Terms and Conditions – Webjet.com.au ‘Win a trip for 2 to Bali’ Competition

Information on how to enter and prizes form part of these conditions of entry. Entry into this competition is deemed to be acceptance of conditions. Webjet Marketing Pty Ltd, of Level 2, 509 St Kilda Road, Melbourne, Victoria 3004, is the Promoter (“Promoter”) and reserves the right to modify these conditions at any time without notice.
The REFERRAL Contest (“Contest”) is open to legal residents of Australia and New Zealand, who have reached 18 years of age (or in the event that a winner is under 18 years of age, the prize will be awarded if the consent of his or her legal guardian is first given and obtained) as of the beginning of the Contest Period, and who are not an employee of or domiciled with an employee of the Promoter or its affiliated companies, their advertising and promotional agencies. No purchase is necessary and only one entry is valid and permitted per entrant. The Contest is subject in all instances to compliance with applicable law.
The Contest Period runs from Tuesday 11th March, 2014 at 9:00am AEST to Friday 21st March, 2014 at 9.00pm AEST (“Contest Closing Date”).
The Contest is running in Australia and New Zealand and there will only be one winner of the Bali prize across Australia and New Zealand.
Entrants who receive a Webjet Marketing Pty Ltd email invitation are herein referred to as the ‘Initial Entrant’. Entrants who are invited by the Initial Entrant are herein referred to as the ‘Invited Friend’. To earn one (1) entry in the Contest, the Initial Entrant and the Invited Friend (collectively referred to as a ‘Team’) must submit their respective form as instructed, for the Team to earn one (1) entry.
The Initial Entrant, having received the Webjet Marketing Pty Ltd email invitation, must ensure he/she complete all mandatory fields of the entry form, and submit as instructed before the Contest Closing Date. Upon successful submission of the entry form, he/she will receive a unique link that must be sent to the friend being invited to the Team.
The Invited Friend, having received the invitation to the Team, must ensure he/she fully complete all mandatory fields of the entry form and submit as instructed before the Contest Closing Date. Upon successful submission of the entry form and having teamed up with the Initial Entrant, he/she will receive a unique link giving them the opportunity to become the Initial Entrant by sending a friend an invitation to join a new Team.
The Initial Entrant and his/her Invited Friend will only be allowed to team up once. Any attempt or suspected attempt to team up more than once with the same person by using multiple email addresses or pen names, or any use of robotic, automatic, programmed or any entry methods not authorized by these rules, shall be deemed as tampering and will void all Entries. All Entries that are incomplete, illegible, damaged, contain an erroneous phone and/or email address or do not conform to or satisfy any condition of the rules may be disqualified by the Promoter.
Following the conclusion of the Contest, Webjet Marketing Pty Ltd will select at random one Team entry as the winner. The Initial Entrant must take his/her Invited Friend to Bali. The draw will take place at the offices of. Webjet Marketing Pty Ltd, Level 2, 509 St Kilda Road, Melbourne, Victoria on Monday 24th March, 2014 at 1pm. The Initial Entrant and the Invited Friend will be notified by email (to the email address registered with the Promoter) on the same date. The winners must claim their prize by responding via email by Tuesday 24 June, 2014. Winners will be published in The Australian on the 31st March 2014.
The Promoter’s decision is final and no correspondence will be entered into.
Three attempts will be made to contact the prize winner prior to the redraw. In the event of the prize being unclaimed by Tuesday 24 June, 2014, further draw/s will take place to determine replacement winners. The draw will take place at the offices of Webjet Marketing Pty Ltd on Wednesday 25 June , 2014 at 1pm AEST. The replacement winners will be notified by email on the same day. The second chance winner will be notified directly in writing and published in The Australian on the 1 July 2014.
The prize is two (2) x return economy tickets to Denpasar, Bali with Virgin Australia plus a $1,000 hotel voucher. Each return economy ticket is valued at $1,507. Two (2) return economy tickets are valued up to $3,014. The prizes must be accepted as awarded and are not transferable or otherwise redeemable for cash. The odds of winning the prize depend on the number of eligible entries received. Upon acceptance of the prize, the prize winners agree to provide reasonable cooperation to allow Webjet Marketing Pty Ltd to use their name and/or likeness for advertising and publicity purposes in connection with this Contest including but not limited to publication of their name and photograph on the Webjet Marketing Pty Ltd websites.
Total prize pool value is $ 4,014 including taxes.
This Contest may be promoted through third party websites, like Facebook. Entrants must at all times comply with the terms of service for those third party websites when using them to participate in this Contest. This Content is in no way sponsored, endorsed or administered by, or associated with, those third party websites.
Members of the Promoter who provide incorrect or fraudulent information are ineligible to participate in the promotion. The Promoter reserves the right to request at its sole discretion, appropriate photo identification or other documentation in order to confirm the members’ eligibility to enter and claim a prize, before issuing a prize. If the documentation required by the Promoter is not received by the Promoter or its nominated agent, or the identity of the member has not been verified or validated to the Promoter’s satisfaction, then that member will be deemed invalid.
Any costs associated with accessing the promotional website are the entrant’s responsibility and are dependent on the Internet service provider used. Any contact details entered incorrectly on the website shall be deemed invalid.
The Promoter is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, technical problems or traffic congestion on the Internet or at any website, or any combination thereof, or any other technical failures, including but not limited to any injury or damage to participants’ or any other person’s computer related to or resulting from participation in or down-loading any materials in this competition. If for any reason this competition is not capable of running as planned (including but not limited to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures or any other causes beyond the control of the Promoter, which corrupt or affect the administration security, fairness, integrity or proper conduct of this competition, the Promoter reserves the right in its sole discretion to cancel, postpone, or amend this competition.
The Promoter as well as its associated agencies and companies are not liable for any loss (including, without limitation, indirect or consequential loss), damage, personal injury or death which is suffered or sustained (including but not limited to that arising from any person’s negligence) in connection with the prize or use of the prize. This excludes any liability that cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).
The Promoter reserves the right in its sole discretion to cancel, terminate, modify or suspend the promotion, and/or if necessary to provide an alternative prize or prizes to the same value as an original prize or prizes, subject to any written directions under applicable State or Territory legislation.
If any of the provisions of these terms and conditions are held to be invalid or unenforceable in whole or in part that part shall be severed from the remainder of the provisions and the validity of the other provisions and the remainder of the provision in question shall not be affected.
The Promoter collects entrants’ personal information in order to conduct the promotion. If the information requested is not provided, the entrant may not participate in the promotion. By entering the promotion, unless otherwise advised, each entrant also agrees that the Promoter may use this information and approved images (photograph and/or film recording), or disclose it to other organizations that may use it, in any media for future promotional, marketing and publicity purposes without any further reference, payment or other compensation to the entrant.

These terms and conditions shall be governed by the laws of Australia and any dispute shall be subject to the exclusive jurisdiction of the Australian courts.

Prize Conditions:
Virgin Australia Terms and Conditions

Flights must be booked by 31 July 2014.
Travel is for a period of no more than 60 days and any tickets which remain unused after the expiry date shall be deemed null and void.
Bookings must be made at least 30 days prior to travel.
Embargo and black-out periods apply and to space being available in relevant sub-class. This Prize cannot be used for travel on national school holidays, peak periods and the Christmas/New Year period.
The following costs are to be borne by the passenger: travel insurance, accommodation, excess baggage over and above the approved 20kgs, meals, all taxes, levies and surcharges, and any other travel related expenses unless stated otherwise.
Once flights have been booked and flight tickets are issued the winner is responsible for any costs associated with subsequent itinerary changes, cancellations, amendments or other administration charges.
No Velocity points will be accrued as part of this prize.
Tickets to Bali are only valid for travel ex. Melbourne, Sydney, Perth, Brisbane, Adelaide. Travel to and from Melbourne, Sydney, Perth, Brisbane, Adelaide airport do not form part of the Prize and are the responsibility of the winner.
Any tickets which remain unused after the expiry date shall be deemed null and void.
Winner and passenger must travel together.
Tickets are non-transferable, non-reroutable, non-endorsable and non-refundable.
When making a booking, names should be as per passports with 6 months validity from date of departure.
Prize is inclusive of airfare taxes, which will be covered by Webjet.
Flight schedules are subject to change without notice. Webjet makes no representation as to the safety, conditions or other issues that may exist at any destination. Domestic and international travel advice can be obtained from various sources, including government, local consular offices and the website of the Australian Department of Foreign Affairs and Trade.

Webjet Gift Voucher Terms and Conditions:

By purchasing, redeeming or attempting to redeem a Voucher, you accept and agree to be bound by these Webjet Voucher Terms and Conditions, and also the Webjet general website Terms and Conditions.
Vouchers may be redeemed at www.webjet.com.au.
Vouchers will take 72 hours to activate, and will not be redeemable for 72 hours after purchase.
Voucher amounts are in Australian dollars (AUD) and can be redeemed in Australian Dollars only.
Vouchers and unused portions of vouchers should be spent within 12 months from the date of purchase, which is the “expiry” date indicated on the voucher.
Vouchers are not redeemable for cash and are not refundable.
Webjet Vouchers are partially redeemable. Any unused balance must be utilised by the end of the validity period. Any unused balance will not be refunded or credited after the voucher expires.
Any unused balance will be placed in the recipient’s voucher account and is not transferable. The original expiration date will apply to any unused balance.
Where the cost of purchase exceeds the available voucher balance, the voucher holder will be required to make up the difference between the purchase price and voucher balance.
Webjet vouchers may be purchased using Visa, MasterCard, American Express or PayPal.
Vouchers are redeemable for bookings that contain flights or hotels. Vouchers can also be used for hotel bookings or flight bookings that include hotels, travel insurance and car hire. However only the amount payable at the time of booking can be redeemed with a Webjet Gift Voucher. Where a booking contains a hotel or car hire, a credit card must be provided to secure the booking(s).
Webjet reserves the right to close customer accounts and request alternative forms of payment if a fraudulently obtained voucher is redeemed through the Webjet web site.
Webjet disclaims responsibility for any lost or stolen vouchers. The voucher holder is responsible for the use and safety of the Voucher and is liable for all transactions on the Voucher.
To the extent permitted by law, Webjet reserves the right to change any terms contained in these Voucher Terms and Conditions at any time. Changes to the Voucher Terms and Conditions will be published on www.webjet.com.au.

General:

The prize must be taken in full by 17 December 2014 and is subject to flight availability. The prize is not available during peak times such as public holidays and school holidays and cannot be changed once the booking has been made.
The winner will be responsible for making the necessary arrangements for the prize, as detailed upon winner notification.
Unless expressly stated in these terms and conditions all other expenses become the responsibility of the winner.
If for any reason the prize, or any element of the prize, becomes unavailable for any reason, which is out of The Promoter’s control then a similar element to equal value, will be awarded in lieu subject to the Relevant State Authorities.
Judges’ decision is final and no correspondence will be entered into. The Promoter, in its absolute discretion, reserves the right to verify the validity of all entries and to disqualify any entrant who tampers with the entry process.
If the opt-in option is selected at time of entry for the Webjet email marketing list, entering the competition automatically adds your details to the respective email list.
All prizes are not redeemable for cash or transferable in full or in part. All travel must be booked at one time prior to 31 July 2014. Once flights have been booked and flight tickets are issued (including e-tickets), the winner is responsible for any costs associated with subsequent itinerary changes, cancellations, amendments or other administration charges.
The prize winners will be contacted by the Promoter via email on 24 March 2014 to the email address provided in the entry. Winners will be published in The Australian on the 31 March 2014.
All entries are deemed to be received at the time of receipt into Webjet’s database NOT time of transmission by the entrant.
It is the winner’s and their companion’s personal responsibility to ensure that they have valid documentation, including, but not limited to, valid passports and visas, which meet the requirements of immigration and other government authorities. Any fines, penalties, payments or expenditures incurred as a result of such documents not meeting the requirements of those authorities will be the sole responsibility of the winner and their companion.
Any costs in excess of the value of the Prize are the responsibility of the winner. Excess amounts will be paid by the winner in full at the time of booking flights prior to tickets being issued.
The winner and their companion are responsible for all other expenses including spending money, meals (unless specified), drinks, transfers (unless specified), laundry charges, activities (unless specified), incidentals, taxes (excluding airline and airport taxes) , energy surcharges, gratuities, services charges, passports, visas, travel insurance and all other ancillary costs. Travel insurance is highly recommended to protect against the additional costs incurred in the event of unforeseen circumstances.
The entrant releases from and indemnifies the Promoter against all liability, cost, loss or expense arising out of the entrant’s participation in the Promotion, or breach of these terms and conditions, including (but not limited to) loss of income, personal injury and damage to property and whether direct or consequential, foreseeable, due to some negligent act or omission or otherwise.
The Promoter is not responsible for any incorrect or inaccurate information, either caused by the entrant or for any of the equipment or programming associated with or utilised in this competition, or for any technical error, or any combination thereof that may occur in the course of the administration of this competition including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite network failure, theft or destruction or unauthorised access to or alteration of entries.
In the event that for any reason whatsoever the winner does not take the prize, or an element of the prize, at the time stipulated by The Promoter then the prize, or that element of the prize, will be forfeited by the winner and cash will not be awarded in lieu.
No responsibility accepted for late, lost or misdirected entries.
If the opt-in option is selected at time of entry, the entrant consents to the personal information they submit with their entry being entered into the Promoter’s marketing database to be used for future promotional, marketing and publicity purposes without any further reference or payment or other compensation to the entrant.
