HOW TO ENTER

This promotion and competition is being conducted by Australian Scholarships Group Friendly Society Limited (ABN 21 087 648 879) of 23 – 35 Hanover Street, Oakleigh VIC 3166 (in Australia) and the ASG Education Programmes (NZ) Limited of Suite 6A, 17 Albert Street, Auckland (in New Zealand). They are referred to hereafter as ‘the Promoter’.

To enter, individuals can either:

(a) Visit www.asg.com.au/excursion (for Australian residents) or www.asg.co.nz/excursion (for New Zealand residents) (or other promotional URLs or third party sites that ASG may designate during the promotion period) and follow the prompts to input the requested details, including an answer to the question “What inspirational ways do you use to help your child to learn?” (in 25 words or less), and submit the fully completed entry form between 18/01/14 and 5pm AEDST on 31/10/14; or

(b) collect an entry form from a representative of the Promoter, fully complete the entry form and then return it to a representative of the Promoter in person or place it in an entry box provided at an ASG event between 18/01/14 and 5pm AEDST on 31/10/14 (where available).

TERMS AND CONDITIONS

Information on how to enter and the prizes form part of these Terms and Conditions. Participation in this promotion is deemed to be acceptance of these Terms and Conditions.
Entry is only open to Australian and New Zealand residents who are the parents or legal guardians of a child/children under ten years of age as at 31/10/14.

Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.

The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions. Errors and omissions will be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
Incomplete, indecipherable or illegible entries will be deemed invalid.
Only one entry permitted per household.
If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
The winner will be notified by telephone and in writing.
This is a game of skill and chance plays no part in determining the winner. Each entry will be individually judged and assessed, at the Promoter’s complete discretion, on creativity and originality.
The Promoter’s decision is final and no correspondence will be entered into.

The best valid entry, as determined by the judges, will win a trip for two adults and two children (under 10 years) to Melbourne valued at a maximum value of up to AU$9,400 depending on date and point of departure.

The prize includes:
Return economy airfares from winner’s nearest capital city (if the winner is from Australia) or from Auckland, Christchurch, Dunedin or Wellington (if the winner is from New Zealand) to Melbourne;
Return airport to accommodation transfers;
Six nights twin share five-star accommodation;
AU$1,000 spending money;
Entry into the Melbourne Museum (including tickets to the IMAX theatre), the National Gallery of Victoria (and the Arts Centre exhibition), ScienceWorks, the National Sports Museum (with a tour of the MCG, subject to availability) and the Melbourne Aquarium; and
Transfers to each of the above locations (where necessary).

If the winner is from Victoria, Australia the prize does not include airfares or airport transfers and these elements of the prize are not redeemable for cash.

Additional spending money, meals, insurance, transport to and from departure point, additional transfers, items of a personal nature, in-room charges and all other ancillary costs are not included and are to be borne entirely by the winner.

The prize and its elements must be booked between 01/01/15 and 29/05/15 and taken between 01/01/15 and 30/11/15, subject to booking and flight availability. Prize cannot be taken during Easter holiday period.
Frequent flyer points will not form part of the prize. The prize and its elements are subject to the standard terms and conditions of individual service providers whose services are included in the prize. The winner may be required to present their credit card at time of accommodation check in.
The winner will be required to take photographs while taking the prize (using a reasonable quality digital camera and not a camera on a mobile phone or other similar electronic device). The winner will be required to provide digital copies of such photographs to the Promoter for use in promotional and marketing material. The winner will license and grant the Promoter a non-exclusive, royalty-free, perpetual, worldwide, irrevocable, and sub-licensable right to use, reproduce, modify, adapt, publish and display such the photographs in any media, without compensation, restriction on use, attribution or liability. The winner must agree not to assert any moral rights in relation to such use and warrant that he/she will have the full authority to grant these rights.
If for any reason the winner does not take the prize (or an element of the prize) at the time stipulated by the Promoter, then the prize (or that element of the prize) will be forfeited and will not be redeemable for cash.
If the prize (or an element of theprize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that element of the prize) with a prize to the equal value and/or specification.
The prize, or any unused element of the prize, is not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.
The entrant who is the winner consents to the Promoter using their name, likeness, image and/or voice (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting the Promoter and/or this promotion (including any outcome), and or any products manufactured, distributed and/or supplied by the Promoter.
If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any factor beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion and to the fullest extent permitted by law (a) to disqualify any entrant; or (b) to modify, suspend, terminate or cancel the promotion, as appropriate.
Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.
Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia or any statutory consumer guarantees as provided under consumer protection laws in New Zealand (“Non-Excludable Guarantees”).
Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) the promotion, the prize or any element of the prize; (b) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (c) any theft, unauthorised access or third party interference; (d) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter); (e) any variation in prize value to that stated in these Terms and Conditions; (f) any tax liability incurred by a winner or entrant; or (g) the taking of the prize.
As a condition of receiving the prize or any element of the prize, the winner (and his/her adult companion) must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.
The Promoter collects personal information (“PI”) in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers and prize suppliers. Entry is conditional on providing this PI. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed at www.asg.com.au/privacy or www.asg.co.nz/privacy. In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. The Privacy Policy also contains information about how entrants may opt out, access, update or correct their PI, how entrants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. All entries become the property of the Promoter.

The laws of Australia apply to this promotion to the exclusion of any other law. Entrants submit to the exclusive jurisdiction of the courts of Australia.
