Qantas Frequent Flyer – Win 20,000 Qantas points

1. Information on how to enter the promotion forms part of these terms and conditions of entry. Entry into the promotion is deemed acceptance of these terms and conditions.

2. The promoter is Qantas Airways Limited (ABN 16 009 661 901) of 10 Bourke Road, Mascot, NSW 2020 (telephone number 02 96912694) (Promoter).

3. The promotion commences at 5.00pm (ADST) on 14 March 2014 and closes at 4.59pm (AEST) on 30 June 2014 (Promotion Period).

4. Entry into the promotion is open only to Australian residents, excluding a) directors, management, agents, employees (and their immediate families) of the Promoter or Mike Da Silva and Associates (Aust) Pty Ltd ABN 50 003 894 022 (MDSA) and each of their related bodies corporate and b) registered travel companions of employees of the Promoter and its related bodies corporate (Eligible Entrants). If an entrant is under 18 years of age they must first obtain their parent or legal guardian’s permission prior to entering the promotion.

5. To enter, during the Promotion Period Eligible Entrants must complete the journey by exploring four Qantas Frequent Flyer partners on www.qantas.com/foreveryjourney and submit their details via the registration form on this website. Multiple entries are not permitted.

6. The Promoter is not responsible for any technical malfunction of any communications network or any late, lost, incorrectly submitted, delayed, ineligible, incomplete, corrupted or misdirected entry whether due to error, transmission interruption or otherwise.

7. The draw will take place at 10:00am (AEST) on 8 July 2014 at the offices of MDSA at 15 Grosvenor Street, Neutral Bay, NSW, 2089 and will be conducted by MDSA (Drawer). The winner will be determined by an automated random draw of all eligible entries. There will be one winner only. The result of the draw is final and no correspondence will be entered into.

8. If the prize winner is under the age of 18, before they can claim their prize they must obtain consent from their parent or legal guardian to do so, and must be accompanied during their prize travel (if applicable) by an Australian resident over the age of 18.

9. The Promoter reserves the right, at any time, to verify the validity of entries and Eligible Entrants (including an entrant’s identity, age and place of residence) and to disqualify any Eligible Entrant who tampers with the entry process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

10. There will be 1 prize of 20,000 Qantas Points (Prize).The total prize pool is 20,000 Qantas Points (Total Prize Pool). Qantas Points may take up to 2 weeks to be credited to the winner’s account from the draw date (or any redraw date, as applicable).

11. If the winner is not already a member of the Qantas Frequent Flyer program, membership to the Qantas Frequent Flyer program, normally valued at AU$89.50, will be included in their Prize. To accept this part of the Prize, the winner must not already be a member of the Qantas Frequent Flyer program, and must complete the standard join process including agreeing to the Terms and Conditions of the Qantas Frequent Flyer program (available at qantas.com/terms).

12. The maximum notional value of the Prize is AU $145.00. The total maximum notional value of the Total Prize Pool awarded in this Promotion is AU $234.50 based on a sample of the Qantas Frequent Flyer reward options (Awards) that could be obtained by redeeming the Prize through the Qantas Frequent Flyer program (as more fully defined in the terms and conditions of the Qantas Frequent Flyer program available at qantas.com.au/terms) as at 28 February 2014. For example, 18,400 Qantas Points could be redeemed for one, one way Economy Qantas flights from Sydney to Melbourne (subject to Award flight availability) including applicable taxes, fees and carrier charges. As at 28 February 2014, the dollar fare for an equivalent commercial one way Economy flight totals AU$145.00.

13. The estimate of the maximum notional value of the Total Prize Pool and Prize is provided for the purposes of licensing this promotion only. The maximum notional value will vary depending on how the Prize is redeemed by the winner through the Qantas Frequent Flyer program. The Promoter accepts no responsibility for any variation in the maximum notional value of the Total Prize Pool or Prize.

14. The Prize must be awarded, and must be redeemed, in accordance with and subject to the terms and conditions of the Qantas Frequent Flyer program (available at qantas.com/terms), the Qantas Frequent Flyer Store Terms of Use, if relevant, voucher terms and conditions (including expiry rules), if relevant, and any other terms and conditions disclosed at the time of redemption. The redemption of the Prize is subject to the availability of Awards that may be obtained through the Qantas Frequent Flyer program.

15. In the event the Prize is redeemed for Award travel, the winner should be aware that the number of Award flight seats available is limited and availability depends on the flight, date, season and destination and some flights may not have any Award seats available. The winner will be responsible for all applicable taxes, fees and carrier charges of Award travel or accommodation booked by redeeming their Prize. Taxes, fees and carrier charges vary depending on departure points, routes, exchange rates and dates of travel, are subject to change without notice and are quoted at the time of booking. Award flights must be booked at least 24 hours before scheduled departure (and other advance booking requirements may apply). Award travel is subject to the fare rules and the Conditions of Carriage of the relevant carrier. Compliance with immigration, health or other government requirements is the responsibility of the winner.

16. The Prize must be taken as stated and no compensation will be payable if the winner is unable to use the Prize as stated. The Prize is not transferable to another person (unless agreed to by the Promoter) or exchangeable for other goods and services and cannot be redeemed for cash. Any element of the Prize that is unused will be forfeited.

17. If the Prize (or part of a Prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the Prize (or that part of the Prize) with a Prize to the equal value and/or specification, subject to any written directions from a regulatory authority.

18. The winner will be notified in writing by email (using the details provided in the winner’s Qantas Frequent Flyer online profile or details provided on the entry form at the time of entry) within 2 business days after the draw and their name will be published on www.qantas.com.au/fflyer/dyn/program/for-every-journey-comp on 11 July 2014 and in The Australian newspaper on 14 July 2014. The winner is responsible for ensuring that his/her contact details in his/her Qantas Frequent Flyer online profile, or his/her details provided via the entry form on www.qantas.com/foreveryjourney at the time of entry, are accurate and up to date. The Promoter takes no responsibility for inaccurate or incomplete details.

19. The Promoter reserves the right to redraw in the event of any entrant being unable to satisfy these terms and conditions or forfeiting or not claiming the Prize by 12.00pm (ADST) on 8 October 2014, the Promoter may conduct such further draws on 22 October 2014 at the same time and place as the original draw as is necessary in order to distribute the Prize if unclaimed by that date subject however to any written directions given under applicable law. The second chance draw Prize winner will be notified in writing by email (using the details provided in the winner’s Qantas Frequent Flyer online profile or provided via the entry form on www.qantas.com/foreveryjourney at the time of entry) within 2 business days following the draw and their name published at qantas.com/foreveryjourney and in The Australian newspaper on 29 October 2014. The winner is responsible for ensuring that his/her contact details in his/her Qantas Frequent Flyer online profile and provided via the entry form at the time of entry is accurate and up to date. The Promoter takes no responsibility for inaccurate or incomplete details.

20. The Promoter, its related bodies corporate and their respective officers, employees, contractors and agents (Promotion Parties) will not be liable for any losses, damages, expenses, costs or personal injuries arising out of this promotion, the promotion of this promotion or the use of any prize, including but not limited to any breach of these terms and conditions, contract or tort (including negligence) and any other common law, equitable or statutory remedy (Damages) whatsoever, including but not limited to direct, indirect and consequential Damages, including Damages that cannot reasonably be considered to arise naturally and in the ordinary course of things, even if those Damages were in the contemplation of the Promotion Parties.

21. The exclusion of liability in clause 20 does not apply to limit or exclude liability:
a) for personal injury or death suffered or sustained in connection with the supply of goods or services which are supplied by the Promoter in the ordinary course of business. To remove doubt: third party goods or services, which other than in connection with this promotion, are in the normal course of business supplied by a third party unrelated to the Promotion Parties, are not supplied by the Promoter in the ordinary course of business; and the Promoter’s Conditions of Carriage and general booking conditions (and any exclusions contained therein) apply despite any statement to the contrary in these terms and conditions; or
b) to the extent it is not permissible at law to limit or exclude liability in the manner contemplated in that clause (in which case that liability is limited to the maximum extent
allowable by law).

22. If any act, omission, event or circumstance occurs which is beyond the reasonable control of the Promoter and which prevents the Promoter from complying with these terms and conditions, the Promoter will not be liable for any failure to perform or delay in performing its obligations and the Promoter reserves the right (subject to any applicable law) to cancel, terminate or modify or suspend this promotion.

23. Entry details remain the property of the Promoter. The name and photograph of the winner may be used for promotional purposes by the Promoter, unless the winner otherwise notifies the Promoter at the time of accepting a prize. Entrants consent to the Promoter using personal information provided in connection with this promotion for the purposes of facilitating the conduct of the promotion and awarding any prizes, (including to MDSA and any applicable statutory authorities). Without limiting the foregoing, entrants’ personal information provided in connection with this promotion will be handled in accordance with the Promoter’s Privacy Statement, a copy of which is available at available at qantas.com/privacy.
