by 31/07/2019.
Prize is not redeemable for cash or cash products (i.e. Travelex, foreign currency etc.).
Redeeming the prize is conditional on acceptance of the terms and conditions of travel and the airline carriers in accordance with normal travel practices.
The prize is non-refundable and non-transferable.
The winner and any travel companions are responsible for ensuring that they have all necessary documents to travel to the chosen destination, including a valid passport with a minimum of 6 months validity from the date of their return flight and any visas that may be required for international destinations.
The winner and any companions are responsible for any amendment fees issued by airlines or suppliers once booking is confirmed and ticketed over and above the $15,000 value.
All other costs associated with the prize, including but not limited to visas, valid passports, transfer costs, taxes, additional spending money, meals (other than those included) and any other ancillary costs, including but not limited to insurance and any applicable insurance excesses, not listed in the travel prize package descriptions above, and that fall outside of the $15,000 allocated maximum budget, are the responsibility of the travel prize winner and his/her nominated traveling companions as incurred.
The Promoter recommends that the winners and any travel companions have appropriate travel insurance for their period of travel. It is the responsibility of the winner and their companions to arrange appropriate travel insurance at their own cost.
During the entire duration of the prize, a nominated parent/guardian must accompany any person under 18 years of age.
Minor Draw Prizes

The first two (2) valid entrants drawn in each Minor Draw will each win a tennis pack valued at AU$330. Each tennis pack includes a family tennis kit, which contains the following:
4 x tennis rackets;
2 x canisters tennis balls; and
1 x tennis bag.
General

The Promoter’s decision is final and no correspondence will be entered into.

Subject to the unclaimed prize draw clause, if for any reason a winner does not take / redeem a prize (or an element of the prize) by the time stipulated by the Promoter, then the prize (or that element of the prize) will be forfeited.

If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.

Total prize pool value is up to AU$17,640

Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash.

A draw for any unclaimed prizes may take place on 08/05/18 at the same time and place as the original draw, subject to any directions from a regulatory authority. Winners, if any, will be notified in writing within two (2) business days of the draw and their names will be published at www.blackmores.com.au/WINtennis from 15/05/18.

Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.

If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.

Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.

Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.

Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use, taking or redemption of a prize.

As a condition of accepting a major prize, the winner must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.

The Promoter collects personal information (“PI”) in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed at https://www.blackmores.com.au/privacy. In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. The Privacy Policy also contains information about how entrants may opt out, access, update or correct their PI, how entrants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. All entries become the property of the Promoter. The Promoter will not disclose entrant’s PI to any entity outside of Australia, with the exception of the Major Prize winner’s name whose information may be shared for the purposes of awarding the prize, including but not limited to airline carriers and hotels located overseas.
