Wall of Weihenstephan” Oktoberfest in the Gardens/Weihenstephan Competition 2017 Terms and Conditions
1. The promoter is: Phoenix Beers Pty Ltd (ABN 52 824 641 743) whose registered office is at 8/10 Dewar Street Morley Western Australia 6062.
2. Employees of Phoenix Beers Pty Ltd or their family members or anyone else connected in any way with the competition or helping to set up, promote or run the competition shall not be permitted to enter the competition.
3. Persons under 18 years of age are not permitted to enter the competition.
4. Competition is open to residents who reside in the states in which Oktoberfest in the Gardens events are being held only being VIC, WA, SA & NSW. Entrants from states outside of those detailed will not be eligible for The Prize.
5. To enter, Eligible Entrants must register their details during the Promotion Period and enter via www.oktoberfestinthegardens.com.au or the official Oktoberfest in the Gardens Facebook page.
6. The Promotion commences on 18/08/2017 and entries close midnight on 31/10/2017 (Promotion Period). After this date/time, no further entries to the competition will be permitted. No responsibility can be accepted for entries not received for whatever reason.
7. The rules of the competition, prize quantities and delivery are as follows:
Should the winner/s be drawn from VICTORIA, WESTERN AUSTRALIA, SOUTH AUSTRALIA:
There is 1 (one) prize. The Prize consists of 30 x Cases of Weihenstephan Beer valued at AU$1800 (The Prize).
The winner may choose their mix of beer from Weihenstephan’s core range of beers (Hefeweissbier, Kristalweissbier, Pils, Original, Traditional Dunkel or Dunkel Weissbier). Each case consists of 12 x 500ml Bottles.
The Prize will be delivered in 4 parts, each approximately 3 months apart, over a 12-month period.
The first delivery of 7 cases will occur during week commencing 13th November 2017.
Subsequent deliveries will occur as follows:
8 cases – w/c 12th February 2018
7 cases – w/c 14th May 2018
8 cases – w/c 13th August 2018
Should the winner/s be drawn from NSW, to comply with the NSW legislation, the prize will be:
There are 10 (TEN) prizes. Each Prize consists of 3 x Cases of Weihenstephan Beer (12 x 500ml Bottles) valued at AU$180 each (The Prize).
The winner may choose their mix of beer from Weihenstephan’s core range of beers (Hefeweissbier,
Kristalweissbier, Pils, Original, Traditional Dunkel or Dunkel Weissbier). Each case consists of 12 x 500ml Bottles.
The Prizes will be delivered during week commencing 13th November 2017.
8. The promoter reserves the right to cancel or amend the competition and these terms and conditions without notice in the event of a catastrophe, war, civil or military disturbance, act of God or any actual or anticipated breach of any applicable law or regulation or any other event outside of the promoter’s control. Any changes to the competition will be notified to entrants as soon as possible by the promoter.
9. No cash alternative to The Prize will be offered. The Prize is not transferable. Breakdown of product requested in The Prize is subject to availability and we reserve the right to substitute a product with another of equivalent value without giving notice.
10. The random prize draw will take place at 10:00am on 03/11/2017 at Nokturnl Events Pty Ltd, 42 O’Malley St, Osborne Park WA 6017.
11. Winners will be selected at random from a list of all entrants generated at the conclusion of the Promotion Period.
12. The winner/s will be notified by email within two (2) business days of the draw date. The winners will have their details published via the Weihenstephaner Australia Facebook page (https://www.facebook.com/WeihenstephanAustralia/) and Oktoberfest in the Gardens Facebook Page (https://www.facebook.com/OktoberfestInTheGardens) on 03/11/2017.
13. Should the winner be drawn from VICTORIA, WESTERN AUSTRALIA, SOUTH AUSTRALIA:
If the winner/s cannot be contacted or do not respond to the notification within Seven (7) days, The Prize will be withdrawn and a prize re-draw will be conducted on 10/11/2017 at the same time and place as the original draw. If a winner is drawn they will be contacted by phone and in writing within two (2) business days and will have their name published via the Weihenstephaner Australia Facebook page (https://www.facebook.com/WeihenstephanAustralia/) and Oktoberfest in the Gardens Facebook Page (https://www.facebook.com/OktoberfestInTheGardens) on 10/11/2017. If the redraw winner cannot be contacted or does not respond to the notification within 14 days, the process will repeat until a valid winner/s is found.
14. Should the winner be drawn from NEW SOUTH WALES:
If the winner/s cannot be contacted or do not respond to the notification within THREE (3) months, The Prize will be withdrawn and a prize re-draw will be conducted on 10/02/2018 at the same time and place as the original draw. If a winner is drawn they will be contacted by phone and in writing within two (2) business days and will have their name published via the Weihenstephaner Australia Facebook page (https://www.facebook.com/WeihenstephanAustralia/) and Oktoberfest in the Gardens Facebook Page (https://www.facebook.com/OktoberfestInTheGardens) on 10/02/2018.
15. The promoter will inform the winner of details of prize delivery upon notification of win.
16. The promoter’s decision in respect of all matters to do with the competition will be final and no correspondence will be entered into.
17. By entering this competition, an entrant is indicating his/her agreement to be bound by these terms and conditions.
18. The competition and these terms and conditions will be governed by Australian law and any disputes will be subject to the exclusive jurisdiction of the courts of Australia.
19. The winner agrees to the use of his/her name and image in any publicity material. Any personal data relating to the winner or any other entrants will be used solely in accordance with current Australian data protection legislation and will not be disclosed to a third party without the entrant’s prior consent.
