“50@CLIPSAL 500” PROMOTION

Information on how to enter, vote and the prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
Promotion commences on 17 February 2014 and ends at 11.59pm AEDST on 2 March 2014 (“Promotional Period”). Only entries received between 17 February 2014 and 11.59pm AEDST on 20 February 2014 will be entered into Draw 1.
Entry is only open to Australian residents aged 18 years or over. Must be able to attend the Clipsal500 2014 event (taking place 27 February – 2 March 2014) if drawn a winner in Draw 1. In the event that the winner of the Clipsal500 2014 prize is unable to take the prize on the required dates to coincide with this event, he/she will forfeit their right to the prize and the prize will be awarded to the next valid reserve entry drawn in Draw 1.
Employees (and their immediate families) of the Promoterand agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
How to Register: To be eligible to enter individuals must register for the promotion by visiting the Clipsal Australia Facebook Page at www.facebook.com/ClipsalAU(“Facebook Page”), select the ‘like’ button on the Facebook Page (if not done so already); follow the prompts to the promotional application, input the requested details as prompted, and submit the fully completed registration form. If a person would like to be entered into Draw 1, he/she must both register and enter before 11.59pm AEDST on 20 February 2014.
How to Enter: To enter, individuals must complete either of the following options during the Promotional Period:
at the time of registration for the promotion on the Facebook Page, upload an eligible selfie of themselves with a Clipsal product; or
after completion of registration, re-visit the Facebook Page, follow the prompts to the promotional application and upload an eligible selfie of themselves with a Clipsal product as prompted.
The selfie must not contain any persons other than the entrant. The table included in Annexure A lists all fifty (50) eligible selfies and the number of entries obtained for each type of selfie. Only one (1) registration permitted per person and Facebook account. Individuals may submit a maximum of fifty (50) selfies, however, each ‘type’ of selfie (as specified in Annexure A) may not be submitted more than once. For the sake of clarity, Annexue A indicates either the type of place where the selfie should take place (e.g. kitchen) or the person with whom the entrant submitting the selfie must appear with in the selfie (e.g. Clipsal representative). Entrants must have consent from the person who appears in their selfie to use such selfie for the purposes of this promotion. Each entry must be submitted separately and in accordance with the entry requirements. Photos uploaded must not be obscene, derogatory, sexually explicit or otherwise in breach of clause 37 of these Terms and Conditions. Uploaded files must be submitted in JPEG or GIF format, must be at least 400 pixels (wide) x 300 pixels (high) and must not exceed 1.5 MB file size.
How to Vote: Photos submitted in accordance with the entry requirements will be uploaded onto the Facebook Page for voting by the public. Voting is open to all valid Facebook members. To vote, an individual must visit the Facebook Page follow the prompts to the promotional application and click ‘like ’ next to the entry they would like to submit a vote for, during the Promotional Period. Each person and Facebook account is only permitted one (1) vote (i.e. ‘like ’ ) for any given entry.
The Promoter reserves the right, at any time, to verify the validity of entries/votes, registrations and entrants/voters (including an entrant ’ s/voter ’ s identity, age and place of residence) and to disqualify any entrant/voter who submits an entry/vote or registration that is not in accordance with these Terms and Conditions or who tampers with the entry/voting/registration process. Errors and omissions may be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
The Promoter reserves the right, at any time: (a) to invalidate any votes which it reasonably suspects have been submitted using false, incorrect, fraudulent or misleading information, including but not limited to personal details and contact information and/or votes that have been submitted through the use of multiple identities, email addresses or accounts, including but not limited to social networking accounts; and/or (b) to disqualify any entrant (or invalidate his/her entry) that the Promoter reasonably suspects has paid, bartered or offered payment or other consideration to another person in exchange for votes or has otherwise encouraged or procured any person to submit votes contrary to these Terms and Conditions.
Incomplete or indecipherable entries/registrations will be deemed invalid.
If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
The draws will take place at Anisimoff Legal, Level 5, 492 St Kilda Road, Melbourne Victoria 3004.
Draw 1 (1 Prize): Draw 1 will take place on 21 February 2014 at 10am AEDST. Only entries received between 17 February 2014 and 11.59pm AEDST on 20 February 2014 will be entered into Draw 1. Draw 1 prize winner will be published on the Facebook Page from 21 February 2014. Draw 1 prize winner will be notified by email and telephone within two (2) business days of the draw.
Draw 1 Prize: The first valid entry drawn in Draw 1 will win a trip for two (2) adults to the 2014 Clipsal 500 valued at up to $7,500, depending on point of departure. The prize includes:
Two (2) x return economy flights from the winner’s nearest Australian capital city to Adelaide, SA (only provided if winner resides outside of South Australia);
VIP Ticketing for two (2) adults to the Pit Pavilion Club at the 2014 Clipsal 500 for four (4) days. VIP ticketing includes fully hosted experience, food & beverage. Please see http://www.clipsal500.com.au/hospitality/shared_facilities/pit_pavilion_club for more information on the facility and inclusions in this component of the prize;
Four (4) nights 5-star accommodation (including breakfast daily) and morning transfers to the race track. The prize is for one (1) room only, and may not have the option of two (2) beds;
5 seconds of fame – TV Spot to switch on the race (includes a video showing a compilation of the winner’s best selfies with Clipsal product, accompanied by Clipsal logo and finger flicking a Clipsal switch);
Race Team Pit Garage Tour for two (2) adults;
Attendance at the Harley Parade (the winner and his/her travel companion to ride on a Harley around the track with drivers and grid girls);
Pit Walk (the winner and his/her travel companion to take a walk through pit straight);
Official 2014 Grid Girl Team photo in Pit Pavillion (one photo featuring both the winner and his/her companion with the 2014 Grid Girl Team); and
Entry for two (2) adults into the Clipsal by Schneider Electric welcome party (Friday evening), brunch event (Saturday morning) and Hutt Street Party (Saturday night).
If a winner is from South Australia, then the prize does not include airfares and the airfare component of the prize is not redeemable for cash. Prize must be taken to coincide with the Clipsal500 2014 event (taking place 27 February – 2 March 2014), with flights departing on 27 February 2014 and is subject to booking and flight availability.
The Draw 1 Prize winner will also be a race correspondent for the Promoter and will be required to provide updates (including but not limited to, pictures, comments, posts, blogs, etc, as required by the Promoter) for upload onto the Clipsal Australia Facebook Page. The Promoter, and its respective agents will aide the Draw 1 Prize winner with drafting of any scripting for inclusion on the Clipsal Australia Facebook Page. All written copy provided by the winner to the Promoter and/or its agencies may be modified at the discretion of the Promoter and its agencies prior to upload onto the Clipsal Australia Facebook Page.
Draw 2 (5 Prizes): Draw 2 will take place on 3 March 2014 at 10am AEDST. Winners will be published on the Facebook Page from 5 March 2014. Draw 2 will be composed of all entries received during the entire Promotional Period (excluding winning entries from Draw 1). Winners will be notified by email and telephone within two (2) business days of the draw. Prizes will be awarded to the first five (5) valid entries drawn in Draw 2, in the order outlined below:
Prize 1 (for 1st valid entry drawn): Clipsal500 2015 Package (GrandStand – Barry Sheene Pit Straight AA-I tickets awarded) valued at up to $2,500, depending on date and point of departure – see clause 23 of prize inclusions.
Prize 2 (for 2nd valid entry drawn): Clipsal500 2015 Package (GrandStand – Barry Sheene Pit Straight AA-I tickets awarded) valued at up to $2,500, depending on date and point of departure – see clause 23 of prize inclusions.
Prize 3 (for 3rd valid entry drawn): Clipspec Electrical Planning consultation and free electrical products to the value of $2,000.
Prize 4 (for 4th valid entry drawn): Clipspec Electrical Planning consultation and free electrical products to the value of $2,000.
Prize 5 (for 5th valid entry drawn): Clipspec Electrical Planning consultation and free electrical products to the value of $2,000.
The Promoter may draw additional reserve entries and record them in order in case an invalid entry or ineligible entrant is drawn.
Top 5 Selfies (based on skill only – draw winners are NOT eligible to win a ‘Top Selfie’ prize): The top five (5) ranked entries (based on the number of valid votes received, and excluding draw winners), will be awarded the relevant prize indicated below, depending on their ranking:
First Prize (Rank 1): Clipsal500 2015 Package (GrandStand – Chicane Inside tickets awarded) valued at up to $3,000, depending on date and point of departure – see clause 23 for prize inclusions.
Second Prize (Rank 2): Clipsal500 2015 Package (GrandStand – Barry Sheene Pit Straight AA-I tickets awarded) valued at up to $2,500, depending on date and point of departure – see clause 23 for prize inclusions.
Third Prize (Rank 3): Clipsal500 2015 Package (trackside tickets awarded) valued at up to $2,000, depending on date and point of departure – see clause 23 for prize inclusions.
Fourth Prize (Rank 4): Clipspec Electrical Planning consultation and free electrical products to the value of $2,500.
Fifty Prize (Rank 5): Clipspec Electrical Planning consultation and free electrical products to the value of $2,000
The ‘Top 5 Selfies’ component of this promotion is a game of skill and chance plays no part in determining the winners of this component of the promotion. In the event of a tie for any of top five (5) ranked positions, the Promoter will break the tie by judging such tied entries based on the artistic and creative merit of the selfie. The Five (5) Top Selfie winners will be notified by telephone and email.
Tickets to the 2015 Clipsal500 event are not yet released. However, the tickets to this event will be provided to the relevant winners once released.
Clipsal500 2015 Packages (inclusions): All Clipsal500 2015 packages include: two (2) return economy airfares from the winner’s nearest Australian capital city to Adelaide, SA (only provided if winner resides outside of South Australia); 4 nights 5-star accommodation in Adelaide, SA (including breakfast daily); and two (2) tickets to the Clipsal500 2015 (exact tickets provided vary for each winner, as specified above). If a winner is from South Australia, then the prize does not include airfares and the airfare component of the prize is not redeemable for cash. Prizes must be taken to coincide with the Clipsal500 2015 event and is subject to booking and flight availability. Each winner’s companion for the prize must be an adult (i.e. aged 18 years or older).
Conditions applicable to Clipspec Package prizes: Valid for one (1) consultation for a renovation/owner build project only. Each prize includes consultation, products and installation (to the value of the prize package amount specified above). Not to be used in conjunction with other discounts. Consultations by appointment only: 9am-5pm Monday to Friday. Appointments must be conducted prior to 1st March 2015. Consultations to occur at Clipsal Powerhouses or Selection Centres only. An installer nominated by the Promoter will conduct installation of all Clipspec products provided under this package.
Additional conditions applicable to all Clipsal500 trip prizes: Unless specified in the prize description above, spending money, meals, insurance, transport to and from departure point, transfers, items of a personal nature, in-room charges and all other ancillary costs are not included. Each winner and his/her companion must depart from and return to the same departure point and travel together. Itinerary to be determined by the Promoter in its absolute discretion. Frequent flyer points will not form part of the prize. Prize is subject to the standard terms and conditions of individual prize and service providers. Each winner may be required to present their credit card at time of accommodation check in.
The Promoter’s and judges’ decision is final and no correspondence will be entered into.
If for any reason a winner does not take a prize (or an element of a prize) at or by the time stipulated by the Promoter, then the prize (or that element of the prize) will be forfeited and will not be redeemable for cash.
Subject to the terms and conditions of the participating prize provider(s), if for any reason a winner does not, once the prize has been booked, take a prize (or an element of a prize) at the time stipulated, then the prize (or that element of the prize) will be forfeited and will not be redeemable for cash.
In the event of war, terrorism, state of emergency or disaster, the Promoter reserves the right to cancel, terminate, modify or suspend the promotion or suspend or modify a prize, subject to any written directions from a relevant regulatory authority.
The winner of the Harley Parade ride (“Activity”) and his/her companion acknowledge that the Activity is a dangerous activity that may result in injury or death, and participate at their own risk. The winner and his/her companion must: (a) attend, undergo and pass any appropriate training, briefings, required medical tests and other requirements of the Promoter and Activity organisers as determined by them in their absolute discretion; (b) not have any heart condition or history thereof, or other medical conditions that would make it dangerous to participate in the Activity; (c) not be under the influence of drugs or alcohol; (d) comply with all directions of the Promoter and Activity organisers at all times; and (e) wear all safety and other equipment required. The Promoter and Activity organisers, in their absolute discretion, at all times reserve the right to: (a) prevent any winner or his/her companion from participating in the Activity if, at any time, they reasonably believe that the winner or his/her companion poses a safety risk or for any other reason; and/or (b) cancel the Activity if the conditions are deemed dangerous. If the Activity is varied for any reason beyond the control of the Promoter it may not be rescheduled and no compensation will be offered.
If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
The Clipsal500 ticket prizes are subject to the event venue and ticket terms and conditions, including any applicable age restriction. The Promoter and event organisers hereby expressly reserve the right to eject any winner (and/or his/her companion) for any inappropriate behaviour, including but not limited to intoxication, whilst participating in any element of the prize.
Total prize pool value is up to $30,500.
Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.
In the event that Draw 1 prize remains unclaimed by 9.30am AEDST on 24 February 2014, a draw for such unclaimed prize may take place on 24 February 2014 at the same time and place as the original draws, subject to any directions from a regulatory authority. The winner, if any, will be notified by telephone and email within two (2) business days of the draw and their name will be published on the Facebook Page on 24 February 2014.
In the event that any Draw 2 prizes remain unclaimed by 5pm AEDST on 3 June 2014, a draw for such unclaimed prizes from Draw 2 may take place on 9 June 2014 at the same time and place as the original draws, subject to any directions from a regulatory authority. Winners, if any, will be notified by telephone and email within two (2) business days of the draw and their names will be published on the Facebook Page on 13 June 2014.
When an entrant submits any materials via the promotion including images (e.g. selfies), comments, and recordings (“Content”), the entrant, unless the Promoter advises otherwise, licenses and grants the Promoter, its affiliates and sub-licensees a non-exclusive, royalty-free, perpetual, worldwide, irrevocable, and sub-licensable right to use, reproduce, modify, adapt, publish and display such Content for any purpose in any media, without compensation, restriction on use, attribution or liability. Entrants agree not to assert any moral rights in relation to such use and warrant that they have the full authority to grant these rights.

Entrants agree that they are fully responsible for the Content they submit. The Promoter shall not be liable in any way for such Content to the full extent permitted by law. The Promoter may remove any Content without notice for any reason whatsoever. Entrants warrant and agree that: (a) they will not submit any Content that is unlawful or fraudulent, or that the Promoter may deem in breach of any intellectual property, privacy, publicity or other rights, defamatory, obscene, derogatory, pornographic, sexually inappropriate, violent, abusive, harassing, threatening, objectionable with respect to race, religion, origin or gender, not suitable for children aged under 15, or otherwise unsuitable for publication; (b) they will obtain prior consent from any person or property that appears in their Content; (c) they will obtain full prior consent from any person who has jointly created or has any rights in the Content, to the uses and terms herein; (d) their Content shall not contain viruses or cause injury or harm to any person or entity; and (e) they will comply with all applicable laws and regulations, including without limitation, those governing copyright, content, defamation, privacy, publicity and the access or use of others’ computer or communication systems.

Without limiting any other terms herein, the entrant agrees to indemnify the Promoter for any breach of the above terms.
Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
Any cost associated with accessing the promotional website is the entrant’s/voter’s responsibility and is dependent on the Internet service provider used. The use of any automated entry or voting software or any other mechanical or electronic means that allows an entrant/voter to automatically enter or vote repeatedly is prohibited and will render all entries/votes submitted by that entrant (or on behalf of a specific entrant) invalid.
Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry, vote or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) if a Clipsal500 event is cancelled, postponed or delayed for any reason beyond the reasonable control of the Promoter; (f) any tax liability incurred by a winner or entrant; or (g) participation in, taking of and/or use of a prize.
As a condition of accepting the prize, each winner (and his/her companion, for the Clipsal500 prizes) must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.
The Promoter collects personal information (“PI”) in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed at http://www.schneider-electric.com.au/sites/australia/en/general/legal-information/legal-information.page. In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. The Privacy Policy also contains information about how entrants may opt out, access, update or correct their PI, how entrants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. All entries become the property of the Promoter. The Promoter will not disclose entrant’s personal information to any entity outside of Australia.
Entry, voting and continued participation in the promotion is dependent on entrants following and acting in accordance with the Facebook Statement of Rights and Responsibilities, which can be viewed at http://www.facebook.com/terms.php.
This promotion is in no way sponsored, endorsed or administered by, or associated with Facebook. Entrants understand that they are providing their information to the Promoter and not to Facebook. The information an entrant provides will only be used for the purposes outlined in these Terms and Conditions. Any questions, comments or complaints about this promotion must be directed to the Promoter and not to Facebook. Facebook will not be liable for any loss or damage or personal injury which is suffered or sustained by an entrant, as a result of participating in the promotion (including taking/use of a prize), except for any liability which cannot be excluded by law.
