Terms and Conditions

1. Instructions on how to enter, prize details and other information contained within the promotional advertisements form part of these terms and conditions. By participating, in this promotion entrants agree to be bound by these terms and conditions.

2. Only entries with the correct code word found in The West Australian from Monday, 3 March to Friday 7 March 2014 and entered via thewest.com.au/competitions with their contact details by midnight Sunday 9 March 2014 are valid. Photocopies and facsimiles are not valid.

3. Subject to clause 14, entry is open to all residents of Western Australia over the age of 18. Winners under the age of 18 must be accompanied by a Parent or Guardian when claiming and collecting their prize. Photo identification may be required upon collection of the prize.

4. The major prize winner will be drawn at 10am on Monday, 10 March 2014.

5. The first valid entry drawn at random will be deemed the major prize winner. The winner will receive the following prize:

– Two night stay for four people on the Mandurah Canals
– A $500 luxury Pontoon cruise for four
– A meal at Catch 22 for four

6. All additional costs incurred will be at the expense of the winner.

7. The winner will be notified by telephone after the prize draw. In the instance that the winner cannot be contacted on the phone number provided by 8.30am Tuesday 11 March 2014, the prize will be forfeited and a new winner will be drawn.

8. It will be the winner’s responsibility to redeem the prize from the promoter. No cartage expenses are included in the prize.

9. The prize/s must be taken as supplied and is/are neither redeemable for cash nor transferable. No responsibility is accepted for any variation in the value of the prize.

10. It is a condition of entry that all prize winners agree to have their name and suburb published for publicity purposes if required. By participating in this competition, participants signify their acceptance of all conditions and the requirement to participate in promotional activity if required.
11. On completion of the prize draw, databases which contain the competition entries will be kept by The West Australian for twelve months. This is a mandatory requirement of the Gaming and Wagering Act WA. All coupon entries will be destroyed after this time period. No personal details will be recorded.
12. Employees of, The City of Mandurah, West Australian Newspaper Limited, their associated agencies and immediate families, are ineligible to enter.

13. All contestants release from, and indemnify The City of Mandurah, and West Australian Newspaper Limited against, all liability, cost, loss or expense arising out of acceptance of any prize(s) or participation in the competition including (but not limited to) loss of income, personal injury and damage to property and whether direct or consequential, foreseeable, due to some negligent act or omission or otherwise.
14. The City of Mandurah, West Australian Newspaper Limited and associated agencies accept no responsibility for any loss, damage, accident, death or injury resulting from the promotion.

15. Entry into this competition signifies acceptance of all conditions. The Promoters’ decision will be final and cannot be contested. No correspondence will be entered into. The Promoters reserve the right to limit entry or amend rules if considered necessary without notice.

16. The entrant consents to the use by West Australian Newspapers Limited Group and its related corporations (as defined by the Corporations Act 2001) of the entrants’ details and acknowledges that West Australian Newspapers Limited Group and its related corporations, may, at its discretion disclose and use those details for the purpose of providing you with goods or services, communicating with you, planning, research, product and business development and sales, the promotion and marketing (whether target, direct or indirect) of their businesses, services or products or those of a third party which we believe may be of benefit to you. The details will also be used to investigate complaints, as required or permitted by any law, to enable West Australian Newspapers Limited Group to perform its obligations to you under this or any other agreement and to ensure that you perform your obligations under this or any other agreement.
