Terms & Conditions for Kia Greatest Fan Promotion Please read these terms and conditions carefully. If you do not agree with them, you should not proceed any further on ‘Kia Greatest Fan’ (‘Kia Competition’ hereafter) for the Australian Open 2014 (‘AO 2014’ held at Melbourne Park (‘Venue’ hereafter). Entry into the Competition is deemed acceptance of these terms and conditions. The Kia Competition is a Game of Skill and chance plays no part in determining the winners 1. Registration All entrants must register prior to taking part in the Kia Competition. This registration procedure involves the provision of data and its storage in digital form. Kia Motors Corporation (‘Kia’ hereafter), reserves the right to refuse registration without stating reasons. The application for registration confirms the entrant’s express agreement to storage of the necessary data for the duration of the Kia Competition and until conclusion of all actions relating to it. The entrant is nevertheless entitled to revoke this agreement and thereby withdraw from the Kia Competition at any time by sending an email to (miran@innocean.com). The entrant’s data will be deleted immediately on receipt of this e-mail notification. The promotion commences at 00.01 (AEDT) on 11 January 2014 and closes at 23.59 (AEDT) on 26 January 2014 (“Promotional Period”). 2. Eligibility The Kia Competition is open to all persons residing in a country where the competition is not prohibited or otherwise unlawful. Any person submitting incorrect or untrue data is thereby disqualified from taking part in the Kia Competition. Employees, shareholders, officers, directors, agents, representatives of Tennis Australia Limited (‘TA’ hereafter) and Kia, or of the promotion and advertising agencies of Kia/TA, and their immediate family members and those living in their household, and each person or entity connected with the production, administration or judging of the promotion, and each sister company, affiliate, subsidiary, agent and representative of any aforementioned entity are excluded from participation in competitions. If a person is under 18 years of age they must first obtain their parent or guardian’s permission prior to entering the Kia Competition. Kia reserves the right to exclude any person infringing these conditions of entry from the Kia Competition. Also excluded from the Kia Competition are persons using prohibited aids or otherwise seeking to obtain advantage by manipulations of any kind whatsoever. In such cases, Kia also reserves the right to disallow prizes already awarded and to demand return or repayment thereof. All persons wishing to take part in the Kia Competition must submit an entrance application which must be received prior to the stated closing date. The date and time of receipt of the application are recorded electronically by Kia and this record shall be conclusive. 3. Event This event prominently focuses on participants’ photos and videos to find the most passionate fan for the Australian Open. Participants are entitled to submit multiple entries for the enjoyment but not entitled to be a winner more than 1 time; the 14 daily winners should not be duplicated. Kia reserves the right to refuse to accept certain photos/videos of the participants that are considered by Kia in its sole discretion to be inappropriate to the Kia Competition. 4. Event Procedure Kia is responsible for organizing the Kia Competition and selecting the prizes awarded in consultation with TA. The Competition starts on 13 January 2014 and ends on 26 January 2014 (Competition Period).

At the end of each day of the Competition Period Kia (in consultation with TA) will chose the daily ‘Kia Greatest Fan’ winner. In choosing the daily winner, Kia and TA will consider the following criteria: 1. “Looking the part” how does the entrant dress for the tennis, what special effects does the entrant include (headwear, make up, face paint); 2. What lengths will the entrant go to watch the Australian Open? (Tell us in a short video) 3. Which players does the entrant support, how many autographs has the entrant collected and what kind of fan the entrant is; At the completion of the Competition Period, Kia (in consultation with TA) will select, from the 14 daily prize winners, the grand prize ‘Kia Greatest Fan’ winner. The schedule to announce winners are as specified on the Kia Competition website page. This is a game of skill and chance plays no part in determining the Prize Winner. The decision of Kia (in consultation with TA) and all matters pertaining to the Kia Competition will be final. No correspondence will be entered into. Kia at its sole discretion reserves the right to decide Kia/TA’s representative(s) who will decide the final tournament winner of the Kia Competition and the judging representative(s) will be specified on Kia Competition website. Kia is responsible for deciding the conditions for delivery of the prizes. Kia will notify prize-winners by e-mail or phone and publish their user names on the websites of its associates subject to prior receipt of the prize-winners’ express consent (including TA). Kia is entitled to supply to its associates and TA the personal data of the prize-winners, which is required for delivery of the prizes. Prize-winners failing to reply to the e-mail notification within a week will forfeit their claim to the prize. In this case, the prize will either be awarded to another entrant. Entrants are responsible for ensuring that the data relating to their e-mail and/or postal address are correct. 5. Prizes The prizes for the Kia Competition are as follow;

The prize value is based on global market price and may vary depending on actual retail price in each country. The entrant must ensure they provide their correct contact details to Kia/TA, and to notify Kia of any changes to their contact details before the date and time for announcing winners. Kia will not be liable if it cannot contact any winner because of any incorrect contact details provided by an entrant. If a winner is under 18 years, Kia may award the prize to the winner’s parents/guardian on the winners’ behalf. The winner(and any parent or guardian of the winner) must provide Kia with proof of identity before being eligible to claim prize. Kia reserves the right, in its sole discretion, to determine the identity of the entrant. Daily Winner of the Kia Competition will receive an Apple iPad 16GB and the Final Winner of the Kia Competition will receive a Kia Soul vehicle. The Final Winner is responsible for relevant costs of vehicle registration, insurance, and any kind of taxes such as income tax, acquisition tax, registration tax, and etc. if occurs by earning the prize. Ancillary options, accessories, upgrades, petrol and all other ancillary costs are also the responsibility of the winner. The Final Winner will be required to collect the prize from a local Kia Dealer closest to the Final Winner’s residence as determined by Kia. Kia may at its sole and absolute discretion, decide trim, colour, and optional features, of the vehicle, subject to availability. If the prizes set out above cannot be awarded due to circumstances beyond the control of Kia or unavailability in out of product market countries, Kia at its sole discretion reserves the right to substitute prize of similar value. For instance, Kia Rio or Kia Picanto can be awarded instead of Kia Soul. Prizes will in no case be paid in cash. Prizes cannot be transferred to third parties. Complaints must be submitted to Kia in writing, stating the name of the relevant competition, within 21 days of the prize-winners’ becoming aware of the grounds for the complaint. No telephone complaints or complaints received after the stated deadline will be accepted. Kia will not be responsible for any local tax incurred by the government resulting from the acceptance of the prize. 6. Premature Termination Notwithstanding the schedule shown on the website, Kia reserves the right to abort or terminate the Kia Competition or change the schedule at any time without prior notice. It will invoke this right, in particular, in cases where it is no longer possible to guarantee correct competition procedures for either legal or technical reasons (e.g. viruses in the computer system, manipulations or defects in the hard- or software). Should it be discovered that an entrant is responsible for the circumstances resulting in premature termination of a competition, Kia reserves the right to file claims for compensation against that person. 7. Liability All contractual obligation of Kia is deemed to be fulfilled on delivery of prizes to the winners. Kia shall not be responsible for any material defect of the prizes. Any announcement or publication of winners’ names are unofficial and do not constitute a guarantee to the winner that the prize will be awarded to him/her. No potential winner is deemed to have won a prize until his/her eligibility has been confirmed by Kia’s verification process. Kia shall not be liable for: (i) late, lost, delayed, stolen, misdirected, incomplete, unreadable, inaccurate, garbled or unintelligible entries, communications or affidavits, regardless of the method of transmission; (ii) telephone system, telephone or computer hardware, software or other technical or computer malfunctions, lost connections, disconnections, delays or transmission errors; (iii) data corruption, theft, destruction, unauthorized access to or alteration of entry or other materials; (iv) any injuries, losses or damages of any kind caused by the prize or resulting from acceptance, possession or use of a prize, or from participation in the promotions and contests; or (v) any printing, typographical, administrative or technological errors in any materials associated with the Kia Competition. Kia disclaims any liability for damage to any computer system resulting from participating in, or accessing or downloading information in connection with this promotions and contests, and reserves the right, in their sole discretion, to cancel, modify or suspend the promotions and contests should a virus, bug, computer problem, unauthorized intervention or other causes beyond Kia’s control, corrupt the administration, security or proper play of the promotions and contests 8. Intellectual Property and Ownership of Content By entering the Kia Competition onsite at Melbourne Park at the 2014 AO, entrants acknowledge and agree that the copyright in any videos and photographs of the entrant taken in the Kia Photo Booth”and/or “Kia Greatest Fan Cam” vests jointly in Kia and TA. Kia and TA may use images and videos for the purposes including but not limited to promoting, publicising or marketing the Kia Competition (including any outcome), and/or promoting any products or services manufactured, distributed and/or supplied by Kia or TA including on Kia and TA official websites, Kia and TA buzz blogs and social media including but not limited to Facebook, Twitter, YouTube, Instagram and/or any other social media website, Kia and TA Flicker, Kia and TA Google plus and Kia and TA AO mobile websites, subject to each service’s privacy policy rules. During the course of the Event, registered entrants will have opportunities to submit user-created contents like images and videos. The entrant bears sole liability and sole responsibility for the legality of these data and information. By entering the Kia Competition online, entrants agree to grant Kia and TA an exclusive, royalty-free, non-revocable, perpetual license to use the story, images and videos submitted to Kia and TA without further notification, remuneration or compensation for the purpose of promoting, publicising or marketing the Kia Competition (including any outcome), and/or promoting any products or services manufactured, distributed and/or supplied by Kia or TA including on Kia and TA official websites, Kia and TA buzz blogs and social media including but not limited to Facebook, Twitter, YouTube, Instagram and/or any other social media website, Kia and TA Flicker, Kia and TA Google plus and Kia and TA AO mobile websites, subject to each service’s privacy policy rules. By submitting a photograph or video, registered entrants warrant that they own the copyright in the photograph or video or are otherwise permitted to submit the photograph or video and that they have all necessary permissions, rights and/or licences covering their use of material included in such photograph or video. Each registered entrant agrees to indemnify Kia and TA and to keep Kia and TA fully indemnified, for any loss, cost, expense that may be incurred or sustained by Kia or TA as a result of any breach by a registered entrant of this warranty. Digital data and information must not contain statements of a racist, sexist or defamatory nature or statements glorifying violence or which could be construed as deriding or insulting or similarly offending specific individuals or groups. Any entrant violating this condition will be excluded from the competition forthwith and Kia and TA reserves the right to take further legal action. Entrants are responsible for ensuring that they have the necessary rights to digital data and information supplied by them. This applies in particular to images and videos, and also to texts not authored by them. Entrants supplying digital data and information automatically grant Kia and TA the rights to publish these data and information. They are not entitled to claim any remuneration for the granting of these rights. The entrant retains the title to the rights. 9. Miscellaneous Provisions These conditions of entry and the wider legal relationship between Kia and the entrants are governed by the law of the Republic of Korea. Any and all legal actions or claims arising in connection with these promotions and contests must be brought in a court of competent jurisdiction within the Republic of Korea, and if you communicate with Kia in regards to any and all legal actions or claims arising in connection with these promotions and contests by email, you should note that the security of internet email is uncertain. By sending sensitive or confidential email messages which are not encrypted you accept the risks of such uncertainty and possible lack of confidentiality over the internet. Kia is subject to the Australia data protection laws when collecting and processing personal data. For details, please refer to our Privacy Policy listed in the site. In addition, please remember that when participating in the promotions and contests, you are also subject to the Terms and Conditions of use of the site. By entering the Kia Competition, entrants consent to TA using the entrant’s personal information to advise it of promotions, events, special offers and other like activities offered by TA and/or its stakeholders. Except where permitted or required by law, or where the entrant’s consent is obtained, this information will not be disclosed to third parties. Kia reserves the right to amend these conditions of entry at any time without prior notice. 10. Disclaimer TA is the owner and promoter of the AO. To the full extent permitted by law TA excludes liability for any loss, damage or injury whatsoever suffered or sustained (including, but not limited to direct, indirect, special or consequential loss or damage, loss of opportunity revenue or profit) arising directly or indirectly out of or in connection with the Kia Competition including attendance at the Venue.
