1. Information on how to claim & entitlements form part of these Terms and Conditions.
2. A claim under this offer constitutes acceptance of these Terms and Conditions .
3. The promotion is only to “Eligible Claimants” being individuals who:
i. Are residents of Australia; and
ii. Are not employees of FANTASTIC FURNITURE (“The promoter”, or any of its related corporations or any of their agencies associated with the Promotion;
iii. Are not purchasing as part of a business or commercial venture.
4. The promotion period commences 2nd February 2014 and concludes 28th of February 2014 (“Promotion Period”). Judging will take place at 12:00pm (AEST) on March 14th 2014 at 62 Hume Hwy Chullora, New South Wales. Entries will be judged by a panel of judges selected from the staff of the Promoter. The winners will be notified using their supplied contact details within two business days. If, for any reason, any winner(s) cannot be contacted by 23:59 (AEST) on 1 April 2014, that winner will forfeit their prize and another winner may be selected.
5. No responsibility is accepted by the Promoter for late, lost, or misdirected entry forms.
6. To be a valid entry, the entrant must provide all requested details and all answers must be entered in English. All valid entries will be judged on the originality and creativity. This is a game of skill and chance plays no part in determining the winners. Incomplete, indecipherable or illegible entry forms will be deemed invalid.
7. The promoter reserves the right to verify the validity of all entry forms and reserves the right to disqualify any claimant for tampering with the claim process or for submitting a claim, which is not in accordance with these Terms and conditions.
8. The Promoters decision in relation to any aspect of the Promotion is final and no correspondence will be entered into.
9. To participate in this Promotion and Eligible claimant must fill in an entry form and deliver the completed form in a participating Fantastic Furniture Retail store throughout Australia between 2nd of February to 28th February 2014. Entrants warrant that their entry is original, does not infringe the intellectual property right of any third party and has not been previously published and/or been used to win prizes in any other competition.
10. Each claimant must complete the official entry form. Entry forms are available at a participating Fantastic Furniture store or download from www.fanasticfurniture.com.au/makeover
11. The Promoter is not responsible for any problems or technical malfunction of any computers or telephones, servers or providers, computer equipment, software, technical problems or traffic congestion on a mobile network, or any combination thereof, or any other technical failures including any damage to entrant’s or any other person’s mobile handset or computer related to, or resulting from, participation in this promotion or the downloading of any materials related to this promotion.
12. The six (6) entries judged to have provided the most original and creative response to the question “Describe your dream home makeover” will win one (1) Fantastic Furniture gift card worth $5000 (1x NSW/ACT, 1xVIC, 1x QLD, 1x WA, 1 x SA, 1 x TAS).
13. If the personal information requested is not provided, the entrant may not participate in the competition. By participating in the competition and opting in at the point of entry, each entrant also acknowledges that a further primary purpose for collection of entrants’ personal information by the Promoter is to enable the Promoter to use the information to assist the Promoter in improving goods and services and to contact entrants in the future with information on special offers or provide entrants with marketing materials via any medium including mail, telephone and commercial electronic messages (SMS (Short Message Service), MMS (Multimedia Message Service), IM (Instant Messaging) and email) or any other form of electronic, emerging, digital or conventional communications channel whether existing now or in the future. The Promoter may share information with its Australian related companies and promotional partners who may contact entrants with special offers in this way. By entering the competition and opting in at the point of entry, each entrant agrees that the Promoter may use entrants’ personal information in this manner. Participants can gain access to, update or correct any personal information by contacting the Promoter at the address below. A copy of the Promoter’s Privacy
14. Policy in relation to the treatment of personal information collected may be obtained by contacting the Promoter.
15. Claimants must allow up to 8 weeks for the delivery of the Gift from the conclusion of the promotion. Winners will be published on the Fantastic Furniture Facebook page https://www.facebook.com/FantasticAU on March 15th 2014
16. The judges’ decision is final and binding and no correspondence will be entered into. The Promoter reserves the right to verify the validity of all entries and reserves the right to disqualify any entrant for tampering with the entry process, including but not limited to entering inappropriate responses (including but not limited to profanity and potentially insulting, scandalous, inflammatory or defamatory language), submitting multiple entries that are not different or submitting an entry that is otherwise not in accordance with these Rules. The Promoter accepts no responsibility for late, lost or misdirected entries or other communications. Entries will be deemed void if forged, manipulated or tampered in any way.
17. The Gift is not transferrable, exchangeable or sold to another party and cannot be taken as cash.
18. The promoter shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for personal injury which is suffered or sustained, as a result of claiming or using the Gift, except for any liability which cannot be excluded by law.
19. The Promoter reserves the right to request Eligible Claimants to provide proof of age, identity and residency at the nominated delivery address. Identification considered suitable for verification is at the discretion of the Promoter.
20. All Claims become and remain the property of the Promoter. The Promoter collects claimants’ personal information in order to conduct the Promotion. If the information requested is not provided, the claimant may not participate in the Promotion. By claiming under this offer, unless otherwise advised, each claimant also agrees that the Promoter may use this information to conduct the Promotion and may disclose it to organisations that provide it with administrative services in this regard. Claimants consent to the Promoter so using and disclosing personal information. If claimants tick the opt in box on the Promotion claim form, claimants also agree that the Promoter may send future material for its future Promotional, marketing and publicity purposes. The name, state of residence and photograph of any winner may be used for promotional purposes by the Promoter unless the winner otherwise notifies the Promoter at the time of accepting the prize
21. The Promoter is bound by the National Privacy Principles under the Privacy Act 1988. All personal information will be stored at the office of the Promoter. Claimants are entitled to access, update or correct this information. Any request to do so should be directed to the Promoter at its address set out below.
22. Failure to enforce any clause of these Terms and Conditions shall not constitute a waiver of that or any other provision by the Promoter.
