PROMOTION TERMS AND CONDITIONS

1. This competition (“Competition”) is conducted by the Gold Coast Tourism Corporation Ltd ABN 75-009-935-184 of Suite N301 Oracle North, 12 Charles Avenue, Broadbeach, Queensland, 4218, phone (07) 5592 2699, (“Promoter”).

2. Entry to the Competition constitutes acceptance of these terms and conditions. All entry instructions and prize information published by the Promoter form part of these terms and conditions.

3. The Competition is only open to individuals who:
a) are Australian permanent residents, and
b) are not employees of the Promoter or any of its agency partners’
i) this includes spouses and/or relatives

4. The Competition commences on 06/02/19 at 11.00AM (AEST) and closes on 05/03/19 at 11.59PM (AEST). This is the official “Entry Period” for this competition.

5. Except as otherwise indicated, all amounts stated in these conditions are stated in Australian dollars.

6. To enter, entrants must update their details via the link in the DestinationGoldCoast.com eDM. Entrants must include their full name, email, country and postcode (for Australian residents only) plus choose up to 3 categories.

7. There is no cost to enter the Competition; however internet connection and usage rates may apply. Entrants should obtain details of such costs from their service providers. The Promoter is not and will not be liable for any such costs.

8. A $250 VISA cash card will be allocated to the single winner.
9. Entries must be received during the Entry Period. The Promoter takes no responsibility for late, lost, incomplete, incorrectly submitted, illegible or misdirected entries or for any delays or failures in any telecommunications service or equipment.
10. The Promoter may reject an Entry if it reasonably forms the opinion that the Entry has been entered using false information or via automated entry means or by use of a competition entry service.
11. The Promoter may, at its absolute discretion, declare an Entry made by an Entrant invalid if the Entrant tampers with the entry process, benefits from such tampering or submits an Entry that is illegible, incomplete or not in accordance with these terms and conditions.
THE PRIZE AND THE WINNER
12. A single winner (“Winner”) will be selected in a random draw at 10.30AM (AEST) on 08/03/19 at XCOM Media, Level 1/235 Edward Street. Brisbane QLD 4000
13. The Prize Winner will be notified in writing via email within two business days of the draw.
ONLY 1 VISA GIFT CARD
14. The Only 1 Gift Card (‘Card’) is issued by Indue Ltd ABN 97 087 822 464 (‘Indue’). In these conditions, ‘you’ are the Card purchaser or user. Blackhawk Australia Pty. Ltd. ACN 123 251 703 (‘Blackhawk’) is Indue’s program manager for the Card, and Indue and Blackhawk are collectively “us” and “we” in these conditions. Until you sign the Card, you may present the Card to another person for their use. The Card must be signed before use. By signing or using the card, you agree to be bound by these Terms & Conditions. If you are not the intended user of the Card, then you must provide these Terms & Conditions to the intended user of the Card.
15. The Card can be used for purchases of goods and services, where prepaid VISA Gift Cards are accepted and processed electronically (excluding cash and cash equivalent transactions at ATM’s over the counter at Financial Institutions and merchants and merchant groups who elect not to accept VISA prepaid gift cards).
16. Each time you use the Card, you authorise us to deduct the amount of the transaction from the balance of funds on the Card. The available balance cannot be exceeded. Where a purchase exceeds the available balance, the excess must be paid using another payment method. The Card cannot be used for direct debit, recurring or instalment payments. Authorisations may be declined at some merchants. We are not liable in any way when authorisation is declined or a transaction otherwise does not proceed, regardless of reason. You are responsible for checking your transaction history and available balance as set out at www.only1giftcard.com.au.
17. The Card is not reloadable, and is valid until the date shown on the front of the Card. Any remaining available balance will be forfeited on the expiry date. The Card is inactive until purchased and loaded with funds by the cashier. Upon purchase of Card for a fee of $5.95, you agree to activate and load the card with the nominated amount on front of pack.
18. Details of Card balance are available at www.only1giftcard.com.au or 1800 178 743. All transactions conducted overseas will be converted into Australian dollars. Transactions will either be converted directly into Australian dollars or will be first converted from the currency in which the transaction was made into US dollars and then converted to Australian dollars by Visa Worldwide PTE Ltd (“Visa”). The conversion rate used is either: a) a wholesale market rate selected by Visa from a range of wholesale rates one day before the transaction is processed by Visa; or b) the government-mandated rate in effect for the applicable processing date. In these circumstances, 3.5% of the total amount of each transaction will be

deducted from your Card at the same time you make a transaction on your Card in a currency other than Australian dollars, or you make a transaction on your gift card in any currency (including AUD) that is processed by a card scheme or billed by the merchant outside of Australia.
19. For disputed transactions, you should notify the merchant where the purchase was made. However, if you are unable to resolve the disputed transaction with the merchant, you should notify us immediately by visiting www.only1giftcard.com.au, or call 1800 178 743 .
20. Credit Card Scheme operating rules impose time limits after the expiry of which we are not able to reverse a transaction. The time limit generally applicable is 75 days after the disputed transaction was made, but some time limits are longer. If you do not notify us in time, we may be unable to investigate your claim in which case you will be liable for the transaction. It is your responsibility to review carefully your online transaction history. Neither Indue nor Blackhawk is responsible for any loss to you, if you do not request us to dispute the transaction, within an applicable time limit.
21. The Card is like cash and cannot be replaced if misused, lost, stolen, or damaged. You are responsible for all transactions on the Card, except where there has been fraud or negligence by our staff or agents. If you notice any error relating to the Card, you should notify Cardholder Services immediately on 1800 178 743 or at www.only1giftcard.com.au
22. If you have a complaint about the Card, or service, please call Only 1 Visa on 1800 178 743. If you have any enquiries or complaints in relation to your Card, you should, in the first instance, contact Only 1 Visa. If you cannot resolve the complaint with Only 1 Visa you should contact Indue. The contact details for Indue are: Indue Limited, PO Box 523, TOOWONG QLD 4066, phone: 1300 671 819.
23. For security reasons, including where we suspect fraud or other illegal activity, we may restrict the number of transactions or amount of transactions you can make with the Card, prevent a transaction, or stop the use of the Card. You cannot stop payment on any transaction made with the Card.
24. Any refunds on Card transactions are subject to the policy of the specific merchant. Refunds may be in the form of a credit to the Card, cash refund or in-store credit. If the Card expires or is revoked before you have spent any funds resulting from a refund (whether or not the original transaction being refunded was made using the Card) then you will have no access to those funds.
25. If you use the Card without presenting it (such as for mail order, telephone or internet purchases), the legal effect will be the same as if you physically presented the Card.

26. Information will be disclosed to third parties about the Card, or transactions made with the Card, whenever allowed by law, required by law, and also where necessary to operate the Card and process transactions. A full privacy policy can be viewed at www.only1giftcard.com.au.
27. We reserve the right to change these Terms and Conditions at any time with 60 days’ notice. Any changes to the Terms and Conditions can be viewed at www.only1giftcard.com.au.
28. The laws of the State of Queensland, in the Commonwealth of Australia, apply to these Terms & Conditions and you irrevocably submit to and accept the exclusive jurisdiction of any of the Courts of the State of Queensland, or the Commonwealth of Australia and any courts of appeal from these courts.
GENERAL
29. The Entrant grants these rights to the Promoter which are perpetual and acknowledges that the Entrant will not receive any payment, royalty or other consideration (whether monetary or otherwise) from the Promoter in connection with the making, use or storage of the Content.
30. If for any reason the conduct or operation of the Competition is interfered with or disrupted in any way (including by vandalism, power failures, natural disasters, acts of God, civil unrest, strikes, computer bugs or viruses, tampering or technical failures), subject to any relevant lotteries or gaming authority regulation’s, the Promoter reserves the right to cancel, terminate, modify or suspend or recommence the Competition.
31. The Promoter assumes no responsibility for:
a) any error, omission, interruption, or delay in the operation or transmission of any communication sent to (or by) the Promoter or any Entrant whether caused by problems with communication networks or lines, computer systems, software or internet service providers, congestion on any carrier network or otherwise, any theft, destruction or unauthorized access to, or alteration of such communications;
b) any problem with, or technical malfunction of, any computer system or other equipment used for the conduct of the Competition;
c) any incorrect or incomplete information which may be communicated in the course of the administering this Competition (whether as a result of one of the foregoing causes or otherwise);
d) any delay in delivery, or failure of safe delivery of the Prize.
32. All of the Promoter’s decisions are final and no correspondence will be entered into. If for any reason any element of the Prize becomes unavailable or not capable of being delivered to the Winner for any reason beyond the Promoter’s reasonable control the Promoter will have no obligation to provide a similar prize to the Winner or otherwise compensate the Winner in any way.

33. All Entrants enter the Competition at their own risk and the Winner accepts the Prize at his or her own risk. To the full extent permitted by law, the Promoter, its associated companies and agencies and any of their personnel (the “Relevant Parties”) exclude all liability for and indemnify the Promoter in respect of any loss (including any damage, claim, injury, cost or expense) which is suffered or incurred by any Entrant in connection with the Competition or Prize, including without limitation:
a) any indirect, economic or consequential loss;
b) any loss arising from the negligence of a Relevant Party;
c) any liability for personal injury or death. The Promoter may request that the Winner sign
and return a deed of release to this effect as a condition of the Prize being awarded. If the Winner fails to sign and return such release, the Winner may forfeit the Prize.
34. All Entrants consent, by entering the Competition to the Promoter using their name, likeness, image and/or voice (including any photograph, film and/or recording of them) in any media at any time or times without compensation, financial or otherwise, for the purpose of promoting this Competition, the Promoter and/or any of the Promoter’s products.
35. Prizes are not transferrable or redeemable for cash and are subject to availability.
PRIVACY, DISCLOSURE AND CONSENT TO USE INFORMATION.
36. The Entrant acknowledges and permits the Promoter during and after the Competition to:
a) collect, store, handle, access, manage, transfer, use and disclose personal information about the Entrant, including name, suburb, age and image, in connection with the Content. This includes transmission outside of Australia. The Entrant may revoke its consent to this clause at any time upon written notice to the Promoter, however existing uses of the Images and Recordings will not be impacted by this revocation or withdrawal of consent;
b) contact the Entrant for any reason related to the Competition or other activities of the Promoter.
