TERMS AND CONDITIONS

1. Information on how to enter and the prize form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.

2. Entry is only open to Australian residents aged 18 years or over. Employees (and their immediate families) of the Promoter, participating Coles supermarkets and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.

3. Promotion commences at 12:01am AEDST on 01/05/2014 and ends at 11:59pm AEST on 30/09/2014 (“Promotional Period”).

4. To be eligible to enter, individuals must purchase a Mutti Polpa 2 pack product in specially marked “Win A Trip To Italy’ packaging from a participating Coles supermarket nationally before 11:59pm AEST on 30/09/2014. To enter, individuals must then during the Promotional Period:

a) visit www.muttiparma.com.au and follow the prompts to the competition entry page;

b) input the requested details manually or allow the Promoter to access the requested details via Facebook (to do this the entrant must log-in as requested using their Facebook log-in details);

c) include the batch number from at least one (1) of their Mutti Polpa cans (batch number is found on the bottom of each Mutti Polpa can); and then

d) finalise their entry by choosing one (1) of the three (3) following options:

I. Photo Entry – take an original photo of themselves featuring their Mutti Polpa product (either its contents or the Mutti Polpa can) and expressing within the photograph how they felt when they first tasted Mutti Polpa, and then submit the fully completed online entry form. Uploaded files must be submitted in JPEG, JPG or PNG format, and must not exceed 4MB MB file size; or

II. Video Entry – create a short movie no longer than 30 seconds in duration featuring their Mutti Polpa product (either its contents or the Mutti Polpa can) and expressing within the video how they felt when they first tasted Mutti Polpa and then submit the fully completed online entry form. Video entries can be recorded straight from compatible computers and laptops or uploaded. Uploaded files must be submitted in MPEG, MOV, MP4, AV or WMV format, and must not exceed 20MB; or

III. Written Entry – provide an answer to the question, in 50 words or less, “How did you feel when you first tasted Mutti Polpa?” in the space providedand then submit the fully completed online entry form.

5. One (1) entry is permitted per Mutti Polpa can purchased in accordance with clause 4 above.

6. Once vetted by the Promoter, entries will be uploaded on to the gallery of the competition website for the purposes of public viewing.

7. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry processor engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of thepromotion. Errors and omissions may be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.

8. Incomplete, indecipherable, inaudible or illegible entries will be deemed invalid.

9. Multiple entries permitted, subject to the following: (a) only one (1) entry permitted per Mutti Polpa can purchased as part of a Mutti Polpa 2 pack in specially marked “Win A Trip To Italy’ packaging; (b) each entry must be substantially unique; (c) only one (1) batch code per entry is permitted; (d) unrecognised batch codes will be deemed invalid; and (e) each entry must be submitted separately and in accordance with entry requirements.

10. Entrants must retain each Mutti Polpa can (clearly specifying the batch number used to enter) and a photocopy of their Coles Supermarket purchase receipt(s) for all entriesas proof of purchase. Failure to produce the proof of purchase for all entries when requested may, in the absolute discretion of the Promoter, result in invalidation of ALL of an entrant’s entries and forfeiture of any right to a prize.

11. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.

12. The judging will take place at Sandhurst Fine Foods, 4 Kiama Street, Miranda NSW 2228, Australia commencing on 13/10/2014. The judges may select additional reserve entries which they determine to be the next best, and record them in order, in case of an invalid entry or ineligible entrant. The winner will be notified by email. This is a game of skill and chance plays no part in determining the winner. Each entry will be individually judged based on artistic and creative merit and overall popularity. The Promoter’s decision is final and no correspondence will be entered into.

13. The best valid entry, as determined by the judges, will win a trip for two (2) peopleto Italyvalued at up to AU$11,444 depending on date andpoint of departure including:

two (2) x return economy airfares from winner’s nearest capital city to Rome, Italy;
two (2) nights twin share accommodation in Rome in a minimum 4-star hotel with breakfast for two (2) people daily;
return transfers for two (2) people from Rome airport to hotel in Rome;
a seven (7) day and six (6) night all inclusive cooking class in Tuscany for two (2) people which includes:

I. Six (6) nights twin share accommodation in a minimum 4 star equivalent lodging;

II. Breakfast, lunch and dinner daily;

III. cooking lessons, for one (1) week), for two (2) people (the first cooking class is available from the week commencing 12/04/2015 and the last available cooking class available in 2015 is the week commencing 01/11/2015 and the class must be taken within these dates. If the prize is taken outside of these dates, the cooking class element of the prize will be forfeited and will not be redeemable for cash);

IV. A Tour for two (2) people (Tour includes visiting Lucca, Pietrasanta, a marble studio, Forte de Marmi, Pisa, Lake Massaciuccoli and the local Viareggio food market);

V. Rail transfers (from Rome to Pisa Central Railway Station in Tuscany) for two (2) people;

VI. Transfers (from Pisa Central Railway Station to Toscana Saporita Cooking School) for two (2) people;

VII. Taxes; and

VIII. Tips and gratuities;

AU$1,500 spending money for the winner only; and
basic travel insurance for a period of up to ten (10) days for two (2) people.

Additional spending money, additional meals, additional taxes (excluding airline and airport taxes), additional insurance, passports, visas, vaccinations, transport to and from departure point, additional transfers, items of a personal nature, in-room charges and all other ancillary costs are not included. Prize must be booked by 16/01/2015 and travel must be completed by 31/12/2015 and is subject to booking and flight availability.

14. Each winner and their companion will each be required to fully complete a travel insurance application form provided by the Promoter, and may also be required to undergo medical tests as required by the Promoter’s nominated travel insurer, in order to redeem the travel insurance element of the prize. Any person found guilty of insurance fraud or failure to honestly and accurately disclose all relevant insurance information at the time of applying for a travel insurance policy or when making a claim forfeits any rights or entitlements to the travel insurance element of the prize. Travel insurance will be provided by the Promoter’s nominated travel insurer, and subject to approval by the travel insurer. In the event that the Promoter’s nominated travel insurer refuses to issue insurance to the winner and/or companion, the winner forfeits that travel insurance element of the prize. Travel insurance is subject to the terms and conditions issued by the Promoter’s nominated travel insurer, including but not limited to any limitations on the covered amount.

15. If the winner decides to take a companion under the age of 18, the winner must accompany their companion during the entire duration of the prize.

16. The winner (and their companion) must depart from and return to the same departure point and travel together.

17. Itinerary to be determined by the Promoter in its absolute discretion.

18. Frequent flyer points will not form part of the prize. The prize is subject to the standard terms and conditions of individual prize and service providers. The winner may be required to present their credit card at time of accommodation check in.

19. If for any reason the winner does not take the prize (or an element of the prize) at the time stipulated by the Promoter, then the prize (or that element of the prize) will be forfeited and will not be redeemable for cash.

20. Subject to the terms and conditions of the participating prize provider(s), if for any reason the winner does not, once the prize has been booked, take the prize (or an element of the prize) at the time stipulated, then the prize (or that element of the prize) will be forfeited and will not be redeemable for cash.

21. In the event of war, terrorism, state of emergency or disaster, the Promoter reserves the right to cancel, terminate, modify or suspend the promotion, or suspend or modify a prize.

22. If the prize (or part of the prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification.

23. Total prize pool value is up to AU$11,444.00. The prize, or any unused portion of the prize, is not transferable or exchangeable and cannot be taken as cash.

24. When an entrant submits any materials via the promotion including comments, recordings, videos and images (“Content”), the entrant, unless the Promoter advises otherwise, licenses and grants the Promoter, its affiliates and sub-licensees a non-exclusive, royalty-free, perpetual, worldwide, irrevocable, and sub-licensable right to use, reproduce, modify, adapt, publish and display such Content for any purpose in any media, without compensation, restriction on use, attribution or liability. Entrants agree not to assert any moral rights in relation to such use and warrant that they have the full authority to grant these rights.

Entrants agree that they are fully responsible for the Content they submit. The Promoter shall not be liable in any way for such Content to the full extent permitted by law. The Promoter may remove any Content without notice for any reason whatsoever. Entrants warrant and agree that: (a) they will not submit any Content that is unlawful or fraudulent, or that the Promoter may deem in breach of any intellectual property, privacy, publicity or other rights, defamatory, obscene, derogatory, pornographic, sexually inappropriate, violent, abusive, harassing, threatening, objectionable with respect to race, religion, origin or gender, not suitable for children aged under 15, or otherwise unsuitable for publication; (b) they will obtain prior consent from any person or property that appears in their Content; (c) they will obtain full prior consent from any person who has jointly created or has any rights in the Content, to the uses and terms herein; (d) their Content shall not contain viruses or cause injury or harm to any person or entity; and (e) they will comply with all applicable laws and regulations, including without limitation, those governing copyright, content, defamation, privacy, publicity and the access or use of others’ computer or communication systems.

Without limiting any other terms herein, the entrant agrees to indemnify the Promoter for any breach of the above terms.

25. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.

26. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) to modify, suspend, terminate or cancel the promotion, as appropriate.

27. Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used. The use of any automated entry or voting software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.

28. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.

29. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) if the cooking class in Tuscany that forms part of the prize is cancelled or postponed for any reason beyond the reasonable control of the Promoter; (f) any tax liability incurred by a winner or entrant; or (g) use of the prize and/or participation in the prize.

30. As a condition of accepting the prize, the winner (and their companion) must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.

31. The Promoter collects personal information (“PI”) in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers and prize suppliers. Entry is conditional on providing this PI. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed at http://retail.sandhurstfinefoods.com.au/privacy/. In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. The Privacy Policy also contains information about how entrants may opt out, access, update or correct their PI, how entrants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. All entries become the property of the Promoter. The Promoter will not disclose entrant’s personal information to any entity outside of Australia.

32. Entry and continued participation in the promotion is dependent on entrants following and acting in accordance with the Facebook Statement of Rights and Responsibilities, which can be viewed at www.facebook.com/terms.php.

33. This promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook. Entrants understand that they are providing their information to the Promoter and not to Facebook. The information an entrant provides will only be used for the purposes outlined in these Terms and Conditions. Any questions, comments or complaints about this promotion must be directed to the Promoter and not to Facebook. Facebook will not be liable for any loss or damage or personal injury which is suffered or sustained by an entrant, as a result of participating in the promotion (including taking/use of a prize), except for any liability which cannot be excluded by law.
