Mountain Designs & Peregrine Adventures ‘Win an Adventure Trip for Two’ Online Competition
TERMS AND CONDITIONS:
Information on how to enter and the prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
1. The Promoter is Mountain Designs Holdings Pty Ltd of 433a Nudgee Road, Hendra, QLD, 4011 ABN: 33 010 021 557, Telephone: (07) 3114 4300.
METHOD OF ENTRY
2. Entrants must be Australian residents to be eligible for prize.
3. Mountain Designs Holdings Pty Ltd (“Mountain Designs”) and Peregrine Adventure employees and their immediate families are ineligible to enter.
· Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
4. To enter, participants:
· Must enter their details and complete the online competition entry form as specified on the Mountain Designs website at www.mountaindesigns.com/adventure-competition
5. NOTE: By entering the competition, entrants agree to receive communications from Mountain Designs and Peregrine Adventures. The decision by entrants to grant their consent in relation to the use of their information for marketing purposes will be confirmed and received as part of their competition entry submission. The option to unsubscribe from communications will be available on receipt of the first communication.
6. Entry is only open to Australian residents aged 18 years or over.
7. The competition period starts on 11th September 2014 and ends on 12th October 2014 at 11.59pm AEST (the “Promotional Period”). Entries will only be accepted during the Promotional Period.
8. All valid entries submitted during the specified Promotional Period, will be entered into the prize draw to win the nominated prizes.
9. Entries are limited to one (1) per person and must be submitted in accordance with the entry requirements.
10. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
11. Incomprehensible and incomplete entries will be deemed invalid.
PRIZES
1. The prize will consist of a travel package for two (2) people supplied by Mountain Designs and Peregrine Adventures. The prize will be valued up to AUD$6,170 (dependent on chosen trip) and consist of:
· Two (2) x return economy flights from Sydney or Melbourne to trip destination, to the maximum total value of AUD$2,500 (including taxes).
· Choice of one (1) Peregrine Holiday Package for two (2) people from the following Peregrine Adventure tours:

3. Additional expenses not included on all trips: Airport departure taxes, airport departure/arrival transfers, transport from winner’s home to tour departure point and transport from tour end point to winner’s home (including any additional airfare costs), pre- and post- tour accommodation, spending money, city taxes, entrance fees, transport, visas, insurance (compulsory on all trips), meals and drinks not listed, any optional tours and activities during free time, laundry, camera fees, excess baggage charges, showers on trek (if available), tips or gratuities and items of a personal nature, are not included and are at the winner’s expense.
4. International Airfare Terms and Conditions: The value of taxes and government charges are not included, and must be paid by the winner.
5. Bookings must be finalised by 20th January 2015 or the prize will be forfeited. Travel must be completed by 30 September 2015. Prize is subject to availability.
6. Departure date of the airfares is subject to availability at the time of booking and can only be confirmed by Peregrine Adventures.
7. The prize is a moderate walking trip. A reasonable level of fitness is required.
8. Prize is provided on a twin share basis. Winner and guest must travel together.
9. Estimated prize value may fluctuate slightly due to time of the year the trip is taken in relation to high and low season. The value of this prize, itinerary and inclusions are correct at time of printing and subject to change. Any change to the prize between the publishing date and the date prize is claimed is not the responsibility of the promoter/s. All prize values are in Australian dollars.
10. The prize and booking of the prize are subject to the standard booking terms and conditions of Peregrine Adventures. Winner must hold a valid passport and must obtain the necessary visas prior to travel, both of which are at the winner’s expense.
11. Once prizes have left the prize supplier’s premises, The Promoter takes no responsibility for prize/s damaged, delayed or lost in transit.
12. The Promoter and Peregrine accept no responsibility for changes in prize value, tour itinerary or inclusions between now and the ultimate travelling date. Compensation will not be offered for any changes. The prize and booking of the prize is subject to the standard Peregrine Adventures booking terms and conditions which will be provided to the winner.
13. In the event that any prize item is unavailable, the Promoter reserves the right to substitute a different prize item of equal or greater value, subject to approval in accordance with state regulations.
PRIZE DRAW AND WINNER NOTIFICATION
1. This is a chance draw, so a winner will be randomly selected from the pool of entrants between the specified dates (Promotional Period).
2. Prize draw will take place at Mountain Designs Head Office, 443a Nudgee Road, Hendra QLD 4011 on 20th October 2014 at 10am AEST. The winner will be notified by email and phone within 2 days of the competition prize draw. Mountain Designs reserves the right to publish the name on the winner on the Mountain Designs website (www.mountaindesigns.com/adventure-competition) and Mountain Designs Facebook page.
CLAIMING PRIZE
1. Prize is subject to availability at time of reservation. The winner agrees to contact Peregrine Travel Centre Melbourne on 1300 854 445 or by email sales@peregrineadventures.com at their earliest convenience to arrange travel. Booking must be completed by 20th January 2015 or the prize will be forfeited.
2. Mountain Designs are responsible for supplying the winner with a $500 gift voucher within 28 days of prize draw. Winner will be required to supply a monitored mailing address in Australia.
3. The winner and their companion are responsible for ensuring they have a valid passport and any other requisite travel documentation. Frequent flyer points will not form any part of the prize. The winner, where necessary, may be required to present credit card at time of accommodation check in.
4. Winner must take the prizes as offered. This prize is non-transferable, non-refundable, cannot be sold or exchanged for cash and cannot be used in conjunction with any other offer.
5. The Promoter accepts no responsibility for any loss, damage, or injury incurred to enter the competition or in connection with taking up the prize.
UNCLAIMED PRIZE DRAW
1. The Promoter reserves the right to draw additional reserve entries, and record them in order, in the event of:
a) An invalid entry or ineligible entrant is drawn
b) The prize remains unclaimed 90 days after the prize draw. The Promoter will make all reasonable efforts to contact the prize-winner in time to take up the prize.
2. In the event of an unclaimed prize, a redraw will take place at Mountain Designs Head Office, 443a Nudgee Road, Hendra QLD 4011 on 21st January at 10am AEST. The winner will be notified by email and phone within 2 days of the competition prize redraw. Mountain Designs reserves the right to publish the name on the winner on the Mountain Designs website (www.mountaindesigns.com/adventure-competition) and Mountain Designs Facebook page.
3. Subject to the terms and conditions of the participating prize provider(s), if for any reason the winner does not, once the price has been booked, take the prize (or an element of the prize) at the time stipulated, then the prize (or that element of the prize) will be forfeited and will not be redeemable for cash. No compensation will be offered if the trip is not taken.
FINAL CONDITIONS
1. The Promoter reserves the right to request information to verify the validity of entries including: proof of identity and/or proof of Australian residency status at the nominated prize delivery address. Acceptance of verification information is at the discretion of The Promoter. The Promoter reserves the right to disqualify any entrant for tampering with the entry process or for submitting an entry that is not in accordance with these conditions of entry.
2. It is a condition of accepting the prize that the winner must comply with all the conditions of use of the prize and the prize supplier’s requirements.
3. The Promoter’s determination of the winner is final and no correspondence will be entered into.
4. No responsibility will be accepted for late, lost or misdirected entries. All entries are deemed to be received at the time of receipt into Mountain Designs database and NOT at the time of transmission by the entrant.
5. If for any reason this promotion is interfered with in any way or is not capable of running as planned including war, terrorism, state of emergency, disaster, infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of The Promoter which corrupts or affect the administration, security, fairness, integrity or proper conduct of this promotion, The Promoter reserves the right to disqualify, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any Entrant; or (b) subject to any written directions from a regulatory authority, to cancel, terminate, modify or suspend the promotion as appropriate.
6. The Promoter is not responsible for any problems or technical malfunction of computer online (or wireless) systems, servers, or providers, computer equipment, software, or technical problems resulting from participation or sending or receiving of any communication or of any materials in this competition.
7. All entries will be and remain the property of Mountain Designs and Peregrine Adventures and will not be shared with any third party partners.
8. The entrants consents to the Promoter using the Entrant’s name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media, including radio, for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter. Entrants consent to the Promoter using the Entrants image on the promotional website when referring to the winner of a Major Prize.
9. The information an entrant provides will only be used for the purposes outlined in these Terms and Conditions. Any questions, comments or complaints about this promotion must be directed to the Promoter.
10. The laws of Australia apply to this promotion to the exclusion of any other law. Entrants submit to the exclusive jurisdiction of the courts of Australia.
