Information on how to enter and the prize(s) form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions and the Privacy Policy (which can be viewed at http://www.think.edu.au/privacy-policy).

Entry is only open to Australian residents of the following states: NSW, QLD, VIC, WA and SA aged 18 years or older on the first day of the Promotion Period. Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.

Promotion commences at 12:01am AEST on 14/07/2014 and ends at 11:59pm AEST on 10/08/2014 (“Promotional Period”). This promotion is divided into two (2) components, component one (“Component 1”) and component two (“Component 2”).

Component 1

To enter Component 1, individuals must, during the Promotional Period, visit www.think20k.com.au, follow the prompts to the promotion entry page, input the requested details including their name, email address, phone number, their industry (from the drop down menu), a course of interest (from the drop down menu) and their State/Territory of residence. Individuals will then be asked to input an answer to the question “What change they would like to make with $20,000 to ‘Change Course’ and kick start their new career?” in 25 words or less, and submit the fully completed entry form, so it is received during the Promotional Period.

Multiple entries into Component 1 are permitted, subject to the following: (a) each entry must be substantially unique; and (b) each entry must be submitted separately and in accordance with entry requirements.

The judging for Component 1 will take place at Think Education, Level 3, 80 Pacific Highway, North Sydney NSW 2060. The winner will be notified by telephone and/or email. This is a game of skill and chance plays no part in determining the winner for Component 1. Each entry will be individually judged based on the expressed passion for a career change as well as literary and creative merit of the answer provided to the promotional question.

The best valid entry as determined by the judges, will win $20,000 awarded in the form of a cheque made out to the winner and a one (1) hour consultation with a Think Education Course and Careers Advisor. The one-hour (1) consultation will take place at a Think Education campus at a date and time to be determined by the winner in agreement with the Promoter. A full list of Think Education campus locations can be found at http://www.think.edu.au/our-campuses. In the event that agreement cannot be reached, the consultation may take place over the phone (at the discretion of the Promoter). Any ancillary costs associated with attending the consultation, (including but not limited to any travel or accommodation costs) will be the responsibility of the winner.

As a condition of accepting the prize for Component 1, the winner must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.

Component 2

To be eligible to enter Component 2, individuals must, during the Promotional Period submit a valid entry into Component 1. Upon submitting a valid entry into Component 1, individuals will be given the instructions on how to enter Component 2.

To enter Component 2, individuals must take an original photograph of their messy desk/workstation (“Photograph”) and then upload their Photograph via Instagram, Facebook, or Twitter during the Promotional Period by undertaking the following steps:

Instagram

a) access and login to their Instagram account; b) upload their Photograph, including the hashtag “#changemydesk”. Only Photographs that contain the hashtag #changemydesk will be eligible. Individuals must ensure that their Instagram account is set to public (not private), and that their profile photo and/or name adequately identifies them, in order to be eligible to participate.

Facebook

(a) visit the Think Education Australia Facebook Page at https://www.facebook.com/ThinkEducationGroup (“Facebook Page”); (b) select the ‘like’ button on the Facebook Page (if not done so already); (c) upload their Photograph to the Facebook Page wall (or their own Facebook wall), including the hashtag “#changemydesk”. Only Photographs that contain the hashtag #changemydesk will be eligible. Individuals must ensure that their Facebook account is set to public (not private) and that their profile photo and/or name adequately identifies them, in order to be eligible to participate.

Twitter

(a) access and login to their Twitter account; (b) upload their Photograph, including the hashtag “#changemydesk”. Only Photographs that contain the hashtag #changemydesk will be eligible. Individuals must ensure that their Twitter account is set to public (not private), and that their profile photo and/or name adequately identifies them, in order to be eligible to participate. Uploaded files must be submitted in JPEG, BMP, PNG, GIF or TIFF format, must not exceed 25MB file size.

Throughout the Promotional Period the Promoter will publish entries on a gallery featured on their website www.think20k.com.au. The Promoter reserves the right, at any time, to refuse to publish or remove any already published Photograph that they deem to be inappropriate or not in accordance with Clause 23 of these Terms and Conditions.

Multiple entries into Component 2 are permitted, subject to the following: (a) each entry must be substantially unique; and (b) each entry must be submitted separately and in accordance with entry requirements.

For the purposes of Component 2, the Promotional Period will be divided into four (4) entry periods (“Entry Periods”). Entries into each Entry Period will open and close each day based on NSW local time. Non-winning entries in each Entry Period will not be entered into subsequent Entry Period(s) and entrants cannot resubmit a non-winning entry in any subsequent Entry Period(s). The judging for each Entry Period, will take place at Think Education, Level 3 80 Pacific Highway, North Sydney NSW 2060 commencing on the dates specified in the table below. Winners will be notified through the relevant social media account and will need to provide the Promoter with further contact details in order to claim the prize. This is a game of skill and chance plays no part in determining the winners. Each entry will be individually judged based on the most creative representation of a messiest desk and the need for efficiency.

The best two (2) valid entries, as determined by the judges, in each of Entry Period 1 and 2 and the best valid entry, as determined by the judges, in each of Entry Period 3 and 4 will win $2,500 awarded in the form of a cheque made out in the winner’s name to conduct a desk/work station makeover.

As a condition of accepting a prize in Component 2, the winner must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.

The Promoter (in its absolute discretion) may choose up to ten (10) Component 2 entries throughout the Promotional Period that they deem noteworthy to also receive a prize of a $100 VISA Gift Card. General

The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.

Incomplete or indecipherable entries will be deemed invalid.

If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.

The Promoter’s decision is final and no correspondence will be entered into.

If for any reason a winner does not take or redeem a prize (or an element of the prize) within four weeks of being contacted by the Promoter, then the prize (or that element of the prize) will be forfeited.

If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification.

Total prize pool value is $36,000. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.

Entrants agree that they are responsible for any materials they submit via the promotion including but not limited to comments, recordings and images (“Content”). The Promoter may remove or decline to publish any Content without notice for any reason whatsoever. Entrants warrant and agree that. (a) they will not submit any Content that is unlawful or fraudulent, or that the Promoter may deem to be in breach of any intellectual property, privacy, publicity or other rights, defamatory, obscene, derogatory, pornographic, sexually inappropriate, violent, abusive, harassing, threatening, objectionable with respect to race, religion, origin or gender, not suitable for children aged under 15, or otherwise unsuitable for publication; (b) their Content shall not contain viruses or cause injury or harm to any person or entity; (c) they will obtain prior consent from any person or from the owner(s) of any property that appears in their Content; (d) they will obtain prior consent from any person who has jointly created or has any rights in the Content to the uses contemplated by these Terms and Conditions, and the Content does not infringe the rights (including copyright or other intellectual property rights) of any third party; (e) they consent to any use of the Content by the Promoter which may otherwise infringe the Content creator’s/creators’ moral rights pursuant to the Copyright Act 1968 (Cth) and warrant that they have the full authority to grant these rights; and (f) they will comply with all applicable laws and regulations, including without limitation, those governing copyright, content, defamation, privacy, publicity and the access or use of others’ computer or communication systems. Without limiting any other terms herein, the entrant agrees to indemnify the Promoter for any breach of the above terms.

As a condition of entering this promotion, each entrant licenses and grants the Promoter, its affiliates and sub-licensees a non-exclusive, royalty-free, perpetual, worldwide, irrevocable, and sub-licensable right to use, reproduce, modify, adapt, publish and display their entry (which shall include Content) for any purpose, including but not limited to future promotional, marketing or publicity purposes, in any media, without compensation, restriction on use, attribution or liability.

Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.

If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) to modify, suspend, terminate or cancel the promotion, as appropriate.

Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.

Except for any liability that cannot by law be excluded, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.

The Promoter collects personal information (“PI”) in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers and prize suppliers in addition to the potential disclosures identified in clause 25. Entry is conditional on providing this PI. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed at http://www.think.edu.au/privacy-policy. In addition to any use that may be outlined in the Promoter’s Privacy Policy, all entrants consent to the Promoter, for an indefinite period, unless and until the entrant opts-out of receiving such, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. The Privacy Policy also contains information about how entrants may opt out, access, update or correct their PI, how entrants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with.
