Official Facebook Giveaway Rules
Bring on the Bathurst 1000 this weekend! To celebrate another HOT weekend of racing with
Shell V-Power, we are giving away a 2019 DJRTP Track Jacket.
To be in the running to WIN the 2019 DJRTP Track Jacket tell us in 25 words or less what the
HOTTEST Mustang moment of the season has been and why?
NO PURCHASE IS NECESSARY TO ENTER OR WIN. A PURCHASE DOES NOT INCREASE THE
CHANCES OF WINNING.
1. Eligibility: Entry is free and is open to residents of Australia aged 18 years or over,
other than the persons listed in Clause 4.
2. Agreement to Rules: By participating in this competition (“Competition”), the
contestant (“You” and “Your”) agrees to be fully and unconditionally bound by
these Official Facebook Giveaway Rules (“Rules”), and You represent and warrant
that You meet the eligibility requirements. In addition, You agree to accept the
decisions of Rheem Australia Pty Ltd (“Rheem Australia”) and the Competition
judges as final and binding as they relate to the conduct of this Competition.
3. Competition Period: Entries will be accepted on the Rheem Australia Facebook
page starting at 5:30am (AEDT) on 10th October 2019 and ending at 11:59pm
(AEDT) on 14th October 2019 (AEDT). No entries will be accepted after this time.
4. Ineligible persons: Employees and contractors of Rheem Australia and associated
companies, and their immediate families, are ineligible to enter.
5. No endorsement: This promotion is in no way sponsored, endorsed, administered
by or associated with Facebook.
6. How to Enter: To enter the Competition, eligible entrants must:
(a) Provide a ‘comment’ under the Comments section of the official Facebook post on
the Rheem Australia Facebook page for this Competition. The ‘comment’ should be
25 words or less and respond to the request:
Simply tell us what the HOTTEST Mustang moment of the season has been and why?
(b) Entries that are incomplete or do not otherwise adhere to these Rules may be
disqualified at the sole discretion of Rheem Australia.
(c) You may enter the Competition only once. You must not attempt to enter the
Competition more than once, for example, by using multiple Facebook accounts
(even if You have more than one such account), email addresses, identities, or
devices. If Rheem Australia becomes aware that You have done so or have
attempted to do so, or if You use any other dishonest or fraudulent methods or
otherwise attempt to circumvent these Rules, Your entry (or entries) may be
disqualified at the sole discretion of Rheem Australia.
7. Entries must be original: Each entry must be an original submission from an
individual entrant and must not:
(a) infringe the copyright, moral rights or other intellectual property rights of any other
person. If You have any doubts about whether You may infringe a third party’s
intellectual property or other rights, You must not enter the Competition using the
material in question;
(b) contain any words (or other content) that are defamatory or disparaging of any
person, or obscene, offensive or inappropriate (which includes, without limitation,
any content involving or describing nudity, malice, excessive violence, or swearing,
or which could be considered threatening, intimidating, or abusive) in the opinion
of Rheem Australia or contrary to Facebook’s Community Standards. Rheem
Australia reserves the right to disqualify such entries and have them removed from
the Facebook page; or
(c) breach any law or any legal obligation or duty to any person which You are under.
8. Compliance with Facebook’s terms and policies: In addition to the requirements
set out above, entries must also comply with Facebook’s Statement of Rights and
Responsibilities and Facebook’s Terms and Policies, including the terms which
You agree to when You use Facebook, and any terms relating to information
received on Facebook and what is not permitted to be published on Facebook
(together, the “Facebook Terms”). Rheem Australia may, in its sole discretion,
disqualify any entry if it does not comply with the Facebook Terms.
9. Assignment of intellectual property rights. By entering this Competition, You
assign to Rheem Australia all intellectual property rights subsisting in or relating to
Your entry (and must do all things necessary to evidence and perfect that
assignment). You irrevocably consent to Rheem Australia and its licensees using
Your name, likeness, image and/or entry in any media for an unlimited period
without remuneration for the purpose of promoting this Competition (including
the outcome), and promoting products manufactured, distributed and/or supplied
by Rheem Australia or its associated companies. In relation to such use and the
entry, you irrevocably consent to all acts and omissions by Rheem Australia or any
of its associated companies or licensees that would otherwise infringe Your moral
rights, and You agree not to assert any such moral rights against Rheem Australia
or any of its associated companies or licensees.
This is a game of skill: Rheem Australia will review all eligible entries submitted by
eligible entrants (see Clause 1) received during the Competition Period (see Clause 3),
and will select 5 (five) entries which it judges to be the most creative, original, and to
best explain the entrant’s response to the request:
Simply tell us what the HOTTEST Mustang moment of the season has been and
why?
The winning entries will be selected from the Shortlist by a member of The IMPACT Agency
(“Winners”).
10. Prizes: There will be 1 (one) prize awarded. The winner will receive a 2019 DJRTP

11. Awarding of prizes: The awarding of prizes will occur as follows:

Competition closing. Without limiting Clause 9, the Winners’ names may be
published on Rheem Australia’s social media channels.
(b) Each prize is awarded conditionally upon acceptance, and if a Winner is unable to
be contacted after fourteen (14) days from the Competition closing, and/or has not
confirmed his or her acceptance of the prize to Rheem Australia within that
timeframe, the relevant prize shall be deemed as unclaimed or unaccepted and a
supplementary winner may be selected.
(c) Rheem Australia will not be responsible for any inability of a Winner to receive the
specified prize and no compensation will be given.
(d) Rheem Australia accepts no responsibility for loss or damage to prizes in transit.
(e) All decisions in relation to the Shortlist and the identity of the Winners are final, and
no correspondence will be entered into.
(f) Subject to Clause 14, Rheem Australia makes no representations or warranties
relating to the quality or suitability of a prize.
12. Integrity of the Competition: Rheem Australia reserves the right, in its sole
discretion, to cancel, terminate, modify or suspend the Competition should a
virus, bug, non-authorized human intervention, fraud, or other cause beyond
Rheem Australia’s control corrupt or affect the administration, security, fairness,
or proper conduct of the Competition. In these circumstances, Rheem Australia
may select the Winners from all eligible entries received prior to and/or after (if
appropriate) the action taken by Rheem Australia. Rheem Australia reserves the
right, in its sole discretion, to disqualify any individual who tampers or attempts to
tamper with the entry process or the operation of the Competition or the
Facebook website, or otherwise violates these Rules. Rheem Australia has the
right to maintain the integrity of the Competition as it sees fit, including, but not
limited to: rejecting multiple entries from the same individual from different
Facebook accounts or IP addresses; or the use of bots, macros, scripts, or other
technical means for entering. Any attempt by You to deliberately damage the
Facebook website or any other website, or to undermine the legitimate operation
of the Competition may be a violation of criminal and civil laws. Should such
attempt be made, Rheem Australia reserves the right to seek damages to the
fullest extent permitted by law.
13. Liability and warranties:
(a) You participate in this Competition at Your own risk and agree that Rheem Australia
will not be liable to any person for any damage or loss or injury to You or Your
property arising out of or in connection with their participation in this Competition,
including damage to or viruses that may infect Your computer equipment.
(b) Except as otherwise expressly stated in these Rules, You are responsible for all costs
related to participating in this Competition.
(c) Nothing in these Rules excludes, restricts or modifies any consumer guarantee, right
or remedy conferred by the Australian Consumer Law or any other applicable law
that cannot be lawfully excluded, restricted or modified by agreement. All other
terms, warranties, guarantees, rights or liability which would otherwise be implied
or apply to these terms are excluded. To the extent permitted by law, in respect of
goods or services that are not of a kind ordinarily acquired for personal, domestic
or household use or consumption, Rheem Australia’s liability is limited, at its option,
to:
(i) in the case of goods, replacing or repairing the goods or supplying
equivalent goods, or paying for the cost of replacing or repairing
the goods or of acquiring equivalent goods;
(ii) in the case of services, resupplying, or paying the cost of
resupplying, the services.
(d) To the extent permitted by law, Rheem Australia is not liable whether in contract,
tort (including negligence) or otherwise for any loss of profits or any indirect or
consequential loss, damage, cost or expense arising from or in connection with this
Competition.
