The B.I.G: Beat Invisible Glaucoma Photo Competition Terms & Conditions

Information on how to enter and prizes form part of these Terms and Conditions and participation in this competition is deemed as acceptance of these Terms and Conditions.

Glaucoma Australia Inc. (The Promoter) employees and Council of Management, competition judges, and each of their immediate families (grand/parents, siblings, partners and children) are not permitted to enter the competition (“Ineligible Entrants”).

Entry to this competition is open to Australian residents except Ineligible Entrants. Entry to the senior categories of this competition is open to those who are 18 years or older, and entry to the junior categories of this competition is open to those who are under the age of 18, in each case as at 11th April 2014 but excluding Ineligible Entrants.

All entries in the junior categories of the competition must be accompanied by permission from a parent or guardian to submit a valid entry as indicated in the entry form and are only valid if a parent consent form is completed and submitted via email (scanned), fax or post. Only one entry and one photo per person will be accepted.

The competition starts at 9.00am (AEST) on Monday 3rd February and finishes at 5.00pm (AEST) on Friday 11th April 2014 (“Competition Period”).

Individuals must complete an entry form to enter, which is available for the entire Competition Period online at www.glaucoma.org.au/BIGphoto. There are four categories and entrants must select which category is being entered on the entry form. An entry must include a photograph taken by the entrant and must be accompanied by a title and the reason (in 25 words or less) that the photograph is relevant to the category chosen. Entrants must only submit an entry in one category that they are eligible to enter, in accordance with clauses 3 and 5. Incomplete, illegible or recurring entries will be deemed invalid.

Entered photographs must be the original work of the entrant; neither digitally enhanced nor manipulated. Any images submitted are subject to review and acceptance by The Promoter in its absolute discretion and are subject to all applicable Australian and International laws regarding, but not limited to, child pornography, child abuse, obscene or pornographic material and intellectual property.

Entered photographs must be provided as a digital JPEG file- minimum size of 1MB and a maximum size of 4MB. Photographs may only ever be entered once.

The Promoter at any time, reserves the right to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who otherwise tampers with the entry process, however errors and omissions may be accepted at the Promoter’s discretion. A failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter reserves the right to disqualify an entry if the content is deemed inappropriate for whatever reason.

This competition is a game of skill, based on each entry’s composition, content and creativity: chance plays no part in determining the winners. The judging panel will be selected by Glaucoma Australia and judging will take place at Glaucoma Australia, Suite 302, Level 3, 621 Pacific Highway, Sydney on Thursday 17th April 2014.

The best entry in each category, as determined by the judges, will each receive a prize (“winners”). The next two best entries in each category, as determined by the judges, will each win a prize (“runners up”). The judges’ decision is final and no correspondence will be entered into. The winners and runners up will all be notified by phone and in writing either via email or post on or as soon as practicable after Monday 21st April 2014.

The winners prize consists of:
Each of the two senior category winners will receive a CANON Powershot S120 digital camera, RRP $499 and each of the two junior category winners will receive a Celestron telescope, RRP $249.00.
First and second runners up in each senior category will each receive a one year subscription to Glaucoma News and a certificate of acknowledgement. The Total RRP is $20.00
First and second runners up in each junior category will each receive a Glaucoma Australia mascot- “GOLDIE the Owl” and a certificate of acknowledgement. The Total RRP is $17.00

The winners may be required to be photographed accepting their prize, their image to be published in Glaucoma News and/or mivision magazine.

If the prize (or part of the prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal or greater value, subject to any written directions from a regulatory authority. The winners must be reasonably available to accept their prizes in their home State, if required.

The total prize pool is RRP $1,570. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash.

The judges’ decision is final and binding – no correspondence will be entered into. If this competition is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the competition, as appropriate.

Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the competition, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter); (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of the prize.

Details from entries will be collected and used in order to process and conduct the competition (which may, for this purpose, include disclosure of such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities) and for promotional purposes surrounding this competition. Entry is conditional on entrants consenting to the use of their information as described and they agree that the Promoter may use this information, or disclose it to other organisations that may use it, in any media for future promotional, marketing, publicity, research and profiling purposes, without further reference or payment to the entrant. Entrants confirm and promise that their entry is original and does not infringe the intellectual property rights of any third party. By submitting an entry to the B.I.G: Beat Invisible Glaucoma Photo Competition the entrant retains ownership of the image, provided however that entrants agree that the Promoter has an unrestricted, irrevocable, transferable, divisible right and license to use, modify and reproduce their entry for the purposes of the Promoter’s business and without the payment of any further fee or compensation, if so desired by the Promoter. The entrant acknowledges that the image entered in the competition may be used by The Promoter to support the Promoter’s endeavours to minimise sight disability from glaucoma in Australia and that the Promoter agrees to attribute the entrant as the photographer in all instances. Where the photograph entry contains people/persons that may be identifiable it is the photographers’ responsibility to ensure that appropriate consent is acquired before entering the competition.
