“RUGBY WORLD CUP 2019 , LAND ROVER MASCOT PROGRAM” PROMOTION
TERMS AND CONDITIONS
1. Information on how to enter and the prizes form part of these Terms and Conditions.
Participation in this promotion is deemed acceptance of these Terms and Conditions.
2. The Promoter is Jaguar Land Rover Australia Pty Limited (ABN 86 004 352 238) of Level 1,
189 O’Riordan Street, Mascot NSW 2020, telephone: 1800 625 642.
3. This promotion is divided into three (3) ‘Entry Periods’ as detailed below. Entry into Entry Period
1 is only open to QLD residents aged 7 to 12 years of age (inclusive) who live within a 30km
radius of Brisbane. Entry into Entry Periods 2 and/or 3 is only open to Australian residents aged
7 to 12 years of age (inclusive). Entrants must have parental/guardian approval to enter and
further, the parent/guardian of the entrant must read and consent to these Terms and
Conditions. Parents/guardians may be required by the Promoter to enter into a further
agreement as evidence of consent to the minor entering this promotion.
4. Employees (and their immediate families) of the Promoter and agencies associated with this
promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-
spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-
parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-
brother, step-sister or 1st
cousin.
5. Entries into the promotion open on 08 June, 2019 and close at 11:59pm AEST on 09 July, 2019
(“Entry Period 1”), 29 July, 2019 (“Entry Period 2”) and 18 August, 2019 (“Entry Period 3”).
6. To enter, a parent/guardian on behalf of an eligible entrant, must, during the applicable Entry
Period visit www.landrover.com.au, follow the prompts to the promotion entry page, input the
requested details and submit either a ‘rally cry’ or ‘motivational message of support’ for the
Wallabies via one (1) of the following methods:
Video Recording; or
Audio Recording
For the removal of doubt, the recording (whether it be video or audio) must be of the eligible
entrant and not the parent/guardian. The video recording must be submitted in either mp4, m4v,
x-flv, flv, wmv, mpg, quicktime, webm, x-ms-wmv, ogg, avi, mov or x-m4v format and must not
exceed 100mg in size and 60 seconds in length. The audio recording must be submitted in
mp3, m4a, aac, oga or wav format and must not exceed 100mg in size and 60 seconds in
length.
7. The Promoter reserves the right, at any time, to verify the validity of entries and entrants
(including an entrant’s identity, age and place of residence) and reserves the right, in its sole
discretion, to disqualify any individual who the Promoter has reason to believe has breached
any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful
or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion.
Errors and omissions may be accepted at the Promoter’s discretion. Failure by the Promoter to
enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter’s
legal rights to recover damages or other compensation from such an offender are reserved.
8. Incomplete, indecipherable or inaudible entries will be deemed invalid.
9. Only one (1) entry permitted per person.
10. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole
discretion, to determine the identity of the entrant.
11. There will be three (3) judging dates for the promotion, corresponding to each Entry Period,
with one (1) winner selected on each date. For the avoidance of doubt, the first judging date

for Entry Period 1 will only contain entries from QLD within a 30km radius of Brisbane CBD
received between 08 June, 2019 and 11:59pm AEST on 09 July, 2019. The judging will take
place at the Promoter’s office, Level 1, 189 O’Riordan Street, Mascot NSW 2020 on 10
July,2019 (for Entry Period 1), 30 July, 2019 (for Entry Period 2) and 19 August, 2019 (for Entry
Period 3). The judges may select additional reserve entries which they determine to be the next
best, and record them in order, in case of an invalid entry or ineligible entrant. Non-winning
entries in each Entry Period will roll over into any subsequent Entry Period judging date(s). The
winners will be notified by telephone and email.
12. This is a game of skill and chance plays no part in determining the winners. Each entry will be
individually judged based on the passion, enthusiasm displayed in, and the creative merit of,
the answer or video provided.
13. The Promoter’s decision is final and no correspondence will be entered into.
14. The best valid entry in each Entry Period, as determined by the judges, will each win a ‘Rugby
World Cup 2019 Land Rover Mascot Experience’ which includes a trip for one (1) adult and one
(1) child to Ruby World Cup 2019, Japan valued at up to AUD$9,371 depending on date (see
clause 15 below) and point of departure. Each prize includes:
Two (2) x return economy airfares from winner’s nearest Australian capital city to Japan
(see clause 16 below);
Return transfers between airport and accommodation in Japan;
Four (4) nights twin share minimum 3-star accommodation;
Two (2) tickets to a Rugby World Cup 2019 match;
The opportunity to walk the Wallabies onto the field at the beginning of a Rugby World Cup
2019 match (for the winner only);
Return transfers between Rugby World Cup 2019 match and accommodation; and
£100 spending money per day for the winner only (awarded as a voucher). For clarity, as
at 20 May, 2019 this equals AUD $748 in total, subject to change due to currency
fluctuation.
Additional spending money, meals, taxes (excluding airline and airport taxes), insurance,
passports, visas, vaccinations, transport to and from departure point, additional transfers, items
of a personal nature, in-room charges and all other ancillary costs are not included. Each prize
will be awarded to the winner’s nominated parent or guardian on the winner’s behalf, and during
the entire duration of the prize, a nominated parent/guardian must accompany the winner.
Winners and their companions are responsible for ensuring that they have valid passports, and
any requisite visas, vaccinations and travel documentation. Winners (and their companions)
must depart from and return to the same departure point and travel together. Itinerary to be
determined by the Promoter in its absolute discretion. Frequent flyer points will not form part of
the prize. Prize is subject to the standard terms and conditions of individual prize and service
providers.
15. Each prize must be taken to coincide with the Rugby World Cup 2019 match in Japan on the
following dates:

The Promoter will liaise with each winner to determine the exact departure dates. Winner 1 will
fly to Sapporo City, Japan. Winners 2 and 3 will fly to Tokyo Metropolitan, Japan.
16. In the event of war, terrorism, state of emergency or disaster, the Promoter reserves the right
to cancel, terminate, modify or suspend the promotion, or suspend or modify a prize.

17. If for any reason a winner does not take / redeem a prize (or an element of the prize) at / by the
time stipulated by the Promoter, then the prize (or that element of the prize) will be forfeited.
18. If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right
to substitute the prize (or that part of the prize) with a prize to the equal value and/or
specification.
19. Total prize pool value is up to AUD$27,251. Prizes, or any unused portion of a prize, are not
transferable or exchangeable and cannot be taken as cash, unless otherwise specified.
20. Entrants agree that they are fully responsible for any materials they submit via the promotion
including but not limited to comments, recordings and images (“Content”). The Promoter shall
not be liable in any way for such Content to the full extent permitted by law. The Promoter may
remove or decline to publish any Content without notice for any reason whatsoever. Entrants
warrant and agree that:
(a) they will not submit any Content that is unlawful or fraudulent, or that the Promoter may
deem in breach of any intellectual property, privacy, publicity or other rights, defamatory,
obscene, derogatory, pornographic, sexually inappropriate, violent, abusive, harassing,
threatening, objectionable with respect to race, religion, origin or gender, not suitable for
children aged under 15, or otherwise unsuitable for publication;
(b) their Content shall not contain viruses or cause injury or harm to any person or entity;
(c) they will obtain prior consent from any person or from the owner(s) of any property that
appears in their Content;
(d) they will obtain full prior consent from any person who has jointly created or has any rights
in the Content to the uses contemplated by these Terms and Conditions, and the Content
does not infringe the rights of any third party;
(e) they consent to any use of the Content which may otherwise infringe the Content
creator’s/creators’ moral rights pursuant to the Copyright Act 1968 (Cth) and warrant that
they have the full authority to grant these rights; and
(f) they will comply with all applicable laws and regulations, including without limitation, those
governing copyright, content, defamation, privacy, publicity and the access or use of others’
computer or communication systems.
Without limiting any other terms herein, the entrant agrees to indemnify the Promoter for any
breach of the above terms.
21. As a condition of entering this promotion, each entrant licenses and grants the Promoter, its
affiliates and sub-licensees a non-exclusive, royalty-free, perpetual, worldwide, irrevocable,
and sub-licensable right to use, reproduce, modify, adapt, publish and display their entry (which
shall include Content) for any purpose, including but not limited to future promotional, marketing
or publicity purposes, in any media, without compensation, restriction on use, attribution or
liability.
22. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event
they are a winner (including photograph, film and/or recording of the same) in any media for an
unlimited period without remuneration for the purpose of promoting this promotion (including
any outcome), and promoting any products manufactured, distributed and/or supplied by the
Promoter.
23. If this promotion is interfered with in any way or is not capable of being conducted as reasonably
anticipated due to any reason beyond the reasonable control of the Promoter, including but not
limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the
right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or
(b) to modify, suspend, terminate or cancel the promotion, as appropriate.
24. Any cost associated with accessing the promotional website is the entrant’s responsibility and
is dependent on the Internet service provider used.

25. Each winner and his/her companion as applicable agree to comply with the terms and
conditions applicable to the issue and use of tickets from time to time (as available and set out
at https://info.tickets.rugbyworldcup.com/tickettc-e/ or such other webpage as determined by
Rugby World Cup Limited (“RWCL”) from time to time), the tournament organiser (Japan Rugby
2019, “JR2019”) and all applicable venue owner or operator rules and regulations to access
Rugby World Cup venues and any other areas associated with Rugby World Cup (including
any terms of accreditation determined by RWCL). Further each winner and his/her guest(s)
acknowledge that he/she may be required to enter into a direct acknowledgement and/or
agreement with RWCL and/or JR2019 concerning use of the tickets and compliance with ticket
terms and conditions prior to receiving the prize.
26. Winners and/or companions shall not, while using Rugby World Cup tickets, display or publicise
any political slogans or homophobic language, images of a lewd or explicitly sexual nature,
images containing logos of competitors and overt brand sponsorship or anything else deemed
to ambush marketing or an abuse of the Rugby World Cup, content which is defamatory,
obscene, illegal, vulgar, offensive or otherwise unsuitable or infringes others’ rights (including
intellectual property rights) or reflects negatively upon any of RWCL or the Rugby World Cup.
Each entrant agrees and acknowledges that any breach of this clause will cause significant
damage and loss to RWCL.
27. The Promoter may pass personal information relating to prize winners to RWCL and/or JR2019
(and any of their service providers or agents) for the purposes of monitoring the distribution and
use of Rugby World Cup tickets and related experiences and, in the event of a suspect breach
of any terms and conditions, rules or regulations of RWCL and/or JR2019 relating to the use of
such tickets and/or experiences, investigating and taking action against such winners.
28. This promotion is run by the Promoter with the permission of RWCL. Accordingly the Promoter
is responsible for the operation of and all matters and concerns relating to the promotion, not
RWCL or any other persons involved in staging of Rugby World Cup 2019 (including JR2019)
and World Rugby (formerly the International Rugby Board), all of whom shall not be responsible
for or liable to entrants in any way whatsoever in connection with this promotion.
29. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude
or modify the statutory consumer guarantees as provided under the Competition and
Consumer Act (Cth), as well as any other implied warranties under the ASIC Act (Cth)
or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable
Guarantees”). Except for any liability that cannot by law be excluded, including the Non-
Excludable Guarantees, the Promoter (including its respective officers, employees and agents)
excludes all liability (including negligence), for any personal injury; or any loss or damage
(including loss of opportunity); whether direct, indirect, special or consequential, arising in any
way out of the promotion.
30. Except for any liability that cannot by law be excluded, including the Non-Excludable
Guarantees, the Promoter (including its respective officers, employees and agents) is not
responsible for and excludes all liability (including negligence), for any personal injury; or any
loss or damage (including loss of opportunity); whether direct, indirect, special or consequential,
arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not
under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c)
any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after
their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter;
(d) any variation in prize value to that stated in these Terms and Conditions; (e) if a Rugby
World Cup 2019 match is delayed, postponed or cancelled for any reason beyond the
reasonable control of the Promoter; (f) any tax liability incurred by a winner or entrant; or (g)
taking of a prize / participation at the prize event.
31. As a condition of accepting the prize, the winners (and his/her companions) must sign any legal
documentation as and in the form required by the Promoter and/or prize suppliers in their
absolute discretion, including but not limited to a legal release and indemnity form. A nominated
parent/legal guardian any person under the age of 18 will be required to sign the legal
documentation required under this clause on their behalf.

32. The Promoter collects personal information (“PI”) in order to conduct the promotion and may,
for this purpose, disclose such PI to third parties, including but not limited to agents, contractors,
service providers and prize suppliers. Entry is conditional on providing this PI. The Promoter
will also use and handle PI as set out in its Privacy Policy, which can be viewed
at https://www.landrover.com.au/privacy-policy.html. In addition to any use that may be
outlined in the Promoter’s Privacy Policy, the Promoter may, for an indefinite period, unless
otherwise advised, use the PI for promotional, marketing, publicity, research and profiling
purposes, including sending electronic messages or telephoning the entrant. The Privacy Policy
also contains information about how entrants may opt out, access, update or correct their PI,
how entrants may complain about a breach of the Australian Privacy Principles or any other
applicable law and how those complaints will be dealt with. All entries become the property of
the Promoter. The Promoter may disclose entrant’s PI to entities outside of Australia – see
Privacy Policy for details.
