“FOX SPORTS and FFA – A-League Hero” Game of Skill Competition
CONDITIONS OF ENTRY
1. Competition and Promoter
1.1 By entering the “FOX SPORTS and FFA – A-League Hero” Game of Skill
Competition (Competition) and in consideration for the opportunity to
participate in the Competition, each entrant agrees to be bound by and
observe these Conditions of Entry. Information on how to enter and prize
details form part of these Conditions of Entry.
1.2 The promoter of the Competition is FOX SPORTS Australia Pty Limited ABN
16 065 445 418 of 4 Broadcast Way, Artarmon NSW 2064 (Promoter).
2. Who may enter
2.1 Subject to paragraph 2.2, entry into the Competition is open to all permanent
residents of Australia aged 18 years or over at the date of entry (Eligible
Entrants).
2.2 The officers, management and employees (and immediate family members of
officers, management and employees) of the Promoter, Football Federation
Australia ACN 106 478 068 (FFA) and its respective corporations, affiliates
and associated agencies are not eligible to enter the Competition.
2.3 Each entrant may only submit one (1) entry during the Competition Period.
3. Competition Period
3.1 The Competition commences at 9:00am Australian Eastern Daylight Time
(AEDT) on 15 October 2018 and closes at 11:59pm AEDT on 18 November
2018 (Competition Period).
3.2 Entries not received during the Competition Period or not completed in
accordance with these Conditions of Entry will not be eligible to win.
3.3 If for any reason an Entry Period is not capable of running as planned,
including due to the delay, postponement, or for any reason whatsoever, the
Promoter reserves the right in its sole discretion to suspend, postpone or
cancel the Entry Period.
4. How to enter
Entry submission
4.1 Eligible Entrants must, during the relevant Entry Period:
(a) visit the Competition website (www.foxsports.com.au/win) and enter the
details requested; and;
(b) tell us in 25 words or less your most creative and unique answer to the
question, “Who is your A-League hero and why?” (Entry Question).

5. Prizes
5.1 Judging of all entries received during each Entry Period will be conducted by
the Promoter at 4 Broadcast Way, Artarmon NSW 2064 at 5:30pm AEDT on
19 November 2018 (Judging Date).
5.2 The ten (10) Eligible Entrants who submitted the most creative and unique
Entries during the Entry Period (as judged by the Promoter in its sole
discretion) in accordance with these Conditions of Entry (Prize Winners) will
each win one (1) of either:
(a) one (1) Double Pass to the Melbourne Victory v Western Sydney
Wanderers A-League match at Marvel Stadium (formerly Etihad Stadium),
Melbourne on 1 December 2018, with a maximum of five (5) Doubles Passes
to be awarded; or
(b) one (1) Double Pass to the Western Sydney Wanderers v Sydney FC
A-League match at ANZ Stadium, Sydney on 15 December 2018, with a
mximum of five (5) Double Passes to be awarded,
as selected by the Promoter in its sole discretion and which are valued at
A$120 per Double Pass.
5.3 The Prize Winners will be notified by email and telephone on the Judging
Date. The Prize Winners must accept or reject the prize by 12:00pm AEDT on
22 November 2018.
5.4 The maximum total prize value in the Competition is A$1,200.
5.5 An entrant will be eligible to win one (1) prize during the Competition Period
only.
5.6 The Prize Winner acknowledges that the prize is subject to additional terms
and conditions imposed by third party prize suppliers, including FFA and
venue operators. The Prize Winner must become acquainted with any such
additional terms and conditions prior to taking the prize. The Prize Winner
must comply with all conditions imposed by any prize supplier. The Promoter
does not accept responsibility and is not liable for any conditions imposed on
the taking of the prize by any other third party prize supplier or a breach of
those conditions by any person. The prize remains the property of the
Promoter and/or prize suppliers until it is received by the selected prize
winner or unclaimed prize winner as the case may be.
5.7 The Promoter accepts no responsibility for any variation in the value of a
prize. The prize is not transferable or exchangeable. The prize is not
redeemable for cash and must be taken as offered.
5.8 A Prize Winner is responsible for all expenses not specified in these
Conditions of Entry, including but not limited to, transport to and from Marvel
Stadium in Melbourne or ANZ stadium in Sydney, accommodation, meals,
drinks, spending money, insurance, items of a personal nature and all other
ancillary costs.
5.9 If for any reason the Prize Winner does not take an element of the prize
during the stated period and on the conditions stipulated by the Promoter or
any third party prize suppliers, that element of the prize will be forfeited.
6. Unclaimed prize
If a prize is unclaimed by 12:00pm AEDT on 22 November 2018, it will be
awarded to the Eligible Entrant who submitted the next most creative and
unique Entry out of all Entries on the competition shortlist (as determined by
the Promoter in its absolute discretion). The unclaimed prize winner will be
notified by writing on 22 November 2018. The process will be repeated every
48 hours until the prize winner is contacted and the prize is claimed. The prize
remains the property of the Promoter until it is collected by the selected prize
winner or unclaimed prize winner as the case may be.
7. Information for Prize Winner
All entrants agree to provide the Promoter with identification and/or proof of
age if selected as a prize winner. In accepting a prize, each prize winner
agrees to the release set out below. The form of identification and/or proof of
age are at the discretion of the Promoter.
8. Limitation of Liability
8.1 Except for any liability that cannot by law be excluded (including as set out
under paragraph 8.3), the Promoter, FFA, their related corporations and
associated agencies (and any of their personnel) exclude all liability for any
loss (including any damage, claim (including any claim pursuant to workers’
compensation legislation), injury, cost or expense) which is suffered or
incurred by any entrant (including the prize winner and their companion) in
connection with the Competition or a prize, including, without limitation: (i) any
indirect, economic or consequential loss; (ii) any loss arising from the
negligence of the Promoter, FFA, its related corporations and associated
agencies (and any of their personnel); and (iii) any liability for personal injury
or death.
8.2 No responsibility will be taken by the Promoter or its authorised agents for
lost, ineligible, misdirected or late entries due to technical reasons or any
other reason. Entries that are not genuine or are incomplete, late or in any
way fraudulent will be declared void.
8.3 Nothing in these Conditions of Entry limits, excludes or modifies, or purports
to limit, exclude or modify, the statutory implied guarantees/warranties as
provided under the Competition and Consumer Act 2010 (Cth) and the ASIC
Act 2001 (Cth), including the statutory consumer guarantees under the
Australian Consumer Law, or similar laws in the States and Territories of
Australia.
9. Privacy
By entering the Competition, the entrant understands and agrees that the
Promoter may use and disclose the entrant’s personal information to assist in
conducting the Competition and communicating with the entrant in regard to
news and updates and special offers from the Promoter and its related
entities. Entrants in the Competition acknowledge that the Promoter may
share an entrant’s personal information with the Promoter’s Australian and
foreign related entities which may contact the entrant with marketing
messages and special offers. Without limiting the foregoing, the Promoter
may disclose the prize winner’s personal information to third parties for the
purpose of fulfilling the prize. If an entrant elects to receive information from
other third parties, the Promoter may also disclose the entrant’s personal
information for that purpose. The Promoter is bound by the Australian Privacy
Principles in the Privacy Act 1988 (Cth). Entrants may find out more
information about how the Promoter collects, uses and discloses personal
information by reading the Promoter’s Privacy Policy, which is available at
http://www.foxsports.com.au/about-us/privacy. Entrants may access the
personal information the Promoter holds about them by writing to the
Promoter at the address set out below. If the Promoter limits or denies an
entrant access to their personal information in certain circumstances, the
Promoter will tell the entrant why access was limited or denied. The entrant
can contact the Promoter by writing to the Promoter at 4 Broadcast Way,
Artarmon NSW 2064.
10. General
10.1 All Entries must be original to and created solely by the entrant. All Entries
and all copyright and other rights in such entries and/or other materials
(including but not limited to, photographs and videos taken by the prize winner
in entering the Competition) become the property of the Promoter and will not
be returned. Each entrant agrees to provide a written assignment of all rights
to the Promoter if requested. By submitting an Entry and any other materials
(save for any personal information) to the Promoter in connection with the
Competition, each entrant:
(a) specifically authorises the Promoter to use and/or license third parties
to use such Entry in whole or in part, throughout the universe, in
perpetuity in or on any and all media, whether currently in existence or
developed in the future, and alone or together or as part of other
information, content and/or material of any kind or nature;
(b) represents and warrants that all elements contained in the Entry or other
material:
(i) are original to the entrant and fully cleared for use as
contemplated in these Conditions of Entry;
(ii) do not and will not, in any way, violate or breach any of the terms
of any other agreement the entrant may be a party to;
(iii) do not contain defamatory, tortious or otherwise unlawful, untrue
or inaccurate information, infringe or violate any copyright or
other right; or contain any matter the publication or sale of which
will violate any law;
(iv) are not obscene or likely to cause offence;
(v) are not in any way cruel or abusive; and
(vi) will not require the Promoter to pay or incur any sums to any
person or entity as a result of Promoters’ use or exploitation of
the same; and
(c) unconditionally and irrevocably consents to any act or omission which
would otherwise infringe any of their moral rights in the entry and waives
all moral rights in the entry that arise outside Australia.
10.2 This Competition is a game of skill. Chance plays no part in determining the
Prize Winners.
10.3 No correspondence will be entered into and the judges’ decision is final and
binding.
10.4 Acceptance of the prize constitutes consent on the Prize Winner’s part to
allow the use of the Prize Winner’s name, image, voice and/or likeness
(including but not limited to, any recordings of the Prize Winner taking the
prize) by Promoter for editorial, advertising, promotional, marketing and/or
other purposes without further compensation except where prohibited by law.
10.5 If for any reason the Competition is not capable of running as planned,
including due to infection by computer virus, bugs, tampering, technical
failures or any other causes beyond the control of the Promoter, which corrupt
or affect the fairness or integrity or proper conduct of the Competition, the
Promoter reserves the right in its sole discretion to disqualify any individual
who tampers with the entry process and to cancel, modify, terminate or
suspend the Competition. Any entrant who breaches the aforementioned
warranties in paragraph 10.1 above, and/or any other provision of these
Conditions of Entry will be not be eligible to win a prize and their Entry will be
disqualified from the Competition.
10.6 The Prize Winner is advised that tax implications may arise from the prize and
should seek independent financial and taxation advice prior to their
acceptance of the prize. The Prize Winner is responsible for all taxes
(excluding GST) which may be payable as consequence of receiving a prize.

entrant’s contact details, including their email address.
