CONDITIONS OF ENTRY

FLIGHT CENTRE #EUROPEWITHETIHAD INSTAGRAM and TWITTER COMPETITION (“PROMOTION”)

Conditions of Entry

1. Information on how to enter and prizes form part of these Conditions of Entry. Entry into this Promotion is deemed acceptance of these conditions of entry by each entrant.

2. Entry is open to residents of Australia aged 18 years or older, who enter the promotion in the required manner.

3. Employees of Flight Centre Limited and their immediate families are not permitted to enter.

Duration of Promotional Period

4. The competition commences at 1000 AEST on Monday 3 March, 2014.

5. The competition closes at 2400 AEST on Thursday 27 March, 2014.

How to Enter

6. Eligible entrants can enter the promotion by uploading a Europe inspired post, photo or video to Instagram™ or twitter with the hashtags #EuropeWithEtihad and #FlightCentrePrize.

8. Entries will be deemed to be accepted at the time of the hashtag (#) search. Entries received will be considered final by the Promoters. Incomplete, inaccurate, erroneous, illegible or incomprehensible entries will be deemed invalid. Entries must be received by the Promoters during the promotional period. The Promoters accept no responsibility for late, lost or misdirected entries.

9. Any costs associated with accessing the Promotional Websites remain the responsibility of each entrant and are dependent on the Internet Service Provider used.

Selection of Prize Winner.

10. The Promotion is a game of skill and chance plays no part in determining the Prize Winner.

11. The winning entry will be determined by two (2) Flight Centre Representatives who will judge the entires based on a unique post that is considered to best represent the excitement and beauty of a Europe holiday.

12. There will be one (1) prize winner.

13. Judging will take place at 1000 AEST on Monday 31 March 2014 at Flight Centre Head Office, Level 2, 545 Queen Street, Brisbane QLD 4000.

14. The prize winner will be notified via Instagram™ the next business day after the judgment has been made and the result(s) will be published on Flight Centre’s Instagram™, Twitter and Facebook. The prize winner will be required to email their details to social_media@flightcentre.com.

15. To confirm their identity, the prize winner may be provided an image by the Promoter that must be loaded onto their own Instagram™ or Twitter account.

16. The judges’ decision is final and the Promoter will not enter into correspondence regarding the result.

17. The prize winner will have until 0900 AEST on Wednesday 30 April, 2014 to claim the prize.

Rights in entries submitted

19. By submitting a photograph or video as an entry in the Promotion, to the extent permitted by law, each entrant:

a) grants to the Promoter, an unlimited, perpetual, irrevocable, world-wide, royalty-free and fully sub- licensable licence to make full use of the photograph or video (or an adaptation or derivative of the photograph or video) throughout the world in any media, including in any promotional, marketing or other material, whether in electronic or printed form, produced by or on behalf of Flight Centre;

b) agrees that Flight Centre is under no obligation to treat the photograph or video as confidential information;

c) grants to Flight Centre, at their discretion, the right to use the entrant’s name, username or any other content the entrant submits with their entry, in connection with the photograph or video;

d) warrants that they have all the necessary rights and licences to grant Flight Centre the rights set out in these terms and conditions and that Flight Centre’ exercise of the rights granted to it by these terms and conditions will not infringe the intellectual property rights of any person;

e) agrees to indemnify, defend and hold Flight Centre harmless from and against any and all claims, liability, losses, damages, costs or expenses (including reasonable legal costs on a solicitor and client basis) directly or indirectly arising out of or in relation to use of the photograph or video, including any third party claims that use of the photograph infringes intellectual property rights (this paragraph (g) will survive termination of these terms and conditions for any reason); and

f) confirms that all persons appearing in the photograph or video consent to the photograph or video being submitted as an entry in the Promotion, including to the Promoter’s right to use the photograph in accordance with these terms and conditions; and

g) acknowledges that Flight Centre is under no obligation to exercise any of the rights granted to it by these terms and conditions in respect of use of the photograph or video.

20. If for any reason the Promoter is unable to publish or otherwise use a photograph or video submitted as part of this Promotion, that entry will be excluded and the entrant is not eligible to be judged the Prize Winner.

Prize Details

21. The prize consists of two (2) return economy flights from the winner’s closest Australian capital city to a Europe destination that Etihad Airways flies to. The flights must be ticketed by 30 June, 2014.

22. The total maximum value of the prize is $5,000.

23. The Prize Winner must take the prize as offered. Prizes are non-refundable, cannot be sold or exchanged for cash and cannot be used in conjunction with any other offer.

24. The prizes and booking of the prizes are subject to the standard booking terms and conditions of Flight Centre.

25. Any passes, tickets or vouchers issued as part of the prizes are subject to prevailing terms and conditions of use and any tickets, passes or vouchers are only valid for use within the stated duration on the passes or tickets issued or the duration of the chosen prize, whichever is earlier.

26. The Prize Winner consents to the use of their name, suburb of residence and image for promotional and marketing purposes.

27. To the extent permitted by law, the Promoter is not responsible or liable for:

a) inaccurate/incorrect transcription of entry information;

b) purported entries that are not received for any reason, including because they are lost, misdirected or stolen, or that are received, but are late, illegible, incomplete, sent with insufficient postage (where entry is by post), or sent other than as directed in the entry instructions;

c) any problems or technical failures of any kind, including malfunction of any telephone network or lines, computer online systems or network, servers or providers, computer equipment, or software;

d) the unavailability or inaccessibility of any service whether or not caused by traffic congestion on the Internet or at any website;

e) unauthorised human intervention in any part of the competition;

f) electronic or human error which may occur in the administration of the competition;

g) any loss suffered or sustained, to person or property and including, but not limited to, consequential (including economic) loss by reason of any act or omission, deliberate or negligent, by the Promoter, or its servants or agents, in connection with the arrangement for supply, or the supply, of any goods or services by any person to a prize winner and, where applicable, to any family/persons accompanying a winner; or

h) any injury or damage to persons or property, including to the participant’s or any other person’s computer related to, or resulting from, participation or downloading any materials in this competition.

28. The Promoter will not be liable for personal injury suffered during prize winnings. If requested by The Promoter, the Prize Winner(s), and his or her guests, must sign and return any liability release and indemnity provided by the Promoter and/or its contractors as a condition of a prize being awarded. Failure to return the signed releases and indemnities will result in the entitlement to the prize being forfeited and the selection of another Prize Winner.

29. This condition does not affect, and is not intended to affect, any rights a consumer might have, which cannot be excluded under applicable consumer protection laws. To the fullest extent permitted by law, any liability of the Promoter or its servant or agents for breach of any such rights is limited to the payment of the cost of having the prize supplied again.

30. When competition entrants subscribe to the Flight Centre email newsletter they are agreeing to receive email marketing from Flight Centre Limited trading as Flight Centre. In the event that entrants decide to opt out of receiving information on promotions, services and market research provided by Flight Centre Limited trading as Flight Centre they can email customer.feedback@flightcentre.com or contact the Global Head Office on 07 3170 7979.

31. The Promoter is Flight Centre Travel Group Limited trading as Flight Centre ABN 25 003 377 188 ACN 003 377 188 Travel Agent Licence Numbers ACT 18800224 NSW 2TA002719 NT 008 QLD TAG262 SA TTA254 TAS TAS031 VIC 31089 WA 9TA 00589. The personal information of entrants will be collected to enable the Promoter to administer and promote this competition. The Prize Winner and their guest may be used to market the Promoter’s services to the entrant. The personal information of the entrants will be held and used in accordance with the Promoter’s privacy policy which is available at www.flightcentre.com.au . The personal information of winners may be provided to others assisting, including prize suppliers and deliverers, and to authorities that regulate this competition. If an entrant does not truthfully provide all requested personal information, the Promoter may determine that they are not eligible to win the prize.
