Terms and Conditions – Game of Chance
Competition – “WIN a Jeep Compass Sport with Jetstar Travel Insurance”
1) Information on how to enter forms part of the terms and conditions of entry.
Participation in the promotion is deemed acceptance of these terms and conditions.
Headings in this document are included for ease reference, and do not affect
interpretation in any way.
2) The promoter is Jetstar Airways Pty Ltd, (ABN 33 069 720 243]) of 79 Victoria Parade,
Collingwood. VIC (Ph (03) 8628 3573) (Promoter).
Duration
3) All references to time in this document are a reference to the local time in Melbourne,
Victoria, Australia, on the date stated. The promotion commences at 12:01am on 15
May 2014 and closes at 11:59pm on 15 August 2014 (Promotion Period).
Eligibility to enter
4) Entry is open only to Australian residents (Eligible Entrants), excluding directors,
management, employees and their immediate families of the Promoter and its related
bodies corporate and registered travel companions of employees of the Promoter and
its related bodies corporate.
Clause for Minors
5) If the major prize winner is under the age of 18, the prize must be claimed their parent
or legal guardian.
Entry into the promotion
6) To enter, Eligible Entrants must during the Promotion Period:
(a) book any domestic Jetstar flight or an international Jetstar flight that originates in
Australia; and
(b) purchase a Jetstar Travel Insurance policy (underwritten by AIG) either when
booking the Jetstar flight on jetstar.com or from Jetstar’s travel insurance website:
http://jetstartravelinsurance.com.au/jetstar/default.aspx.
7) Entry into the promotion will occur automatically upon purchase of an insurance policy
in the manner detailed in clause 6.
8) For policies purchased during the promotion period, with two or more people named on
each policy, only the first person named on the policy will gain entry.
9) The Promoter is not responsible for any lost, late or misdirected entries.
10) The time of entry will be deemed to be the time the entry is received by the Promoter.
11) The Promoter reserves the right, at any time, to verify the validity of entries and Eligible
Entrants (including an entrant’s identity, age and place of residence) and to disqualify
any entrant who tampers with the entry process. Failure by the promoter to enforce
any of its rights at any stage does not constitute a waiver of those rights.
Drawing of entries
12) The result of the prize draws is final and no correspondence will be entered into.
13) There will be two (2) prize draws as follows and each will take place at 4pm at Suite 3,
Erina Plaza, 210 The Central Coast Highway, Erina NSW 2250 and be conducted by
Anisimoff Legal, on behalf of the Promoter:
a) Draw Minor Draw Date: 3 July 2014 Prize: 5 x consolation prizes
b) Draw Grand Prize Draw Date:20 August 2014 Prize: 5 x Consolation prizes and
1 x First prize
14) After each minor draw, remaining eligible entrants will have their entries rolled into the
Grand Prize Draw from which ONE entrant will be randomly selected to be awarded the
Grand Prize.
The prizes
15) There will be 11 prizes (10 consolation prizes and one grand prize). The maximum
total prize value is up to $51,946, based on the recommended retail value at the time of
printing. The Promoter accepts no responsibility for any variation in the value of the
prizes.
Major Prize
2.1 The major prize winner will win one 2014 Jeep Compass Sport 2.0L Petrol 6A 4X2
car with a petrol engine. The total MSRP of the vehicle is $29,000. The prize
includes dealer delivery, stamp duties, 12 months’ registration (in the State or
Territory in which the winner resides), compulsory third party insurance and
premium paint. The prize excludes any additional accessories and all other costs
are to be borne by the winner. In accepting the prize vehicle, the winner
acknowledges that the winner may incur ongoing costs associated with the prize
vehicle which are the entire responsibility of the winner. The total major prize is
therefore valued at:
• MSRP $29,000
• Dealer Delivery $600
• Stamp Duties (to a maximum of $1,007)
• Registration (to a maximum of $889)
• Premium Paint work $450
Making a total value of $31,946.
16) The colour of the prize vehicle is silver. Should this colour not be available due to stock
or other unforeseen circumstances, the Promoter will endeavour to provide the winner’s
preferred colour although this cannot be guaranteed.
17) The prize vehicle will be supplied by an authorised Chrysler Jeep Dodge dealership
nominated by Chrysler Australia Pty Ltd (ABN 23 125 956 505) and must be registered
in the name of the winner before the prize vehicle can be collected. It is a condition of
winning that the winner of the prize vehicle provides Jeep Australia with the winner’s
full name, address and current Australian driver’s license prior to receiving the prize
vehicle. The winner of the prize vehicle must provide the Promoter with certified copies
of all required documentation as required by the Promoter before the prize vehicle is
awarded.
18) The prize vehicle will only be delivered in Australia. The Promoter is unable to
guarantee delivery of the prize vehicle to the winner within a set time frame, but will
endeavor to deliver the vehicle to the winner within 4 weeks of the winner being
determined by the Promoter. The winner will be informed of the delivery status by Jeep
Australia. Collection of the vehicle prize will be via an authorised Chrysler Jeep Dodge
dealership nominated by Chrysler Australia Pty Ltd.
19) The prize vehicle is not transferable unless with the prior agreement of Jeep Australia
and cannot be taken as cash.
20) The Jeep Compass depicted in all promotional materials is not necessarily the same as
the prize vehicle and may have options and/or accessories featured which are not part
of and/or fitted to the prize vehicle.
Consolation Prizes
21) There will be 10 Jetstar travel vouchers (‘vouchers’) valued at $2,000 each awarded as
consolation prizes. All vouchers will be issued within 7 days of each prize draw and
distributed to the winners via electronic mail. Travel vouchers must be redeemed within
6 months of the date of issue or will be forfeited. Travel vouchers will be subject to the
Jetstar Travel Voucher Conditions as set out below.
Jetstar Travel Voucher Conditions
22) a) ‘How to use this Voucher’ forms part of these Terms & Conditions. (b) Booking
dates will be strictly applied. Your booking must be made or changed through
Jetstar.com or Jetstar Contact Centre before the Expiry Date, for travel on any Jetstar
flight or Jetstar flights together with Jetstar Holidays products available at the time you
redeem this Voucher. If you do not redeem this Voucher within this timeframe this
Voucher will expire and you will lose the value of this Voucher. If you redeem this
Voucher but later change your booking on a date after the Expiry Date, you will lose the
value of this Voucher. This Voucher was created on the Issue Date and expires on the
Expiry Date as noted above. The 6 month booking period is calculated as 183 days
from the Issue Date. (c) All travel is subject to availability at the time of booking, the
fare rules quoted at the time of booking and the Jetstar Conditions of Carriage and
Jetstar Holidays Booking Conditions (applicable when holiday products are purchased).
The standard Jetstar fare and bundle rules apply according to the fare or fare with
bundle selected when booking. Limited changes are permitted, charges apply and
unless otherwise stated, airfares are non-refundable. See Jetstar.com for further
details. For Jetstar Holidays products, cancellation fees up to 100% apply. See Jetstar
Holidays Booking Conditions for full details. (d) You must redeem this Voucher in one
booking only. Any amount not redeemed in that booking will be lost and no credit will
remain. (e) This Voucher is not transferable – it is redeemable only by the person
whose name is stated on this Voucher for travel by that person or to make a new
booking for others to travel (if a booking is made for others to travel, the person named
on this Voucher must be listed as the contact in the booking). (f) This Voucher is only
redeemable up to the value stated on this Voucher for Jetstar fares and bundle options,
taxes, fees and other charges associated with normal Jetstar internet or telephone
reservations bookings. This Voucher can be redeemed for Jetstar Holiday products
(including accommodation, activities, transfers, parking, insurance and car hire). This
Voucher must be taken as stated and no compensation will be payable if the recipient
is unable to use it as stated. This Voucher is not redeemable for cash or other goods
and services. Jetstar Vouchers are not refundable. (g) Jetstar Airways Pty Limited
(“Jetstar”) makes no claims in relation to weather or other conditions at the travel
destination and the Voucher recipient should make their own enquiries before travel.
Jetstar, its related bodies corporate, their officers, employees and agents will not be
liable for any loss, damage or personal injury whatsoever (including but not limited to
direct, indirect and consequential loss) suffered or sustained in connection with the use
of this Voucher, except for any liability which cannot be excluded by law. (h) Any
additional travel booked in conjunction with the use of this Voucher will be subject to
standard booking conditions. (i) Jetstar will collect information about you and any other
person named in the booking so that it can issue this Voucher and, when redeeming
this Voucher, can process the travel arrangements. For more information about
Jetstar’s privacy policy, including how to access your information, refer to Jetstar.com.
23) Each voucher must be taken as stated and no compensation will be payable if a winner
is unable to use the voucher as stated. Vouchers are not exchangeable or redeemable
for cash or other goods or services. A prize cannot be transferred to any other person,
unless agreed to by the Promoter. There can be no changes made to travel
arrangements once travel vouchers are issued. If the prize is not utilised within six
months of issue date, it will be forfeited. If the prize (or part of the prize) is unavailable,
the Promoter, in its discretion, reserves the right to substitute the prize (or that part of
the prize) with a prize to the equal value and/or specification, subject to any written
directions from a regulatory authority.
Notification of winners
24) All winner(s) will be notified by mail and the winner of the first prize will also be notified
by telephone call. After each draw, winners of the consolation prizes will be notified by
mail, and will remain in the draw to win the first prize. All winners’ names for each draw
will be published in The Australian newspaper on10th July 2014 for the Minor Draw and
the 27th August 2014 for the Major Draw. .
25) If for any reason a winner does not take an element of the prize at the time stipulated
by the Promoter, then that element of the prize will be forfeited. Unused elements of the
prize will not be reissued or replaced. If the winner notifies that they are also unable to
take the prize, the prize will be forfeited.

Right of the Promoter to redraw
27) The Promoter reserves the right to redraw in the event of an entrant being unable to
satisfy these promotion terms and conditions or forfeiting or not claiming a prize. For
each prize that remains unclaimed on 21 November 2014, a redraw will be held on 28
November 2014 at the same time and place as the original draw, subject to any
direction given under applicable law. Any winners determined in accordance with this
clause will be notified by mail and telephone by 30 November 2014 and their names
will be published in the Australian newspaper on 4th December 2014.
Limitation of liability and variation of terms
28) If any act, omission, event or circumstance occurs which is beyond the reasonable
control of the Promoter and which prevents the Promoter from complying with these
terms and conditions, the Promoter will not be liable for any failure to perform or delay
in performing its obligations. The Promoter reserves the right (subject to any applicable
law) to cancel, terminate or modify or suspend this promotion.
29) The Promoter, its related bodies corporate and their respective officers, employees,
contractors and agents (Promotion Parties) will not be liable for any losses, damages,
expenses, costs or personal injuries arising out of this promotion, the promotion of this
promotion or the use of any prize, including but not limited to any breach of these terms
and conditions, contract or tort (including negligence) and any other common law,
equitable or statutory remedy (Damages) whatsoever, including but not limited to
direct, indirect and consequential Damages, including Damages that cannot reasonably
be considered to arise naturally and in the ordinary course of things, even if those
Damages were in the contemplation of the Promotion Parties.
30) The exclusion of liability in clause 27 does not apply to limit or exclude liability:
a) for personal injury or death suffered or sustained in connection with the supply of
goods or services which are supplied by the Promoter in the ordinary course of
business. To remove doubt: third party goods or services, which other than in
connection with this promotion, are in the normal course of business supplied by
a third party unrelated to the Promotion Parties, are not supplied by the Promoter
in the ordinary course of business; and the Promoter’s [Conditions of Carriage
and general booking conditions] (and any exclusions contained therein) apply
despite any statement to the contrary in these terms and conditions; or
b) to the extent it is not permissible at law to limit or exclude liability in the manner
contemplated in that clause (in which case that liability is limited to the maximum
extent allowable by law).
Entry details and privacy
31) Entrants’ personal information provided in connection with this promotion will be
handled in accordance with the Promoter’s Privacy Statement, a copy of which is
available at http://www.jetstar.com/au/en/privacy-policy. All entrants consent to the
Promoter using the entrant’s name, suburb, likeness and/or image in the event they are
a winner (including photograph, film and/or recording of the same) in any media for an
unlimited period without remuneration for the purpose of promoting this promotion
(including any outcome), and promoting any products manufactured, distributed and/or
supplied by the Promoter.
The Promoter collects entrants’ personal information in order to conduct the promotion.
Entry is conditional on providing this information and an entrant cannot enter the
promotion without it. The Promoter may for these purposes disclose such information to
third parties, including, but not limited to, prize suppliers and other partners of the
promoter and as required, to Australian regulatory authorities. Entry details remain the
property of the Promoter.
Tax Implications
32) The Promoter accepts no responsibility for any tax implications that may arise from
accepting a prize. Independent financial advice should be sought.
