HOW TO ENTER
Simply tell us in 25 words or less ”Why you would love to run the TCS New York City Marathon with your
running buddy” and complete the online entry form at www.newbalance.com.au between 03/06/18 and
15/06/18 to be entered into the competition.
Entries close 15/06/18 at 11.59pm (AEST)

CONDITIONS OF ENTRY
1. Information on how to enter and prizes forms part of these conditions. Entry into this
competition is deemed to be an acceptance of these conditions.
2. The Promoter is New Balance Australia Pty Ltd, ABN 65 003 049 296, 47 Wangara Road,
Cheltenham VIC 3192.
3. Entry is open to Australian residents 18 years or older. The Promoter and its agencies directly
associated with the organisation of this promotion and their immediate families are not eligible
to enter.
4. Competition commences at 00.01am AEST on 03/06/18 and closes at 11.59pm on 15/06/18
(Promotional Period). Entries are deemed received at the time of receipt by the Promoter in its
promotional database and not at the time of transmission by the entrant.
5. Entrants may enter this Promotion once only. All eligible entries will be reviewed by a panel of
judges from the Promoter or commissioned by the Promoter on or before 25/06/18 at New
Balance Australia, 47 Wangara Road, Cheltenham VIC 3192. The two most unique and inspiring
entries as determined by the Promoter in its absolute discretion, will be declared the Winners.
The judging panel will also determine the third most unique and inspiring entry to be declared
the Second Chance winner. The Winners will be notified by email or phone and the winners’
names will be published at www.newbalance.com.au from 02/07/18.
6. The two Winners will each win a trip for two people to New York for 5 nights (2-6/11/18) to
compete in the TCS New York City Marathon valued at AUD$8,180. Total prize pool: 2 prizes.
Maximum total value of prize pool is AUD$16,360. The prize trip includes return economy class
airfares from Melbourne or Sydney to New York for two people, 4 star twin share
accommodation, return private airport transfers to New York accommodation, entry into the TCS
New York City Marathon, New Balance product and AUD$550 spending money. Prize travellers
must be physically able to, and must commit to participating in the 2018 TCS New York City
Marathon and must also commit to wearing the supplied New Balance apparel and shoes whilst
participating in the 2018 TCS New York City Marathon. Prize does not include; additional
spending money, meals, drinks, transport to and from Melbourne or Sydney departure points,
passports, departure taxes, vaccinations, visas, travel insurance or any other ancillary costs,
which are the sole responsibility of the winner. Prize trip must be taken 2-6/11/18 and is subject
to flight and accommodation conditions and availability. Prize travellers must have and maintain
valid passports endorsed with all relevant visas and with expiry dates no less than six (6) months
following the proposed dates of travel. These passports, and their holders, must not be subject to
any restrictions on their rights to travel to the USA or transit countries. The Promoter will not be
held responsible if a prize winner does not qualify for travel insurance, cannot obtain a relevant
visa and is not required to substitute a different prize or prize of equivalent value. Prize is not
transferable or exchangeable and cannot be taken as cash. If the prize or a component of the
prize is unavailable, the Promoter, in its absolute discretion, reserves the right to substitute the
Prize with a prize to the equal or greater value and/or specification. The Promoter’s decision is
final and no correspondence will be entered into.
7. If the Winner cannot be contacted by email or phone by 5pm (AEST) on 30/07/18, is not able to
satisfy these Terms and Conditions, or forfeits or fails to accept their prize by 5pm on 30/07/18,
then they will be deemed to have forfeited their entitlement to their prize. In those
circumstances, the Second Chance winner will be awarded the prize. The Second Chance winner
will be notified by email or phone and their name published at www.newbalance.com.au from
06/08/18.
8. Prize winners are advised that tax implications may arise from their prize winnings and they
should seek independent financial advice prior to the acceptance of the prize.
9. To the extent permitted by law, The Promoter is not liable for any loss or damage that is suffered
(including but not limited to indirect or consequential loss), or for any personal injury suffered or
sustained, as a result of entering this Promotion, or receiving, accepting or using any prize,
except for any liability which cannot be excluded by law.
10. Entries will be deemed to be accepted at the time of receipt by the Promoter and not at the time
of transmission by the entrant. The Promoter is not liable for any delays in the processing of
information or for late, lost or misallocated entries. If for any reason this promotion is not
capable of running as planned, including but not limited to reasons due to computer viruses,
bugs, tampering, unauthorised intervention, technical failures or any other causes beyond the
control of the Promoter which corrupt or affect the administration, security, fairness, integrity or
proper conduct of this promotion, the Promoter may in its sole discretion to cancel, terminate,
modify or suspend the promotion, subject to any written directions under State or Territory
legislation.
11. The Promoter may verify the validity of entries and disqualify any entrant for tampering with the
entry process, submitting an entry which is not in accordance with these Conditions of Entry, or
for engaging in any unlawful or other improper conduct calculated to jeopardise the fair and
proper conduct of the promotion. The Promoter’s legal rights to recover damages or other
compensation from such an offender will not be affected by the disqualification.
12. The Promoter collects personal information about entrants to include entrants in the promotion
and where appropriate, award prizes. If any information requested by the Promoter is not
provided, the entrant may not participate in the promotion. By entering the promotion, each
entrant agrees that the Promoter may disclose entrants’ personal information to relevant lottery
departments, and that the winner’s name and locality will be published as required under the
relevant lottery legislation. A request to access, update or correct any personal information
should be directed to the Promoter at the address stated in condition 2.
