TERMS AND CONDITIONS

By entering Nationwide News and Tourism New Zealand ‘New Zealand Golf Open Giveaway ‘competition, you are agreeing to the following Terms and Conditions:

1. STANDARD TERMS

1.1 Information on how to enter forms part of the Terms and Conditions. Entry into the competition is deemed acceptance of these Terms and Conditions.

2. WHO CAN ENTER

2.1 Entry is only open to Australian residents who are aged 18 years of age or over. Entrants must have a current passport and must be able to travel between 22 February 2014 and 5 March 2014. Employees and their immediate families of the Promoters and their associated agencies and companies are not eligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether by natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin.

3. HOW TO ENTER

3.1 The competition commences on Friday 24 January, 2014 at 12.01am AEST and concludes on Sunday 26 January 2014 at 11.59pm AEST (“the Competition Period”).

3.2 This competition is a game of skill, and chance plays no part in the results of this competition.

and submit an online entry form including entrant’s full name, address, postcode, daytime contact number, email address and answer to the question ‘Tell us why you deserve a spot beside Matt Griffin in the NZ Open‘ in 25 words or less. The entry judged by the Promoters in their absolute discretion to be the most creative entry will win.

3.4 Limit one (1) entry permitted per person during the Competition Period.

3.5 The time of entry will, in each case, be the time that the entry is received by the servers of the Promoters or their appointed agent or contractors for the receipt of entries and not the time of transmission by the entrant.

3.6 The Promoters, their agents, affiliates or representatives will not be liable for any lost, late or misdirected entries.

3.7 Incomprehensible, indecipherable or incomplete entries will be deemed invalid.

3.8 If there is a dispute as to the identity of an entrant, the Promoters reserve the right, in their sole discretion, to determine the identity of the entrant.

3.9 Competition entrants assign to the Promoters all right, title and interest in and to all copyright and waive all moral rights in any material created pursuant to their entry or participation in any aspect of the competition and acknowledge that the Promoters are free to use competition entries and to exercise its rights in relation thereto and entrants will not be entitled to any fee for such use.

4. JUDGING

4.1 Judging will take place at 10.00am AEST on 28 January 2014 at Nationwide News, 2 Holt St, Surry Hills 2010.

4.2 The winner will be notified within two (2) days of being determined and his or her name will be published online at thetelegraph.com.au/promotions

4.3 The Promoters’ decision in relation to any aspects of the competition is final and the Promoters will not enter into any correspondence regarding the result.

4.4 It is a condition of accepting the prize that the winner and his or her companion may be required to sign a legal release in a form determined by the Promoters in their absolute discretion.

4.5 Entries not completed in accordance with these Terms and Conditions will not be considered valid.

4.6 The Promoters reserve the right to request that the winner provide proof of identity, proof of age, proof of residency at the nominated prize delivery address and/or proof of entry validity in order to claim the prize. Proof of identification, residency and entry considered suitable for verification is at the discretion of the Promoters. In the event that a winner cannot provide suitable proof, the winner will forfeit the prize in whole and no substitute will be offered.

4.7 The Promoters reserve the right to verify the validity of entries and to disqualify any entry which, in the opinion of the Promoters, includes objectionable content, profanity, potentially insulting, inflammatory or defamatory statements, disqualify any entrant who tampers with the entry process, who submits an entry that is not in accordance with these Terms and Conditions, or who has, in the opinion of the Promoters, engaged in conduct in entering the competition which is fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the competition and/or Promoters. The Promoters reserve the right to disqualify the winner if the Promoters become aware that the winner and/or the winner’s entry is of a type described in this clause.

5. PRIZES

There will be one (1) prize winner who will receive the prize as outlined in 5.1 below:

5.1 Prize includes:

– Return Airfares from Melbourne or Sydney to Queenstown for the winner and one companion.

– Accommodation for 2 people(twin share) at the Kawarau Hotel (breakfast included)

– Participation for either the winner or their travelling companion in the NZ Pro-am Championship (played alongside the NZ Open), playing with a PGA Professional. Invitation for the other traveller to join the winner for the week.
– One designated practice round for the one player at Millbrook and The Hills from Monday 24th Feb.
– Invitation for winner and their travelling companion to attend official welcome ceremony (Players and amateurs only) on Wednesday 26th February, 2014.
– Invitation for winner and their travelling companion to attend official cocktail party on Friday 28th Feb
– Onsite hospitality at the Tournament for winner and their travelling companion (excludes dinners)
– Official NZ Open Merchandise for winner and their travelling companion
– On ground transfers for winner and their travelling companion

TOTAL PRIZE POOL VALUED AT UP TO: AU$11, 000 including GST.

5.2 Prizes cannot be transferred, exchanged or redeemed for cash.

5.3 It is a condition of accepting the prize that the winner must comply with all the conditions of use of the prize and the prize supplier’s requirements

5.4 It is a condition of accepting the prize that the winner may be required to sign a legal release in a form determined by the Promoter in its absolute discretion. [If an entrant under 18 years of age wins a prize then their parent or guardian must sign the legal release referred to inthis clause on the minor’s behalf].

5.5 Where the prize involves driving, travel or an event, winners and any companions under the age of 18 must be accompanied by their legal parent or guardian over the age of 18 at all times.

5.6 Event tickets are only valid for the date or period specified on the tickets or by the provider, and are subject to any terms and conditions imposed by the provider. Once awarded, the Promoter is not liable for any ticket that has been lost, stolen, forged, damaged or tampered with in any way.

5.8 By entering this competition, and by collecting a prize, the winner acknowledges and accepts that driving, travel and any other activities comprising the prize, are inherently dangerous and may result in death, injury, incapacity, damage to property or other losses. The Promoter is not responsible for any acts of god, such as adverse weather conditions or industrial action or civil commotion that may occur whilst the winner is travelling. It is the responsibility of the prize-winner to enquire about local issues and conditions at destinations prior to travel. The Promoter does not guarantee that the winner will enjoy the travel prize or be suited to the type of travel prize that is offered.

5.9 The winner/s (and their companion/s) is/are responsible for all other expenses including spending money, meals (unless specified), drinks, transfers (unless specified), laundry charges, activities (unless specified), incidentals, taxes (excluding departure and any other flight associated taxes included within the prize), energy surcharges, gratuities, services charges, passports, visas, travel insurance and all other ancillary costs. Travel insurance is highly recommended to protect against the additional costs incurred in the event of unforeseen circumstances. The winner is responsible for ensuring that they and their travelling companion(s) are fit to travel and have received appropriate immunisations and/or health checks prior to taking the prize.

5.10 The winner/s and travelling companions must travel at the same time, must depart from the same capital city and are responsible for transport from their residence to their nearest capital city for flight departure (Sydney or Melbourne). The winner and their travelling companion will responsible for making their way to and from the airport in Sydney or Melbourne.

5.11 If the winner/s is under the age of 18 as at the date on which the winner is determined, an adult must accompany the minor in the participation of the prize.

5.12 [The prize must be taken by 23 February 2014 and is subject to hotel and flight availability. The prize is not available during peak times such as public holidays and school holidays (if applicable) and cannot be changed once the booking has been made. Air tickets are available on the regular scheduled services of each airline and are subject to seasonal embargos. Flight itinerary may have to be adjusted depending on the airlines departure city and their current flight schedule. Frequent Flyer points are not available from any airline. A credit card imprint or cash deposit may be required from the winner at check-in to the hotel, for all incidental charges. Once accommodation vouchers are issued they are non-changeable.

5.13 Compliance with any health or other government requirements is the responsibility of the prize winner and their travel companions. All prize travel will be subject to the carrier’s General Conditions of Carriage. It is the traveller’s personal responsibility to ensure that they have valid documentation, including but not limited to valid passports and visas, which meet the requirements of immigration and other government authorities at every destination. Any fines, penalties, payments or expenditures incurred as a result of such documents not meeting the requirements of those authorities will be the sole responsibility of the traveller/s. The Promoter makes no representation as to the safety, conditions or other issues that may exist at any destination. International travel advice can be obtained from various sources, including government, local consular offices and the web site of the Australian Department of Foreign Affairs and Trade

5.14 Travel must be taken at the time specified by the promoter and must coincide with the dates of 24 February 2014 to 28 February 2014. Travel must be taken between 23 February 2014 and 30 February 2014 at the time specified by the Promoter and must coincide with the dates of 24 February 2014 to 28 February 2014. If a winner and travelling companion are, for whatever reason, unable to travel on a nominated date, or do not take an element of the prize within the time stipulated by the Promoter then that element of the prize will be forfeited by the winner. Cash will not be awarded in lieu of the prize or element thereof.

5.15 The prize is for the specified dates of the event only. If the winner (for whatever reason) is unable to travel or does not take an element of the prize within the time stipulated by the Promoter then the prize will be forfeited and cash will not be awarded in lieu of the major prize. The Promoter makes no representations or warranties about the attendance at the event of any individuals or groups involved in the marketing of the event

5.20 If the winner, for whatever reason, is unable to participate in a prize, or does not take an element of the prize within the time stipulated by the Promoters then that element of the prize will be forfeited by the winner. Cash will not be awarded in lieu of the prize or element thereof.

5.21 If the prize or any part of the prize becomes unavailable for reasons beyond the Promoters’ control, the Promoters reserve the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.

5.22 Spending money, meals, taxes (excluding airline and airport taxes), passports, visas, insurance, transfers from the winner’s home to and from his or her nearest Australian capital city airport, items of a personal nature, in-room charges and all other ancillary costs are not included unless specified in the major prize details.

5.23 The winner and his or her travel companion must depart from and return to the same departure point and travel together

5.24 Frequent flyer points will not form part of the prizes.

5.25 Itinerary and service providers (including airline and hotel) to be determined by the Promoters in their absolute discretion.

5.26 Prizes are subject to the standard terms and conditions of individual prize and service providers.

5.27 The winner may be required to present his or her credit card at time of accommodation check in.

6. NO LIABILITY

6.1 If for any reason, this competition is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the reasonable control of the Promoters which corrupt or affect the administration, security, fairness, integrity or proper conduct of this competition, the Promoters reserve the right, in its sole discretion, to disqualify any individual who tampers with the entry process, take any action that may be available and to cancel, terminate, modify or suspend the competition subject to any written directions given under State Legislation.

6.2 In the event of war, terrorism, state of emergency or disaster, the Promoters reserve the right to cancel, terminate, modify or suspend the competition or suspend or modify a prize, subject to any written directions from a relevant regulatory authority.

6.3 Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoters (including their respective officers, employees and agents) exclude all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the competition.

6.4 Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoters (including their respective officers, employees and agents) are not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoters’ control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoters) due to any reason beyond the reasonable control of the Promoters; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by the winner or entrant; or (f) use of a prize / participation in a prize.

6.5 Once prizes have left the Promoters’ possession or control, the Promoters and their associated agencies take no responsibility for prizes damaged, delayed or lost in transit.

6.6 The Promoters reserve the right, in their sole discretion, to disqualify any individual who the Promoters has reason to believe has breached any of these conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the competition. The Promoters’ legal rights to recover damages or other compensation from such an offender are reserved.

6.7 Any cost associated with accessing the competition website is the entrant’s responsibility and is dependent on the Internet service provider used.

7. PRIVACY CONSENT

7.1 The Promoters collect information about you, including for example your name and contact details which you provide when registering or using our services as well as information from other sources. We collect and use that information to provide you with our goods and services and to promote and improve our goods and services. We may share your information with our related companies and any of us may be in contact for those purposes (including by email and SMS). We may also use your information as described when we collect information from you. If you do not provide us with requested information we may not be able to provide you with the goods and services you require. We disclose your information to our related companies, service and content providers, including those located outside Australia. Where you have entered a competition, we may disclose your personal information to authorities if you are a prize winner or otherwise as required by law. 7.2 Entrants consent to the Promoters using their name, likeness, image and/or voice in the event they are the winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoters.
