Squarespace – Make It Awards – Win 1 of 3 prize packages valued at $30,000 each

The “Contest Entry Period” starts on 9 May 2022 at 12:01 AM Australian Eastern Standard Time (“AEST”) and ends on 3 June 2022 at 11:59 PM AEST. All entries must be received during the Contest Entry Period to be valid.

How to Enter:

During the Contest Entry Period, visit http://makeitawards.com.au (the “Website”) to submit your entry which must include honest responses to each of the provided entry fields (each such submission, an “Entry” and collectively, the “Entries”). Entries shall consist of: (a) your first name; (b) your last name; (c) the name of your business; (d) your email address; (e) your phone number; (f) your postal code; (g) your business’s ABN; and (h) answers to the following questions (such answers, the “Content”):

(i) Describe your company’s mission statement and/or company values.

(ii) What inspired you to become an entrepreneur or small business owner?

(iii) Does your company engage with or benefit your community? If so, please describe.

(iv) What was your company’s revenue for the financial year ending on 30/6/21?

(v) What is your company’s estimated revenue for this financial year?

(vi) Does your company have a website? If so, please provide the website address.

(vii) Are there any other examples of your company’s branding/design/aesthetic that you wish to share? Please include URLs, social handles, etc…

(viii) Please provide a short description of how you plan to use the $30,000 grant.

Incomplete or indecipherable Entries will be disqualified; however, Sponsor reserves the right to allow for minor deviations from the guidelines and restrictions set forth herein, based on clear intent to comply with these Official Rules, as determined by Sponsor in its sole discretion. Sponsor reserves the right, in its sole discretion, to disqualify any and all Entrants who submit more than one Entry (and void any Entries submitted by such Entrants) by using multiple/different email addresses, identities, or any other methods, or who Sponsor believes has breached any of these Official Rules, attempted to tamper with, influence or impair the administration, security, fairness, or proper administration of this Contest, or engaged in any unlawful or other improper misconduct calculated to jeopardize fair and proper conduct of the Contest. Proof of entering information is not considered proof of delivery to or receipt by Sponsor of an Entry. Any use of robotic, automatic, programmed or any other method which subverts the Entry process will void all such Entries by such methods. All Entries become the property of Sponsor.

Limit: One (1) entry per person/email address during the entire Contest Entry Period.

Automated entries are prohibited, and any use of automated devices will cause disqualification. Entrants may not enter with multiple email addresses nor may Entrants use any other device or artifice to enter multiple times or as multiple Entrants. Any Entrant who attempts to enter with multiple email addresses, under multiple identities, or uses any device or artifice to register multiple times will be disqualified and forfeits any and all prizes won, in Sponsor’s sole discretion. Multiple Entrants are not permitted to share the same email address. Should multiple users of the same email account enter the Contest and a dispute thereafter arise regarding the identity of the Entrant, the authorized account holder of said email account at the time of entry will be considered the Entrant. “Authorized Account Holder” is defined as the natural person who is assigned an email address by an Internet access provider, online service provider or other organization which is responsible for assigning email addresses or the domain associated with the submitted email address. Potential winner(s) may be required to show proof of being the Authorized Account Holder.

Content Requirements. Entrants agree that they are fully responsible for any materials they submit via their Entry. The Sponsor shall not be liable in any way for such Entry materials to the full extent permitted by law. By submitting an Entry, each Entrant represents and warrants that: (a) their Entry is original and the Entrant’s own work; (b) their Entry does not infringe or violate any third party’s rights and the Entrant will comply with all applicable laws and regulations, including without limitation, those governing copyright, trade mark, patent, trade secret, defamation, privacy, publicity, false light, idea misappropriation, contractual or other rights; (c) their Entry is true, accurate and verifiable, is not unlawful or fraudulent and is an expression of his/her personal experience and/or beliefs; (d) their Entry is not copied from any other source and that Entrant did not use the works of others in the Entry without permission or right to do so; (e) no other persons other than Entrant have any right, title or interest in any part of the Entry; (f) their Entry does not contain viruses or cause injury or harm to any person or entity; and (g) they consent to any use of their Entry which may otherwise infringe the Entrant’s moral rights pursuant to the Copyright Act 1968 (Cth) and warrant that they have the full authority to grant these rights. Without limiting any other terms herein, the Entrant agrees to indemnify the Sponsor for any breach of the above. Sponsor reserves the right to require that Entrants provide proof of statements made in their respective Entries, in a form acceptable to Sponsor. Failure of an Entrant to provide any such requested proof of statements as requested by Sponsor may result in disqualification.

Entries must not contain any image or depiction of the following: (i) materials that include or constitute trade marks, trade names or copyrighted works created or owned by any person or entity other than Entrant; (ii) materials bearing profanities or that are lewd, obscene, pornographic, disparaging, indecent or that are otherwise deemed to be inappropriate by Sponsor; (iii) materials that bear the name or likeness of any celebrity, living or dead, or that contain visibly identifiable or potentially identifiable information, including without limitation, phone numbers, street addresses, email addresses and license plate numbers; (iv) inappropriate behavior for a general audience; (v) materials that violate anyone’s reasonable privacy expectations, violate any known agreement, or that are defamatory in nature; (vi) violence in any form; (vii) materials that are derogatory to Sponsor or DNSW; (viii) materials which are discriminatory based on race, religion, national origin, physical disability, age, sex, or sexual orientation or preference; or (ix) materials that do not comply with all other requirements in these Official Rules. Entries that do not conform to these guidelines will be disqualified and Sponsor shall have no obligation to notify the Entrant is such event. Sponsor reserves the right to reject or disqualify any Entry that Sponsor, in its sole and absolute discretion, determines to be (A) inconsistent with the letter or spirit of the Official Rules or the Contest, or (B) potentially damaging to Sponsor’s, the Contest’s, or any other party’s image or reputation.

Judging/Winner Notification. This is a game of skill. Chance plays no part in determining the winners. At the conclusion of the Contest Entry Period on 6 June 2022, Sponsor will review and evaluate all valid Entries based on the below judging criteria (“Judging Criteria”), which Judging Criteria will be weighted as indicated:

Business Strategy – 40%

Innovation of Business – 25%

Benefit to Community – 20%

Branding & Design – 15%

The ten (10) Entries that receive the highest scores, as determined by Sponsor in its sole discretion, will each be a “Finalist.” Sponsor reserves the right to select fewer than ten (10) Finalists if, in Sponsor’s sole discretion, Sponsor does not receive a sufficient number of eligible and qualified Entries. In the event of a tie, Sponsor will review the tied Entries again and re-evaluate and re-rank them based on the foregoing Judging Criteria until the ten (10) Finalists are determined. Decisions of Sponsor are final and binding in all aspects of this Contest.

Following the selection of the ten (10) Finalists, all Finalist Entries will be re-judged, based on the above Judging Criteria, by a panel of qualified judges chosen by Sponsor. Subject to the other provisions of these Official Rules, the three (3) Finalists that receive the highest scores, as determined by Sponsor in its sole discretion, will each be the winners (“Winners”) of the Grand Prize (as defined below). In the event of a tie, the judges will determine the Winners based on each Finalist’s overall story and what inspired him/her to become a small business owner. Sponsor reserves the right to not award all or any prizes if, in Sponsor’s sole discretion, Sponsor deems there to be an insufficient number of eligible and qualified Finalists. Judging scores will not be revealed. The decisions of Sponsor and judges are final and binding, and no correspondence will be entered into.

Winner Notification/Conditions. Within two (2) weeks after the end of the Contest Entry Period, three (3) potential Winners will be notified via the email address provided in their Entry and will be required, within three (3) business days, to: (a) sign a liability and publicity release; and (b) provide Sponsor with all necessary tax and related financial documentation. Potential winners are subject to verification. If a potential Winner is found not to be eligible or not in compliance with these Official Rules, if attempted notification or any prize is returned as undeliverable, if any required documents are not returned within the required number of days, if a winner cannot be verified, or if a winner is otherwise unable or unwilling to accept and claim a prize as stated, then winner may be disqualified and their prize may be forfeited in Sponsor’s sole discretion. Further, if for any reason a winner does not take/redeem a component of the prize at/by the time stipulated by the Sponsor, then the component of the prize will be forfeited. Sponsor is not responsible for any change of email address, mailing address and/or telephone number of Entrants. Potential winners acknowledge that Sponsor may conduct a search into their background before a prize is awarded. Sponsor reserves the right to disqualify any potential winner based on the results of such check if Sponsor determines in its sole discretion that awarding a prize to any such individual might reflect negatively on Sponsor. By accepting the Grand Prize, each Winner consents to being photographed and/or interviewed on camera (including via virtual recording) by Sponsor and/or DNSW (“Captured Materials”). Each Winner must further agree: (i) not to release any publicity or other materials on their own or through another person or entity regarding their participation in the Contest without the prior written consent of Sponsor, which may be withheld in Sponsor’s sole discretion; and (ii) upon receipt of the Grand Prize, Sponsor and DNSW may use Winner’s name, city and state of residence, picture, portrait, likeness and voice, biographical information, Captured Materials and Content for advertising, promotional and other purposes, in any and all media (including without limitation on Sponsor and DNSW’s websites and social media channels) now or hereafter devised, in any manner, worldwide, in perpetuity, without further compensation, notification or permission.

Grand Prize & Approximate Retail Value. Each of the three (3) Winners will receive the following package of prizes (collectively, the “Grand Prize”): (a) $30,000 Australian dollars (“AUD”) to be deposited into the Winner’s bank account via electronic funds transfer (EFT) or paid by check at the Sponsor’s discretion (in the form of a grant); (b) a one (1) year annual Squarespace website subscription valued at $624 AUD; and (c) a one (1) year annual subscription to Unfold Pro valued at $140 AUD. Total approximate retail value of each Grand Prize is up to $30,764 AUD. Total prize pool value is up to $92,292 AUD. Use of the Squarespace platform is subject to the Squarespace Terms of Service available at http://www.squarespace.com/terms-of-service/ (the “Squarespace TOS”). Any ancillary costs associated with redeeming a subscription component of a Grand Prize are not included. If a subscription component of the Grand Prize is canceled, any unused balance of the subscription will not be awarded as cash. Grand Prize is awarded “as is” with no warranty or guarantee, either express or implied, to the extent permitted by law. Winners may not substitute, exchange, assign or transfer the Grand Prize or any component thereof or redeem any component of the Grand Prize for cash unless otherwise specified, but Sponsor reserves the right, at its sole discretion, to substitute a Grand Prize (or portion thereof) with one of equal or greater value and/or specification. However, in such event, the remainder of the Grand Prize will be awarded and Sponsor will have no further obligation to any Winner. All advertisements and collateral materials provided by each Winner in connection with such Winner’s receipt of the Grand Prize shall be subject to Sponsor’s prior written approval in each instance and to each winner’s acknowledgement and acceptance of Sponsor’s standard terms and conditions related thereto. Winners are responsible for all applicable taxes, if any, as well as any other costs and expenses associated with prize acceptance and use not specified herein as being provided. All Grand Prize details are at Sponsor’s sole discretion. Limit one (1) Grand Prize per person.
