Eligibility Criteria

Entry is only open to Australian residents aged 21 years or over who can take the Major Prize on the terms outlined below if drawn as the Major Prize winner.
Employees (and their immediate families) of the Promoter, JOBY, Lowepro, Nevada Commission on Tourism, Reno Sparks Convention & Visitors Authority, Delta Air Lines, Alamo, V&T Railroad, LVH (Las Vegas Hotel and Casino), Silver Legacy Resort Casino Reno, Peppermill Resort Spa Casino, The Ridge Resorts South Tahoe and Hyatt Regency Lake Tahoe and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
Entry Instructions
Promotion commences on 14/08/2014 and entries close at 11:59pm AEDST on 31/10/2014 (“Promotional Period”).
To enter, individuals must, during the Promotional Period, visit www.joby.com/nevada or www.lowepro.com/nevada, follow the prompts to the promotion entry page, input the requested details (including their full name, telephone number, mailing address and a valid email address) and submit the fully completed entry form.
Incomplete or indecipherable entries will be deemed invalid.
Only one (1) entry is permitted per person.
Draw & Winner Notification
The draw will take place at Maxwell International Australia Pty Limited, Unit 12, 11-21 Underwood Road, Homebush, NSW, 2140 on 12/11/2014 at 11:00am AEDST. The Promoter may draw additional reserve entries and record them in order in case an invalid entry or ineligible entrant is drawn.
The winners will be notified by email within two (2) business days of the draw, and the Major Prize winner’s name will also be published online at www.joby.com/nevada and www.lowepro.com/nevada from 26/11/2014.
A re-draw for any unclaimed prizes may take place on 12/02/2015 at the same time and place as the original draw, subject to any directions from a regulatory authority. Winners, if any, will be notified by email within two (2) business days of the draw, and the Major Prize winner’s name (if the Major Prize is awarded) will also be published online at www.joby.com/nevada and www.lowepro.com/nevada from 26/02/2015.
Major Prize
The first valid entry drawn in the draw will win a trip for two (2) adults aged 21 years or over to Nevada, USA, valued at up to AU$7,600 depending on date and point of departure (“Major Prize”). The Major Prize includes:
return economy airfares from Sydney, NSW to Las Vegas, USA for two (2) adults with Delta Airlines. The winner and their companion must make their own way to/from the departure point in Sydney, at their own expense;
seven (7) day full-size car rental with Alamo. The driver must have a current valid driver’s licence issued in an Australian State or Territory and be aged 21 years or over;
one (1) round of golf (i.e. 18 holes) at Wildcreek Golf Course in Reno for two (2) adults;
three (3) nights accommodation at the LVH (Las Vegas Hotel and Casino) in Las Vegas for two (2) adults, staying in a Resort Room (twin share) with Resort Club Lounge access, VIP check-in and two (2) tickets to see “Raiding the Rock Vault” in the LVH Theatre;
three (3) nights accommodation at the Silver Legacy Resort Casino in Reno for two (2) adults, staying in a Luxury Room (twin share) with US$34.05 resort credit (i.e. AU$36.38, based on current exchange value as at 10/06/14), one (1) breakfast at Flavors (exact menu to be determined by the Promoter in its absolute discretion), and one (1) dinner at Café Sedona up to the value of US$50 (i.e. AU$53.42, based on current exchange value as at 10/06/14);
two (2) nights accommodation at the Peppermill Resort Spa Casino in Reno for two (2) adults, staying in a standard suite (twin share) in Tuscany Tower with US$50 resort credit (i.e. AU$53.42, based on current exchange value as at 10/06/14);
three (3) nights accommodation at The Ridge Resorts South Tahoe in South Lake Tahoe for two (2) adults, staying in a one bedroom suite (twin share); and
two (2) nights accommodation at the Hyatt Regency Lake Tahoe Resort, Spa and Casino in North Lake Tahoe for two (2) adults, staying in a Deluxe room (twin share) with Regency Club privileges (including Private Lounge with Breakfast, energizing mid-day snacks, to Evening Cocktails & Hors d’oeuvres and after dinner desserts).
If the Major Prize winner elects to travel between May and October, they will also receive two (2) round trip tickets on the V&T Railroad steam train from Carson City to Virginia City. If the Major Prize winner does not travel between May and October, the steam train component of the prize will be forfeited.
Spending money, additional meals, taxes (excluding airline and airport taxes), insurance, passports, visas, vaccinations, transport to and from departure point in Sydney, NSW, additional accommodation (if required), additional rentals (if required), transfers, items of a personal nature, in-room charges and all other ancillary costs are not included.
The Major Prize is subject to the standard terms and conditions of individual prize and service providers. The following validity and blackout periods apply to the Major Prize components:
Delta Airlines economy airfares: valid until 12/11/2015;
LVH (Las Vegas Hotel and Casino): valid until 01/09/2015, excluding 03/11/2014 – 05/11/2014, 30/12/2014 – 31/12/2014, 04/01/2015 – 12/01/2015, 01/02/2015 – 06/02/2015, 27/03/2015 – 28/03/2015 and major US holidays;
Silver Legacy Resort Casino Reno: valid until 01/09/2015;
Peppermill Resort Spa Casino Reno: valid until 01/09/2015;
The Ridge Resorts South Tahoe: valid until 31/05/2015, excluding June, July, August, and any US holiday period;
Hyatt Regency Lake Tahoe: valid until 01/09/2015, excluding 15/06/2014 – 25/09/2015 and US holiday periods;
Wildcreek Golf Course round of golf: valid until 01/09/2015;
V&T Railroad tickets: valid until 01/09/2015; and
Alamo car rental: valid until 30/06/2015, excluding 15/07/2014 – 20/08/2014 and 15/12/2014 – 31/12/2014.
Delta Airlines economy airfares: valid until 12/11/2015;
For the sake of clarity, the Major Prize winner can elect to take all elements of the Major Prize together (subject to the validity and blackout periods outlined above), or they can elect to take each element separately at different times.
Alamo car hire prize is subject to standard rental conditions. Car rental will be in a full-size car (FCAR) in the USA (equivalent to a Ford Fusion or similar). Car rental includes unlimited mileage, collision damage waiver, extended protection up to $1 million, tax and airport fees for the seven (7) days. Rental does not include additional drivers, underage fees, GPS handsets, petrol or child’s seats and one way fees. Fines and additional charges are the driver’s responsibility. The driver must have a current valid driver’s licence issued in an Australian State or Territory and be aged 21 years or over.
The Major Prize winner and his/her companion are responsible for ensuring that they have valid passports with a minimum of 6 months validity from the date of travel, and any requisite visas, vaccinations and travel documentation. The Major Prize winner and his/her companion must depart from and return to the same departure point and travel together. Itinerary to be determined by the Promoter in agreement with the Major Prize winner but in the event that agreement cannot be reached, the Promoter reserves the right to determine the itinerary. Frequent flyer points will not form part of the Major Prize. The Major Prize winner may be required to present their credit card at time of accommodation check in.
Runner-Up Prizes
The next forty (40) valid entries drawn in the draw will each win a GorillaPod Action Tripod with GoPro mount, valued at AU$59.95 (“Runner Up Prizes”).
General
Information on how to enter and the prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
The Promoter’s decision is final and no correspondence will be entered into.
The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.
If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
Subject to the unclaimed prize draw clause, if for any reason a winner does not take a prize (or an element of a prize) by the time stipulated by the Promoter, then the prize (or that element of the prize) will be forfeited.
If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
Total prize pool value is up to AU$9,998.
Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash.
In the event of war, terrorism, state of emergency or disaster, the Promoter reserves the right to cancel, terminate, modify or suspend the promotion or suspend or modify a prize, subject to any written directions from a relevant regulatory authority.
Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.
Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) taking/use of and/or participation in a prize.
As a condition of accepting the Major Prize, the Major Prize winner (and his/her companion) must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.
The Promoter collects personal information (“PI”) in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed at http://www.maxwell.com.au/site/privacy.html. In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. The Privacy Policy also contains information about how entrants may opt out, access, update or correct their PI, how entrants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. All entries become the property of the Promoter. The Promoter will not disclose entrant’s personal information to any entity outside of Australia.
The laws of Australia apply to this promotion to the exclusion of any other law. Entrants submit to the exclusive jurisdiction of the courts of Australia.
