STAR STABLE
Star Stable is an online fantasy stable of thoroughbred horses. The website www.starstable.com.au (the Website) and Star Stable are operated by Vapormedia Virtual Sports, a business unit of Vapormedia Group Pty Ltd ACN 095 684 067 (Vapormedia), for Tabcorp (defined below).
1. General Entry
1.1 Information on how to enter this Star Stable promotion (the Promotion) form part of these terms and conditions (the Terms and Conditions).
1.2 The promoter is Tabcorp Holdings Limited ABN 66 063 780 709 of 495 Harris Street, Ultimo NSW 2007 (the Promoter or Tabcorp).
1.3 Subject to these Terms and Conditions, entry is open to all Australian residents aged 18 years and over (the Player(s)).
1.4 By entering and/or participating in the Promotion, each Player agrees to abide by these Terms and Conditions.
1.5 Directors, officers and employees of, or contractors to, Tabcorp or any of its Related Bodies Corporate (as defined in Section 50 of the Corporations Act 2001), their immediate families and all Tabcorp agencies and companies associated with the Promotion, may enter the Promotion but will not be eligible to be awarded any prizes for participation in Star Stable, including any TAB Rewards points. For the purposes of these Terms and Conditions, the term “immediate families” includes a spouse (including de facto), parent, sibling, child, grandparent, grandchild, or parent in law and includes stepparents, stepchildren and half siblings.
1.6 Entry into the Promotion is free for all Players.
1.7 Tabcorp reserves the right to limit the number of Players in the Promotion at any time for any reason.
1.8 Any entry that fails to provide all required information may be disqualified. Tabcorp assumes no responsibility for incomplete, late or misdirected entries, or entries received through impermissible or illegitimate channels or for failed, partial or garbled computer transmissions, or for technical failures of any kind. Tabcorp reserves the right to disqualify and remove any entrant submitting an entry which is not made in accordance with these Terms and Conditions or who does not abide by the Website’s Conditions of Entry.
2. Term of Promotion
2.1 The Promotion will be based on nominated race meetings occurring between Saturday 8 March 2014 and Saturday 26 April 2014 set out in the table in clause 4.3(e) (the Promotion Period).
2.2 The entry period is from 06:00 AM (ADST) on Monday 10 February 2014 to 11:00 AM (ADST Time) Saturday 8 March 2014 (the Entry Period).
3. How to Enter
3.1 To enter, Players must first, during the Entry Period, complete the online registration form located on the Website (the Registration Process). There are no charges for completing the Registration Process and all aspects of the Promotion are absolutely free.
3.2 Once registered, each Player will receive a personalised home page, where they are required to:
a. choose a nickname, which is also used as their stable name (this name must not be offensive, otherwise objectionable, or illegal, or contain or relate to a corporation, in each case, in the Promoter’s opinion);
b. participate in the selection of a fantasy 10 horse stable (Stable) to the value of $1,000,000 fantasy dollars, one stable jockey and one stable trainer;
c. play and maintain the Stable in accordance with these Terms and Conditions; and
d. if they are invited to join a Mini League enter the appropriate details to join that Mini League. (A “Mini League” is a ‘mini competition’ within the overall promotion where friends, family and colleagues can set up their own individual competition to compete against each other).
3.3 Stables in the Mini League will score points as detailed in these Terms and Conditions.
3.4 Mini Leagues can be joined in one of two ways:
a. a Player can use the Mini League page on the Website to create and name a Mini League that other Players can be invited to join. The Player will be included in that Mini League.
b. Players invited by another Player to join a Mini League will receive an invitation and link to the registration page on the Website and once registered, will be automatically added to the Mini League.
3.5 A Player can accept an invitation from another Player to join their Mini League using a syndicate code that will be sent to them.
3.6 Mini League winners will be the highest scoring stable in that Mini League
3.7 Players can join up to 3 mini leagues at once.
3.8 Players can only enter the Promotion once per email address.
4. Game Rules and Scoring
4.1 Stable
a. Players must select 10 different thoroughbred horses (each a Horse) from a pool of Horses determined and ranked by Racing experts (Pool). Each Horse in the Pool will be categorised and given a dollar value. A Player may choose to add Horses to the Pool at his or her discretion by allocating their fantasy dollars to acquire Horses for their Stable.
b. While the Player’s initial Stable will be limited to a maximum value of $1,000,000, the value of a Player’s Stable may exceed $1,000,000 where the value of one or more Horses held by the Player increases in accordance with clause 4.3.
c. Registered Stables must be filled (meaning having 10 Horses selected) by 11:00am (ADST time) on Saturday 8 March 2014, or the stable will be ‘auto filled’.
d. At specified times during the Promotion Period, a Player may vary the composition of their Stable in accordance with these Terms and Conditions (see clauses 4.6 and 4.7).
4.2 Races
a. The Promotion will be split into 8 separate race meetings (Race Meetings) and will feature approximately 81 scoring races (Featured Races). If an additional race, or an additional race meeting, is scheduled, those races and race meetings will be included in the Promotion. If a Race Meeting or a race within a Race Meeting is abandoned or cancelled no credit allocations will be made.
b. Each Player’s Stable will receive virtual credit (Credit) if a Horse in its Stable wins or runs a place in a Featured Race throughout the Promotion Period.
c. The amount of Credit allocated to a Player’s Stable for a Horse that wins or runs a place in a Featured Race throughout the Promotion Period will equal 1 Credit per dollar of actual prize money awarded to the Horse for the relevant win or place. A Player’s Stable will not receive Credit in relation to any other payment made to the Horse by the race clubs including payments such as BOBS, VOBIS incentives, trophies or rugs.
d. Following each Race Meeting, scoring updates will be posted on the Website, setting out the number of Credits allocated to each Horse and to each Stable.
e. In the event that a Player’s Horse, jockey or trainer is unable to, or does not, participate in a Featured Race for any reason whatsoever (including where the Horse is scratched), Players are not entitled to replace the Horse, jockey or trainer (as the case may be) in relation to that Featured Race or Race Meeting, unless that Player makes a trade in one of the Trade Periods prior to the relevant Race Meeting.
f. In the event of a dead heat for any of the positions that attracts prize money, those Players who have the affected Horses, jockeys or trainers in their Stable will be allocated Credit equal to the final prize money that the relevant race club allocates to that position.
4.3 Horse Values
a. Subject to clause 4.3(c), each Horse’s value will increase each time it wins or placed in a group or listed race that is a Feature Race, during the Promotion Period. If a Player already had the Horse in its Stable, the value of the Player’s Stable will increase accordingly. If a Player wishes to trade horses in order to add a particular Horse to its Stable, it must pay the then current value of the desired Horse, which may be higher than the starting value.
b. If a Player Trades a Horse (as set out in clauses 4.6 and 4.7), the Player will receive the current Purchase Price of that Horse at the time of the Trade (e.g. if a Player acquires a Horse for $100,000 fantasy dollars, the Horse then wins a Group 1 Featured Race so that its value increases by $75,000 fantasy dollars, and the Player then Trades the Horse before the next Race Meeting, the Player will receive the new Purchase Price of that Horse, being $175,000 fantasy dollars).
c. The Purchase Price of each Horse is capped at $250,000, notwithstanding the application of the Scoring Chart.

4.4 Stable Jockey
a. Tabcorp will select a pool of jockeys that will ride during the Promotion Period. Players must select 1 jockey to accompany their Stable. If the Player’s Stable jockey comes first, second or third in one of the Feature Races, the Stable will receive 5% of the relevant Horse’s winnings (the Jockey Bonus).
b. The Jockey Bonus is based on the performance of the Player’s selected jockey and not on the performance of the Player’s Stable.
c. Registered Stables must have a jockey selected by 11:00am (ADST time) on Saturday 8 March 2014, or the Stable will be automatically allocated a jockey.
4.5 Stable Trainer
a. Tabcorp will select a pool of trainers that will train during the Promotion Period. Players must select 1 trainer to accompany their Stable. If the Player’s Stable trainer has a first, second or third in one of the Feature Races, the Stable will receive 10% of the Horse’s winnings (the Trainer Bonus).
b. The Trainer Bonus is based on the performance of the Player’s selected trainer and not on the performance of the Player’s Stable.
c. Registered Stables must have a trainer selected by 11:00am (ADST time) on Saturday 8 March 2014, or the Stable will be automatically allocated a trainer.
4.6 Trades
a. Except for wildcard horse trades (see clause 4.7), there will be seven (7) periods (Trade Periods) during the Promotion Period (see details of dates below) where Players can modify their Stable of Horses, their jockey and/or their trainer (Trades).
b. Each Trade Period allows a Player to exchange no more than:
i. two (2) Horses from their Stable with those in the Pool;
ii. one (1) jockey with another listed jockey; and
iii. one (1) trainer with another listed trainer.
c. Trades take effect prospectively, i.e. for Featured Races still to be run at the time of the Trade.
d. Upon buying a Horse, a Player will have to pay the then current Purchase Price of that Horse.
e. Upon selling a Horse, a Player will receive the then current Purchase Price of that Horse.
f. Each Stable must at all times maintain the stipulated stable number of Horses (10 Horses). Players cannot have the same Horse in their Stable more than once.
g. There will be seven (7) Trade Periods during the course of the Promotion Period. Detailed below are the opening and closing times of each Trade Period:

4.7 Wildcard Trades
a. Each Player will be entitled to make two (2) additional Trades by way of a wildcard (Wildcards) during the Promotion Period. A Wildcard allows a Player to, within its available budget and during a trade period, make an additional Horse trade to its Stable.
b. Wildcards take effect prospectively, i.e. for Featured Races still to be run at the time of the Trade.
c. Only one (1) Wildcard trade may be used in any Trade Period.
d. Trades made by way of Wildcards are tracked in each Player’s Stable for the Promotion Period.
e. Horse that are Traded by way of Wildcards will be valued as per all other Horses, as outlined in clause 4.3.
4.8 Stable Champion
a. The Race Meetings being conducted at Royal Randwick Racecourse on 12 April 2014 and 19 April 2014 respectively are referred to as ‘The Championships’ (The Championships).
b. The Trade Periods immediately prior to each of the Race Meetings that comprise The Championships (being Trade Period 5 and Trade Period 6 as further detailed in clause 4.6(g)) will allow each Player to select one (1) Horse within their Stable as their ‘Stable Champion’ by clicking on the Stable Champion Button for any Horse from their Stable.
c. The amount of Credit allocated to a Player’s selected ‘Stable Champion’ that wins or runs a place in a Featured Race throughout the Star Stable Championships will equal 2 Credits per dollar of actual prize money awarded to the Horse for the relevant win or place. A Player’s Stable will not receive any Credit in relation to any other payment made to the Horse by the race clubs including payments such as BOBS, VOBIS incentives, trophies or rugs.
5. Selection of Winners
5.1 Major Prize
a. At the completion of the Promotion, the Player with the Stable that has been awarded the highest aggregate Credit during the Promotion Period will be declared the winner (the Major Prize Winner).
b. The Major Prize Winner will be determined by the Promoter at the offices of Tabcorp, 495 Harris Street, Ultimo, NSW, at 10:00 AM (AEST) on Monday 28 April 2014 (the Major Prize Determination).
c. In the event of a tie, the Player with the Stable that has the highest value in fantasy dollars will be declared the Major Prize Winner. Should this fail to break the tie, the Player with the Stable that has the highest number of first-place finishes will be declared the Major Prize Winner. Should this fail to break the tie, the Player with the Stable that has the highest number of first and second place finishes will be declared the Major Prize Winner. Where a tie cannot be resolved by any of the means above, the Player whose entry into the Promotion was registered first in time will be declared the Major Prize Winner.
5.2 Minor Prizes
a. There will also be weekly minor prizes awarded (the Minor Prize(s)).
b. At the completion of each Race Meeting, the Stable that has been awarded the highest aggregate Credit for that Race Meeting will be declared the winner of the Minor Prize described at clause 6.1(b) below (the Minor Prize Winner). Each Minor Prize Winner will be determined by the Promoter at its offices, 495 Harris Street, Ultimo, NSW, on each of Monday 10 March 2014, Monday 17 March 2014, Monday 24 March 2014, Monday 31 March 2014, Monday 7 April 2014, Monday 14 April 2014, Tuesday 22 April 2014 and Monday 28 April 2014 (each a Minor Prize Determination). The Major Prize Winner and Minor Prize Winners are collectively referred to as Winners.
c. In the event of a tie, the Stable with the highest number of first-place finishes for that Race Meeting will be declared the Minor Prize Winner. Should this fail to break the tie, the Stable with the highest number of first and second place finishes for that Race Meeting will be declared the Major Prize Winner. Where a tie cannot be resolved by any of the means above, the Player whose Star Stable entry was registered the earliest in time will be declared the Major Prize Winner.
d. Each Minor Prize Winner will be notified by phone and/or email within 48 hours of the relevant Minor Prize Determination.
6. Prizes
6.1 There is one Major Prize and eight (8) Minor Prizes (collectively referred to as Prizes).
a. Major Prize
1st Prize: The Major Prize Winner, as determined in accordance with clause 5.1, will be entitled to receive:
A trip for two to South Africa in June 2014 to see the Durban July Handicap which will include:
2 x Economy class return international airfares to Johannesburg departing from the Winner’s nearest Australian capital city;
2 x Return group transfers from Johannesburg airport to the hotel;
2 x First class accommodation (11 nights) on a twin share basis;
2 x Coach transfers throughout as per itinerary;
2 x Breakfast daily;
2 x Game Viewing drive in Kruger National Park,
2 x Stud farm visit to Summerhill Stud;
2 x Reserved seating at Turffontein Race Track in Johannesburg;
2 x Reserved seating at Greyville in Durban for the Durban July Handicap; and AUD $1,000 spending money.
* The trip comprising the Major Prize is only valid for adults (over the age of 18). The trip is for twelve (12) nights including transit time.
Total Maximum Major Prize value: $18,300
b. Minor Prizes
At each Minor Prize Determination, the Player that was awarded the most Credit (when compared to other Players) over the preceding race meeting will be determined and will receive:
i. If a NSW or Victorian TAB Rewards Member, 100,000 TAB Rewards Points, where 1 TAB Reward Point has a value of $0.0025. Reward Points can be redeemed for rewards and privileges via the TAB Rewards website (www.tabrewards.com.au). The TAB Reward Points will be deposited the relevant Player’s TAB Rewards account within 7 days of the Minor Prize Determination; and
ii. If a NSW or a Victorian TAB Account Holder (but not a NSW or Victorian TAB Rewards Member), a $200 Account Top up. The Account Top Up will be deposited the relevant Player’s TAB Account within 7 days of the Minor Prize Determination; and
iii. If neither a NSW nor a Victorian TAB Account holder and also not a NSW or Victorian TAB Rewards Member, a $200 betting voucher, or cheque, to be sent to the Player within 21 days of the Minor Prize Determination.
Total Minor Prize Pool: $1600
TOTAL MAXIMUM PRIZE POOL (Major and Minor Prize): $19,900
7. Costs
All other costs associated with the Prizes, including but not limited to any meals (not specified), taxes, travel insurance, and other ancillary costs are the responsibility of the respective Prize winners.
8. Prize Specific Conditions
8.1 If Prizes are unavailable, for whatever reason, the Promoter reserves the right to substitute the Prizes for prizes of equal or greater value, subject to any relevant State regulations.
8.2 All Prizes must be taken as offered and cannot be varied.
8.3 Subject to clause 8.1, all Prizes must be taken on the dates specified only and cannot be transferred or redeemed for cash.
8.4 In the event that for any reason whatsoever the Major Prize Winner does not confirm acceptance of the Major Prize by phone or email within 3 months of the Major Prize Determination, cash will not be awarded in lieu of that element of the Major Prize and a re-determination will be conducted in accordance with clause 14.
8.5 Unless otherwise advised in these Terms and Conditions, all other costs associated with the redemption of the Prizes are the responsibility of the respective Winners.
9. Winner Notification
Each Winner will be notified by phone and in writing, using the details provided in their entry. Each Prize winner’s name and suburb will be published on the Website. The Winners’ names and suburbs will also be published in the Australian newspaper on Friday 2 May 2014.
10. Tax Statement
Any taxes which may be payable as a consequence of a Winner receiving one or more Prizes is the sole responsibility of that Winner. The Promoter accepts no responsibility for any tax implications that may arise from any Prize. Independent financial and tax advice should be sought prior to the acceptance of any Prize.
11. Exclusion of Liability
11.1 While the Promoter will use all reasonable endeavours to arrange the delivery of the Prizes by the times detailed in these Terms and Conditions, by entering this Promotion, Players acknowledge that circumstances beyond the control of the Promoter may prevent the delivery of the Prize by that date, or at all (including the failure by the Player to notify the Promoter of any change of delivery address or the closure of the Player’s NSW or Victorian TAB account). In circumstances where the Promoter forms a reasonable belief that any delay or loss of the Prize has not been caused or contributed by the Player’s negligence, fraud, misconduct, the Promoter may (if circumstances permit) re-deliver the Prize to the Player.
11.2 To the extent permitted by law, the Promoter is not liable to any Player for any loss (however arising) including without limitation, any direct loss, indirect loss or Consequential Loss sustained or incurred by a Player by reason of any act or omission, deliberate or negligent, by the Promoter or its servants and/or agents, in connection with this Promotion or the arrangement for supply, or the supply or failure to supply, of any goods or services by any person to a Player or a Prize winner. For the purpose of this clause, the term “Consequential Loss” includes loss of profits, loss of revenue, loss of enjoyment, loss of opportunity, loss of goodwill, loss of reputation, economic loss and/or any other remote or unforeseeable loss.
11.3 Nothing in these Terms and Conditions affect, nor is intended to affect, any rights that a Player might have that are not able to be excluded under applicable Australian law.
12. Use of Personal Information / Marketing
12.1 The Promoter complies with the National Privacy Principles contained in the Privacy Act 1988 (Cth).
12.2 Any entries become the property of the Promoter. Any information Players provide will be used by the Promoter for the purpose of conducting this Promotion.
12.3 The Promoter may disclose Players’ personal information to its contractors and agents to assist in conducting this Promotion or communicating with Players.
12.4 By entering the Promotion, Players consent to their personal information being collected, used and disclosed by the Promoter, its agents, affiliates, related business companies, other companies associated with this Promotion, and business partners for any promotional activities, including the Player’s personal participation in reasonable promotional activities as requested by the Promoter, and any marketing and publicity purposes without any further reference, payment or other compensation to the Player.
12.5 Players’ consent includes authorising the Promoter, its agents, affiliates, related business companies, other companies associated with this Promotion and business partners to send the Player future electronic messages including but not limited to, SMS, MMS, and email regarding any promotional, marketing and publicity activities.
12.6 Players’ personal information may be disclosed to State and Territory lottery departments and winners’ names published as required under the relevant lottery legislation. The Promoter will use reasonable endeavours to provide the Player reasonable prior notice where their personal information is going to be disclosed to State or Territory lottery departments or published under lottery legislation. A request to access, update or correct any information should be directed to the Promoter at 495 Harris Street, Ultimo NSW 2007.
12.7 All Players consent to the publication of their name and suburb of residence (however their full address will not be published) and agree to participate in reasonable Promotion activities as requested by the Promoter.
12.8 For more information, refer to the Promoter’s Privacy Policy located on the Website.
13. General Conditions
13.1 The Promoter and its Related Bodies Corporate (as defined in Section 50 of the Corporations Act 2001) and their respective officers, employees and agents will not responsible for and will not be liable to any Player for:
a. any condition caused by events beyond the control of the Promoter that may cause the game to be disrupted, corrupted or terminated;
b. any injuries, losses (including, without limitation, loss of profits), or damages of any kind (even where resulting from negligence of the Promoter or any other person) caused by the Prizes or resulting from acceptance, possession, use, or misuse of the Prizes, or from participation in the Promotion or downloading material from the Website; and/or
c. any printing or typographical errors in any materials associated with the Promotion.
13.2 The Promoter reserves the right, in its sole discretion, to:
a. cancel or suspend the Promotion, should the security, fairness, integrity, or proper operation of the Promotion be compromised in any way by any virus or bugs in the IT system used for this Promotion; unauthorised human intervention, or other causes beyond the reasonable control of the Promoter;
b. disqualify any Player who engages in offensive, illegal or objectionable conduct;
c. disqualify any individual who tampers with the entry process, or who submits an entry that is not in accordance with these Terms and Conditions;
d. cancel, terminate, modify or suspend the Promotion in accordance with any written directions given by any relevant government or regulatory authority to do so; and
e. request each winner provide proof of age, identity or proof of residency at the nominated Prize delivery address.
13.3 In the case of the intervention of any outside agent or event which naturally changes the result or prevents or hinders its determination, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest or strikes; the Promoter may in its absolute discretion cancel the event and recommence it from the start on the same conditions subject to State Regulation.
13.4 It is a condition of accepting a Prize that each winner may be required to sign a legal release in a form determined by the Promoter and agreed to by the Player, acting reasonably.
13.5 To the extent that a situation or issue arises for which these Terms and Conditions make no provision or in relation to which the relevant Terms and Conditions are unclear, the Promoter will make a decision regarding such situation. The Player will have the right to request an internal review of the Promoter’s decision. Subject to any regulator direction to the contrary, the decision of the internal review will be final and binding.
13.6 In the event that a Player is identified as a minor, self excluded patron, involuntarily excluded patron or any other person who is in breach of these Terms and Conditions, the Promoter reserves the right to refuse to allow the Player to take part in, or receive, any or all aspects of the Prizes, and the Promoter will notify any relevant regulator accordingly where required by law to do so. In such circumstances, a re-determination may occur.
13.7 Decisions of the management of the Promoter are final. No correspondence will be entered into.
13.8 These Terms and Conditions are governed by and must be construed in accordance with the Laws in force in New South Wales, Australia. Players submit to the exclusive jurisdiction of the Courts of New South Wales and the Commonwealth of Australia in respect of all matters arising out of or relating to these Terms and Conditions or the Promotion.
14. Unclaimed Prize Determination
14.1 If a Minor Prize is not claimed within 3 months after the relevant Minor Prize Determination, the relevant Minor Prize will be awarded to the Player who finished in second position for that week. This re-determination will take place at 10:00 AM (AEST) on Monday 28 July 2014 at the offices of Tabcorp Holdings Limited at 495 Harris Street, Ultimo, NSW subject to any written directions by the Promoter (the Unclaimed Minor Prize Determination).
14.2 If the Major Prize is not claimed within 3 months after the completion of the Promotion, the Major Prize will be awarded to the Player who finishes in second position. This re-determination will take place at 10:00 AM (AEST) on Monday 28 July 2014 at the offices of Tabcorp Holdings Limited at 495 Harris Street, Ultimo, NSW, subject to any written directions by the Promoter (the Unclaimed Major Prize Determination).
